in the entirety of the text - Complete Text of Regulation 181 Prohibits fishing vessels flying the national flag from interacting with data buoys in the Antigua Convention Area (Eastern Pacific Ocean) Complete Text of act: 10ED1C COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/181-2016.-Puntarenas, on the twentieth day of May, two thousand sixteen.

1.- Mr. Antonio Porras Porras, Technical Director General, submits official communication DGT-060-2016, through which he forwards a proposal for the prohibition of fishing on data buoys, in accordance with what was resolved by Resolution of the Inter-American Tropical Tuna Commission -IATTC- No. C-11-03, adopted at the 82nd Meeting of that Commission, which becomes binding for our country.

2.- That said proposal states that the Inter-American Tropical Tuna Commission at its 82nd Meeting, held from July 4 to 8, 2011, approved Resolution C-11-03, by which fishing on data buoys is prohibited.

3.- That aware that many nations, including Members of the Commission, operate and deploy data buoys throughout the eastern Pacific Ocean and the world's oceans to obtain information used to generate better weather and marine forecasts, provide assistance to fisheries by generating data on surface and subsurface ocean temperatures, assist search and rescue efforts at sea, and obtain critical data for the research of meteorological and oceanographic topics and climate prediction; 4.- That knowing that highly migratory species, particularly tunas, aggregate near data buoys; 5.- That the World Meteorological Organization and the Intergovernmental Oceanographic Commission have determined that vandalism and damage to data buoys by fishing vessels constitute a significant problem in the Pacific Ocean and worldwide; 6.- That vandalism or damage to data buoys results in a significant loss of critical data for weather prediction, the study of marine conditions, tsunami warnings, and the support of search and rescue efforts at sea, and that the Members of the Commission spend considerable time and resources locating, replacing, and repairing data buoys damaged or lost due to fishing activities or vandalism; 7.- That the loss of critical data for the study of marine conditions due to vandalism or damage to data buoys undermines the analyses by IATTC scientists seeking to improve knowledge of the habitat use of tunas and the relationships between climate and tuna recruitment, and research by environmental scientists in general; and 8.- That Costa Rican fishing vessels have been detected fishing on buoys or have used them to tie up to them, and even at least one case has occurred in which a data buoy had to be retrieved in Puntarenas.

9.- That the IATTC resolutions are binding on Costa Rica and that therefore, said resolutions must be progressively harmonized into national regulations; the Board of Directors. Therefore,

1.- To prohibit fishing vessels flying the national flag from interacting with data buoys in the Antigua Convention Area (Eastern Pacific Ocean). Interactions include, but are not limited to, encircling the buoy with fishing gear (arte de pesca), tying or securing the vessel, or any part or portion of the vessel, to a data buoy, or cutting its anchor cable.

2.- To prohibit national fishing vessels or foreign-flagged vessels with a Costa Rican fishing license from deploying their fishing gear (artes de pesca) in an area that is less than one nautical mile from an anchored data buoy in the Antigua Convention area.

3.- To prohibit fishing vessels from taking on board a data buoy, unless a Contracting Party or the owner responsible for that buoy specifically authorizes or requests it.

4.- Fishing vessels shall take all reasonable measures to avoid entangling their fishing gear (arte de pesca) or interacting directly in any way with data buoys that are adrift.

5.- Fishing vessels whose gear has become entangled with a data buoy are required to remove the entangled fishing gear (arte de pesca) with the minimum possible damage to the data buoy.

6.- If a fishing vessel incurs what is indicated in point 5, it must notify the Head of the Department of Protection and Registry in writing upon the return of its trip, indicating in said report the date, position, and nature of the entanglement, along with any identifying information about the data buoy, for the purpose of proceeding with the respective submission of said report to the IATTC.

7.- Scientific research programs notified to the Commission may operate fishing vessels at less than one nautical mile from a data buoy, provided they do not interact with it.

8.- The Department of Extension and Training must carry out the communication of this agreement to the Fishermen's Organizations, for their knowledge and application.

9.- Violations of this regulation shall be sanctioned as established in Law No. 8436, the Fisheries and Aquaculture Law.

10.- It enters into force upon its publication in the Official Gazette La Gaceta.

11.- Final Agreement.

en la totalidad del texto - Texto Completo Norma 181 Prohíbe a las embarcaciones pesqueras de bandera nacional interactuar con boyas de datos en el Área de la Convención de Antigua (Océano Pacífico Oriental) Texto Completo acta: 10ED1C INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/181-2016.-Puntarenas, a los veinte días del mes de mayo de dos mil dieciséis.

1º-Presenta el Sr. Antonio Porras Porras, Director General Técnico, oficio DGT-060-2016, por medio del cual remite propuesta de prohibición de la pesca sobre boyas de datos, de conformidad con lo resuelto mediante resolución de la Comisión Interamericana del Atún Tropical -CIAT- N°. C-11-03, adoptada en la 82° Reunión de esa Comisión, la cual se vuelve vinculante para nuestro país.

1. 2Que dicha propuesta señala que la Comisión Interamericana del Atún Tropical en su 82ª Reunión, celebrada del 4 al 8 de julio de 2011 aprobó la Resolución C-11-03 mediante la cual se prohíbe la pesca sobre boyas de datos.
2. 3Que conscientes de que muchas naciones, incluidos Miembros de la Comisión, operan y emplazan boyas de datos por todo el Océano Pacífico oriental y los océanos del mundo para obtener información usada para generar mejores pronósticos meteorológicos y marinos, brindar ayuda a la pesca mediante la generación de datos sobre temperaturas oceánicas superficiales y subsuperficiales, ayudar esfuerzos de búsqueda y rescate en el mar, y obtener datos críticos para la investigación de temas meteorológicos y oceanográficos y predicción climática;
3. 4Que sabiendo que especies altamente migratorias, en particular los atunes, se agregan cerca de boyas de datos;
4. 5Que la Organización Meteorológica Mundial y la Comisión Oceanográfica Intergubernamental han determinado que el vandalismo y daños a las boyas de datos por buques pesqueros constituyen un problema importante en el Océano Pacífico y en todo el mundo;
5. 6Que el vandalismo o daño a las boyas de datos resulta en una pérdida importante de datos críticos para la predicción del tiempo, el estudio de condiciones marinas, avisos de tsunamis, y el apoyo de esfuerzos de búsqueda y rescate en el mar, y que los Miembros de la Comisión gastan time y recursos considerables en localizar, reemplazar, y reparar boyas de datos dañadas o pérdidas debido a actividades de pesca o vandalismo;
6. 7Que la pérdida de datos críticos para el estudio de las condiciones marinas debido al vandalismo o daño a las boyas de datos menoscaba los análisis por los científicos de la CIAT que buscan mejorar los conocimientos del uso de hábitat de los atunes y las relaciones entre el clima y el reclutamiento de los atunes, y la investigación por científicos ambientales en general; y
7. 8Que embarcaciones pesqueras costarricenses han sido detectadas haciendo pesca sobre boyas o las han utilizado para amarrarse a ellas e incluso se ha presentado al menos un caso en que se ha tenido que recoger una boya de datos en Puntarenas.
8. 9Que las resoluciones de la CIAT son vinculantes para Costa Rica y que por lo tanto se debe ir homologando dichas resoluciones a la normativa nacional; la Junta Directiva. Por tanto,

ACUERDA:

1º-Prohibir a las embarcaciones pesqueras de bandera nacional interactuar con boyas de datos en el Área de la Convención de Antigua (Océano Pacífico Oriental). Las interacciones incluyen, pero no se limitan a, cercar la boya con el arte de pesca, amarrar o sujetar al buque, o cualquier parte o porción de la embarcación a una boya de datos o cortar su cable de ancla.

2º-Prohibir a los buques pesqueros nacionales o de bandera extranjera con licencia de pesca de Costa Rica calar sus artes de pesca en un área que este a menos de una milla náutica de distancia de una boya de datos anclada en el área de la Convención de Antigua.

3º-Prohibir a las embarcaciones pesqueras subir a bordo una boya de datos, a menos que una Parte Contratante o el propietario responsable de esa boya lo autorice o solicite específicamente.

4º-Las embarcaciones pesqueras deberán tomar toda medida razonable para evitar enmallar en el arte de pesca o interactuar directamente de cualquier forma con las boyas de datos que flotan a la deriva.

5º-Se obliga a las embarcaciones pesqueras cuyo arte se haya enmallado con una boya de datos extraer el arte de pesca enmallado con el daño mínimo posible a la boya de datos.

6º-Si una embarcación pesquera incurre en lo señalado en el punto 5, deberá notificarlo al regreso de su viaje por escrito ante la Jefatura del Departamento de Protección y Registro, indicando en dicho reporte la fecha, posición, y naturaleza del enmallamiento, junto con cualquier información identificadora sobre la boya de datos, a efectos de proceder a realizar la remisión respectiva de dicho informe ante la CIAT.

7º-Los programas de investigación científica notificados a la Comisión podrán operar buques pesqueros a menos de una milla náutica de una boya de datos serán permitidos, siempre que no interactúen con la misma.

8º-El Departamento de Extensión y Capacitación deberá realizar la comunicación de este acuerdo a las Organizaciones de Pescadores, para su conocimiento y aplicación.

9º-Las faltas a esta regulación serán sancionadas conforme se establece en la Ley N° 8436, Ley de Pesca y Acuicultura.

10.-Rige a partir de su publicación en el Diario Oficial La Gaceta.

11.-Acuerdo Firme.
