Based on the powers granted by subsections 3) and 18) of articles 140 and 146 of the Political Constitution of Costa Rica, article 28, subsection 2, subparagraph b) of the General Law of Public Administration, Law No. 6227 of May 2, 1978, the Law Creating the National Registry, Law No. 5695 of May 28, 1975, (amended by laws No. 8766 of September 1, 2009, No. 8823 of May 5, 2010, No. 8710 of February 3, 2009, No. 7764 of April 17, 1998, No. 6934 of November 28, 1983, and by Law No. 5950 of October 27, 1976). Likewise, articles 13, 14, 15, 20, 21 of the National Cadastre Law No. 6545 of March 25, 1981, articles 7 and 26 of the Regulation to the National Cadastre Law, Executive Decree No. 34331 of November 29, 2007 (amended by Executive Decree No. 34763 of September 16, 2008), Law No. 8154 of November 27, 2001, "Loan Agreement No. 1284/0C-CR, Cadastre and Registry Regularization Program," Executive Decree No. 30106-J of December 6, 2001, "Declares the Entirety of the Cantons of the National Territory a Cadastral Zone," and Executive Decree No. 35509-J of September 30, 2009, "Regulation for the Organization of the Real Property Registry."
I.—That through Law No. 8710, published in La Gaceta No. 43 of March 10, 2009, article 2 of Law No. 5695, the Law Creating the National Registry, and its amendments, is reformed, indicating that the National Cadastre becomes part of the Real Property Registry.
II.—That Executive Decree No. 35509-J of September 30, 2009, Regulation for the Organization of the Real Property Registry, published in the Official Gazette La Gaceta No. 198 of October 13, 2009, establishes that the Real Property Registry is composed of the Subdirectorate of Cadastre and the Subdirectorate of Registration.
III.—That the Real Property Registry of the National Registry, based on the National Cadastre Law No. 6545 of March 25, 1981, in its article 13, has as its exclusive authority the execution and maintenance of the Cadastre, a function that may be partially delegated to other state institutions.
IV.—That the Legislative Assembly, on November 27, 2001, approved Law No. 8154, "Loan Agreement No. 1284/0C-CR, Cadastre and Registry Regularization Program," signed between the Government of the Republic and the Inter-American Development Bank (IDB), for the execution of the Cadastre and National Registry Regularization Program, which, by provision of the same law, is in charge of an Executing Unit attached to the Minister of Finance as a deconcentrated body.
V.—That the Cadastre and National Registry Regularization Program's task is the cadastral survey with the objective of forming the national cadastre and making the cadastral and registral information of properties compatible, in application of the provisions of the Cadastre Law No. 6545 of March 25, 1981.
VI.—That in accordance with the provisions of article 1 of Executive Decree No. 30106-J, which "Declares the Entirety of the Cantons of the National Territory a Cadastral Zone," published in La Gaceta No. 19 of January 28, 2002, and article 7 of the Regulation to the National Cadastre Law, Executive Decree No. 34331, which has been in effect since September 27, 2008, the entirety of the cantons of the national territory were declared a cadastral zone.
VII.—That the Regulation to the National Cadastre Law, Executive Decree No. 34331, which has been in effect since September 27, 2008, establishes the technical requirements for the surveying of cadastral plans.
VIII.—That since the cadastral survey work for Canton 09 Nandayure, Districts 01 Carmona, 02 Santa Rita, 03 Zapotal, 04 San Pablo, 05 Porvenir, and 06 Bejuco of the Province of Guanacaste has concluded, and in accordance with the provisions of article 19 of the National Cadastre Law and article 10 of its regulation, the property owners of said districts were summoned by the Real Property Registry of the National Registry and the Executing Unit of the Cadastre and National Registry Regularization Program to a public exhibition to review the survey results and express their conformity or non-conformity.
IX.—That the summons to the public exhibition of the cadastral survey results for Canton 09 Nandayure, Districts 01 Carmona, 02 Santa Rita, 03 Zapotal, 04 San Pablo, 05 Porvenir, and 06 Bejuco of the Province of Guanacaste was published in the Official Gazette La Gaceta No. 51 of March 12, 2012, page 6, and in the nationally circulated newspapers Al Día of March 11, 2012, page 33, and of March 12, 2012, page 22; and in La Teja, of March 11, 2012, page 3, and of March 12, 2012, page 44, for districts 01 Carmona, 02 Santa Rita, and 05 Porvenir. For districts 03 Zapotal, 04 San Pablo, and 06 Bejuco, the publication was in La Gaceta No. 133 of July 9, 2010, page 9, and in the newspapers Al Día of September 30, 2013, page 17, and of October 1, 2013, page 7.
X.—That in a resolution issued at nine-thirty hours on March seventeenth of the year two thousand sixteen, the Real Property Registry of the National Registry declared the cadastral data resulting from the cadastral survey conducted in Canton 09 Nandayure, Districts 01 Carmona, 02 Santa Rita, 03 Zapotal, 04 San Pablo, 05 Porvenir, and 06 Bejuco of the Province of Guanacaste as final.
XI.—That the terms of the deadlines established in article 20 of the National Cadastre Law have elapsed and the claims filed by the owners have been resolved by the Directorate of the Real Property Registry of the National Registry. Therefore, They decree:

I.-Que mediante Ley N° 8710, publicada en La Gaceta N° 43 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley N° 5695, Ley de Creación del Registro Nacional, y sus reformas, indicando que el Catastro Nacional pasa a formar parte del Registro Inmobiliario.
II.-Que el Decreto Ejecutivo N° 35509-J de 30 de setiembre de 2009, Reglamento de Organización del Registro Inmobiliario publicado en el Diario Oficial La Gaceta N° 198 del 13 de octubre de 2009, establece que el Registro Inmobiliario está conformado por la Subdirección de Catastro y la Subdirección Registral.
III.-Que el Registro Inmobiliario del Registro Nacional, con fundamento en la Ley de Catastro Nacional N° 6545 de 25 de marzo de 1981, en su artículo 13 tiene como potestad exclusiva, la ejecución y mantenimiento del Catastro, función que puede delegar parcialmente en otras instituciones estatales.
IV.-Que la Asamblea Legislativa, el 27 de noviembre del 2001, aprobó la Ley N° 8154, "Convenio de Préstamo N° 1284/0C-CR, Programa de Regularización del Catastro y Registro", suscrito entre el Gobierno de la República y el Banco Interamericano de Desarrollo (BID), para la ejecución del Programa de Regularización del Catastro y Registro Nacional, que por disposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita al Ministro de Hacienda como órgano desconcentrado.
V.-Que el Programa de Regularización del Catastro y Registro Nacional, tiene como tarea el levantamiento catastral con el objetivo de formar el catastro nacional y compatibilizar la información catastral y registra] de los inmuebles, en aplicación de lo que dispone la Ley de Catastro N° 6545 de 25 de marzo de 1981.
VI.-Que de conformidad con lo que establece el artículo 1° Decreto Ejecutivo N° 30106-J donde se "Declara Zona Catastral la Totalidad de los Cantones del Territorio Nacional" publicado en La Gaceta N° 19 de 28 de enero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro Nacional, Decreto Ejecutivo N° 34331, el cual rige desde el 27 de setiembre de 2008, la totalidad de los cantones del territorio nacional fueron declarados zona catastral.
VII-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo N° 34331 el cual rige desde el 27 de setiembre de 2008, establece los requerimientos técnicos para el levantamiento de planos de agrimensura.
VIII.-Que por haber concluido los trabajos de levantamiento catastral del Cantón 09 Nandayure, Distritos 01 Carmona, 02 Santa Rita, 03 Zapotal, 04 San Pablo, 05 Porvenir y 06 Bejuco de la Provincia de Guanacaste y de conformidad con lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su reglamento, fueron convocados por el Registro Inmobiliario del Registro Nacional y la Unidad Ejecutora del Programa de Regularización del Catastro y Registro Nacional, los propietarios de inmuebles de dichos distritos a una exposición pública para conocer los resultados del levantamiento y manifestar su conformidad o disconformidad.
IX.-Que la convocatoria a la exposición pública de los resultados del levantamiento catastral del Cantón 09 Nandayure, Distritos 01 Carmona, 02 Santa Rita, 03 Zapotal, 04 San Pablo, 05 Porvenir y 06 Bejuco de la Provincia de Guanacaste fue publicada en el Diario Oficial La Gaceta Nº 51 de fecha 12 de marzo del 2012, página 6 y en los diarios de circulación nacional Al Día de fecha 11 de marzo del 2012, página 33 y del 12 de marzo del 2012, página 22; y en La Teja, de fecha 11 de marzo del 2012, página 3 y 12 de marzo del 2012, página 44, para los distritos 01 Carmona, 02 Santa Rita y 05 Porvenir. Para los distritos 03 Zapotal, 04 San Pablo y 06 Bejuco, la publicación en La Gaceta Nº 133 de fecha 09 de julio del 2010, página 9 y en los Diarios, Al Día del 30 de setiembre del 2013, página 17 y 1 de octubre del 2013, página 7.
X.-Que en resolución de las nueve horas treinta minutos del diecisiete de marzo del año dos mil dieciséis, el Registro Inmobiliario del Registro Nacional declaró firmes los datos catastrales resultantes del levantamiento catastral efectuado en el Cantón 09 Nandayure, Distritos 01 Carmona, 02 Santa Rita, 03 Zapotal, 04 San Pablo, 05 Porvenir y 06 Bejuco de la Provincia de Guanacaste.
XI-Que ya transcurrieron los términos de los plazos establecidos en el artículo 20 de la Ley del Catastro Nacional y fueron resueltos, por la Dirección del Registro Inmobiliario del Registro Nacional, los reclamos presentados por los propietarios. Por tanto,
