1That the proposed Regulation for the Rehabilitation of Expired Fishing Licenses, submitted by Mr. Guillermo Ramírez Gätjens, Head of the Technical Secretariat of the Board of Directors, having been submitted in the first instance for consideration by the Board Members, the opinion of the General Technical Directorate and the Legal Advisory was requested regarding its pertinence.
2That having received the corresponding favorable legal opinion, the Board Members assess and consider that it fulfills the purposes and objectives pursued in order to regulate the existing legal vacuum in that area, especially in relation to Dictamen C-064-2014 of the Procuraduría General de la República, in accordance with the specific and peculiar characteristics that commercial fishing activity represents in our country.
3That by virtue of the foregoing, the Board of Directors, therefore;

AGREES:

1º-To approve the creation of the Commission for the Study, Analysis, Review, and Recommendation of requests for the rehabilitation of expired licenses, as well as the procedure for the rehabilitation of fishing licenses whose expiration occurred due to causes other than those established in article 113 of the Ley de Pesca y Acuicultura, Ley N° 8436, except for subsection a), under the following terms and conditions:

COMMISSION FOR THE STUDY, ANALYSIS, REVIEW, AND RECOMMENDATION OF REQUESTS FOR THE REHABILITATION OF EXPIRED LICENSES, AS WELL AS THE PROCEDURE FOR THE REHABILITATION OF FISHING LICENSES WHOSE EXPIRATION OCCURRED DUE TO CAUSES OTHER THAN THOSE ESTABLISHED IN ARTICLE 113 OF THE LEY DE PESCA Y ACUICULTURA, LEY N° 8436, EXCEPT FOR SUBSECTION A) CHAPTER I On the creation and powers of the Commission for the Study, Analysis, Review, and Recommendation of requests for the rehabilitation of Expired licenses (CEARLP)

Considering:

For this purpose, they must accredit and demonstrate the circumstances of force majeure or act of God (caso fortuito o fuerza mayor) or any others that they consider prevented them from timely submitting the renewal of their fishing license.

The minutes (acta) of the meetings must be transcribed in a book duly legalized by the Legal Advisory, which shall be kept in custody by the secretary.

CHAPTER II On the procedure

a)That INCOPESCA officials have carried out an on-site Inspection (Inspección in situ) of each vessel, verifying the physical existence and the general condition thereof (length overall (eslora), beam (manga), depth (puntal), hull characteristics, engine, and fishing gear (artes de pesca)), recording this by means of photographs or videos that verify said action.
b)That a Certification to the Caja Costarricense de Seguro Social (CCSS) is on file stating that the person requesting the rehabilitation of their vessel is not a salaried employee or pensioner, nor has outstanding debts with the CCSS.
c)That the expiration of the fishing license did not occur prior to January 1, 2010.

CHAPTER III Limitations

Said limitation must be recorded as such with the fishing license.

CHAPTER IV Final provisions

once by the duly legitimated interested parties; unless, once the documentation has been reviewed and analyzed by the Commission, it warns and requires them to provide further documentation to resolve accordingly, or the Board of Directors reasonably requests a new review of the file.

That likewise, the Board Members consider it convenient, in order to safeguard the sustainability and sustainable yield of fisheries resources, to include as an applicable general rule, not only to the Agreement AJDIP/297-2016, but also extending to Agreement AJDIP/123-2016, within the proposal set forth, to establish the measures cited herein as an integral part of the operative part of both the Agreement for the Creation of the Commission for the study, analysis, and rehabilitation of licenses (AJDIP/123-2016), as well as the Agreement for the Authorization of Transfer of inactive licenses with substitution of vessels (AJDIP/297-2016), the provisions contained in the following subsections:

i. For vessels belonging to the Medium Advanced and Advanced Fleets (Flotas Media Avanzada y Avanzada) whose licenses have been enabled (habilitadas) according to the terms of Agreement AJDIP/123-2016, or, being inactive, have been transferred with substitution of the vessel, in accordance with Agreement AJDIP/297-2016, in both cases, the use of steel leader (reinal de acero) shall be prohibited. Likewise, in the case of vessels belonging to the Advanced Fleet (Flota Avanzada), the unloadings of fishery products must be carried out obligatorily at the Muelle Multiuso of the Terminal Pesquera Barrio El Carmen of INCOPESCA.

ii. In the case of those vessels that have been enabled (habilitadas) through the cited Agreements, they may not be modified with respect to the original length overall (eslora) established in the fishing license valid at the time of its expiration and/or inactivation (inactivación).

1Que habiéndose sometido en primera instancia a consideración de los Sres. Directivos la propuesta de Reglamento de Rehabilitación de Licencias de Pesca Vencidas, presentada por el Sr. Guillermo Ramírez Gätjens, Jefe de la Secretaría Técnica de Junta Directiva, se procedió a requerir criterio a la Dirección General Técnica y a la Asesoría Legal, sobre la pertinencia de la misma.
2Que habiéndose recibido criterio legal favorable correspondiente, estiman y consideran los Sres. Directivos que la misma, cumple con los fines y objetivos perseguidos a efecto de normar el vacío legal existente en ese ámbito, sobretodo en relación con el Dictamen C-064-2014 de la Procuraduría General de la República, en concordancia con las características particulares y peculiares que representa la actividad pesquera comercial en nuestro país.
3Que en virtud de lo anterior, la Junta Directiva, por tanto;

ACUERDA:

1º-Aprobar la creación de la Comisión para el Estudio, Análisis, Revisión y Recomendación de las solicitudes de rehabilitación de licencias vencidas, así como el procedimiento para la rehabilitación de licencias de pesca cuyo vencimiento haya acaecido por causas distintas a las establecidas en el artículo 113 de la Ley de Pesca y Acuicultura, Ley N° 8436, salvo el inciso a), en los siguientes términos y condiciones:

COMISIÓN PARA EL ESTUDIO, ANÁLISIS, REVISIÓN Y RECOMENDACIÓN DE LAS SOLICITUDES DE REHABILITACIÓN DE LICENCIAS VENCIDAS ASÍ COMO EL PROCEDIMIENTO PARA LA REHABILITACIÓN DE LICENCIAS DE PESCA CUYO VENCIMIENTO HAYA ACAECIDO POR CAUSASDISTINTAS A LASESTABLECIDASENEL

Considerando:

ACUICULTURA, LEY N° 8436, SALVO EL INCISO A)

De la creación y competencias de la Comisión para el Estudio, Análisis, Revisión y Recomendación de las solicitudes de rehabilitación de Licencias vencidas (CEARLP)

CAPÍTULO I

El acta de las reuniones deberá trascribirse en un libro debidamente legalizado por la Asesoría Legal, que se mantendrá en custodia por parte del secretario.

Del procedimiento

CAPÍTULO II

a)Que funcionarios del INCOPESCA hayan realizado Inspección in situ de cada embarcación, verificando la existencia física y el estado general de éstas (eslora, manga, puntal, características del casco, del motor y de las artes de pesca), haciéndolo constar mediante fotografías o videos que constaten dicha actuación.
b)Que conste Certificación a la Caja Costarricense de Seguro Social (CCSS) de que quien solicita la rehabilitación de su embarcación, no sea asalariado o pensionado, así como que no tiene deudas pendientes con la CCSS.
c)Que el vencimiento de la licencia de pesca no haya acaecido con anterioridad al 01 de enero de 2010.

Limitaciones

CAPÍTULO III

Dicha limitante debe hacerse constar así con la licencia de pesca.

Disposiciones finales

(*)3. Que asimismo, estiman los Sres. Directivos que resulta conveniente, en aras de resguardar la sostenibilidad y sustentabilidad de los recursos pesqueros, incluir como norma general aplicable, no solo al Acuerdo AJDIP/297-2016, sino extensiva al Acuerdo AJDIP/123-2016, dentro de la propuesta planteada, establecer las medidas citadas en éste como parte integral en la parte dispositiva tanto del Acuerdo de Creación de la Comisión para el estudio, análisis y rehabilitación de licencias (AJDIP/123-2016), así como del Acuerdo de Autorización de Traspaso de licencias inactivas con sustitución de embarcaciones (AJDIP/297-2016), la disposiciones contenidas en los siguientes acápites:

i. Para las embarcaciones pertenecientes a las Flotas Media Avanzada y Avanzada cuyas licencias hayan sido habilitadas al tenor del Acuerdo AJDIP/123-2016, o bien, encontrándose inactivas hayan sido traspasadas con sustitución de embarcación, de conformidad con el Acuerdo AJDIP/297-2016, para ambos casos, quedará prohibido el uso de reinal de acero. Asimismo tratándose de embarcaciones pertenecientes a la Flota Avanzada, las descargas de productos pesqueros deberán realizarse obligatoriamente en el Muelle Multiuso de la Terminal Pesquera Barrio El Carmen del INCOPESCA.

ii. En el caso de aquellas embarcaciones que hayan sido habilitadas mediante los Acuerdos citados, no podrán ser modificadas en cuanto a la eslora original establecida en la licencia de pesca vigente al momento de su vencimiento y/o inactivación.

Commission for the Rehabilitation of Expired Fishing LicensesComisión de Rehabilitación de Licencias de Pesca Vencidas

Artículo 1 — In accordance with article 23 of the Ley de Creación del INCOPESCA, the Commission for the Study, Analysis, Review, and Recommendation of requests for the rehabilitation of Expired Licenses, CEARLP, is hereby created.

Artículo 2 — Requests for the rehabilitation of commercial fishing licenses shall be submitted before the corresponding administrative offices and referred by these to the secretary of the CEARLP, with a certified copy of the respective administrative file of the fishing license.

Artículo 7 — Once the requests are received, the Commission must render its recommendation to the Board of Directors within a maximum period of 60 days, for which purpose the file must previously contain the following:

Artículo 10 — The Board of Directors shall neither hear nor resolve any request for the rehabilitation of expired fishing licenses without having the opinion issued by the Commission for the Study, Analysis, Review, and Recommendation of requests for the rehabilitation of Expired Licenses.

Artículo 12 — Those requests for which the Commission's recommendation for the rehabilitation of licenses is negative, once said recommendation is endorsed by the Board of Directors, shall result in the definitive archiving of the administrative file.

Artículo 13 — The agreements issued by the Board of Directors, based on the recommendations of this Commission, shall be subject to the procedural remedies of revocation and appeal (revocatoria y apelación) as determined by the Ley General de la Administración Pública.

Artículo 14 — This shall take effect upon its publication.

Artículo 113 — DE LA LEY DE PESCA Y

Artículo 1 — De conformidad con el artículo 23 de la Ley de Creación del INCOPESCA, créase la Comisión para el Estudio, Análisis, Revisión y Recomendación de las solicitudes de rehabilitación de Licencias Vencidas, CEARLP.

Artículo 2 — Las solicitudes de rehabilitación de licencias de pesca comercial serán presentadas ante las oficinas administrativas correspondientes y remitidas por estas a la secretaria de la CEARLP, con copia certificada del respectivo expediente administrativo de la licencia de pesca.

Artículo 4 — Dicha Comisión estará constituida por el Director General Técnico, quien la coordinará; el Director General de Organizaciones Pesqueras y Acuícolas; el Asesor Legal; el Jefe del Departamento de Protección y Registro y el Jefe del Departamento de Extensión y Capacitación.

Artículo 7 — Recibidas las solicitudes, la Comisión deberá rendir su recomendación a la Junta Directiva en un plazo máximo de 60 días, para lo cual de previo deberá constar en el expediente lo

Artículo 12 — Aquellas solicitudes cuya recomendación para la rehabilitación de licencias por parte de la Comisión sean negativas, una vez avalada dicha recomendación por parte de la Junta Directiva acarreará el archivo definitivo del expediente administrativo.

Artículo 13 — Los acuerdos emanados por parte de la Junta Directiva, en razón de las recomendaciones de esta Comisión, tendrán los recursos procesales de revocatoria y apelación que determina la Ley General de la Administración Pública.

Artículo 14 — Rige a partir de su publicación.
