However, said plan is still in the process of review of fragility indices by SETENA, therefore, in order to better attend to the management of the maritime-terrestrial zone (zona marítimo terrestre), safeguarding the interests of the State and the legal security of concessionaires (concesionarios), it is necessary to readjust the Zoning Sheet of the Regulatory Plan of Playa Carrillo, to include the Natural Heritage of the State (Patrimonio Natural del Estado) classified and certified by MINAE, the communication routes that over time have been formalized in the coastal sector and that are necessary to provide access to the restricted concessionable zone, as well as the boundary markers placed by the National Geographic Institute (Instituto Geográfico Nacional) that are not visible on said sheet, and the adjustments to the regulations in accordance with the provisions established through decree No. 37882-MP-H-TUR, published in official gazette (gaceta) No. 176 of Friday, 13 September 2013, which will form an integral part of the Partial Regulatory Plan Punta Carrillo.

For this process, the manual for the elaboration of coastal regulatory plans was used, prepared by the Costa Rican Institute of Tourism and published in Digital Supplement (Alcance Digital) No. 58 to Official Gazette (Gaceta) No. 63 of Tuesday, 23 April 2013, using Level 1. Technical rectifications and Level 2. Partial adjustments in the planning sheet, in which the objectives and purposes of the plan, nor the originally proposed planning, are modified.

13.6.4 Carry out the partial adjustment to include the areas declared as Natural Heritage of the State (Patrimonio Natural del Estado) through certification dated 3 February 2014 and official letter ACT-OR-DR-1209-2015, dated 24 September 2015, issued by the senior management of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) of the Ministry of Environment and Energy.

13.5.1 Carry out the technical rectification to adjust the tracing precision of the road network (vialidad) of the original Sheet, as well as the incorporation of roads that over time have been formalized and that are necessary to provide access to the restricted concessionable zone.

Carry out a partial adjustment in the boundaries and areas that demarcate the different uses resulting from the technical rectifications in the road network and adjustments resulting from the incorporation of the Natural Heritage of the State certified by MINAE.

ZONING REGULATIONS

The Municipality of the canton of Hojancha, adhering to the provisions of Law (Ley) No. 6043 on the Maritime-Terrestrial Zone and recognizing the need to regulate the use of land in Playa Carrillo (south sector), issues these "Zoning Regulations" (Reglamento de Zonificación), which will be applicable to part of the Maritime-Terrestrial Zone, specifically the south sector of the Beach, comprised between the CRTM05 coordinates:

These regulations have the following basic objectives:

a. Achieve compliance with Law No. 6043 and its regulations.

b. Protect and restore natural resources.

c. Control the development of infrastructure and installations in the Maritime-Terrestrial Zone.

d. Establish a more convenient relationship between the possible alternatives for land uses, their control, and their planning (ordenamiento).

e. Favor public and private investment in the area.

f. Generate economic income for the Municipality of Hojancha.

g. Favor the development, health, economy, and general well-being of the local inhabitants and visitors.

a. Access: Public road (Vía) facing a lot or property.

b. Green Area (Área Verde): Open areas with grass or trees, for public, communal use intended for the recreation and ornamentation of the community.

c. Concession (Concesión): Public contract between the Municipality and the concessionaire, granting the latter the right to use the land on a lot within the Maritime-Terrestrial Zone.

d. Concessionaire (Concesionario): Legal, physical, or moral person who holds a Concession right in the Maritime-Terrestrial Zone.

e. Construction (Construcción): Any structure that is fixed to or incorporated into land: it constitutes any building, reconstruction, remodeling, or expansion work that implies permanence.

f. Buildings (Edificaciones): All those works intended for habitation, work, recreation, tourism, etc.

g. Infractor: Person or Government agency that does not comply with these Zoning Regulations.

h. Lot (Lote): A parcel of land of any size, whether given in concession or private property.

i. Infrastructure (Infraestructura): Services and installations of an urban nature, such as: roads, drainages, aqueducts, sewers, electricity, telephony, and other similar ones.

j. Owner (Propietario): The person(s), company(ies), or agency(ies) that holds a property title over lands adjacent to the Maritime-Terrestrial Zone.

k. Protection: The area in which urban works are subject to restrictions.

l. Regulations (Reglamento): Compilation of norms that govern the development of areas subject to the plan and requirements for the construction of installations and roads.

ll. Setbacks (Retiros): Open, unbuilt spaces between a structure and the boundaries of the respective property.

m. Use (Uso): Exploitation, under private title, of areas or properties.

n. Permitted Use (Uso permitido): That use of a land or lot over which the concessionaire has the possibility of designating their land, without more restrictions than those indicated here, and after processing the construction permits required by the Municipality of Hojancha.

ñ. Conditional Use (Uso condicional): That which, while not being the most recommendable for the land conditions, does not generate conflicts with the permitted uses. This use can be given to a land, upon special authorization from the Municipality and the Instituto Costarricense de Turismo, through a certificate.

o. Conflicting Use (Uso conflictivo): That which does not conform to the zoning indicated in the Regulatory Plan. Conflicting uses are not permitted under any condition.

p. Public Road (Vía pública): Spaces intended for the circulation of vehicles or pedestrians.

r. Road Network (Vialidad): All kinds of roads that allow public access to each of the lots resulting from the concessions.

s. Single-family dwelling (Vivienda unifamiliar): The building provided with habitable areas intended to shelter a single family.

t. Zoning (Zonificación): The division of a territory into use zones, for the effect of its rational development.

a. Zones of the Coastal Regulatory Plan. For the purposes of these Regulations, the Maritime-Terrestrial Zone of Playa Carrillo (south sector) is divided into the following zones:

b. General norms:

The fences of the parcels resulting from the established zoning shall be adjusted to the line of the 50 inalienable meters in case they do not coincide with it.

The delimitation of the parcels will be carried out by an authorized surveyor, who must adhere to the provisions established in the Regulatory Plan.

Installations may not be built until the parcels are clearly delimited on the land, in accordance with the provisions established by the Regulatory Plan and following inspection by the Municipality of Hojancha.

c. It is an essential requirement to have the lease contract (concession).

a. Purposes: To achieve compliance with Chapter III of Law No. 6043, regarding the right of public use of the 50 meters measured from the ordinary high-water mark (pleamar ordinaria).

b. Location: The Public Zone is located along the entire length of the regulatory plan bounded by the boundary markers placed by the Instituto Geográfico Nacional.

c. Permitted, conditional, and conflicting uses: All those indicated by Law No. 6043 and its Regulations. Constructions currently occupying part of the public zone must be eliminated as soon as possible.

d. Concessions: No concessions will be granted in this zone.

a. Purposes: Area intended for the installation and commercial facilities for visitors, both those who stay overnight and those on a daily visit.

b. Location: The planned area for Commercial-Tourist is located on the boundary of the ZMT, between boundary markers 25 and 26.

c. Permitted Uses: Restaurants, bar, discotheque, handicrafts, sports articles and beach articles, commissary, and any other business serving tourists.

d. Conditional Uses: Dance hall, pool, indoor games.

e. Conflicting Uses: Any use or installation that is not of a tourist nature.

f. Requirements:

Minimum area: 200 m2 Maximum area: 5,000 m2 Maximum height: 2 floors or 10 meters maximum Coverage (Cobertura): 75% The lateral, rear, and front setbacks (retiros) shall be governed according to the provisions established in Article 65 of the Regulations of the Maritime-Terrestrial Zone Law.

g. Concessions: They shall be granted according to the process established in Law No. 6043 and its regulations.

a. Purposes: Area intended for lodging, food, and tourist recreation facilities.

b. Location: The planned area for Tourist Lodging is located between boundary markers 19 to 24, up to the boundary of the ZMT.

c. Permitted Uses: Hotels, cabins, motels, rental apartments, restaurants, cafeterias, bar, outdoor sports.

d. Conditional Uses: Single-family and multi-family dwellings, dance hall, discotheque, sports article shops, youth hostel shelter.

e. Conflicting Uses: Any installation that is not of a tourist nature.

f. Requirements:

In case of hotels and cabin complexes, it will be necessary to provide a treatment plant for black water.

Once this preliminary project is approved by the ICT, INVU, and the Municipality, the interested party must prepare the construction plans for the infrastructure and installation works, in which they must comply with the norms established in this regard by the INVU and the Ministry of Health.

The interested party in developing any type of construction must comply with the construction requirements of the laws in force.

h. Concessions: They shall be granted according to the process established in Law No. 6043 and its regulations.

a. Purposes: To provide areas for the construction of homes for local inhabitants and the provision of adequate installations for basic urban services: potable water, lighting, road network (vialidad), evacuation of sewage and rainwater, and urban furniture.

b. Location: This zone is located in the Restricted Zone, between boundary markers 21 to 27.

c. Permitted Uses: Single-family dwelling (Vivienda Unifamiliar), ranches, planting of ornamental trees and plants.

d. Conditional Uses: Tourist, retail commerce, soda.

e. Conflicting Uses: Warehouse, Bar, multi-family dwelling, agricultural, dance hall, discotheque, materials depot, hardware stores, pigsties, industry.

f. Requirements:

Article 65 of the Regulations of the Maritime-Terrestrial Zone Law.

Article 65 of the Regulations of the Maritime-Terrestrial Zone Law.

g. Concessions: They shall be granted according to the process established in Law No. 6043 and its regulations.

a. Purposes: Zone intended for the construction of summer homes and lodging facilities for national and international tourists.

b. Location: Corresponds to the zone adjacent to boundary marker 28 to 34.

c. Permitted Uses: Single-family dwelling, pool, sports, ranches, hotel, apartotel, and other tourist services.

d. Conditional Uses: Multi-family dwelling, cabins or rooms for rent. Retail commerce of handicrafts, fruits, vegetables.

e. Conflicting Uses: Industry, dance hall, commerce, discotheque, warehouse, workshops, materials depot, hardware store.

f. Requirements:

Article 65 of the Regulations of the Maritime-Terrestrial Zone Law.

g. Concessions: They shall be granted according to the process established in Law No. 6043 and its regulations.

a. Purposes: To give effect to subsection c) of Article 5 of Law No. 6043 on the Maritime-Terrestrial Zone, which allocates up to 25% of the leasable land for cooperatives, guild groups, associations, unions, etc.

b. Location: The Cooperatives Zone is located in front of boundary marker 21.

c. Permitted Uses: Cabins, restaurants, pool, outdoor sports, camp, parking, basic services.

d. Conditional Uses: Dance hall, discotheque, pool, outdoor sports, camp, parking, basic services.

e. Conflicting Uses: Any installation that is not of a recreational-tourist nature related to the activities of non-profit organizations.

f. Requirements:

Maximum Coverage (Cobertura): ...........................................................60% Maximum height: 2 floors or 10 meters maximum.

The minimum and maximum areas per lot shall be governed according to the provisions established in Article 65 of the Regulations of the Maritime-Terrestrial Zone Law.

The lateral, rear, and front setbacks (retiros) shall be governed according to the provisions established in Article 65 of the Regulations of the Maritime-Terrestrial Zone Law.

g. Concessions: According to the provisions established in Law No. 6043 and its regulations.

The association or group of interested parties must present a project with the same requirements indicated for tourist-type developments, in accordance with the Instituto Costarricense de Turismo.

a. Purposes: Zones intended for the establishment and operation of state installations of a tourist nature serving public use.

b. Location: The Institutional Zone is located adjacent to boundary markers 26 and 27.

c. Permitted Uses: Any state installation of a tourist nature intended for public use and of notable convenience for the country. d. Conditional and conflicting uses: Any use that contradicts Article 22 of Law No. 6043.

e. Requirements:

The lateral, rear, and front setbacks (retiros) shall be governed according to the provisions established in Article 65 of the Regulations of the Maritime-Terrestrial Zone Law.

f. Concessions: According to the provisions established in Law No. 6043 and its regulations.

a. Purposes: To protect unstable areas, especially the small existing mangrove ecosystems and the depressions caused by the courses of the streams.

b. Location: The Green zones are located behind boundary marker 19 adjacent to the Tourist Zone and another behind boundary marker 28.

c. Permitted Uses: Reforestation, mangrove protection, erosion control.

d. Conditional and conflicting uses: Any use that is not protection and conservation.

e. Concessions: According to the provisions established in Law No. 6043 and its regulations.

It takes effect as of its publication, and any prior municipal provision opposing the provisions established in this sheet and regulations is hereby repealed.

La Municipalidad del cantón de Hojancha, atendiendo a las disposiciones de la Ley N° 6043 sobre la Zona Marítimo Terrestre y reconociendo la necesidad de reglamentar el uso de terrenos en Playa Carrillo (sector sur), dicta el presente "Reglamento de Zonificación", que será aplicable a parte de la Zona Marítimo Terrestre, específicamente el sector sur de la Playa, comprendido entre las coordenadas de CRTM05:

Este reglamento tiene como objetivos básicos los siguientes:

a. Lograr el cumplimiento de la Ley N°6043 y su reglamento.

b. Proteger y restaurar los recursos naturales.

c. Controlar el desarrollo de infraestructura e instalaciones en la Zona Marítimo Terrestre.

d. Establecer una relación más conveniente entre las posibles alternativas de usos del suelo, su control y su ordenamiento.

e. Favorecer la inversión pública y privada del área.

f. Generar ingresos económicos para la Municipalidad de Hojancha.

g. Favorecer el desarrollo, la salud, la economía y el bienestar general de los pobladores locales y los visitantes.

a. Acceso: Vía hacia donde da frente un solar o propiedad.

b. Área Verde: Áreas libres enzacatadas o arborizadas, de uso público, comunal destinadas a la recreación y ornamentación de la comunidad.

c. Concesión: Contrato público entre la Municipalidad y el concesionario, que otorga a este último el derecho de uso de la tierra en un lote sobre la Zona Marítimo Terrestre.

d. Concesionario: Persona jurídica, física o moral que posee un derecho de Concesión en la Zona Marítimo Terrestre.

e. Construcción Toda estructura que se fije o incorpore a un terreno: constituye cualquier obra de edificación, reconstrucción, remodelación o ampliación que implique permanencia.

f. Edificaciones: Todas aquellas obras destinadas para la habitación, trabajo, recreación, turismo, etc.

g. Infractor: Persona, o dependencia del Gobierno que no atienda el presente Reglamento de Zonificación.

h. Lote: Una parcela de tierra de cualquier tamaño, ya sea dada en concesión o propiedad privada.

i. Infraestructura: Servicios e instalaciones de carácter urbano, tales como: vías drenajes, acueductos, alcantarillados, electricidad, telefonía y otros similares.

j. Propietario: Es la persona(s), empresa (s), o dependencia(s) que tiene título de propiedad sobre terrenos colindantes a la Zona Marítimo Terrestre.

k. Protección: Es aquella área en la cual las obras urbanas están sujetas a las restricciones.

l. Reglamento: Compilación de normas que rigen el desarrollo de las áreas sujeta al plan y requisitos para la construcción de instalaciones y vías.

ll. Retiros: Espacios abiertos no edificados comprendidos entre una estructura y los linderos del respectivo predio.

m. Uso: Aprovechamiento, a título particular, de áreas o predios.

n. Uso permitido: Es aquel uso de un terreno o lote, sobre el cual, el concesionario, tiene la posibilidad de destinar su terreno, sin más restricciones que las aquí indicadas, y previa tramitación de los permisos de construcción requeridos por la Municipalidad de Hojancha.

ñ. Uso condicional: es aquel que aun no siendo el más recomendable para las condiciones del terreno, no genera conflictos con los usos permitidos. Este uso puede darse a un terreno, previa autorización especial de la Municipalidad y el Instituto Costarricense de Turismo, mediante un certificado.

o. Uso conflictivo: Es aquel que no se ajusta a la zonificación indicada en el Plan Regulador. Los usos conflictivos no se permiten bajo ninguna condición.

p. Vía pública: Espacios destinados a circulación de vehículos o peatones.

r. Vialidad: Toda clase de vías que permiten el acceso público a cada uno de los lotes resultantes para las concesiones s. Vivienda unifamiliar: Es la edificación provista de áreas habitacionales destinados a dar albergue a una sola familia.

t. Zonificación: Es la división de un territorio en zonas de uso, para efecto de su desarrollo racional.

a. Zonas del Plan Regulador Costero. Para efectos de este Reglamento, la Zona Marítimo Terrestre de Playa Carrillo (sector sur), queda dividida en las siguientes zonas:

b. Normas generales:

Las cercas de las parcela resultantes de la zonificación establecida, deberán ajustarse a la línea de los 50 metros inalienables en el caso de no coincidir con ésta.

La delimitación de las parcelas correrá a cargo de un topógrafo autorizado, el que deberá ajustarse a lo establecido en el Plan Regulador.

No se podrán construir instalaciones hasta que las parcelas estén claramente delimitadas en el terreno, de conformidad a lo establecido por el Plan Regulador y según la inspección de la Municipalidad de Hojancha.

c. Es requisito indispensable disponer del contrato de arrendamiento (concesión)

a. Propósitos: Lograr el cumplimiento del Capítulo III de la Ley N°6043, en cuanto al derecho de uso público de los 50 metros medidos a partir de la pleamar ordinaria.

b. Localización: La Zona Pública se localiza a todo lo largo del plan regulador limitado por los mojones colocados por el Instituto Geográfico Nacional.

c. Usos permitidos, condicionales y conflictivos: Todos los que señala la Ley N°6043 y su Reglamento. Las construcciones que actualmente ocupan parte de la zona pública deben ser eliminadas en el menor plazo posible.

d. Concesiones: No se darán concesiones en esta zona.

a. Propósitos: Área destinada a la instalación y facilidades comerciales para los visitantes tanto los que pernoctan, como aquellos de visita diaria.

b. Localización: El área planificada para Comercial Turística se encuentra en el límite de la ZMT, entre los mojones 25 y 26.

c. Usos permitidos: Restaurantes, bar, discoteque, artesanías, artículos deportivos y de playa, comisariato y cualquier otro comercio al servicio de turista.

d. Usos condicionales: Salón de baile, piscina, juegos bajo techo.

e. Usos conflictivos: Cualquier uso o instalación que no sea de carácter turístico.

f. Requisitos:

Área mínima: 200 m2 Área máxima: 5 000 m2 Altura máxima 2 pisos en 10 metros máximo Cobertura 75% Los retiros laterales, posteriores y anteriores, se regirán de acuerdo a lo establecido en el Artículo 65 del Reglamento de la Ley de la Zona Marítimo Terrestre.

g. Concesiones: Se darán de acuerdo al proceso establecido en la Ley N°6043 y su reglamento.

a. Propósitos: Área destinada a facilidades de hospedaje, alimentación y recreación turística.

b. Localización: El área planificada para Alojamiento Turístico se encuentra entre los mojones 19 al 24, hasta el límite de la ZMT.

c. Usos permitidos: Hoteles, cabinas, moteles, apartamentos de alquiler, restaurantes, cafeterías, bar, deportes al aire libre.

d. Usos condicionales: Vivienda unifamiliares y multifamiliares, salón de baile, discoteque, comercio de artículos deportivos, refugio de albergues juveniles.

e. Usos conflictivos: Cualquier instalación que no sea de carácter turístico.

f. Requisitos:

1. Nombre y dirección del solicitante.

2. Nombre del proyecto.

3. Plano catastro del área a desarrollar.

4. Plano de las curvas de nivel y localización de árboles principales.

5. Plano del diseño de sitio a escala 1:1,000.

6. Estudio de abastecimiento de agua potable.

7. Estudio de suelos.

8. Anteproyecto de las instalaciones 9. Secciones típicas longitudinales y transversales.

10. Presupuesto estimado de la inversión.

11. Forma de financiamiento.

12. Estudio de factibilidad económica - financiera.

13. Sistema de abastecimiento de agua potable y disposición de aguas residuales.

En caso de hoteles y conjuntos de cabinas, será necesario proveer una planta de tratamiento de aguas negras.

g. El diseño de sitio deberá ajustarse a las siguientes normas de carácter general:

Retiros Los retiros laterales, posteriores y anteriores, se regirán de acuerdo a lo establecido en el Artículo 65 del Reglamento de la Ley de la Zona Marítimo Terrestre.

Una vez aprobado este anteproyecto por el ICT, INVU y la Municipalidad el interesado deberá elaborar los planos constructivos de las obras de infraestructura e instalaciones, en las cuales deberá cumplir con las normas establecidas al respecto por el INVU y el Ministerio de Salud.

El interesado en desarrollar cualquier tipo de construcción deberá ajustarse a los requisitos constructivos de las leyes vigentes.

h. Concesiones: Se darán de acuerdo al proceso establecido en la Ley N°6043 y su reglamento.

b. Localización: Esta zona se localiza en Zona Restringida, entre los mojones del 21 al 27.

c. Usos permitidos: Vivienda Unifamiliar, ranchos, siembra de árboles y plantas ornamentales.

d. Usos condicionales: Turístico, comercio al detalle, soda.

e. Usos conflictivos: Bodega, Bar, vivienda multifamiliar, agrícola, salín de baile, discoteca, depósito de materiales, ferreterías, porquerizas, industria.

f. Requisitos:

a. Propósitos: Zona destinada a la construcción de viviendas de veraneo y facilidades de alojamiento para los turistas nacionales e internacionales.

b. Localización: Corresponde a la zona aledaña al mojón 28 al 34.

c. Usos permitidos: Vivienda unifamiliar, piscina, deportes, ranchos, hotel, apartotel y otros servicios turísticos.

d. Usos condicionales Vivienda multifamiliar, cabinas o habitaciones para alquiler. Comercio al detalle de artesanías, frutas, verduras.

e. Usos conflictivos: Industria, salón de baile, comercio, discoteca, bodega, talleres, depósito de materiales, ferretería.

f. Requisitos:

a. Propósitos: Hacer efectivo el inciso c) del Artículo 5 de la Ley N°6043 sobre la Zona Marítimo Terrestre, que destina hasta un 25% del terreno arrendable para cooperativas, agrupaciones gremiales, asociaciones, sindicatos, etc.

b. Localización: La Zona de Cooperativas se encuentra frente al mojón 21.

c. Usos permitidos: Cabinas, restaurantes, piscina, deportes al aire libre, campamento, estacionamiento, servicios básicos.

d. Usos condicionales: Salón de baile, discoteca, piscina, deportes al aire libre, campamento, estacionamiento, servicios básicos.

e. Usos conflictivos: Toda instalación que no sea de carácter recreativo-turístico a afín con las actividades propias de las organizaciones sinfines de lucro.

f. Requisitos Cobertura Máxima: ...........................................................60% Altura máxima 2 pisos en 10 metros máximo Las áreas mínima y máxima por cada lote, se regirán de acuerdo a lo establecido en el Artículo 65 del Reglamento de la Ley de la Zona Marítimo Terrestre.

La asociación o grupo de interesados deberá presentar un proyecto con los mismos requisitos señalados en los desarrollos de tipo turístico, acorde con el Instituto Costarricense de Turismo.

a. Propósitos: Zonas destinadas al establecimiento y operación de instalaciones estatales de carácter turístico atendiendo al uso público.

b. Localización: La Zona Institucional se encuentra colindando con los mojones 26 y 27.

c. Usos permitidos: Cualquier instalación estatal de carácter turístico destinada a uso público y de notoria conveniencia para el país. d. Usos condicionales y conflictivos: Cualquier uso que contradiga el artículo 22 de la Ley N° 6043.

e. Requisitos:

f. Concesiones: De acuerdo a lo establecido en la Ley N°6043 y su reglamento.

a. Propósitos: Proteger las áreas inestables, en especial los pequeños ecosistemas existentes de manglar y las depresiones causadas por los causes de las quebradas.

b. Localización: Las zonas Verdes se localizan posterior al mojón 19 colindando con la Zona Turística y otra posterior al mojón 28.

c. Usos permitidos: Reforestación, protección del mangle, control de la erosión.

d. Usos condicionales y conflictivos: Cualquier uso que no se la protección y la conservación.

e. Concesiones: De acuerdo a lo establecido en la Ley N°6043 y su reglamento.

Rige a partir de su publicación y queda derogada toda disposición municipal anterior que se oponga a lo establecido en esta lámina y reglamento.
