in the entirety of the text - Full Text of Regulation 39658 Declares the activity "Border to Border, United for Water" to be of public interest Full Text record: 110F70 N° 39658-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Based on articles 140, subsections 3), 18), and 20), and 146 of the Political Constitution; articles 4, 11, 25, subsection l), and 28 of the General Law of Public Administration No. 6227 of May 2, 1978; and articles 1, 12, 13, and 50 of the Organic Law of the Environment, No. 7554 of October 4, 1995.
1. That article 50 of the Organic Law of the Environment No. 7554 establishes that water is in the public domain, and that its conservation and sustainable use are of social interest.
2. That population growth, pollution, and the general lack of awareness among Costa Ricans regarding the importance of the rational use of natural resources (water, flora, fauna, among others) have led to excessive consumption patterns among inhabitants regarding these resources.
3. That Costa Rica urgently needs movements that enable rapid progress toward the sustainability of its productive activities, energy patterns, and the protection of water resources.
4. That under the all-encompassing importance of water, Executive Decree No. 30480-MINAE establishes the principles that will govern the national policy on water resource management, and which must be incorporated into the work plans of the relevant public institutions, for which purpose subsection l) of the first article establishes that access to potable water is an inalienable human right and must be constitutionally guaranteed.
5. That the Constitutional Chamber of the Supreme Court of Justice, through Resolution No. 2003-4654 of fifteen hours forty-four minutes on May twenty-seventh, two thousand three, recognized as part of Constitutional Law a fundamental right to potable water, derived from the fundamental rights to health, life, a healthy environment, food, and adequate housing, among others.
6. That environmental education (educación ambiental) is a vital process for achieving the protection of water resources, and under this framework, the activity "Border to Border, United for Water" aims to raise public awareness about the importance of the rational use of water.

1. Que el artículo 50 de la Ley Orgánica del Ambiente Nº 7554, establece que el agua es de dominio público, y que su conservación y uso sostenible son de interés social.
2. Que el crecimiento de la población, la contaminación y el desconocimiento general de los costarricenses, sobre la importancia del uso racional de los recursos naturales (agua, flora, fauna, entre otros) han hecho que los patrones de consumo de los habitantes -hacia estos recursos- sean desmedidos.
3. Que Costa Rica está urgida de movimientos que permitan avanzar rápidamente hacia la sostenibilidad de sus actividades productivas, los patrones energéticos y la protección del recurso hídrico.
4. Que bajo la importancia que engloba el agua, mediante Decreto Ejecutivo Nº 30480- MTNAE, se determinan los principios que regirán la política nacional en materia de gestión de los recursos hídricos, y que deberán ser incorporados, en los planes de trabajo de las instituciones públicas relevantes, estableciéndose para ello, en el inciso l) del artículo primero, que el acceso al agua potable constituye un derecho humano inalienable y debe garantizarse constitucionalmente.
5. Que la Sala Constitucional de la Corte Suprema de Justicia mediante el voto N° 2003- 4654 de las quince horas cuarenta y cuatro minutos del veintisiete de mayo de dos mil tres, reconoció como parte del Derecho de la Constitución, un derecho fundamental al agua potable, derivado de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros.
