1º-We have before us the memorandum of the meeting of the Joint Tariff Commission, who, in accordance with what was agreed by this Board of Directors through Agreement AJDIP/190-2016, proceeded to present to the representatives of this Board of Directors before said Commission, the proposal contained in memorandum CT-003-2016.

1. 2That from the analysis and discussion raised, the following agreements were reached:

• 1)To recommend to the Board of Directors the approval of the presented scenario, which contemplates achieving a sales goal of 350 sport and tourist fishing licenses to reach the break-even point, with the following tariffs:

Autonomy Proposed Tariff Less than or equal to 5 miles ¢90,000.00 Less than or equal to 40 miles ¢270,000.00 Greater than 40 miles ¢460.000.00 2) To recommend adopting these tariffs starting from the month of November 2016, given that it is the beginning of the high season for the 2016-2017 period, so that it constitutes an incentive for those who have been continuously and duly paying for the fishing license, as well as for individuals and legal entities that must regularize their status for the start of the high season and comply with the current legislation on the matter.

• 3)To achieve this goal, there must be support from organizations and associations, so that their members or non-members engaged in this activity, voluntarily and consciously, come to the INCOPESCA offices to regularize their status, in accordance with the provisions of the Law on this matter.
• 4)The General Technical Directorate will develop a Work Plan for the fulfillment and monitoring of the set goal as well as to coordinate with organizations and associations so that, jointly, they promote the development of the sport and tourist activity under the stated objectives.
• 5)To conduct an annual evaluation of the work plan and income obtained, to determine the results achieved.

1. 3That having fulfilled and achieved the objectives proposed by this Board of Directors in the sense of establishing with absolute clarity a clear definition on which the tariff for the sport fishing license for vessels of various autonomies is based, the Board Members deem it appropriate to accept the presented proposal, on the understanding that it would come into effect once published in the Official Gazette La Gaceta and not as the Commission proposed for it to take effect starting next November; reason for which, the Board of Directors; Therefore,

AGREES:

1º-To modify items 26, 27, 28, and 29 of Agreement AJDIP/318-2014 and, as applicable, Agreement AJDIP/434-2015, establishing in their place the tariffs for the concept of a license for national sport and tourist fishing vessels, in accordance with the following chart:

2º-Firm Agreement.

3º-Effective from its publication.

Considering:

1º-Se conoce oficio minuta de reunión de la Comisión Mixta de Tarifas, quienes atendiendo lo acordado por ésta Junta Directiva mediante Acuerdo AJDIP/190-2016, procedieron a presentar ante los representantes de ésta Junta Directiva ante dicha Comisión, la propuesta contenida en el oficio CT-003-2016.

1. 2Que del análisis y discusión planteada se arribaron a los siguientes acuerdos:

• 1)Recomendar a la Junta Directiva la aprobación del escenario expuesto, en el que se contempla alcanzar una meta de venta de 350 licencias de pesca deportiva y turística para alcanzar el punto de equilibrio, con las siguientes tarifas:

Autonomía Tarifa Propuesta Menor o igual 5 millas ¢90,000.00 Menor o igual 40 millas ¢270,000.00 Mayor 40 millas ¢460.000.00 2) Recomendar adoptar estas tarifas a partir del mes de noviembre 2016, siendo que es el inicio de la temporada alta del periodo 2016-2017, a fin de que se constituya como un incentivo para aquellos que han estado pagando de manera continua y cumplida la licencia de pesca, así como para las personas físicas y jurídicas que deben regularizar su estatus para el inicio de la temporada alta y cumplir con la legislación vigente sobre la materia.

• 3)Para el cumplimiento de esta meta, debe existir el apoyo de las organizaciones y asociaciones, para que sus agremiados o no agremiados dedicados a esta actividad, voluntaria y conscientemente, lleguen a las oficinas del INCOPESCA a regularizar su estatus, conforme a lo que dispone la Ley en esta materia.
• 4)La Dirección General Técnica desarrollará un Plan de Trabajo para el cumplimiento y seguimiento de la meta fijada así como para coordinar con las organizaciones y asociaciones para que de manera conjunta, fomenten el desarrollo de la actividad deportiva y turística bajo los objetivos planteados.
• 5)Realizar una evaluación anual del plan de trabajo e ingresos obtenidos, para determinar los resultados alcanzados.

1. 3Que habiéndose cumplido y alcanzado los objetivos propuestos por ésta Junta Directiva en el sentido de establecer con claridad meridiana la definición clara sobre la que se sustenta la tarifa por licencia de pesca deportiva para embarcaciones de las diversas autonomías, estiman los Sres. Directivos que resulta procedente acoger la propuesta presentada, en el entendido que la misma entraría en vigencia una vez sea publicada en el Diario Oficial La Gaceta y no como lo planteó la Comisión para que rigiera a partir del próximo mes de noviembre; razón por la cual, la Junta Directiva; Por tanto,

ACUERDA:

1º-Modificar los ítems 26, 27, 28 y 29 del Acuerdo AJDIP/318-2014 y en lo conducente el Acuerdo AJDIP/434-2015, estableciendo en su lugar las tarifas por concepto de licencia para embarcaciones nacionales de pesca deportiva y turística, de conformidad con el siguiente cuadro:

2º-Acuerdo Firme.

3º-Rige a partir de su publicación.
