I have the honour to address Your Excellency on the occasion of acknowledging receipt of your kind note dated 18 November 2015, which reads as follows:
«Your Excellency Mr. Minister:
Pursuant to the Convention on Technical Cooperation concluded between our two Governments on 23 July 1965, as well as the Amending Protocols of 13 March 1986 and of 18 December 2006, I have the honour to propose to Your Excellency, on behalf of the Government of the Federal Republic of Germany, the following Agreement concerning the project “Low‑Emission Coffee of Costa Rica – support project for the NAMA,” within the framework of the “NAMA Facility,” a joint climate protection programme between the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety of the Federal Republic of Germany and the Ministry of Energy and Climate Change of the United Kingdom of Great Britain and Northern Ireland:
1. The Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica shall jointly promote the following project:
“Low‑Emission Coffee of Costa Rica – support project for the NAMA,” if, after examination, said project proves worthy of support.
TO HIS EXCELLENCY INGO WINKELMANN AMBASSADOR OF THE FEDERAL REPUBLIC OF GERMANY SAN JOSE 2. The objective of the project is to contribute to climate protection and sustainable development in the Republic of Costa Rica by reducing the environmental impacts caused by coffee production, through improved efficiency for coffee producers and the benefits, favouring the promotion of a low‑climate‑impact economy and the reduction of greenhouse gas emissions.
3. The Government of the Federal Republic of Germany shall provide at its own expense human resources and shall make material contributions and, where applicable, financial contributions for the project in a total amount of up to 3,700,000 euros. The project shall have a total volume of up to 7 million euros as a component of the “NAMA Facility.” The Government of the Federal Republic of Germany shall entrust the execution of the project to Deutsche Gesellschaft für internationale Zusammenarbeit (GIZ) GmbH.
4. On the part of the Government of the Republic of Costa Rica, the Ministry of Environment and Energy (MINAE) is designated as the entity responsible for the project at the political level. In addition to MINAE, the Ministry of Agriculture and Livestock (MAG), jointly with the Coffee Institute of Costa Rica (ICAFE), as well as the Central American Bank for Economic Integration (BCIE) shall be responsible for the execution of the project.
5. The details of the project and of the respective contributions and obligations shall be set forth in an execution contract and, where applicable, a financing contract, which shall be concluded between the executing organization mentioned in paragraph 3 and the institutions to which the Government of the Republic of Costa Rica entrusts the execution of the project, and which shall be subject to the legal provisions in force in the Federal Republic of Germany.
6. The commitment of the Government of the Federal Republic of Germany with respect to the project shall cease to have effect if the respective execution contract and, where applicable, financing contract mentioned in paragraph 5 is not concluded within a period of four years commencing from the year of authorization of the 7. Commitment. For the commitment relating to the project in question, the period shall end on 31 December 2019.
8. The Government of the Republic of Costa Rica shall reimburse, upon request, to GIZ GmbH the value‑added tax or other similar indirect taxes that accrue in the Republic of Costa Rica in connection with the objects purchased and services used for the execution of the project. Special consumption taxes accruing in connection with the project shall be borne by the Government of the Republic of Costa Rica, upon request.
9. For the rest, the provisions of the above‑ mentioned Convention on Technical Cooperation of 23 July 1965, as well as of the Amending Protocols of 13 March 1986 and of 18 December 2006, shall also apply to this Agreement.
10. The present Agreement is concluded in German and Spanish, both texts being equally authentic.
Should the Government of the Republic of Costa Rica declare itself in agreement with the proposals contained in paragraphs 1 to 9, this Note and the Note in reply from Your Excellency stating the agreement of your Government shall constitute an Agreement between our Governments that shall enter into force on the day on which the Government of the Republic of Costa Rica notifies the Government of the Federal Republic of Germany through the diplomatic channel of the fulfilment of the internal requirements necessary for the entry into force of the Exchange of Notes. For such purposes, the date of receipt of the notification in question shall be determinative.
I take this opportunity to reiterate to Your Excellency, Mr. Manuel Antonio González Sanz, the assurance of my highest and most distinguished consideration.» In this regard, I have the honour to inform Your Excellency that the above proposal is acceptable to the Government of the Republic of Costa Rica and that Your Excellency’s Note and the present Note constitute an Agreement between our two Governments that shall enter into force on the day on which the Government of the Republic of Costa Rica has notified the Government of the Federal Republic of Germany, through the diplomatic channel, of the fulfilment of the internal requirements necessary for the entry into force of this Exchange of Notes.
