in the entirety of the text - Full Text of Norm 39964 Assigns to the Ministry of Environment and Energy a property for its use, surveillance and maintenance Full Text of record: 1120B8 Nº 39964-H THE FIRST VICE PRESIDENT EXERCISING THE PRESIDENCY OF THE REPUBLIC THE ACTING MINISTER OF ENVIRONMENT AND ENERGY AND THE ACTING MINISTER OF FINANCE In accordance with the powers granted by subsections 3) and 18) of Article 140 and Article 146 of the Political Constitution; Articles 25 subsection 1), 27 subsection 1), and 28 subsection 2.b) of Law number 6227, the General Law of Public Administration of May 2, 1978, and its amendments, Decree number 30720-H of August 26, 2002; as well as in official letters numbers 08339 (DAGJ-1985-2005) of July 12, 2005, and 06525 (DCA-1385) of May 23, 2006, both from the Office of the Comptroller General of the Republic.
I.By official letters SINAC-ACAT-D-0159-2015 dated August 17, 2015, from the Regional Director of the Tempisque Conservation Area (Área de Conservación Tempisque), SINAC-DE-1969 dated December 10, 2015, from the Executive Director of the National System of Conservation Areas (Sistema Nacional de Área de Conservación); and official letters DM-0882-2015 dated September 25, 2015, DM-0103-2016 dated February 8, 2016, and DM-0104-2016 dated February 8, 2016, issued by the Office of the Minister of Environment and Energy, they expressed their consent to accept the administration of the farm from the Guanacaste district, real folio 124599-000, farm called "El Cerrito", located in the province of Guanacaste, canton 7 Abangares, district of 1 Las Juntas, with an area of 5,058,681.00 square meters, cadastral plan G-0717569-2001, once it had been handed over by Radiográfica Costarricense S. A. to the Ministry of Finance, so that it would become part of the State's Natural Heritage (Patrimonio Natural del Estado).
II.Whereas, by resolution number 0568-2016 at eleven hours twenty-six minutes on June tenth, two thousand sixteen, from this Office, which accepts the proposal for dation in payment (dación en pago) submitted by Radiográfica Costarricense S.A. regarding the delivery of the farm of the Guanacaste district, real folio 124599-000, property located in the province of Guanacaste, canton 7 Abangares, district of 1 Las Juntas, with an area of 5,058,681.00 square meters, cadastral plan G-0717569-2001, for a value of ₡2,306,265,930.20 (two billion three hundred six million two hundred sixty-five thousand nine hundred thirty colones with twenty céntimos), in partial payment of the sums owed for the concept of Penalty (general sales tax), periods 2008, 2009, and 2010.
III.Whereas, by public deed number one hundred twenty, of August 22, two thousand sixteen, executed before State Notary Jonathan Bonilla Córdoba, Radiográfica Costarricense S.A. transferred to the Ministry of Finance the farm of the Guanacaste district, real folio 124599-000, called "El Cerrito", located in the province of Guanacaste, canton 7 Abangares, district of 1 Las Juntas, with an area of 5,058,681.00 square meters, cadastral plan G-0717569-2001, which is a property with several buildings, timber plantations, areas of natural regeneration of secondary forest and pastures.
IV.Whereas, by official letter number 08339 (DAGJ-1985-2005) of July 12, 2005, the Legal Advisory and Management Division of the Office of the Comptroller General of the Republic considered that any public institution, in order to dispose of its assets and transfer them to other ministerial portfolios, or decentralized entities, non-state public entities or public enterprises, can do so as long as there is a legal norm that expressly authorizes it to incur acts of liberality for the benefit of such entities.
V.Whereas, by official letter number 06525 (DCA-1385) of May 23, 2006, the Administrative Procurement Division of the Office of the Comptroller General of the Republic reconsidered the criterion set out in official letter number 08339 and indicated that when it involves a transfer between the same organs of the Executive Branch, the existence of a law is not essential, since the property will not leave the State's assets, so to change the nature by indicating who will be the new administrator of the asset, the issuance of a decree is required.
VI.That by virtue of the foregoing, and addressing reasons of public interest, it is appropriate to assign the administration of the described farm to the Ministry of Environment and Energy.
THEY DECREE:
Article One.- To assign to the Ministry of Environment and Energy the following real estate asset for its use, surveillance, and maintenance, which has the following characteristics:
1. Guanacaste District Real Folio 124599-000 Canton 07 Abangares District 01 Las Juntas Location: Las Juntas de Abangares.
Nature Land with several buildings, timber plantations, areas of natural regeneration of secondary forest and pastures.
Area 5,058,681.00 m2 Boundaries North: Public Road, Bernabé Alfaro Alfaro, Armando Chaves Guadamuz, Dora Villalobos Anchía, Integral Development Association of Santa Lucia (Asociación de Desarrollo Integral De Santa Lucia), Arturo Brenes Espinoza, Ronulfo Chaves Leiton, Manuel León Ramos, Elena Lobo Hernández, Jorge Murillo Porras. South: Carlos Bonilla Ayub, Public Road, Francisco Bogantes Herrera, Public Road, Municipality of Abangares (Municipalidad De Abangares), Public Road, María Del Carmen Morelli Guillen. Article Two.- The Ministries of Finance and of Environment and Energy must comply with the procedure stipulated in articles 14, 24, and following of Decree number 30720-H of August 26, 2002, which is the "Regulation for the Registration and Control of Central Administration Assets" (Reglamento para el Registro y Control de Bienes de la Administración Central) in order to remove and register, respectively, in their inventories the property that by means of this Decree is assigned to the Ministry of Environment and Energy to be used for the purposes of said Ministry.

Article Three.- The Ministry of Environment and Energy shall be responsible for carrying out the pertinent legal actions in order to protect and monitor the property that has been assigned to it.

De conformidad con las atribuciones que conceden los incisos 3) y 18) del artículo 140 y el artículo 146 de la Constitución Política; los artículos 25 inciso 1), 27 inciso 1), y 28 inciso 2.b) de la Ley número 6227 Ley General de la Administración Pública del 2 de mayo de 1978 y sus reformas, Decreto número 30720-H del 26 de agosto del 2002; así como en los oficios números 08339 (DAGJ-1985-2005) del 12 de julio de 2005 y 06525 (DCA-1385) del 23 de mayo de 2006 ambos de la Contraloría General de la República.
I.Mediante oficios SINAC-ACAT-D-0159-2015 de fecha 17 de agosto del 2015, el Director Regional del Área de Conservación Tempisque, SINAC-DE-1969 de fecha 10 de diciembre del 2015, el Director Ejecutivo del Sistema Nacional de Área de Conservación; y oficios DM-0882-2015 de fecha 25 de setiembre del 2015, DM-0103-2016 de fecha 8 de febrero del 2016 y DM-0104-2016 de fecha 8 de febrero del 2016 emitidos por el Despacho del Ministro de Ambiente y Energía manifestó la anuencia de aceptar la administración de la finca del partido de Guanacaste, folio real 124599-000, finca denominada "El Cerrito", ubicada en la provincia de Guanacaste, cantón 7 Abangares, distrito de 1 Las Juntas, con un área de 5.058.681.00 metros cuadrados, plano catastrado G-0717569-2001, una vez que fuera entregada por Radiográfica Costarricense S. A. al Ministerio de Hacienda, con el fin de que pasara a formar parte del Patrimonio Natural del Estado
II.Que mediante resolución número 0568-2016 de las once horas veintiséis minutos del diez de junio del dos mil dieciséis, de este Despacho, mediante la cual se acepta la propuesta de dación en pago presentada por Radiográfica Costarricense S.A. en cuanto a la entrega de la finca del partido de Guanacaste, folio real 124599-000, inmueble ubicado en la provincia de Guanacaste, cantón 7 Abangares, distrito de 1 Las Juntas, con un área de 5.058.681.00 metros cuadrados, plano catastrado G-0717569-2001, por un valor de ¢2.306.265.930,20 (dos mil trescientos seis millones doscientos sesenta y cinco mil novecientos treinta colones con veinte céntimos), en pago parcial de las sumas adeudadas por concepto de Sanción (impuesto general sobre las ventas), períodos 2008, 2009 y 2010.
III.Que mediante escritura pública número ciento veinte, del 22 de agosto del dos mil dieciséis, otorgada ante el Notario del Estado Jonathan Bonilla Córdoba, Radiográfica Costarricense S.A. traspasó al Ministerio de Hacienda, la finca del partido de Guanacaste, folio real 124599-000, denominada "El Cerrito", ubicada en la provincia de Guanacaste, cantón 7 Abangares, distrito de 1 Las Juntas, con un área de 5.058.681.00 metros cuadrados, plano catastrado G-0717569-2001, que es inmueble con varias edificaciones, plantaciones maderables, áreas de regeneración natural de bosque secundario y pastos.
IV.Que mediante oficio número 08339 (DAGJ-1985-2005) del 12 de julio de 2005, la División de Asesoría y Gestión Jurídica de la Contraloría General de la República consideró que toda institución pública, para disponer de sus bienes y trasladarlos a otras carteras ministeriales, o entes descentralizados, entes públicos no estatales o empresas públicas, puede hacerlo siempre y cuando exista una norma legal que en forma expresa le autorice a incurrir en actos de liberalidad en beneficios de tales entidades.
V.Que mediante oficio número 06525 (DCA-1385) del 23 de mayo de 2006, la División de Contratación Administrativa de la Contraloría General de la República reconsideró el criterio vertido en el oficio número 08339 y señaló que cuando se trate del traspaso entre los mismos órganos del Poder Ejecutivo no es indispensable la existencia de una ley, ya que el inmueble no saldrá del patrimonio del Estado, por lo que para cambiar la naturaleza indicando quien será el nuevo administrador del bien se requiere la emisión de un decreto.
VI.Que en virtud de lo expuesto, y atendiendo a razones de interés público, procede asignar la administración de la finca descrita al Ministerio de Ambiente y Energía.
Artículo Primero.- Asignar al Ministerio de Ambiente y Energía el siguiente bien inmueble para su utilización, vigilancia y mantenimiento, el cual tiene las siguientes características:
1. Partido de Guanacaste Folio Real 124599-000 Cantón 07 Abangares Distrito 01 Las Juntas Ubicación: Las Juntas de Abangares.
Naturaleza Terreno con varias edificaciones, plantaciones maderables, áreas de regeneración natural de bosque secundario y pastos.
Medida 5.058.681.00 m2 Linderos Norte: Calle Publica, Bernabé Alfaro Alfaro, Armando Chaves Guadamuz, Dora Villalobos Anchía Asociación de Desarrollo Integral De Santa Lucia , Arturo Brenes Espinoza Ronulfo Chaves Leiton Manuel León Ramos Elena Lobo Hernández Jorge Murillo Porras Sur : Carlos Bonilla Ayub, Calle Publica Francisco Bogantes Herrera Calle Publica Municipalidad De Abangares , Calle Publica María Del Carmen Morelli Guillen Este: Calle Publica Bernabé Alfaro Alfaro Espinoza Asociación De Desarrollo Integral De Santa Lucia Elena Lobo Hernández, Jorge Luis Murillo Porras, Calle Publica, Colegio Técnico Profesional de Abangares Calle Publica María Del Carmen Morelli Guillen Municipal Oeste : Antonio Álvarez Chaves Arsenio Quesada Rodríguez, Carlos Bonilla Ayub Plano Catastrado: G-0717569-2001.
Artículo Segundo.-Los Ministerios de Hacienda y de Ambiente y Energía deberán cumplir con el trámite estipulado en los artículos 14, 24 y siguientes del Decreto número 30720-H del 26 de agosto del 2002, que es el "Reglamento para el Registro y Control de Bienes de la Administración Central" a fin de dar de baja y de alta respectivamente en sus inventarios a la propiedad que mediante este Decreto se asigna al Ministerio de Ambiente y Energía para ser utilizada para los fines de dicho Ministerio.
