Regulation for the Practice of Underwater Sport Fishing (Agreement AJDIP/098-2017) COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/098-2017.-Puntarenas, on the twenty-fourth day of February, two thousand seventeen.

1. 1That in accordance with Law 7384, Law Creating the Costa Rican Institute of Fisheries and Aquaculture, and Law 8436, Fisheries and Aquaculture Law, it is the responsibility of Incopesca, as the executing authority of said regulatory body, to regulate the rational use of fishery resources aimed at achieving greater economic returns, the protection of marine species and aquaculture; as well as to draft, monitor, and follow up on the application of legislation to regulate and prevent the contamination of maritime and aquaculture resources as a result of fishing, aquaculture, and activities that generate pollution which threatens said resources.
2. 2That the Fisheries and Aquaculture Law, in its Article 68 and following, establishes Sport Fishing as a non-commercial fishing activity, which is related to the provisions of Article 79 of said law, which defines Tourist Fishing as a commercial fishing activity, and the regulations related to Sport Fishing are applicable to the latter.
3. 3That Executive Decree 36782-MINAET-MAG-MOPT-TUR-SP-S-MTSS, Regulation to the Fisheries and Aquaculture Law, regulates matters concerning the general concepts of said fisheries.
4. 4That Article 70 of the Fisheries and Aquaculture Law determines that sport fishing may be carried out either from land, on board a vessel, or underwater. That due to this provision, it becomes necessary to regulate matters related to sport or tourist fishing activities carried out underwater.
5. 5That at the request of the Legal Advisory Office of Incopesca, the General Technical Directorate has issued an opinion via Official Letter DGT-SJ-020-2016, through which it recommends the parameters that must be established for the practice of underwater sport fishing.
6. 6That as it is the legal authority of Incopesca, the following regulation is issued,

The Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture. Therefore, AGREES:

REGULATION FOR THE PRACTICE OF UNDERWATER SPORT FISHING 1º-Underwater fishing is defined as the fishing modality carried out by apnea diving (inmersión en apnea) and the hunting of fish using a harpoon, speargun (arbaleta), or underwater rifle.

2º-For underwater fishing, the provisions established in the Regulation to the Fisheries and Aquaculture Law, Executive Decree 36782-MINAET-MAG- MOPT-TUR-SP-S-MTSS, in its Articles 62 through 69, are applicable as relevant.

3º-The activity of underwater fishing is only permitted for those individuals (personas físicas) who have obtained from Incopesca the respective permit for the practice of underwater sport fishing, as defined by the Fisheries and Aquaculture Law and its Regulation; likewise, individuals (personas físicas) who, duly authorized for the practice of this type of fishing, contract the services provided by tourist fishing operators may also engage in underwater sport fishing.

4º-Incopesca will authorize the practice of underwater sport fishing only through the practice of apnea or breath-hold sport diving. Underwater fishing is not permitted using autonomous diving equipment such as oxygen tanks or semi-autonomous equipment such as compressors. Except in those fishing tournaments approved by INCOPESCA, aimed at fishing for Lionfish (Pez León, Pterois volitans) in the Costa Rican Caribbean, where the use of diving with oxygen tanks is authorized.

(Thus amended by Agreement No. AJDIP/194-2024 of July 30, 2024)   5º-Anyone engaging in sport fishing may possess and use a maximum of two spearguns (arbaletas), whether they are band-powered, pneumatic (aire comprimido), or one of each type; they may also use flashlights, a knife, mesh net bags, or a catch retrieval tool (cachador) to recover captured pieces.

(Thus amended by Agreement No. AJDIP/239-2017 of August 11, 2017) 6º-Anyone engaging in underwater sport fishing activities must comply with the requirements established by the Regulation to the Fisheries and Aquaculture Law and the payment of the respective fee. Additionally, they must provide a sworn statement (declaración jurada) indicating that they are aware of the risks of said activity, that they are qualified to perform it, and that they release Incopesca from all liability for any type of accident suffered during the practice of this type of activity.

7º-The practice of underwater sport fishing is not permitted for individuals (personas físicas) under 18 years of age.

8º-Incopesca will maintain a registry of persons registered for the practice of underwater sport fishing.

9º-The authorization issued by Incopesca will be made by means of an underwater sport fishing license (carné), which will indicate the authorized equipment and method, the limit of a maximum of 5 pieces to be caught per trip or day of fishing intended for self-consumption or taxidermy; the warning is made that the sizes to be caught must be larger than the size at first sexual maturity (tallas de primera madurez sexual), that the closed seasons (épocas de veda) and zones (zonas de veda) established by Incopesca must be respected, as well as in National Parks and Protected Wild Areas.

10.-Non-compliance with any of these provisions will be sanctioned in accordance with the sanctions determined in the Fisheries and Aquaculture Law.

11.-It takes effect upon its publication in the Official Gazette La Gaceta.

Considering:

Reglamento para el ejercicio de la pesca deportiva subacuática (acuerdo AJDIP/098-2017) INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/098-2017.-Puntarenas, a los veinticuatro días del mes de febrero de dos mil diecisiete.

1. 1Que de conformidad con la Ley 7384 Ley de Creación del Instituto Costarricense de Pesca y Acuicultura y la Ley 8436, Ley de Pesca y Acuicultura, corresponde al Incopesca como autoridad ejecutora de dicho cuerpo normativo, normar el aprovechamiento racional de los recursos pesqueros, que tiendan a lograr mayores rendimientos económicos, la protección de las especies marinas y de la acuicultura; así como elaborar, vigilar y dar seguimiento a la aplicación de la legislación, para regular y evitar la contaminación de los recursos marítimos y de acuicultura, como resultado del ejercicio de la pesca, de la acuicultura y de las actividades que generen contaminación, la cual amenace dichos recursos.
2. 2Que la Ley de Pesca y Acuicultura, en sus artículos 68 y siguientes establece la Pesca Deportiva como una actividad de la pesca no comercial, la cual se encuentra relacionada con lo que dispone el artículo 79 de dicha ley que define la Pesca Turística, como una actividad de la pesca comercial, siendo que le son aplicables a esta ultima las normas relacionadas con la Pesca Deportiva.
3. 3Que el Decreto Ejecutivo 36782-MINAET-MAG-MOPT-TUR-SP-S-MTSS, Reglamento a la Ley de Pesca y Acuicultura, regula lo concerniente a los conceptos generales de dichas pesquerías.

4 º-Que el artículo 70 de la Ley de Pesca y Acuicultura, determina que la pesca deportiva puede, realizarse ya sea desde tierra, a bordo de una embarcación o de manera subacuática. Que por tal disposición es que se hace necesario reglamentar lo relativo a las actividades de pesca deportiva o turística que se realice de manera subacuática.

1. 5Que ha solicitud de la Asesoría Jurídica del Incopesca la Dirección General Técnica ha emitido criterio por medio del Oficio DGT-SJ-020-2016, mediante el cual recomienda los parámetros que se deben establecer para el ejercicio de la pesca deportiva de manera subacuática.
2. 6Que por ser potestad legal del Incopesca, se emite la siguiente normativa,

La Junta Directiva del Instituto Costarricense de Pesca y Acuicultura. Por tanto, ACUERDA:

REGLAMENTO PARA EL EJERCICIO DE LA PESCA DEPORTIVA SUBACUÁTICA 1º-La pesca subacuática, se define como la modalidad de pesca que se realiza mediante la inmersión en apnea y la caza del pez mediante el uso de un arpón, arbaleta o fusil submarino.

2º-Para la pesca subacuática, son aplicables en lo que le corresponda, las disposiciones establecidas en el Reglamento de la Ley de Pesca y Acuicultura, decreto Ejecutivo 36782-MINAET-MAG- MOPT-TUR-SP-S-MTSS, en sus artículos 62 al 69.

3º-La actividad de la pesca subacuática únicamente está permitida a aquellas personas físicas que han obtenido del Incopesca el respectivo permiso para la práctica de pesca deportiva subacuática, según lo define la Ley de Pesca y Acuicultura y su Reglamento, igualmente podrían realizar pesca deportiva subacuática, aquellas personas físicas que debidamente autorizadas para el ejercicio de este tipo de pesca, contraten los servicios que presten operadores de pesca turística.

4º-El Incopesca, autorizará la práctica de la pesca deportiva subacuática, únicamente mediante la práctica de buceo deportivo de apnea o pulmón. No se permite la pesca subacuática utilizando equipos autónomos de buceo como tanques de oxígeno o equipos semiautónomos como compresores. Excepto en aquellos torneos de pesca aprobados por el INCOPESCA, destinados a la pesca del Pez León (Pterois volitans) en el Caribe costarricense, donde se autoriza el uso de buceo con tanques de oxígeno.

(Así reformado mediante acuerdo N° AJDIP/194-2024 del 30 de julio del 2024) 5º-Quien realice pesca deportiva, podrá tener en posesión y utilizar como máximo dos arbaletas ya sean estas de ligas, aire comprimido, o una de cada tipo, igualmente podrá utilizar linternas, cuchillo, bolsos de paños de red o cachador para recuperar las piezas capturadas.

(Así reformado mediante acuerdo N° AJDIP/239-2017 del 11 de agosto del 2017) 6º-Quien realice actividades de pesca deportiva subacuática, deberá cumplir con los requisitos que establece el Reglamento de la Ley de Pesca y Acuicultura y el pago de respectivo canon. Además deberá aportar declaración jurada donde indique que conoce de los riesgos de dicha actividad, que está capacitado para ejercerla y que exime de todo tipo de responsabilidad al Incopesca, por cualquier tipo de accidente que sufra durante el ejercicio de este tipo de actividad.

7º-No se permite el ejercicio de pesca deportiva subacuática a personas físicas menores de 18 años.

8º-El Incopesca llevará un registro de las personas inscritas para el ejercicio de la pesca deportiva subacuática.

9º-La autorización que emita el Incopesca, se hará por medio de un carné de pesca deportiva subacuática, en el cual se indicará el equipo y método autorizado, la limitante a un máximo de 5 piezas a capturar por viaje o día de pesca destinadas para autoconsumo o taxidermia, se hace la advertencia de que las tallas a capturar deben ser mayores a las tallas de primera madurez sexual, que se deben respetar la épocas y zonas de veda que establezca el Incopesca, así como en Parques Nacionales y Áreas Silvestres Protegidas.

10.-El Incumplimiento a cualesquiera de estas disposiciones, será sancionado de conformidad con las sanciones que se determinan en la Ley de Pesca y Acuicultura.

11.-Rige a partir de su publicación en el Diario Oficial La Gaceta.

Considerando:
