throughout the entire text - Complete Text of Regulation 2 Delimitation of the Public Zone corresponding to the Estuary (Ría) of the Gigante River Complete Text of record: 10CBAC NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT Notice No. 2016-02 MARITIME-TERRESTRIAL ZONE Delimitation of the public zone corresponding to the estuary (ría) of the Gigante River Pursuant to the provisions of Article 63 of the Regulation to Law No. 6043 on the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) of March 2, 1977, the definition of estuary (ría) found in: Article 69 of the Water Law (Ley de Aguas) No. 276 of August 27, 1942 and Article 2 of the Regulation to Law No. 6043, the technical recommendations of Executive Decree (Decreto Ejecutivo) No. 36786-MINAET of August 12, 2011, and the promulgation of the executive decree on national wetlands No. 35803-MINAET of January 7, 2010, the National Geographic Institute (Instituto Geográfico Nacional) ANNOUNCES:

1. 1That it used, on the Gigante River, located in district 05 Paquera, canton 01 Puntarenas of the province of Puntarenas, the "Georeferenced Digital Delimitation" methodology, in accordance with Executive Decree (Decreto Ejecutivo) No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre)" of June 28, 2011, for the delimitation of the public zone of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) corresponding to the estuary (ría) of the Gigante River, given that in said estuary (ría), as of the date of signing of this Notice, there is no delimitation of the public estuary (ría) zone officially established via the respective publication in the Official Gazette (Diario Oficial La Gaceta).
2. 2That the public zone of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) corresponding to the estuary (ría) of the Gigante River, located in district 05 Paquera, canton 01 Puntarenas of the province of Puntarenas, determined by the National Geographic Institute (Instituto Geográfico Nacional) with georeferenced digital delimitation, corresponds to the river channel with tidal influence (afectación mareal) whose "upstream" extreme point coordinates were verified on November 16, 2015 and certified by means of note ACT-OSRLP-691-2015 on the State Natural Heritage Registry (Registro de Patrimonio Natural del Estado) of the Tempisque Conservation Area (Área de Conservación Tempisque) dated November 16, 2015; and certification: ACT-OR-DR-1488-15, dated November 19, 2015, carried out respectively by Luis Ángel Mena Aguilar and Lic. Nelson Marín Mora, Regional Director of the Tempisque Conservation Area (Área de Conservación Tempisque) of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) of the Ministry of Environment and Energy (Ministerio del Ambiente y Energía).
3. 3That the georeferenced digital delimitation methodology used by the Tempisque Conservation Area (Área de Conservación Tempisque) is in accordance with Executive Decree (Decreto Ejecutivo) No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre)" of June 28, 2011, and the technical criteria of the National Geographic Institute (Instituto Geográfico Nacional), to delimit the public zone of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) corresponding to the estuary (ría) of the Gigante River; located in district 05 Paquera, canton 01 Puntarenas of the province of Puntarenas, given that the sector of the estuary (ría) located on the aforementioned river, as of the date of signing of this notice, is not delimited through the placement of official boundary markers (mojones) established via the respective publication in the Official Gazette (Diario Oficial La Gaceta).
4. 4That the public zone of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) corresponding to the estuary (ría) of the Gigante River, verified and delimited by the Tempisque Conservation Area (Área de Conservación Tempisque) and the National Geographic Institute (Instituto Geográfico Nacional), corresponds to a sector of tidal influence (afectación mareal) whose "upstream" extreme point coordinates are indicated in the official cartographic projection system of Costa Rica CRTM05, as follows:

6º-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre), the estuary (ría) of the Gigante River of the canton of Puntarenas, of the province of Puntarenas, have been registered in the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (Instituto Geográfico Nacional, IGN) on the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT).

en la totalidad del texto - Texto Completo Norma 2 Delimitación de la Zona Pública correspondiente a la Ría del Río Gigante Texto Completo acta: 10CBAC INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO Aviso Nº 2016-02 ZONA MARÍTIMO TERRESTRE Delimitación de la zona pública correspondiente a la ría del río Gigante De conformidad con lo dispuesto en el artículo 63 del Reglamento de la Ley Nº 6043 sobre la Zona Marítimo Terrestre del 2 de marzo de 1977, el concepto de ría que se encuentra en: artículo 69 de la Ley de Aguas N° 276 del 27 de agosto de 1942 y el artículo 2 del Reglamento de la Ley Nº 6043, las recomendaciones técnicas del Decreto Ejecutivo Nº 36786-MINAET del 12 de agosto de 2011, y la promulgación del decreto ejecutivo sobre humedales nacionales N° 35803-MINAET del 7 de enero 2010, el Instituto Geográfico Nacional COMUNICA:

1. 1Que utilizó en el río Gigante, ubicado en el distrito 05 Paquera, cantón 01 Puntarenas de la provincia de Puntarenas, la metodología de "Delimitación Digital Georreferenciada", conforme al Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre" del 28 de junio de 2011, la delimitación la zona pública de la Zona Marítimo Terrestre correspondiente a la ría del río Gigante, dado que en dicha ría no existe a la fecha de firma del presente Aviso, delimitación de la zona pública de ría oficializada vía respectiva publicación en el Diario Oficial La Gaceta.
2. 2Que la zona pública de la Zona Marítimo Terrestre correspondiente a la ría del río Gigante, ubicado en el distrito 05 Paquera, cantón 01 Puntarenas de la provincia de Puntarenas, determinada por el Instituto Geográfico Nacional con delimitación digital georreferenciada, corresponde al cauce del río con afectación mareal cuyas coordenadas de punto extremo "aguas arriba" fueron verificadas el 16 de noviembre de 2015 y certificadas por medio de la nota ACT-OSRLP-691-2015 sobre Registro de Patrimonio Natural del Estado del Área de Conservación Tempisque del 16 de noviembre de 2015; y la certificación: ACT-OR-DR-1488-15, del 19 de noviembre de 2015 , realizados respectivamente por Luis Ángel Mena Aguilar y el Lic. Nelson Marín Mora, Director Regional del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía.
3. 3Que la metodología de delimitación digital georreferenciada empleada por el Área de Conservación Tempisque es conforme con el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre" del 28 de junio del 2011, y los criterios técnicos del Instituto Geográfico Nacional, para delimitar la zona pública de la Zona Marítimo Terrestre correspondiente a la ría del río Gigante; ubicado en el distrito 05 Paquera, cantón 01 Puntarenas de la provincia de Puntarenas, dado que el sector de la ría localizada en el río antes citado a la fecha de firma del presente aviso no está delimitada a través de la colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta.
4. 4Que zona pública de la Zona Marítimo Terrestre correspondiente a la ría del río Gigante, verificada y delimitada por el Área de Conservación Tempisque y el Instituto Geográfico Nacional, corresponde a un sector de afectación mareal cuyas coordenadas de punto extremo "aguas arriba" se indican en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, como sigue:

Coordenadas Norte Este CRTM05 1093438 396984 6º-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre, la ría del río Gigante del cantón de Puntarenas, de la provincia de Puntarenas han quedado registrados registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
