- Complete Text of Regulation 39769 Declares a surveyed zone the districts first Heredia, second Mercedes and fourth Ulloa of canton 01 Heredia of province 04 Heredia Complete Text of record: 10EE41 N° 39769-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on subsections 3) and 18) of article 140 and 146 of the Political Constitution of Costa Rica, on article 28 subsection b) of the General Law of Public Administration, Law N° 6227 of May 2, 1978, Law of Creation of the National Registry, Law N° 5695 of May 28, 1975, (amended by laws N° 8766 of September 1, 2009, N° 8823 of May 5, 2010, N° 8710 of February 3, 2009, N° 7764 of April 17, 1998, N° 6934 of November 28, 1983 and by Law N° 5950 of October 27, 1976). I.-That through Law N° 8710, published in La Gaceta N° 48 of March 10, 2009, article 2 of Law N° 5695, Law of Creation of the National Registry, and its amendments, is reformed, indicating that the National Cadastre becomes part of the Real Property Registry.
II.-That Decreto Ejecutivo N° 35509-J of September 30, 2009, Organization Regulation of the Real Property Registry published in the Official Gazette La Gaceta N° 198 of October 13, 2009, establishes that the Real Property Registry is composed of the Subdirectorate of Cadastre and the Subdirectorate of Registration.
III.-That the Real Property Registry of the National Registry, based on the National Cadastre Law N° 6545 of March 25, 1981, in its article 13 has the exclusive power, the execution and maintenance of the Cadastre, a function that may be partially delegated to other state institutions.
IV.-That the Legislative Assembly, on November 27, 2001, approved Law N° 8154, "Loan Agreement N° 1284/0C-CR, Cadastre and Registry Regularization Program", subscribed between the Government of the Republic and the Inter-American Development Bank (IDB), for the execution of the Cadastre and National Registry Regularization Program, which by provision of the same law, is in charge of an Executing Unit attached to the Minister of Finance as a deconcentrated body.
V.-That the Cadastre and National Registry Regularization Program has the task of cadastral surveying (levantamiento catastral) with the objective of forming the national cadastre and making compatible the cadastral and registral information of properties, in application of the provisions of the Cadastre Law N° 6545 of March 25, 1981.
VI.-That in accordance with the provisions of article 10 of Decreto Ejecutivo N° 30106-J where "Declares the Entirety of the Cantons of the National Territory a Cadastral Zone" published in La Gaceta N° 19 of January 28, 2002 and article 7 of the Regulation to the National Cadastre Law, Decreto Ejecutivo N° 34331, which has been in effect since September 27, 2008, the entirety of the cantons of the national territory were declared a cadastral zone (zona catastral).
VII-That the Regulation to the National Cadastre Law, Decreto Ejecutivo N° 34331 which has been in effect since September 27, 2008, establishes the technical requirements for the surveying of land survey plans (planos de agrimensura).
VIII.-That because the cadastral surveying (levantamiento catastral) work of Canton 01 Heredia, Districts 01 Heredia, 02 Mercedes and 04 Ulloa of the Province of Heredia has been concluded and in accordance with the provisions of article 19 of the National Cadastre Law and 10 of its regulation, the property owners of said districts were summoned by the Real Property Registry of the National Registry and the Executing Unit of the Cadastre and National Registry Regularization Program to a public exhibition to learn of the results of the survey (levantamiento) and express their agreement or disagreement.
IX.-That the call for the public exhibition of the results of the cadastral survey (levantamiento catastral) of Canton 01 Heredia, Districts 01 Heredia, 02 Mercedes and 04 Ulloa of the Province of Heredia was published in the Official Gazette La Gaceta No. 158 of August 16, 2010, page 14 and in La Gaceta No. 124 of June 27, 2012, page 3 and in the national circulation newspapers Al Día and La Teja on the dates of August 17 and 18, 2010 and June 30 and July 1, 2012.
X.-That in a resolution at eight o'clock on the twenty-third of February of the year two thousand sixteen, the Real Property Registry of the National Registry declared firm the cadastral data resulting from the cadastral survey (levantamiento catastral) conducted in Canton 01 Heredia, Districts 01 Heredia, 02 Mercedes and 04 Ulloa of the Province of Heredia.
XI-That the terms of the deadlines established in article 20 of the National Cadastre Law have elapsed and the claims submitted by the owners were resolved by the Directorate of the Real Property Registry of the National Registry.

I.-Que mediante Ley N° 8710, publicada en La Gaceta N° 48 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley N° 5695, Ley de Creación del Registro Nacional, y sus reformas, indicando que el Catastro Nacional pasa a formar parte del Registro Inmobiliario.
II.-Que el Decreto Ejecutivo N° 35509-J de 30 de setiembre de 2009, Reglamento de Organización del Registro Inmobiliario publicado en el Diario Oficial La Gaceta N° 198 del 13 de octubre de 2009, establece que el Registro Inmobiliario está conformado por la Subdirección de Catastro y la Subdirección Registral.
III.-Que el Registro Inmobiliario del Registro Nacional, con fundamento en la Ley de Catastro Nacional N° 6545 de 25 de marzo de 1981, en su artículo 13 tiene como potestad exclusiva, la ejecución y mantenimiento del Catastro, función que puede delegar parcialmente en otras instituciones estatales.
IV.-Que la Asamblea Legislativa, el 27 de noviembre de 2001, aprobó la Ley N° 8154, "Convenio de Préstamo N° 1284/0C-CR, Programa de Regularización del Catastro y Registro", suscrito entre el Gobierno de la República y el Banco Interamericano de Desarrollo. (BID), para la ejecución del Programa de Regularización del Catastro y Registro Nacional, que por disposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita al Ministro de Hacienda como órgano desconcentrado.
V.-Que el Programa de Regularización del Catastro y Registro Nacional, tiene como tarea el levantamiento catastral con el objetivo de formar el catastro nacional y compatibilizar la información catastral y registral de los inmuebles, en aplicación de lo que dispone la Ley de Catastro N° 6545 de 25 de marzo de 1981.
VI.-Que de conformidad con lo que establece el artículo 10 Decreto Ejecutivo N° 30106-J donde se "Declara Zona Catastral la Totalidad de los Cantones del Territorio Nacional" publicado en La Gaceta N° 19 de 28 de enero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro Nacional, Decreto Ejecutivo N° 34331, el cual rige desde el 27 de setiembre de 2008, la totalidad de los cantones del territorio nacional fueron declarados zona catastral.
VII-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo N° 34331 el cual rige desde el 27 de setiembre de 2008, establece los requerimientos técnicos para el levantamiento de planos de agrimensura.
VIII.-Que por haber concluido los trabajos de levantamiento catastral del Cantón 01 Heredia, Distritos 01 Heredia, 02 Mercedes y 04 Ulloa de la Provincia de Heredia y de conformidad con lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su reglamento, fueron convocados por el Registro Inmobiliario del Registro Nacional y la Unidad Ejecutora del Programa de Regularización del Catastro y Registro Nacional, los propietarios de inmuebles de dichos distritos a una exposición pública para conocer los resultados del levantamiento y manifestar su conformidad o disconformidad.
IX.-Que la convocatoria a la exposición pública de los resultados del levantamiento catastral del Cantón 01 Heredia, Distritos 01 Heredia, 02 Mercedes y 04 Ulloa de la Provincia de Heredia fue publicada en el Diario Oficial La Gaceta No. 158 del 16 de agosto del 2010, página 14 yen La Gaceta No. 124 del 27 de junio del 2012, página 3 y en los diarios de circulación nacional Al Día y La Teja de fechas 17 y 18 de agosto del 2010 y del 30 de junio y 01 de julio del 2012.
X.-Que en resolución de las ocho horas del veintitrés de febrero del año dos mil dieciséis, el Registro Inmobiliario del Registro Nacional declaró firmes los datos catastrales resultantes del levantamiento catastral efectuado en el Cantón 01 Heredia, Distritos 01 Heredia, 02 Mercedes y 04 Ulloa de la Provincia de Heredia.
XI-Que ya transcurrieron los términos de los plazos establecidos en el artículo 20 de la Ley del Catastro Nacional y fueron resueltos, por la Dirección del Registro Inmobiliario del Registro Nacional, los reclamos presentados por los propietarios.
SE DECLARA ZONA CATASTRADA LOS DISTRITOS PRIMERO HEREDIA, SEGUNDO MERCEDES Y CUARTO ULLOA DEL CANTON 01 HEREDIA DE LA PROVINCIA 04 HEREDIA
