I.-That by means of Law Nº 8710, published in La Gaceta Nº 48 of March 10, 2009, article 2 of Law Nº 5695, Law for the Creation of the National Registry, and its amendments, is reformed, indicating that the National Cadastre becomes part of the Real Estate Registry.
II.-That Executive Decree Nº 35509-J of September 30, 2009, Organization Regulation of the Real Estate Registry published in the Official Gazette La Gaceta Nº 198 of October 13, 2009, establishes that the Real Estate Registry is comprised of the Subdirectorate of Cadastre and the Registral Subdirectorate.
III.-That the Real Estate Registry of the National Registry, based on the National Cadastre Law Nº 6545 of March 25, 1981, in its article 13 has the exclusive power of execution and maintenance of the Cadastre, a function that it may partially delegate to other state institutions.
IV.-That the Legislative Assembly, on November 27, 2001, approved Law Nº 8154, "Loan Agreement Nº 1284/0C-CR, Cadastre and Registry Regularization Program", subscribed between the Government of the Republic and the Inter-American Development Bank (IDB), for the execution of the Cadastre and National Registry Regularization Program, which, by provision of the same law, is under the charge of an Executing Unit attached to the Minister of Finance as a deconcentrated body.
V.-That the Cadastre and National Registry Regularization Program has as its task the cadastral survey (levantamiento catastral) with the objective of forming the national cadastre and making compatible the cadastral and registral information of real properties, in application of the provisions of the Cadastre Law N° 6545 of March 25, 1981.
VI.-That in accordance with what is established by article 1 of Executive Decree N° 30106-J, which "Declares a Cadastral Zone the Entirety of the Cantons of the National Territory" published in La Gaceta N° 19 of January 28, 2002, and article 7 of the Regulation to the National Cadastre Law, Executive Decree N° 34331, which has been in force since September 27, 2008, the entirety of the cantons of the national territory were declared a cadastral zone (zona catastral).
VII.-That the Regulation to the National Cadastre Law, Executive Decree N° 34331, which has been in force since September 27, 2008, establishes the technical requirements for the survey of cadastral plans (planos de agrimensura).
VIII.-That because the cadastral survey (levantamiento catastral) work of Canton 01 Cartago, Districts 01 Oriental, 02 Occidental, 03 Carmen, 04 San Nicolás, 05 Agua Caliente, 06 Guadalupe, 07 Corralillo, 08 Tierra Blanca, 09 Dulce Nombre, 10 Llano Grande, and 11 Quebradilla of the Province of Cartago has been concluded, and in accordance with what is established by article 19 of the National Cadastre Law and 10 of its regulation, the property owners of said districts were summoned by the Real Estate Registry of the National Registry and the Executing Unit of the Cadastre and National Registry Regularization Program to a public exhibition to learn the results of the survey (levantamiento) and to express their conformity or disagreement.
IX.-That the summons to the public exhibition of the results of the cadastral survey (levantamiento catastral) of Canton 01 Cartago, Districts 01 Oriental, 02 Occidental, 03 Carmen, 04 San Nicolás, 05 Agua Caliente, 06 Guadalupe, 07 Corralillo, 08 Tierra Blanca, 09 Dulce Nombre, 10 Llano Grande, and 11 Quebradilla of the Province of Cartago was published in the Official Gazette La Gaceta No. 89 of May 9, 2012, page 6, and in the nationally circulated newspapers Al Día and La Teja of May 20 and 21, 2012, for the districts Oriental, Occidental, Guadalupe, and El Carmen; in La Gaceta No. 123 of June 26, 2012, page 5, and in the newspapers Al Día and La Teja on June 17 and 18, 2012, for the districts Dulce Nombre and Aguacaliente; Gaceta No. 124 of June 27, 2012, page 3, newspapers Al Día and La Teja on June 30 and July 1, 2012, for the districts San Nicolás, Tierra Blanca, and Llano Grande; Gaceta No. 190 of October 2, 2012, page 4, Newspapers Al Día and La Teja of September 23 and 24, 2012, for District Quebradilla; and in La Gaceta No. 197 of October 11, 2012, page 2, and the Newspapers Al Día and La Teja of October 21 and 22, 2012, for the district Corralillo.
X.-That in a resolution issued at ten o'clock on February twenty-third of the year two thousand sixteen, the Real Estate Registry of the National Registry declared the cadastral data resulting from the cadastral survey (levantamiento catastral) carried out in Canton 01 Cartago, Districts 01 Oriental, 02 Occidental, 03 Carmen, 04 San Nicolas, 05 Agua Caliente, 06 Guadalupe, 07 Corralillo, 08 Tierra Blanca, 09 Dulce Nombre, 10 Llano Grande, and 11 Quebradilla of the Province of Cartago to be final.
XI.-That the terms of the deadlines established in article 20 of the National Cadastre Law have already elapsed, and the claims filed by the owners were resolved by the Directorate of the Real Estate Registry of the National Registry.

I.-Que mediante Ley Nº 8710, publicada en La Gaceta Nº 48 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley Nº 5695, Ley de Creación del Registro Nacional, y sus reformas, indicando que el Catastro Nacional pasa a formar parte del Registro Inmobiliario.
II.-Que el Decreto Ejecutivo Nº 35509-J de 30 de setiembre de 2009, Reglamento de Organización del Registro Inmobiliario publicado en el Diario Oficial La Gaceta Nº 198 del 13 de octubre de 2009, establece que el Registro Inmobiliario está conformado por la Subdirección de Catastro y la Subdirección Registra!.
III.-Que el Registro Inmobiliario del Registro Nacional, con fundamento en la Ley de Catastro Nacional Nº 6545 de 25 de marzo de 1981, en su artículo 13 tiene como potestad exclusiva, la ejecución y mantenimiento del Catastro, función que puede delegar parcialmente en otras instituciones estatales.
IV.-Que la Asamblea Legislativa, el 27 de noviembre de 2001, aprobó la Ley Nº 8154, "Convenio de Préstamo Nº 1284/0C-CR, Programa de Regularización del Catastro y Registro", suscrito entre el Gobierno de la República y el Banco Interamericano de Desarrollo (BID), para la ejecución del Programa de Regularización del Catastro y Registro Nacional, que por disposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita al Ministro de Hacienda como órgano desconcentrado.
V.-Que el Programa de Regularización del Catastro y Registro Nacional, tiene como tarea el levantamiento catastral con el objetivo de formar el catastro nacional y compatibilizar la información catastral y registral de los inmuebles, en aplicación de lo que dispone la Ley de Catastro N° 6545 de 25 de marzo de 1981.
VI.-Que de conformidad con lo que establece el artículo 1° Decreto Ejecutivo N° 30106-J donde se "Declara Zona Catastral la Totalidad de los Cantones del Territorio Nacional" publicado en La Gaceta N° 19 de 28 de enero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro Nacional, Decreto Ejecutivo N° 34331, el cual rige desde el 27 de setiembre de 2008, la totalidad de los cantones del territorio nacional fueron declarados zona catastral.
VII.-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo N° 34331 el cual rige desde el 27 de setiembre de 2008, establece los requerimientos técnicos para el levantamiento de planos de agrimensura.
VIII.-Que por haber concluido los trabajos de levantamiento catastral del Cantón 01 Cartago, Distritos 01 Oriental, 02 Occidental, 03 Carmen, 04 San Nicolás, 05 Agua Caliente, 06 Guadalupe, 07 Corralillo, 08 Tierra Blanca, 09 Dulce Nombre, 10 Llano Grande y 11 Quebradilla de la Provincia de Cartago y de conformidad con lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su reglamento, fueron convocados por el Registro Inmobiliario del Registro Nacional y la Unidad Ejecutora del Programa de Regularización del Catastro y Registro Nacional, los propietarios de inmuebles de dichos distritos a una su conformidad o disconformidad.
IX.-Que la convocatoria a la exposición pública de los resultados del levantamiento catastral del Cantón 01 Cartago, Distritos 01 Oriental, 02 Occidental, 03 Carmen, 04 San Nicolás, 05 Agua Caliente, 06 Guadalupe, 07 Corralillo, 08 Tierra Blanca, 09 Dulce Nombre, 10 Llano Grande y 11 Quebradilla de la Provincia de Cartago fue publicada en el Diario Oficial La Gaceta No. 89 del 09 de mayo del 2012, página 6 y en los diarios de circulación nacional Al Día y La Teja de 20 y 21 de mayo del 2012 para los distritos Oriental, Occidental, Guadalupe y El Carmen, en La Gaceta No. 123 del 26 de junio del 2012, página 5, y en los diarios Al Día y La Teja, fechas 17 y 18 de junio del 2012 para los distritos Dulce Nombre y Aguacaliente, Gaceta No. 124 del 27 de junio del 2012, página 3, diarios Al Día y La Teja en fecha 30 de junio y 01 de julio del 2012, para los distritos San Nicolás, Tierra Blanca y Llano Grande, Gaceta No. 190 del 02 de octubre del 2012, página 4, Diarios Al Día y La Teja de 23 y 24 de setiembre del 2012 para el Distrito Quebradilla y en La Gaceta No. 197 del 11 de octubre del 2012, página 2 y los Diarios Al Día y La Teja del 21 y 22 de octubre del 2012 para el distrito Corralillo.
X.-Que en resolución de las diez horas del veintitrés de febrero del año dos mil dieciséis, el Registro Inmobiliario del Registro Nacional declaró firmes los datos catastrales resultantes del levantamiento catastral efectuado en el Cantón 01 Cartago, Distritos 01 Oriental, 02 Occidental, 03 Carmen, 04 San Nicolas, 05 Agua Caliente, 06 Guadalupe, 07 Corralillo, 08 Tierra Blanca, 09 Dulce Nombre, 10 Llano Grande y 11 Quebradilla de la Provincia de Cartago.
