8131, as far as its ordinary and prevention activities are concerned, is under the supervision of the General Directorate of Administration of Goods and Administrative Contracting of the Ministry of Finance and must comply with the policies, directives, instructions, technical standards, manuals, and procedures established by the said General Directorate in its areas of competence, and must provide it with the information and render the reports it requests, or that are required by current legislation.

Therefore, this regulation is approved:

REGULATION FOR THE CONTROL OF GOODS AND ASSETS OF THE NATIONAL COMMISSION FOR PREVENTION OF RISKS AND EMERGENCY RESPONSE

General Provisions

• a)Asset: A set of goods, securities, or rights valuable in money that make up an estate or a legal universality.
• b)Administrator of Institutional Goods: An institutional official assigned to the Institutional Procurement Office, who will have responsibility for the administration of goods both in the SIBINET system of the Ministry of Finance and any other support system used by the financial administration of the CNE.
• c)Registration of Goods and Assets: Process by which a good is entered into the inventory register. The way in which it is registered is by assigning it an asset number that is affixed to the good in order to link the digital record with the physical good.
• d)Removal from inventory (Baja) of goods and assets: Process by which a good is excluded from the digital inventory; it is removed after complying with the specifications requested by the Regulation for the Registration and Control of Goods of the Central Administration.
• e)Good: Anything that can be subject to appropriation; therefore: that has an economic value; that is: it is found within commerce.
• f)Donation: There is a donation or gift when, through the liberality of a natural or legal person, national or international, the property and ownership of a good are transferred free of charge in favor of the State, which accepts it.
• g)Official in charge of custody: This is understood as any institutional and non-institutional official to whom a series of goods acquired by the CNE are assigned in writing and are entrusted for the performance of their work, whether ordinary or extraordinary.
• h)Tagging (Plaquear): This is understood as the action of placing a high-security label on the goods received into the warehouse to identify them within the inventory with an asset number for easy location.
• i)SIBINET: Computer system of the Ministry of Finance in which the records of goods and assets of all Central Government institutions converge. The function of this system is to act as a database, in which the CNE's assets are registered. Serving as a database and as an accounting auxiliary.

Obligations of CNE Officials

• a)Request from the Central Warehouse Process the necessary documents to create the database required for the registration of goods in the functional systems.
• b)Maintain a physical and electronic file within the SIBINET system of the Ministry of Finance, classified by the plate number assigned in the consecutive order.
• c)Maintain a database with the location of the assets and their custodian official. Detailing registrations, removals, donations, and other movements permitted by Law.
• d)Keep the information in both the SIBINET system of the Ministry of Finance and Optec, or the system in operation, up to date; this applies internally within the Institution.
• e)Carry out a physical inventory at least annually, and another self-inventory with the same frequency; annually.
• f)Physically tag (Plaquear) all goods acquired by the CNE in a visible, secure, and legible place. In the event of deterioration or loss of the asset identification plate, it must be replaced immediately upon becoming aware of this situation.

Officials who are in the service of the Administration as heads of Office or department, who have goods under their charge or maintain custody or concession of goods or assets under their administration, must comply with the following obligations:

• a)Heads of Unit will deliver to their subordinates the goods or assets entrusted to each one for their use, service, administration, and custody, or those supplied for the performance of their institutional work, through the preparation of individual inventories that the responsible official must sign, along with their name and identification number.
• b)Officials designated as Heads of Unit, upon taking possession of their positions, will request from their predecessor, or from their immediate superior, the inventory and delivery of the goods and assets left under their charge. If the inventory and delivery are correct, this shall be recorded; otherwise, the official receiving them will note observations regarding any missing items or the condition of the goods, and in both cases, the report must include the signature and data of both the person delivering and the person receiving.
• c)Upon ceasing their functions, the officials mentioned in the preceding paragraphs are obligated to return the assets and goods through an inventory detailing their condition and location.
• d)In the specific case of the Operations Management Unit and the Communications Process, the heads must maintain a detailed control of assets and goods indicating: location, condition, and official responsible for the goods and assets located in each region of the country. The Head of Operations and the Communications Process are responsible for the custody of each of the goods and assets acquired by purchase or donation on behalf of the CNE.
• e)Maintain a file with documentation recording inventory movements or changes due to larceny, theft, destruction, or any other reason. They may designate an official within their Unit with the responsibility for its custody.

• a)Ensure the well-being of the assigned goods or assets; otherwise, said official will be responsible if they are missing from the official inventory, or if they are detailed as missing during the physical count carried out by the institutional asset inspection.
• b)Submit reports to the CNE Administrator of Goods on the movement of assets.
• c)Carry out Self-Inventories for reconciliation with the official inventory maintained by the official in charge of Assets periodically; this will be done in the first quarter of each year, on a date to be defined by the Assets Administrator, through which each official will forward an inventory of the goods and assets assigned to them, which must be signed by the public servant and their hierarchical superior. The forms created for this purpose will be used.
• d)Complete the forms stipulated for any movement of goods or Assets such as: Transfers between officials, exit of assets outside the CNE to regional warehouses or internal departments within or outside the CNE.
• e)Request permission to move a good out of the country when the official requires it due to their institutional activities. Said permit must have the endorsement of the Head of Unit, who must communicate the respective permit to the CNE Administrator of Goods.
• f)Communicate in writing to the CNE Administrator of Goods when there are assets considered for disuse or that are no longer useful. Said official letter must detail the reasons why it is no longer functional, its characteristics, and their request for donation or destruction. This official letter must have the approval of the Head of the Unit or Process.
• g)Deliver the portable and non-fixed assets assigned to their person, along with a detail of the condition of the goods and assets, in cases where officials have custody of institutional goods or assets and are on vacation or disabled for a period greater than ten business days.
• h)Deliver to their immediate superior an official letter indicating the assigned inventory, with a copy to the Administrator of Institutional Assets, prior to ceasing their duties for the institution.

• a)Every asset or good received into the Warehouse Process will be assigned to the Coordinator or Head of the Process that acquired or requested the good, and will be transferred from their custody, until it is assigned to a subordinate of the process under their responsibility, or to whomever the Senior Administration determines.
• b)Goods and assets leaving the institutional Warehouse without complying with the formalities established for the exit of goods and assets from where they are stored shall be the responsibility of the Coordinator of the Warehouse Process.

Similarly, the goods and assets that have been acquired by the Operations Management Unit for each of the Regions will be in charge of the Liaison Officer to whom they have been assigned.

In the event that the Liaison Officer changes Region, they must deliver to their successor a detailed inventory of the goods and assets remaining in their custody, with a copy to the CNE Administrator of Goods.

• a)Abandoning institutional goods outside the areas of the corresponding departments, claiming they are not useful or that they are damaged, or, failing that, making changes to goods and assets without the proper use of the control mechanisms established by the Assets Unit, such that the official who carries out this type of activity may be sanctioned through the corresponding administrative procedure.
• b)Using CNE goods and assets for personal or unauthorized purposes, or for other functions that differ from those for which they were originally assigned.
• c)Removing assets that have been received into the Central Warehouse without their respective asset number; excluded from this procedure are assets required for use in an emergency situation.

Movable and immovable goods subject to registration in the National Property Registry

Any movable or immovable good susceptible to registration in the Public Property Registry must be registered in the corresponding registry in the name of the National Commission for Risk Prevention and Emergency Response.

In those cases where goods are purchased from a contractor and they are not delivered registered, the Institutional Procurement Office must forward the corresponding documents to the Legal Advisory Office for the respective registration process, before the State Notary or before the corresponding Registry, as the case may be. To this end, the Institutional Procurement Office must necessarily include in the Procurement Announcement the requirement for the contractor to register the good in the name of the CNE or the corresponding Executing Unit.

For each case, procurement regulations supporting each of the Emergency Decrees issued will be established.

Donations

Lending, removal from inventory (baja) of assets, and treatment of idle assets

• a)Record the condition of the asset leaving the Institutional Warehouse before it leaves and at the time of its return to the warehouse where it will be stored again, this information must be put in writing.
• b)Formalize an official letter for the loan of one or several goods or assets within the same institution, detailing the loan conditions: time, place of use, who will be responsible for the good, and the commitment to maintenance and to bear any expense generated by damage due to negligence or carelessness.

For the response to emergency situations, the principles of control must be respected, for which the pertinent documentation for exit from the Warehouse and for Control of Goods and Assets must be completed. To the extent possible, the procedure will be expedited to provide prompt attention to the needs of the emergency.

Otherwise, the Administration must use the most efficient means consistent with the legal framework for the best use of the mentioned assets, for storage or sale.

Asset losses due to natural disaster must also comply with this requirement.

Inventories

The inventory will be carried out by one person per unit who maintains an ordered and updated database for each of the officials in the Unit to which they belong, and will act as a liaison between said unit and the Administrator of Institutional Goods, for carrying out any procedure related to changes in the unit's inventory.

As long as assets or goods remain in the Institutional Warehouse, they will remain under the custody and responsibility of the Head of the Warehouse Process, until they are assigned to an official through the presentation and issuance of the documentation authorized for this purpose.

Disciplinary and administrative measures

• a)Until the moment assets acquired with budgets from the Communications and Operations Processes are assigned, said assets will remain under the custody of the corresponding Head.
• b)Within one year from the publication of this regulation, a digital system must be in place for the control of the inventory of communication assets, which must include at least the management of the following information: asset number, Location by Province, Canton, and specific place of custody of the good; in remote cases, it will be necessary to georeference the location of said goods and assets. Likewise, a requirement of said system will be to have a history of the movements of the goods and assets mobilized and their reassignment to officials.

Any other previously published Regulation or Norm is hereby repealed.

Por tanto, se aprueba el presente reglamento:

REGLAMENTO PARA EL CONTROL DE BIENES Y ACTIVOS DE LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS

• a)Activo: Conjunto de bienes, valores o derechos apreciables en dinero que integran un patrimonio o una universalidad jurídica.
• b)Administrador de Bienes Institucionales: Funcionario institucional destacado en la Proveeduría Institucional, el cual tendrá como responsabilidad la administración de los bienes tanto en el sistema SIBINET del Ministerio de Hacienda y cualquier otro sistema soporte que utilice la administración financiera de la CNE.
• c)Alta de Bienes y Activos: Proceso mediante el cual se ingresa al registro de inventarios un bien. La forma en que se le da de alta, es asignándole un número de activo que se le adhiere al bien para así relacionar el registro digital con el bien en físico.
• d)Baja de bienes y activos: Proceso en el cual se excluye del inventario digital un bien; el cual se da de baja luego de cumplir con las especificaciones solicitadas por Reglamento para el Registro y Control de Bienes de la Administración Central.
• e)Bien: Todo aquello que puede ser objeto de apropiación; por tanto: que tiene un valor económico; esto es: que se encuentra dentro del comercio.
• f)Donación: Hay donación u obsequio cuando por liberalidad de una persona física o jurídica, nacional o internacional, se transmite gratuitamente la propiedad y el dominio de un bien a favor del Estado que la acepta.
• g)Funcionario encargado de la custodia: Se entiende como todo aquel funcionario institucional y no institucional, al que de forma escrita se le asignan una serie de bienes adquiridos por la CNE y son confiados para su la realización de sus trabajo ya sea ordinario o extraordinario.
• h)Plaquear: Se entiende como la acción de colocar con una etiqueta de alta seguridad a los bienes ingresados a la bodega para identificarlo dentro del inventario con un número de activo para ubicarlo con facilidad.
• i)SIBINET: Sistema informático del Ministerio de Hacienda en el cual convergen los registros de bienes y activos de todas las instituciones del Gobierno Central. La función de dicho sistema es el de funcionar como base de datos, en la que se registran los activos de la CNE. Sirviendo de base de datos y como auxiliar contable.

Obligaciones de los funcionarios de la CNE

• a)Solicitar al Proceso de Bodega Central, los documentos necesarios para crear la base de datos requerida para el alta de los bienes en los sistemas funcionales.
• b)Mantener un archivo físico y electrónico dentro del sistema SIBINET del Ministerio de Hacienda, clasificado por número de placa adjudicada en el consecutivo.
• c)Mantener una base de datos con la ubicación de los activos, su funcionario custodio. Detallando altas, bajas, donaciones y los otros movimientos permitidos por la Ley.
• d)Mantener actualizado la información en los sistemas tanto SIBINET del Ministerio de Hacienda y Optec o el que esté en funcionamiento; esto a lo interno de la Institución.
• e)Efectuar un inventario físico anual, como mínimo y otro auto inventario con la misma periodicidad; anual.
• f)Plaquear físicamente todos los bienes adquiridos por la CNE, en un lugar visible, segura y legible. En caso de deterioro o pérdida de la placa de identificación de activos; se debe reemplazar inmediatamente, del conocimiento de esta situación.

Los funcionarios que se encuentren al servicio de la Administración como jefes de Oficina o dependencia, que tengan a su cargo bienes o que mantengan bajo su administración la custodia o concesión de bienes o activos, deberán cumplir con las siguientes obligaciones:

• a)Los Jefes de Unidad harán entrega a sus subalternos de los bienes o activos que a cada uno se les confíe para su uso, servicio, administración y custodia, o aquellos que se suministren para el desarrollo de su labor institucional, mediante la elaboración de inventarios individuales cuyo funcionario responsable deberá firmar, junto a su nombre y número de cédula.
• b)Los funcionarios designados como Jefes de Unidad, al tomar posesión de sus cargos, solicitarán a su antecesor o bien a su superior inmediato, el inventario y entrega de los bienes y activos que queden a su cargo. Si el inventario y la entrega fuesen correctos, se hará constar, de lo contrario el funcionario que lo reciba hará las observaciones en relación a los faltantes o estado de los bienes y en ambos casos, el informe deberá contar con la firma y datos del que entrega como de quien recibe.
• c)Al cesar en sus funciones, los funcionarios mencionados en los incisos anteriores, tendrán la obligación de realizar la devolución de los activos y bienes mediante inventario que detalle el estado y ubicación de los mismos.
• d)En el caso específico de la Unidad de Gestión de Operaciones y el Proceso de Comunicaciones, deberán existir por parte de las jefaturas, un control detallado de activos y bienes que indique: ubicación, estado y funcionario responsable de los bienes y activos ubicados en cada región del país. Siendo responsabilidad de la Jefatura de Operaciones y del Proceso de Comunicaciones, la custodia de cada uno de los bienes y activos adquiridos por compra o donación a favor de la CNE.
• e)Mantener un expediente con la documentación que haga constar los movimientos o cambios de inventario por razones de hurto, robo, destrucción o cualquier otro. Quien podrá designar en un funcionario de su Unidad la responsabilidad de custodia del mismo.

• a)Velar por el bienestar de los bienes o activos asignados, caso contrario dicho funcionario será responsable en caso de que falte en el inventario oficial, o que se detalle como faltante en la toma física que realice la inspección de activos institucional.
• b)Presentar informes al Administrador de Bienes de la CNE sobre el movimiento de los activos.
• c)Realizar Auto Inventarios para la conciliación de los mismos con el inventario oficial que mantiene el funcionario Encargado de Activos de manera periódica, el mismo se realizará en el primer trimestre de cada año, en una fecha a definir por el Administrador de Activos, mediante el cual cada funcionario remitirá un inventario los bienes y activos asignados a su persona, el cual debe ser firmado por el servidor y su superior jerárquico. Se usarán los formularios creados para este propósito.
• d)Llenar los formularios estipulados para cualquier movimiento de bienes o Activos tales como: Traslado entre funcionarios, salida de activos fuera de la CNE a bodegas regionales o dependencias internas dentro o fuera de la CNE.
• e)Solicitar permiso para trasladar un bien fuera del país cuando el funcionario lo requiera en razón de sus actividades institucionales. Dicho permiso deberá contar con el aval del Jefe de Unidad quién deberá comunicar el permiso respectivo al Administrador de Bienes de la CNE.
• f)Comunicar mediante oficio al Administrador de Bienes de la CNE cuando existan activos que se consideren para desuso o que ya no son de utilidad. En dicho oficio deberá detallar los motivos por el cual el mismo ya no es funcional, sus características y su solicitud de donación o destrucción. Este oficio deberá contar con el visto bueno de la Jefatura de la Unidad o Proceso.
• g)Entregar los activos portátiles y no fijos que estén asignados a su persona, junto con un detalle del estado de los bienes y los activos en los casos en los que los funcionarios tengan bajo su custodia bienes o activos institucionales y se encuentren gozando de vacaciones o estén incapacitados por un periodo mayor a diez días hábiles.
• h)Entregar a su superior inmediato un oficio indicando el inventario asignado, con copia al Administrador de Activos Institucionales de previo al cese funciones para la institución.

• a)Todo activo o bien que ingrese al Proceso de Bodega, será asignado al Coordinador o Jefe del Proceso que adquirió o solicitó el bien, y será trasladado de su custodia, hasta que el mismo sea asignado a un subordinado del proceso bajo su responsabilidad, o bien a aquel que la Administración Superior determine.
• b)Los bienes y activos que salgan de la Bodega institucional sin cumplir los formalismos establecidos para la salida de bienes y activos, de donde están almacenados, serán responsabilidad del Coordinador del Proceso de Bodega.

Del mismo modo los bienes y activos que hayan sido adquiridos por la Unidad de Gestión de Operaciones para cada una de las Regiones, estarán a cargo del Oficial de Enlace al que se le haya asignado.

En el caso en que el Oficial de Enlace cambie de Región, deberá entregar a su sucesor un inventario detallado de los bienes y activos que quedan en su custodia, con copia al Administrador de Bienes de la CNE.

• a)Abandonar bienes institucionales fuera de las áreas de los departamentos correspondientes alegando que no son de utilidad o que se encuentran dañados o en su defecto realizar cambios de bienes y activos sin el uso adecuado de los mecanismos de control establecidos por la Unidad de Activos, de manera tal que el funcionario que realice este tipo de actividades, podrá ser sancionado mediante el procedimiento administrativo correspondiente.
• b)Utilizar bienes y activos de la CNE para fines personales o no autorizados, o para otras funciones que difieran de las que originalmente fueron asignadas.
• c)Sacar activos que hayan ingresado a la Bodega Central sin su respectivo número de activo; quedan excluidos de este procedimiento activos que se requiera su utilización en una situación de emergencia.

De los bienes muebles e inmuebles sujetos a inscripción en el Registro Nacional de la Propiedad

Todo bien mueble o inmueble susceptible de inscripción en el Registro Público de la Propiedad, deberá ser inscrito en el registro correspondiente a nombre de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias.

En aquellos casos en los que se realice la compra de bienes a un contratista y éste no los entregue inscritos, la Proveeduría Institucional deberá remitir los documentos correspondientes a la Asesoría Legal para el trámite de inscripción respectivo, ante la Notaría del Estado o bien ante el Registro correspondiente según sea el caso. Para tal efecto la Proveeduría Institucional necesariamente deberá incluir en el Cartel de la Contratación el requisito por parte del contratista de inscribir el bien a nombre de la CNE o de la Unidad Ejecutora correspondiente.

Para cada caso se emitirán reglamentos de compras que amparan cada uno de los Decretos de Emergencia emitidos.

De las donaciones

Préstamo, baja de activos y tratamiento de los activos ociosos

• a)Consignar el estado del activo que sale de la Bodega Institucional antes de salir y al momento de su regreso a la bodega donde se almacenará nuevamente, debiendo quedar por escrito esta información.
• b)Formalizar un oficio para el préstamo de uno o varios bienes o activos dentro de la misma institución, detallando las condiciones del préstamo: tiempo, lugar a utilizar, quien será el responsable del bien y el compromiso de mantenimiento y sufragar cualquier gasto que genere su daño por inopia o por descuido.

Para la atención de situaciones de emergencia deberán respetarse los principios de control, para lo cual se deberá completar la documentación pertinente de salida de Bodega y de Control de Bienes y Activos. En la medida de las posibilidades el trámite se agilizará para cumplir con una pronta atención de las necesidades de la emergencia.

En caso contrario la Administración deberá utilizar los medios más eficientes y acordes al marco legal para el mejor aprovechamiento de los activos en mención para su almacenamiento o su venta.

Las pérdidas de activos por desastre natural también tendrán que cumplir con este requisito.

Inventarios

El inventario será realizado por una persona por unidad que efectúe el mantenimiento en una base de datos ordenada y actualizada, de cada uno de los funcionarios de la Unidad a la que pertenece y fungirá como enlace entre la misma y el Administrador de Bienes Institucional, para la realización de cualquier gestión relacionada con cambios en el inventario de la unidad.

Mientras los activos o bienes permanezcan en la Bodega Institucional, permanecerán bajo la custodia y responsabilidad de la Jefatura del proceso de Bodega, hasta que se asignen a un funcionario por medio de la presentación y emisión de la documentación autorizada para el fin.

Medidas disciplinarias y administrativas

• a)Hasta el momento en que sean asignados los activos adquiridos con presupuestos de los Procesos de Comunicaciones y Operaciones, dichos activos permanecerán bajo la custodia de la Jefatura correspondiente.
• b)En un lapso de un año a partir de la publicación de este reglamento, se debe contar con un sistema digital, para control de inventario de activos de comunicación, que contenga como mínimo el manejo de la siguiente información: número de activo, Ubicación por Provincia, Cantón y lugar específico de custodia del bien en casos remotos; será necesario geo referenciar la ubicación de dichos bienes y activos. Así mismo será requerimiento de dicho sistema que cuente con un historial de los movimientos de los bienes y activos movilizados y su reasignación a los funcionarios.

Se deroga cualquier otro Reglamento o Norma publicada anteriormente.
