the entire text - Complete Text of Regulation 39780 Declares a cadastral zone for Canton 08 Poas, Districts 01 San Pedro, 02 San Juan, 03 San Rafael, 04 Carrillos, and 05 Sabana Redonda, of the Province of Alajuela Complete Text of Record: 10EE4B N° 39780-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on subsections 3) and 18) of Article 140 and Article 146 of the Political Constitution of Costa Rica, Article 28 subsection /b) of the General Law of Public Administration, Law N° 6227 of May 2, 1978, Law Creating the National Registry, Law N° 5695 of May 28, 1975, (amended by Laws N° 8766 of September 1, 2009, N° 8823 of May 5, 2010, N° 8710 of February 3, 2009, N° 7764 of April 17, 1998, N° 6934 of November 28, 1983, and by Law N° 5950 of October 27, 1976). Also, Articles 13, 14, 15, 20, 21 of the National Cadastre Law N° 6545 of March 25, 1981, Articles 7 and 26 of the Regulation to the National Cadastre Law, Executive Decree N° 34331 of November 29, 2007 (amended by Executive Decree N° 34763 of September 16, 2008), Law N° 8154 of November 27, 2001, "Loan Agreement N° 1284/0C-CR, Cadastre and Registry Regularization Program", Executive Decree N° 30106-J, of December 6, 2001, "Declares a Cadastral Zone for the Entirety of the Cantons of the National Territory", and Executive Decree N° 35509-J of September 30, 2009, "Regulation for the Organization of the Real Property Registry".
I.—That through Law N° 8710, published in La Gaceta N° 48 of March 10, 2009, Article 2 of Law N° 5695, Law Creating the National Registry, and its amendments, is reformed, indicating that the National Cadastre becomes part of the Real Property Registry.
II.—That Executive Decree N° 35509-J of September 30, 2009, Regulation for the Organization of the Real Property Registry, published in the Official Gazette La Gaceta N° 198 of October 13, 2009, establishes that the Real Property Registry is composed of the Subdirectorate of Cadastre and the Subdirectorate of Registration.
III.—That the Real Property Registry of the National Registry, based on the National Cadastre Law N° 6545 of March 25, 1981, in its Article 13, has the exclusive authority for the execution and maintenance of the Cadastre, a function that it may partially delegate to other state institutions.
IV.—That the Legislative Assembly, on November 27, 2001, approved Law N° 8154, "Loan Agreement N° 1284/0C-CR, Cadastre and Registry Regularization Program", subscribed between the Government of the Republic and the Inter-American Development Bank (IDB), for the execution of the Program for the Regularization of the Cadastre and National Registry, which, by provision of the same law, is under the charge of an Executing Unit attached to the Minister of Finance as a deconcentrated body.
V.—That the Program for the Regularization of the Cadastre and National Registry has the task of cadastral surveying with the objective of forming the national cadastre and making the cadastral and registry information of real properties compatible, in application of the provisions of the Cadastre Law N° 6545 of March 25, 1981.
VI.—That in accordance with the provisions of Article 1 of Executive Decree N° 30106-J, which "Declares a Cadastral Zone for the Entirety of the Cantons of the National Territory," published in La Gaceta N° 19 of January 28, 2002, and Article 7 of the Regulation to the National Cadastre Law, Executive Decree N° 34331, which has been in effect since September 27, 2008, the entirety of the cantons of the national territory were declared a cadastral zone.
VII.—That the Regulation to the National Cadastre Law, Executive Decree N° 34331, which has been in effect since September 27, 2008, establishes the technical requirements for the survey plan preparation (levantamiento de planos de agrimensura).
VIII.—That because the cadastral survey work for Canton 08 Poas, Districts 01 San Pedro, 02 San Juan, 03 San Rafael, 04 Carrillos, and 05 Sabana Redonda, of the Province of Alajuela, has concluded, and in accordance with the provisions of Article 19 of the National Cadastre Law and Article 10 of its regulation, the Real Property Registry of the National Registry and the Executing Unit of the Program for the Regularization of the Cadastre and National Registry convened the property owners of said districts to a public exhibition to learn the survey results and to state their agreement or disagreement.
IX.—That the call for the public exhibition of the results of the cadastral survey of Canton 08 Poas, Districts 01 San Pedro, 02 San Juan, 03 San Rafael, 04 Carrillos, and 05 Sabana Redonda, of the Province of Alajuela, was published in the Official Gazette La Gaceta 208 of October 29, 2013, page 3, and in the nationally circulating newspapers Al Día, on October 29, 2013, page 13, and October 30, 2013, page 13.
X.—That in a resolution at eight-thirty hours on the seventeenth of March of the year two thousand sixteen, the Real Property Registry of the National Registry declared confirmed (firmes) the cadastral data resulting from the cadastral survey carried out in Canton 08 Poas, Districts 01 San Pedro, 02 San Juan, 03 San Rafael, 04 Carrillos, and 05 Sabana Redonda, of the Province of Alajuela.
XI.—That the terms of the timeframes established in Article 20 of the National Cadastre Law have now elapsed, and the claims filed by the property owners were resolved by the Directorate of the Real Property Registry of the National Registry.
THEY DECREE:

I.-Que mediante Ley N° 8710, publicada en La Gaceta N° 48 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley N° 5695, Ley de Creación del Registro Nacional, y sus reformas, indicando que el Catastro Nacional pasa a formar parte del Registro Inmobiliario.
II.-Que el Decreto Ejecutivo N° 35509-J de 30 de setiembre de 2009, Reglamento de Organización del Registro Inmobiliario publicado en el Diario Oficial La Gaceta N° 198 del 13 de octubre de 2009, establece que el Registro Inmobiliario está conformado por la Subdirección de Catastro y la Subdirección Registral.
III.-Que el Registro Inmobiliario del Registro Nacional, con fundamento en la Ley de Catastro Nacional N° 6545 de 25 de marzo de 1981, en su artículo 13 tiene como potestad exclusiva, la ejecución y mantenimiento del Catastro, función que puede delegar parcialmente en otras instituciones estatales.
IV.-Que la Asamblea Legislativa, el 27 de noviembre de 2001, aprobó la Ley N° 8154, "Convenio de Préstamo N° 1284/0C-CR, Programa de Regularización del Catastro y Registro", suscrito entre el Gobierno de la República y el Banco Interamericano de Desarrollo (BID), para la ejecución del Programa de Regularización del Catastro y Registro Nacional, que por disposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita al Ministro de Hacienda como órgano desconcentrado.
V.-Que el Programa de Regularización del Catastro y Registro Nacional, tiene como tarea el levantamiento catastral con el objetivo de formar el catastro nacional y compatibilizar la información catastral y registral de los inmuebles, en aplicación de lo que dispone la Ley de Catastro N°6545 de 25 de marzo de 1981.
VI.-Que de conformidad con lo que establece el artículo 1° Decreto Ejecutivo N° 30106-J donde se "Declara Zona Catastral la Totalidad de los Cantones del Territorio Nacional" publicado en La Gaceta N° 19 de 28 de enero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro Nacional, Decreto Ejecutivo N° 34331, el cual rige desde el 27 de setiembre de 2008, la totalidad de los cantones del territorio nacional fueron declarados zona catastral.
VII.-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo N° 34331 el cual rige desde el 27 de setiembre de 2008, establece los requerimientos técnicos para el levantamiento de planos de agrimensura.
VIII.-Que por haber concluido los trabajos de levantamiento catastral del Cantón 08 Poas, Distritos 01 San Pedro, 02 San Juan, 03 San Rafael, 04 Carrillos y 05 Sabana Redonda, de la Provincia de Alajuela y de conformidad con lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su reglamento, fueron convocados por el Registro Inmobiliario del Registro Nacional y la Unidad Ejecutora del Programa de Regularización del Catastro y Registro Nacional, los propietarios de inmuebles de dichos distritos a una su conformidad o disconformidad.
IX.-Que la convocatoria a la exposición pública de los resultados del levantamiento catastral del Cantón 08 Poas, Distritos 01 San Pedro, 02 San Juan, 03 San Rafael, 04 Carrillos y 05 Sabana Redonda, de la Provincia de Alajuela, fue publicada en el Diario Oficial La Gaceta 208 de fecha 29 de octubre del 2013, página 3 y en los diarios de circulación nacional Al Día, en fecha 29 de octubre del 2013, página 13 y el 30 de octubre del 2013, página 13.
X.-Que en resolución de las ocho horas treinta minutos del diecisiete de marzo del año dos mil dieciséis, el Registro Inmobiliario del Registro Nacional declaró firmes los datos catastrales resultantes del levantamiento catastral efectuado en el Cantón 08 Poas, Distritos 01 San Pedro, 02 San Juan, 03 San Rafael, 04 Carrillos y 05 Sabana Redonda, de la Provincia de Alajuela XI-Que ya transcurrieron los términos de los plazos establecidos en el artículo 20 de la Ley del Catastro Nacional y fueron resueltos, por la Dirección del Registro Inmobiliario del Registro Nacional, los reclamos presentados por los propietarios.
SE DECLARA ZONA CATASTRADA LOS DISTRITOS PRIMERO SAN PEDRO, 02 SAN JUAN, 03 SAN RAFAEL, 04 CARRILLOS Y 05 SABANA REDONDA.
