The Minister of Foreign Affairs and Worship San José, August 9, 2016 DM-DGPE-413-16 Your Excellency I have the honor to address Your Excellency on the occasion of acknowledging receipt of your kind note dated June 9, 2016, which reads as follows:
Mr. Minister In compliance with the Convention on Technical Cooperation concluded between our two Governments on July 23, 1965, as well as the Amendment Protocols of March 13, 1986, and December 18, 2006, I have the honor to propose to Your Excellency, on behalf of the Government of the Federal Republic of Germany, the following Agreement on the project "Promotion of Costa Rica's Climate Neutrality Strategy as a low-carbon development model (Phase II)", within the framework of the International Climate Protection Initiative of the Federal Ministry for the Environment, Nature Conservation, Public Works and Nuclear Safety 1. The Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica shall jointly promote the project "Promotion of Costa Rica's Climate Neutrality Strategy as a low-carbon development model (Phase II)" if, after examination, said project proves worthy of support.
TO HIS EXCELLENCY INGO WINKELMANN AMBASSADOR OF THE FEDERAL REPUBLIC OF GERMANY SAN JOSÉ 2. The objective of the project is to contribute to climate protection and sustainable development in Costa Rica through the promotion of a low-climate-impact economy and the reduction of greenhouse gas emissions.
3. The Government of the Federal Republic of Germany shall provide human resources and make material contributions and, where applicable, financial contributions for the project for a total amount of up to 4,500,000 euros (in words four million five hundred thousand euros) It shall entrust the execution of the project to the Deutsches Gesellschaft fur Internationale Zusammenarbeit (GIZ) GmbH.
4. On behalf of the Government of the Republic of Costa Rica, the Ministry of Environment and Energy (MINAE) shall be responsible for the execution of the project.
5. The details of the project and the respective contributions and obligations shall be set forth in an execution contract and, where applicable, a financing contract to be concluded between the Deutsches Gesellschaft fur Internationale Zusammenarbeit (GIZ) GmbH and the governmental institution of the Republic of Costa Rica mentioned in paragraph 4 and which shall be subject to the legal provisions in force in the Federal Republic of Germany.
6. The commitment of the Government of the Federal Republic of Germany regarding the project shall cease to have effect if the respective execution contract and, where applicable, the financing contract mentioned in paragraph 5 is not concluded within a period of four years counting from the year of authorization of the commitment. For the commitment relating to the project in question, the period shall conclude on December 31, 2019.
7. The Government of the Republic of Costa Rica shall reimburse, upon request, GIZ GmbH for the value-added tax or other similar indirect taxes that accrue in the Republic of Costa Rica in relation to items acquired and services performed for the execution of the project. Special consumption taxes that accrue in relation to the project shall be borne by the Government of the Republic of Costa Rica, upon request.
8. Moreover, the provisions of the above-mentioned Convention on Technical Cooperation of July 23, 1965, as well as the Amendment Protocols of March 13, 1986, and December 18, 2006, shall also apply to this Agreement.
9. This Agreement is concluded in German and Spanish, both texts being equally authentic.
Should the Government of the Republic of Costa Rica declare its agreement with the proposals contained in paragraphs 1 to 9, this Note and the Note of reply from Your Excellency confirming your Government's agreement shall constitute an Agreement between our Governments that shall enter into force on the day on which the Government of the Republic of Costa Rica communicates to the Government of the Federal Republic of Germany through diplomatic channels that the internal requirements necessary for the entry into force of the Exchange of Notes have been fulfilled. For these purposes, the date of entry of the communication in question shall be determinative.
I take this opportunity to reiterate to Your Excellency, Mr. Minister, the assurance of my highest and most distinguished consideration." In this regard, I have the honor to inform Your Excellency that the foregoing proposal is acceptable to the Government of the Republic of Costa Rica and that Your Excellency's Note and this Note constitute an Agreement between our Governments that shall enter into force on the day on which the Government of the Republic of Costa Rica has communicated to the Government of the Federal Republic of Germany, through diplomatic channels, the fulfillment of the internal requirements necessary for the entry into force of this Exchange of Notes.
