...in the entirety of the text - Complete Text Standard 04 Delimitation of the Public Zone of the Canton of Pococí used the methodology of “Georeferenced Digital Delimitation” in accordance with Executive Decree No. 36642-MP-MOPT-MINAET “Regulation of Specifications for the Delimitation of the Public Zone” Complete Text record: 10E886 NATIONAL GEOGRAPHIC INSTITUTE NOTICE No. 2016-04 MARITIME TERRESTRIAL ZONE DELIMITATION OF THE PUBLIC ZONE CANTON OF POCOCÍ Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227 General Public Administration Act, and in accordance with the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, and Articles 62 and 63 of the Regulation to the Law on the Maritime Terrestrial Zone, of March 2, 1977, the National Geographic Institute,

1. 1That by means of Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry, and that the Administrative Board of the National Registry shall administer the Institute's budget, and sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, investigations or tasks and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature that are related to said works, with the aim of supporting planning processes.
2. 2That the Law Creating the National Geographic Institute, No. 59, constitutes it permanently and in representation of the State, as the official authority in geodetic matters and of the spatial representation of the geography of the Republic, its authority extending to activities of any order originating from the works entrusted to its charge.
3. 3That in accordance with the Law Creating the National Geographic Institute, No. 59, in Article 62 of the Regulation to Law No. 6043, the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone is recognized, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation indicates that "The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."
4. 4That in Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone", it is established according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or georeferenced digital delimitation, this with the aim of streamlining delimitations and providing greater technical security to interested parties.
5. 5That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically indicating in Article 11 that: "The National Geodetic Horizontal Reference Network CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the National Territory by any public dependency, person, or national or foreign private entity must be referenced."; while Article 7 indicates that "As cartographic data in the new CRTM05 cartographic projection system is produced, the National Geographic Institute shall publish by appropriate means that information which has been officialized."
6. 6That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), approving cadastral survey plans (visado de planos de agrimensura), granting concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal land-use planning (ordenamiento territorial costero).
7. 7That the National Geographic Institute used, in canton 02 Pococí - province of Limón, the methodology of "Georeferenced Digital Delimitation" to delimit the public zone of the Maritime Terrestrial Zone in specific coastal sectors, where to date, no delimitation of the public zone exists through the placement of boundary markers (mojones) officialized via respective publication in the Official Gazette La Gaceta.
8. 8That the "Georeferenced Digital Delimitation" of the public zone of the Maritime Terrestrial Zone of canton 02 Pococí - province of Limón, was carried out by the National Geographic Institute within the framework of Public Tender No. 2013LN-000010-00100 called "Delimitation of the public zone on the Caribbean coast of Costa Rica."
9. 9That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the National Geographic Institute is called the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).

10.—That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P "Regulation to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOPT "Declares as the official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection, CRTM05", and c) Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone".

11.—That Article 140 of Law No. 6227 General Public Administration Act indicates that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the time it is adopted," a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by indicating that: "General acts shall be communicated by publication and concrete acts, by notification." COMMUNICATES:

First.—The National Geographic Institute used, in canton 02 Pococí - province of Limón, the methodology of "Georeferenced Digital Delimitation" in accordance with Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone" of June 28, 2011, to delimit the public zone of the Maritime Terrestrial Zone, in coastal sectors where, as of the signing date of this Notice, no delimitation of the public zone exists through the placement of boundary markers (mojones) officialized via respective publication in the Official Gazette La Gaceta.

Second.—The public zone of the Maritime Terrestrial Zone of canton 02 Pococí - province of Limón, determined by the National Geographic Institute with georeferenced digital delimitation, was carried out in 2014 and corresponds to the coastal sectors whose coordinates of extreme points are indicated below, both in the official cartographic projection system of Costa Rica CRTM05, as well as for reference, in the Lambert North projection of Map MBCR- 1/50,000 Tortuguero, California, and Parismina, as follows:

Third.—The coastal sectors of canton 02 Pococí - province of Limón, that currently have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

Fourth.—The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone, corresponding to canton 02 Pococí - province of Limón, have been recorded in the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT), in a vector shape format file, under the coding: RN/IGNˍGDG-IGN-ZMTˍ702/ GeolíneaˍVersiónˍ01ˍ04/05/2016.

en la totalidad del texto - Texto Completo Norma 04 Delimitación de la Zona Pública Cantón de Pococí se utilizó la metodología de “Delimitación Digital Georreferenciada” conforme al Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET “Reglamento de Especificaciones para la Delimitación de la zona pública" Texto Completo acta: 10E886 INSTITUTO GEOGRÁFICO NACIONAL AVISO Nº 2016-04 ZONA MARÍTIMA TERRESTRE DELIMITACIÓN DE ZONA PÚBLICA CANTÓN DE POCOCÍ Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley Nº 6227 General de la Administración Pública, y de conformidad con lo dispuesto en la Ley Nº 59 de creación del Instituto Geográfico Nacional, la Ley Nº 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley Nº 6043 sobre la Zona Marítimo Terrestre, y los artículos 62 y 63 del Reglamento de la sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, el Instituto Geográfico Nacional,

1. 1Que mediante Ley Nº 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, Nº 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional, Nº 59, en el artículos 62 del Reglamento a la Ley Nº 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
4. 4Que en el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
7. 7Que el Instituto Geográfico Nacional, utilizó en el cantón 02 Pococí - provincia de Limón, la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en sectores costeros específicos, donde no existe a la fecha, delimitación de la zona pública a través de la colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta.
8. 8Que la "Delimitación Digital Georreferenciada" de la zona pública de la Zona Marítimo Terrestre del cantón 02 Pococí - provincia de Limón, el Instituto Geográfico Nacional la realizó dentro del marco de la Licitación Pública N° 2013LN-000010- 00100 denominada "Delimitación de la zona pública en el litoral Caribe de Costa Rica.
9. 9Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el Instituto Geográfico Nacional, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).

10.-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo Nº 7841-P "Reglamento a la Ley Nº 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo Nº 33797-MJ-MOPT ―Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05‖, y c) el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

11.-Que el artículo 140 de la Ley Nº 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos.

COMUNICA:

Primero.-El Instituto Geográfico Nacional, utilizó en el cantón 02 Pococí - provincia de Limón, la metodología de "Delimitación Digital Georreferenciada" conforme al Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre" del 28 de junio de 2011, para delimitar la zona pública de la Zona Marítimo Terrestre, en sectores costeros donde no existe a la fecha de firma del presente Aviso, delimitación de la zona pública a través de la colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta.

Segundo.-La zona pública de la Zona Marítimo Terrestre del cantón 02 Pococí - provincia de Limón, determinada por el Instituto Geográfico Nacional con delimitación digital georreferenciada, fue realizada en el 2014 y corresponde a los sectores costeros cuyas coordenadas de puntos extremos se indican a continuación, tanto en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, así como por referencia, en la proyección Lambert Norte del Mapa MBCR- 1/50.000 Tortuguero, California y Parismina, a saber:

Tercero.-Los sectores costeros del cantón 02 Pococí - provincia de Limón, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

Cuarto.-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre, correspondiente al cantón 02 Pococí - provincia de Limón, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: RN/IGNˍGDG-IGN-ZMTˍ702/ GeolíneaˍVersiónˍ01ˍ04/05/2016.
