I.- That by means of Law No. 8905, the Instituto Geográfico Nacional is established as a dependency of the National Registry and that the Administrative Board of the National Registry shall administer the budget of the Institute, sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the Instituto Geográfico Nacional shall be the scientific and technical dependency rector of national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, investigations or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature that are related to said works, with the purpose of supporting planning processes.

II.- That the Law creating the Instituto Geográfico Nacional, No. 59, constitutes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order that originate from the works entrusted to its charge.

III.- That in accordance with the Law creating the Instituto Geográfico Nacional, No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the Instituto Geográfico Nacional for the boundary delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette (Diario Oficial La Gaceta), while Article 63 of the same Regulation indicates that “The Instituto Geográfico Nacional must publish a notice in the Official Gazette, for each portion of the Maritime Terrestrial Zone in which it has demarcated the public zone.” IV.- That in Executive Decree No. 36642-MP-MOPT-MINAET “Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone,” it is established according to Article 18 that for the boundary delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, indicated in Articles 19 and 20, corresponding to the boundary delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or georeferenced digital delimitation, this with the purpose of expediting the delimitations and providing greater technical security to interested parties.

V.- That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically indicating in Article 11 that: “The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the single official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities developed within the National Territory by any public dependency, person, or private national or foreign entity must be referenced.” ; while Article 7 indicates that “As cartographic data are produced in the new cartographic projection system CRTM05, the Instituto Geográfico Nacional shall publish, through adequate means, that information which has been officialized.” VI.- That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone, enables the correct boundary delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), the approval of surveying plans (planos de agrimensura), the granting of concessions (concesiones) in the Restricted Zone, and other aspects of coastal land-use planning (ordenamiento territorial costero).

VII.- That the Instituto Geográfico Nacional, used in canton 05 Matina - province of Limón, the “Georeferenced Digital Delimitation” methodology to delimit the public zone of the Maritime Terrestrial Zone in specific coastal sectors, where to date, no boundary delimitation of the public zone exists through the placement of boundary markers officialized via respective publication in the Official Gazette.

VIII.- That the “Georeferenced Digital Delimitation” of the public zone of the Maritime Terrestrial Zone of canton 05 Matina, province of Limón, was carried out by the Instituto Geográfico Nacional within the framework of Public Tender (Licitación Pública) No. 2013LN-000010-00100 named “Delimitation of the public zone on the Caribbean Coast of Costa Rica.” IX.- That the georeferenced digital information on the boundary delimitation of the public zone of the Maritime Terrestrial Zone held by the Instituto Geográfico Nacional is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT).

X.- That the Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P “Regulation to Law No. 6043 on the Maritime Terrestrial Zone,” b) Executive Decree No. 33797-MJ-MOPT “Declares the CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05,” and c) Executive Decree No. 36642-MP-MOPT-MINAET “Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone.” XI.- That Article 140 of Law No. 6227 General Law of Public Administration indicates that “the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the moment it is adopted,” a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the suitable instrument to communicate acts of a generic nature by noting that: “General acts shall be communicated by publication, and concrete acts by notification.” COMMUNICATES:

1°- The Instituto Geográfico Nacional, used in canton 05 Matina - province of Limón, the “Georeferenced Digital Delimitation” methodology in accordance with Executive Decree No. 36642-MP-MOPT-MINAET “Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone” dated June 28, 2011, to delimit the public zone of the Maritime Terrestrial Zone, in coastal sectors where, as of the signing date of this Notice, no boundary delimitation of the public zone exists through the placement of boundary markers officialized via respective publication in the Official Gazette.

2°- The public zone of the Maritime Terrestrial Zone of canton 05 Matina, province of Limón, determined by the Instituto Geográfico Nacional with georeferenced digital delimitation, was carried out in 2014 and corresponds to the coastal sectors whose coordinates of extreme points are indicated below, both in the official cartographic projection system of Costa Rica CRTM05, as well as by reference, in the Lambert North projection of the MBCR-1/50,000 Parismina and Moín Map, namely:

3°- The coastal sectors of canton 05 Matina, province of Limón, that currently have boundary delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers and respective publication in the Official Gazette, maintain their official status.

4°- The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone, corresponding to canton 05 Matina, province of Limón, have been registered in the Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT), in a vector format shape file, under the coding: RN/IGN_GDG-IGN-ZMT_705/Geolínea_ Versión_01_04/05/2016.-Curridabat, June 20, 2016.

Considering:

en la totalidad del texto - Texto Completo Norma 07 Delimitación de Zona Pública Cantón de Matina se utilizó la metodología de “Delimitación Digital Georreferenciada” conforme al Decreto Ejecutivo N° 36642-MP-MOPT-MINAET “Reglamento de Especificaciones para Delimitación de la zona pública de Zona Marítimo Texto Completo acta: 10E883 INSTITUTO GEOGRÁFICO NACIONAL AVISO N° 2016-07 ZONA MARITIMA TERRESTRE DELIMITACION DE ZONA PÚBLICA CANTON DE MATINA text-indent:35.4pt'>Con fundamento en las facultades que confiere el artículo 140 y artículo 240, inciso 1 de la Ley N° 6227 General de la Administración Pública, y de conformidad con lo dispuesto en la Ley N° 59 de creación del Instituto Geográfico Nacional, la Ley N° 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley N° 6043 sobre la Zona Marítimo Terrestre, y los artículos 62 y 63 del Reglamento de la sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, el Instituto Geográfico Nacional,

I.-Que mediante Ley N° 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

II.-Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

III.-Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional, N° 59, en el artículos 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública." IV.-Que en el Decreto Ejecutivo No. 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

V.-Que en el Decreto Ejecutivo No. 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado." VI.-Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

VII.-Que el Instituto Geográfico Nacional, utilizó en el cantón 05 Matina - provincia de Limón, la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en sectores costeros específicos, donde no existe a la fecha, delimitación de la zona pública a través de la colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta.

VIII.-Que la "Delimitación Digital Georreferenciada‖ de la zona pública de la Zona Marítimo Terrestre del cantón 05 Matina, provincia de Limón, el Instituto Geográfico Nacional la realizó dentro del marco de la Licitación Pública N° 2013LN-000010- 00100 denominada "Delimitación de la zona pública en el litoral Caribe de Costa Rica".

IX.-Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el Instituto Geográfico Nacional, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).

X.-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P "Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo N° 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

XI.-Que el artículo 140 de la Ley Nº 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte‖, disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: ―Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1°-El Instituto Geográfico Nacional, utilizó en el cantón 05 Matina - provincia de Limón, la metodología de "Delimitación Digital Georreferenciada" conforme al Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre" del 28 de junio de 2011, para delimitar la zona pública de la Zona Marítimo Terrestre, en sectores costeros donde no existe a la fecha de firma del presente Aviso, delimitación de la zona pública a través de la colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta.

2°-La zona pública de la Zona Marítimo Terrestre del cantón 05 Matina, provincia de Limón, determinada por el Instituto Geográfico Nacional con delimitación digital georreferenciada, fue realizada en el 2014 y corresponde a los sectores costeros cuyas coordenadas de puntos extremos se indican a continuación, tanto en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, así como por referencia, en la proyección Lambert Norte del Mapa MBCR-1/50.000 Parismina y Moín, a saber:

3°-Los sectores costeros del cantón 05 Matina, provincia de Limón, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

4°-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre, correspondiente al cantón 05 Matina, provincia de Limón, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT_705/Geolínea_ Versión_01_04/05/2016.-Curridabat, 20 de junio del 2016.

Considerando:
