in the entirety of the text - Full Text of Regulation 06 Delimitation of the public zone of the canton of Talamanca was carried out using the “Georeferenced Digital Delimitation” methodology to delimit the public zone of the Maritime-Terrestrial Zone in specific coastal sectors Full Text of record: 10E87D NATIONAL GEOGRAPHIC INSTITUTE NOTICE No. 2016-06 MARITIME-TERRESTRIAL ZONE Delimitation of the public zone of the canton of Talamanca Based on the powers conferred by Article 140 and Article 240, subsection 1) of Law No. 6227, General Public Administration Act, and in accordance with the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime-Terrestrial Zone, and Articles 62 and 63 of the Regulations to the Law on the Maritime-Terrestrial Zone, dated March 2, 1977, the National Geographic Institute,

I.-That by means of Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry shall administer the Institute's budget, enter into the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, with the purpose of supporting planning processes.

II.-That the Law Creating the National Geographic Institute, No. 59, establishes it permanently and in representation of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any kind that originate from the works entrusted to its charge.

III.-That in accordance with the Law Creating the National Geographic Institute, No. 59, in Article 62 of the Regulations to Law No. 6043, the competence of the National Geographic Institute is recognized for the delimitation of the public zone of the Maritime-Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulations states that "The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone." IV.-That in Executive Decree No. 36642-MP-MOPT-MINAET "Regulations of Specifications for the Delimitation of the public zone of the Maritime-Terrestrial Zone", it is established according to Article 18 that for the delimitation of the public zone of the Maritime-Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of milestones (mojones) and/or through georeferenced digital delimitation, this with the purpose of streamlining delimitations and providing greater technical security to interested parties.

V.-That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Network of Horizontal Reference CR05 and the CRTM05 cartographic projection system shall constitute the only official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities developed in the National Territory by any public agency, person or private national or foreign entity must be referenced." ; while Article 7 indicates that "As cartographic data are produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish by appropriate means that information which has been officialized." VI.-That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime-Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, approving survey (agrimensura) plans, granting concessions in the Restricted Zone, and other aspects of coastal territorial planning (ordenamiento territorial costero).

VII.-That the National Geographic Institute used, in canton 04 Talamanca - province of Limón, the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime-Terrestrial Zone in specific coastal sectors, where to date there is no delimitation of the public zone through the placement of official milestones (mojones) via respective publication in the Official Gazette La Gaceta.

VIII.-That the "Georeferenced Digital Delimitation" of the public zone of the Maritime-Terrestrial Zone of canton 04 Talamanca - province of Limón, was carried out by the National Geographic Institute within the framework of Public Tender No. 2013LN-000010-00100 called "Delimitation of the public zone on the Caribbean coast of Costa Rica".

IX.-That the georeferenced digital information on the delimitation of the public zone of the Maritime-Terrestrial Zone held by the National Geographic Institute is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime-Terrestrial Zone (ZMT).

X.-That the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime-Terrestrial Zone (ZMT) is technically based on application of the regulations established by: a) Executive Decree No. 7841-P "Regulations to Law No. 6043 on the Maritime-Terrestrial Zone", b) the Executive Decree No. 33797-MJ-MOPT "Declares as official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection, CRTM05", and c) the Executive Decree No. 36642-MP-MOPT-MINAET "Regulations of Specifications for the Delimitation of the public zone of the Maritime-Terrestrial Zone".

XI.-That Article 140 of Law No. 6227, General Public Administration Act, states that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the moment it is adopted", a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and specific ones by notification." Communicates:

1st-The National Geographic Institute used, in canton 04 Talamanca - province of Limón, the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime-Terrestrial Zone in specific coastal sectors, where to date there is no delimitation of the public zone through the placement of milestones (mojones) officialized via respective publication in the Official Gazette La Gaceta.

2nd-The public zone of the Maritime-Terrestrial Zone of canton 04 Talamanca - province of Limón, determined by the National Geographic Institute with georeferenced digital delimitation, was carried out in 2014 and corresponds to the coastal sectors whose extreme point coordinates are indicated below, both in the official cartographic projection system of Costa Rica CRTM05, as well as by reference, in the Lambert North and South projection of the Map MBCR-1/50,000 Cahuita and Amubri, namely:

2 Orthophotos produced by the Cadastre and Registry Regularization Program (Programa de Regularización de Catastro y Registro, PRCR).

3rd-The coastal sectors of canton 04 Talamanca - province of Limón, which to date have delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of milestones (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

4th-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime-Terrestrial Zone, corresponding to canton 04 Talamanca - province of Limón, have been recorded in the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime-Terrestrial Zone (ZMT), in a file with vector shape format, under the coding: RN/IGN_GDG-IGN-ZMT_704/Geolínea_ Versión_01_02/05/2016.

Considering:

en la totalidad del texto - Texto Completo Norma 06 Delimitación de zona pública cantón de Talamanca se utilizó la metodología de “Delimitación Digital Georreferenciada” para delimitar la zona pública de la Zona Marítimo Terrestre en sectores costeros específicos Texto Completo acta: 10E87D INSTITUTO GEOGRÁFICO NACIONAL AVISO Nº 2016-06 ZONA MARITIMA TERRESTRE Delimitación de zona pública cantón de Talamanca Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1) de la Ley N° 6227 General de la Administración Pública, y de conformidad con lo dispuesto en la Ley N° 59 de creación del Instituto Geográfico Nacional, la Ley N° 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley N° 6043 sobre la Zona Marítimo Terrestre, y los artículos 62 y 63 del Reglamento de la sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, el Instituto Geográfico Nacional,

I.-Que mediante Ley N° 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

II.-Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

III.-Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional, N° 59, en el artículos 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".

IV.-Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

V.-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado." VI.-Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

VII.-Que el Instituto Geográfico Nacional, utilizó en el cantón 04 Talamanca - provincia de Limón, la metodología de -Delimitación Digital Georreferenciada‖ para delimitar la zona pública de la Zona Marítimo Terrestre en sectores costeros específicos, donde no existe a la fecha, delimitación de la zona pública a través de la colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta.

VIII.-Que la "Delimitación Digital Georreferenciada" de la zona pública de la Zona Marítimo Terrestre del cantón 04 Talamanca - provincia de Limón, el Instituto Geográfico Nacional la realizó dentro del marco de la Licitación Pública N° 2013LN- 000010-00100 denominada "Delimitación de la zona pública en el litoral Caribe de Costa Rica".

IX.-Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el Instituto Geográfico Nacional, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).

X.-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P -Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre‖, b) el Decreto Ejecutivo N° 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

XI.-Que el artículo 140 de la Ley Nº 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

1º-El Instituto Geográfico Nacional, utilizó en el cantón 04 Talamanca -provincia de Limón, la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en sectores costeros específicos, donde no existe a la fecha, delimitación de la zona pública a través de la colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta.

2º-La zona pública de la Zona Marítimo Terrestre del cantón 04 Talamanca - provincia de Limón, determinada por el Instituto Geográfico Nacional con delimitación digital georreferenciada, fue realizada en el 2014 y corresponde a los sectores costeros cuyas coordenadas de puntos extremos se indican a continuación, tanto en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, así como por referencia, en la proyección Lambert Norte y Sur del Mapa MBCR- 1/50.000 Cahuita y Amubri, a saber:

2 Ortofotos elaboradas por el Programa de Regularización de Catastro y Registro (PRCR).

3º-Los sectores costeros del cantón 04 Talamanca - provincia de Limón, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

4º-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre, correspondiente al cantón 04 Talamanca - provincia de Limón, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT_704/Geolínea_ Versión_01_02/05/2016.
