1. 1That through official communication CNV-005-2017, this Board of Directors received the 2017 closure (veda) proposal from the National Closures Commission (Comisión Nacional de Vedas).
2. 2That in ordinary session No. 10-2017, Mr. Álvaro Otárola Fallas, Acting Technical Director General, in his capacity as Coordinator of the National Closures Commission (CV), presented the 2017 closure (veda) proposal for the Gulf of Nicoya, in accordance with what was thus agreed upon by that Commission, for which the recommendations made by the Scientific Technical Coordination Commission (CCCT) were also considered.
3. 3That with the implementation of this closure (veda), as conceived, the imperative need to protect and guarantee the hydrobiological resources of commercial interest in the Gulf of Nicoya during their most important reproductive stage is addressed; furthermore, thanks to the efforts of IMAS in coordination with INCOPESCA, it was possible to coordinate the payment of temporary economic aid for fishers whose license only allows them to fish in those areas.

4º-Having heard the presentation by the Acting Technical Director General, the Board Members expressed their satisfaction, their opinion being that the proposal received integrates not only the criteria of these two Commissions, but also that it is presented with the due advance notice, which will allow the necessary precautions to be taken so that its implementation occurs in a timely manner and in proper form with respect to the legal and social spheres, therefore, The Board of Directors of INCOPESCA. Therefore,

1º-To approve the 2017 closure (veda) under the following terms and conditions:

1.1. To establish a total closure (veda) for small-scale fishing in the area bounded by an imaginary straight line running from Punta Torres, known as Peñón (09°53'31" North Latitude, 084°43'52" West Longitude) to the Faro de la Isla Negritos afuera (09°49'14" North Latitude, 084°49'35" West Longitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula, and from there seaward to the imaginary line running from Estero Canjelito (10°01'05" North Latitude, 085°09'47" West Longitude) to Estero Moraga (10°08'03" North Latitude, 085°03'51" West Longitude). This fishing prohibition runs from May 1, 2017, to July 31, 2017, both dates inclusive.

In this closed (vedada) area, in the zone bounded by the imaginary line running from the Muelle de Cruceros in Puntarenas to Punta Cuchillo, and from there to the Faro de la Isla Los Negritos afuera, and from there to Punta Torres, known as Peñón, it is recommended that those fishers whose fishing license allows them to operate in said zone be authorized to fish for barracudas or candado (Sphyraena ensis), using only handlines and during the months of June and July 2017 1.2. To establish a total closure (veda) for small-scale fishing in the zone known as 201, which corresponds to the area bounded by an imaginary straight line running from Estero Canjelito (10°01'5" North Latitude, 085°09'47" West Longitude) to Estero Moraga (10°08'03" North Latitude, 085°03'51" West Longitude) and from there seaward to the mouth of the Tempisque River. This fishing prohibition runs from May 1, 2017, to July 31, 2017, both dates inclusive.

1.3. To establish a closure (veda) for semi-industrial shrimp trawling in the area bounded by an imaginary line running from Punta Agujas (09°43'46- North Latitude, 084°38'57" West Longitude) to the Faro de la Isla Negritos afuera (09°49'14" North Latitude, 084M9'35" West Longitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula, and from this line seaward to the mouth of the Tempisque River. This closure (veda) runs from May 1, 2017, to August 31, 2017, both dates inclusive.

1.4. To authorize tourist and sport fishing permit holders to carry out fishing activities in the zone closed to small-scale fishing, only in the zone bounded by the imaginary line running from Punta Torres, known as Peñón (09°53'31" North Latitude, 084°43'52" West Longitude) to Guayabo, located on the outer part of Isla San Lucas (09°54'54".1 North Latitude, 084°53'15" West Longitude), and from there to Punta Gigante on the Nicoya Peninsula (09°50'41".2 North Latitude, 084°52'45" West Longitude), and from there offshore. This fishing is only permitted using trolling and casting ("casting (caña lanzada) directed at pelagic species") as fishing methods, and using the catch-and-release modality; therefore, no specimen caught as a product of this fishing may be retained.

1.5. Fishing for barracudas or candado (Sphyraena ensis) is approved only with No. 6 and No. 7 hooks and without using live bait to do so, in accordance with the provisions of clause 1 of considering 2°) of this recommendation.

1.6. Likewise, those fishers who decide to fish for barracudas or candado (Sphyraena ensis) must identify their vessels by painting a triangle of phosphorescent color on both sides of the stern, the dimensions of which shall be 40cm by 40cm; furthermore, they must notify the Department of Protection and Registration (Departamento de Protección y Registro) of INCOPESCA at least one month in advance, on the understanding that they will not be granted the right to receive temporary aid during the months they carry out fishing work, but rather they will be entitled to receive fuel at a competitive price for the exercise of those fishing tasks, in accordance with their fishing license.

2º-The map attached in the following table shall be taken as an integral part of this Agreement:

1. 1Que mediante oficio CNV-005-2017, recibe ésta Junta Directiva la propuesta de veda 2017, por parte de la Comisión Nacional de Vedas.
2. 2Que en sesión ordinaria N° 10-2017 el Sr. Álvaro Otárola Fallas, Director General Técnico a. í., en su condición de Coordinador de la Comisión Nacional de Vedas (CV), presentó la propuesta de veda 2017, para el Golfo de Nicoya, de conformidad con lo así acordado por esa Comisión, para lo cual se consideraron, además, las recomendaciones vertidas por la Comisión de Coordinación Científico Técnica (CCCT).
3. 3Que con la puesta en marcha de ésta veda, tal cual se ha concebido, se atiende la imperiosa necesidad de proteger y garantizar los recursos hidrobiológicos de interés comercial del Golfo de Nicoya en su etapa más importante de reproducción; además gracias a los esfuerzos del IMAS en coordinación con el INCOPESCA, se logró coordinar el pago de las ayudas económicas temporales para los pescadores cuya licencia solo les permite pescar en dichas zonas.

4º-Escuchada la presentación del Director General Técnico a. í., manifiestan los señores Directivos su satisfacción siendo su criterio que la propuesta recibida, integre no solo los criterios de éstas dos Comisiones, sino que la misma se presenta con la antelación debida, lo cual permitirá tomar las previsiones necesarias a efecto que su implementación en tiempo y forma en relación a los ámbitos legal y social, razón por la cual, La Junta Directiva de INCOPESCA. Por tanto, ACUERDA:

1º-Aprobar la veda 2017 en los siguientes términos y condiciones:

1.1. Establecer una veda total para la pesca en pequeña escala, en el área comprendida por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (09°53'31"Latitud Norte, 084°43'52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49'14" Latitud Norte, 084°49'35" Longitud Oeste) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya y de ahí agua adentro hasta la línea imaginaria que va desde del Estero Canjelito (10°01'05" Latitud Norte, 085°09'47" Longitud Oeste) hasta Estero Moraga (10°08'03" Latitud Norte, 085°03'51" Longitud Oeste). Esta prohibición de pesca va desde el 01 de mayo del 2017 hasta el 31 de julio del 2017, ambas fechas incluidas.

En esta área vedada, en la zona comprendida por la línea imaginaria que va desde el Muelle de Cruceros en Puntarenas hasta Punta Cuchillo y de ahí al Faro de la Isla Los Negritos afuera y de ahí hasta Punta Torres, conocida como Peñón, se recomienda se autorice para aquellos pescadores cuya licencia de pesca les permita faenar en dicha zona, realizar la pesca de barracudas o candado (Sphyraena ensis), utilizando únicamente cuerda de mano y durante los meses de junio y julio del 2017 1.2. Establecer una veda total para la pesca en pequeña escala, en la zona conocida como 201, que corresponde al área comprendida por una línea recta imaginaria que va desde el Estero Canjelito (10°01'5" Latitud Norte, 085°09'47" Longitud Oeste) hasta Estero Moraga (10°08'03" Latitud Norte, 085°03'51" Longitud Oeste) y de ahí aguas adentro hasta la desembocadura del río Tempisque. Esta prohibición de pesca va desde el 01 de mayo del 2017 hasta el 31 de julio del 2017, ambas fechas incluidas.

1.3. Establecer una veda para la pesca semi-industrial camaronera de arrastre en el área comprendida por una línea imaginaria que va desde Punta Agujas (09°43'46- Latitud Norte, 084°38'57" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49'14" Latitud Norte, 084M9'35" Longitud Oeste) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya y de esta líneas aguas adentro hasta la desembocadura del río Tempisque. Esta veda va desde el 01 de mayo del 2017 hasta el 31 de agosto del 2017, ambas fechas incluidas.

1.4. Autorizar a los permisionarios de pesca turística y deportiva realizar actividades de pesca, en la zona vedada para la pesca en pequeña escala, únicamente en la zona comprendida entre la línea imaginaria que va desde Punta Torres conocida como Peñón (09°53 '31"Latitud Norte, 084°43'52" Longitud Oeste) hasta Guayabo ubicado en la parte externa de Isla San Lucas (09°54'54".1 Latitud Norte, 084°53'15" Longitud Oeste) y de ahí hasta Punta Gigante en la península de Nicoya (09°50'41".2 Latitud Norte, 084°52'45" Longitud Oeste) y de ahí aguas afuera. Esta pesca únicamente se permite utilizando como métodos de pesca el troleo y casting (caña lanzada "dirigida a especies pelágicas") y utilizando la modalidad de captura y liberación; por lo que no se podrán retener ningún espécimen capturados como producto de esta pesca.

1.5. Se aprueba la pesca de barracudas o candado (Sphyraena ensis) únicamente con anzuelo N° 6 y N° 7 y sin utilizar carnada viva para ello, de conformidad con lo dispuesto en el inciso 1 del considerando 2°) de la presente recomendación.

1.6. Asimismo, aquellos pescadores que decidan realizar la pesca de barracudas o candado (Sphyraena ensis), deberán identificar sus embarcaciones pintando un triángulo color fosforescente a ambos lados de la popa, cuyas medidas serán de 40cm por 40cm; además, deberán comunicarlo con al menos un mes de antelación al Departamento de Protección y Registro del INCOPESCA, en el entendido que no se les reconocerá el derecho a recibir las ayudas temporales durante los meses que realicen labores de pesca, sino que tendrán derecho a recibir combustible a precio competitivo para el ejercicio de esas labores de pesca, de conformidad con su licencia de pesca.

2º-Téngase como parte integral del presente Acuerdo, el mapa que se anexa en el cuadro siguiente:
