08-2016, Mr. Antonio Porras Porras, Technical Director General, proceeded to present and submit for consideration by the Board Directors, the proposed Agreements regarding: 1) The Marking of fishing gear of Medium-Scale and Advanced commercial vessels, 2) The Fishing Operations Logbook (Libro de registro de operaciones de pesca) to be used on commercial Medium-Scale and Advanced commercial fishing vessels, during fishing trips, and 3) The Sets and Transshipments Registry Forms per fishing trip; which seek to address the control and management measures established in Article 11 of Executive Decree No. 38681-MAG-MINAE, Management Plan for the Harvesting of Tuna and Related Species in the Exclusive Economic Zone of the Costa Rican Pacific Ocean (Ordenamiento para el Aprovechamiento de Atún y Especies Afines en la Zona Económica Exclusiva del Océano Pacífico Costarricense), which arose from the commitments previously acquired by the longline sector by reason of the establishment and implementation of this management regulation.

HEREBY AGREES:

Antonio Porras Porras, Technical Director General, pursuant to what is established in Article 11 of Executive Decree No. 38681-MAG-MINAE, Management Plan for the Harvesting of Tuna and Related Species in the Exclusive Economic Zone of the Costa Rican Pacific Ocean (Ordenamiento para el Aprovechamiento de Atún y Especies Afines en la Zona Económica Exclusiva del Océano Pacífico Costarricense); which is carried out in the following terms and conditions:

I- Marking of fishing gear of commercial Medium-Scale and Advanced vessels.

. That in accordance with the provisions of Laws No. 7384 of March 16, 1994, Law Creating the Costa Rican Institute of Fisheries and Aquaculture, and No. 8436 of March 1, 2005, Fisheries and Aquaculture Law, it is the responsibility of INCOPESCA to dictate the measures that regulate and govern the harvesting of hydrobiological resources, in accordance with the availability and conservation of fishery resources, but in direct relation to the development and sustainability needs of the Costa Rican fishing sector, based on scientific, technical, economic, or social studies.

. That having coordinated with the longline fishing sector, those directly involved in the use of the longline fishing gear (arte de pesca del palangre) and keeping in mind the mode of operation and assembly of this fishing gear, it is necessary to establish regulatory measures aimed at minimizing the conflicts generated by interactions among the different fisheries for the tuna resource and related species, having as an objective the marking or identification of the longline fishing gear.

. That according to Executive Decree No. 38681-MAG-MINAE published in the official gazette La Gaceta No. 213 of November 05, 2014, it establishes in Article 11, subsection b, the obligation for each Medium-Scale and Advanced commercial fishing vessel to identify its longline, so as to allow identification of the ownership of the fishing gear.

THEY AGREE:

In the case of buoys or plastic floats (galones), each letter or number must be engraved by making a line or a small channel (without perforating the buoys or plastic floats), and subsequently in that same area, place the marking with permanent phosphorescent-colored paint.

In the case of radio buoys, these must be identified with the registration number of the vessel to which they belong; each letter and number must at least be sufficiently large to be legible, using for said marking, permanent phosphorescent-colored paint or by performing the marking in a stamped manner.

If the marking of the longline is illegible or not visible, it may be seized, in the event that it is being used in fishing trips.

II- Fishing Operations Logbook (Libro de registro de operaciones de pesca) to be used on commercial Medium-Scale fishing vessels and Advanced commercial fishing, during fishing trips

The Fishing Operations Logbook (Libro de Registro de Operaciones de Pesca), as indicated in Article 105 of the Fisheries and Aquaculture Law No. 8436, and in Article 114 of the Regulations to the Fisheries and Aquaculture Law, is the equivalent of the logbook (bitácora) indicated in Article 11 Subsection C, of Executive Decree No. 38681-MAG-MINAE.

That according to Executive Decree No. 38681-MAG-MINAE, MANAGEMENT PLAN FOR THE HARVESTING OF TUNA AND RELATED SPECIES IN THE EXCLUSIVE ECONOMIC ZONE OF THE COSTA RICAN PACIFIC OCEAN (ORDENAMIENTO PARA EL APROVECHAMIENTO DE ATÚN Y ESPECIES AFINES EN LA ZONA ECONÓMICA EXCLUSIVA DEL OCÉANO PACÍFICO COSTARRICENSE) and published in the official gazette La Gaceta No. 213 of November 05, 2014, establishes in Article 11, subsection c, the obligation for each Medium-Scale and Advanced commercial fishing vessel to keep on board a fishing logbook (bitácora) (Fishing Operations Logbook (Libro de Registro de Operaciones de pesca)) and record all the information on fishing operations requested therein, including among others, the objective of the fishing trip, the vessel's equipment and provisioning at the time of departure, the positions of the fishing sets, and any other important information on the fishing trip.

That the fishing logbook (bitácora) is a compendium of forms, of mandatory use for each of the Medium-Scale and Advanced commercial fishing vessels, in which the different information relating to the fishing trip must be recorded, such recorded information being confidential, so that it can only be used for research purposes. The information collected may be used by INCOPESCA to determine the effectiveness of existing management measures or to improve them, considering that the goal is for the logbooks (bitácoras) to have precise and consistent information on the fishery conducted by the Medium-Scale and Advanced commercial fishing vessels.

The Fishing Operations Logbook (Libro de Registro de Operaciones de Pesca) will be composed of two sections:

• 1)Information related to the objective of the fishing trip, the vessel's equipment and provisioning at the time of departure, and the description of the fishing gear. Likewise, the form numbers corresponding to the sets forms and the transshipment form will be recorded, which will not be part of the Fishing Operations Logbook (libro de registro de operaciones de pesca) (bitácora), but must be provided duly completed by the captain, at the time of landing.
• 2)The sets registry forms and the transshipment form will be delivered to each owner of a medium-scale and advanced vessel, along with the Fishing Operations Logbook (libro de registro de operaciones de pesca).

Section 1st-Fishing trip, provisioning, and description of the fishing gear. This section will consider the following variables to be recorded:

Fishing trip Vessel name: Enter the name of the vessel to which the logbook (cuaderno de bitácora) belongs, and which undertakes the fishing trip.

Vessel registration: Code provided by the competent Authority for vessel identification, through which the navigation permit is granted.

Captain's name: Record the name of the Captain who directed the fishing trip.

Fishing license number: Record the fishing license number, a document issued by INCOPESCA.

Departure number: Note the official identification number of the departure authorization (zarpe) issued to the vessel so that it can proceed to carry out its fishing trip.

Departure date: Enter the date on which the vessel left for the fishing trip. This information will be obtained from the Departure Permit (Permiso de Zarpe) issued by the Competent Authority.

Vessel's port of departure: Enter the official name of the place where the vessel's departure (zarpe) occurs.

Vessel departure date: indicate the date on which the vessel departs (zarpa) to carry out its fishing trip.

Arrival dock: Enter the official name of the place where the vessel docks.

Landing dock: Enter the official name of the place where the landing is carried out.

Arrival date: Enter the date on which the vessel arrived at the landing site after carrying out its fishing trip.

Landing date: Enter the date on which the landing inspection begins. The date must be written in the following form: day, month, and year separated by a hyphen. In the case of the day and month, use two digits, and for the year, four digits, in order to avoid confusion or lack of information when tabulating it.

Date of first set: indicate the date on which the first fishing set was made.

Date of last set: indicate the date on which the last fishing set was made.

Effective fishing days: Consider effective fishing days as the number of days on which fishing sets were made.

Target catch: note the species towards which the fishing is directed.

Number of sets: Enter the total number of sets made during the fishing trip.

Number of crew members: note the total number of crew members participating on the vessel and carrying out the fishing trip.

Observer on board: note "yes" or "no" depending on whether during the fishing trip the vessel carries an observer on board.

Transshipment form(s) number(s): if the vessel transshipped product on the high seas, the vessel must complete the transshipment request form and note in this space the form number to which each of the transshipments corresponds.

Sets form(s) number(s): The vessel must complete the sets registry form and note in this space the form number to which the sets per fishing trip correspond.

Provisioning Total outfitting cost: note the total cost of the fishing trip upon the vessel's departure (food, water, fuel, ice, hygiene products, among others).

Quantity of bait per species: note the estimated quantity in kg by type of bait.

Product preservation method: note the method used to preserve the catch on board: a) ice, b) frozen, c) ice and frozen.

Quantity of ice used: In the event that the catch is preserved with ice, it is necessary to note the quantity of ice in kg.

Ice machine: The vessel has a cooling system other than ice:

Other trip expenses: note other expenses incurred during the trip and their value.

General description of the fishing gear Length of the longline: Note in nautical miles the total length of the longline. The distance from the first flag of the line to where the last flag is cast.

Depth at which the longline is used: Enter the average depth of the fishing ground or site where the fishing trip is carried out. Specify the value in meters or in fathoms.

Distance between hooks: record the distance between each hook. Indicate the distance in fathoms.

Number of hooks between buoys: Write the number of hooks located between each buoy.

Number of radio buoys: Write the number of radio buoys used on the mainline.

Number of buoys between flags: Write the number of buoys or plastic floats (galones) located between one flag and another.

Number of flags between radio buoys: Write the number of flags located between each of the radio buoys.

Total number of hooks used in the longline: Note the average number of hooks used in each of the fishing sets.

Hook size: specify the size of the hooks used during the fishing trip.

Length of the buoy line or dropper (boyero o bajante): Note the length of the line ("mecatilla") between the float and the mainline. Indicate the length in fathoms.

Length of the branch line or snood (reinal o chilillo): Write the average distance from the clip (gacilla) that holds the branch line to the mainline, up to the hook. Indicate the length in fathoms.

Lower branch line (reinal) of steel: Indicate if the branch line or snood (reinal o chilillo) uses a steel cable to hold the hook and mark with an "x" the options: yes or no.

Loss of fishing gear: In the event that buoys or radio buoys marked with the vessel's registration number and name are lost during the fishing trip, it is necessary for the captain to note the coordinates where the loss occurred and the size or quantity of the gear that was lost.

The Fishing Operations Logbook (libro de operaciones de pesca) must be duly paginated by the Legal Department of INCOPESCA, and the permit holder will assume the costs of both the Fishing Operations Logbook (Libro de operación de pesca), and the cost of the sets forms and the transshipment form.

• III)Forms Sets Sheet 2) The Marking of fishing gear of commercial Medium-Scale and Advanced vessels takes effect one month after its publication, and the Fishing Operations Logbook (L i b r o de registro de operaciones de pesca) to be used on commercial Medium-Scale fishing vessels and Advanced commercial fishing, during fishing trips, as well as the Forms, will take effect three months after their publication.
• 3)Firm Agreement.

Antonio Porras Porras, Director General Técnico a presentar y someter a consideración de los Sres. Directivos, las propuestas de Acuerdos sobre: 1) El Marcaje de equipos de pesca de las embarcaciones comerciales de Mediana Escala y Avanzada, 2) El Libro de registro de operaciones de pesca para ser utilizado en embarcaciones de pesca comercial de Mediana Escala y pesca comercial Avanzada, durante las faenas de pesca, y 3) Los Formularios Registro de Lances y Trasbordos por viaje de pesca; mismas que buscan atender las medidas de control y ordenamiento fijadas en el artículo 11 del Decreto Ejecutivo N°. 38681-MAG-MINAE, Ordenamiento para el Aprovechamiento de Atún y Especies Afines en la Zona Económica Exclusiva del Océano Pacífico Costarricense, los cuales surgieron de los compromisos adquiridos de previo por el sector palangrero en razón del establecimiento e implementación de ésta normativa de ordenamiento.

Directivos, según se dispuso en el Acuerdo AJDIP/093-2016.

Directivos la procedencia de atender favorablemente la aprobación de éstos instrumentos operativos, razón por la cual, la Junta Directiva, Por tanto; ACUERDA:

Antonio Porras Porras, Director General Técnico, al tenor de lo establecido fijadas en el artículo 11 del Decreto Ejecutivo N° 38681-MAG-MINAE, Ordenamiento para el Aprovechamiento de Atún y Especies Afines en la Zona Económica Exclusiva del Océano Pacífico Costarricense; mismas que se realiza en los siguientes términos y condiciones:

I- Marcaje de equipos de pesca de las embarcaciones comerciales de Mediana Escala y Avanzada.

. Que de conformidad con lo dispuesto en las Leyes Nº 7384 del 16 de marzo de 1994, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura y Nº 8436 del 01 de marzo del 2005, Ley de Pesca y Acuicultura, corresponde al Incopesca dictar las medidas que normen y regulen el aprovechamiento de los recursos hidrobiológicos, de conformidad con la disponibilidad y conservación de los recursos pesqueros, pero en relación directa con las necesidades de desarrollo y sostenibilidad del sector pesquero costarricense, fundamentado en estudios científicos, técnicos, económicos o sociales.

. Que habiéndose coordinado con el sector pesquero palangrero, involucrados directos en el uso del arte de pesca del palangre y teniendo presente la forma de operar y de armarse estos artes de pesca, se hace necesario establecer medidas de regulación tendientes a minimizar los conflictos generados por las interacciones entre las diferentes pesquerías sobre el recurso atún y las especies afines, es que se tiene como objetivo el marcaje o identificación del arte de pesca de palangre.

. Que según el Decreto Ejecutivo Nº 38681-MAG-MINAE publicado en el diario oficial La Gaceta Nº 213 del 05 de noviembre 2014, establece en el artículo 11, inciso b, la obligatoriedad de que cada embarcación pesquera comercial de Mediana Escala y de Avanzada, identifiquen su palangre, a efecto de que con ello se permita identificar la propiedad del arte de pesca.

ACUERDAN:

En el caso de las boyas o galones, cada letra o número debe ser grabada realizando una raya o un pequeño canal (sin perforar las boyas o galones) y posteriormente en esa misma área, colocar la rotulación con pintura permanente de color fosforescente.

Para el caso de las radioboyas, estas deberán estar identificadas con el número de matrícula de la embarcación a la que pertenece, cada letra y número debe al menos ser lo sufrientemente grande para que sea legible, utilizando para dicha rotulación, pintura permanente de color fosforescente o bien realizar el marcaje de manera troquelada.

Si la rotulación del palangre es ilegible o no es visible, el mismo puede ser decomisado, en caso de que este siendo utilizado en faenas de pesca.

II- Libro de registro de operaciones de pesca para ser utilizado en embarcaciones de pesca comercial de Mediana Escala y pesca comercial Avanzada, durante las faenas de pesca

Libro de Registro de Operaciones de Pesca, según se señala en el artículo 105 de la Ley de pesca y Acuicultura Nº 8436, y en el Artículo 114 del Reglamento a la Ley de pesca y Acuicultura, es el equivalente a la bitácora que se indica en el Artículo 11 Inciso C, del Decreto Ejecutivo Nº 38681-MAG-MINAE.

Que según el Decreto Ejecutivo Nº 38681-MAG-MINAE, ORDENAMIENTO PARA EL APROVECHAMIENTO DE ATÚN Y ESPECIES AFINES EN LA ZONA ECONÓMICA EXCLUSIVA DEL OCÉANO PACÍFICO COSTARRICENSE y publicado en el diario oficial La Gaceta N° 213 del 05 de noviembre 2014, establece en el artículo 11, inciso c, la obligatoriedad de que cada embarcación pesquera comercial de Mediana Escala y de Avanzada, debe mantener abordo una bitácora de pesca (libro de Registro de Operaciones de pesca) y registrar toda la información de las operaciones de pesca que en ella se solicite, incluyendo entre otras, el objetivo del viaje de pesca, los equipos y avituallamiento de la embarcación al momento del zarpe, las posiciones de los lances de pesca, y cualquier otra información importante del viaje de pesca.

Que la bitácora de pesca, es un compendio de formularios, de uso obligatorio para cada una de las embarcaciones de pesca comercial de Mediana Escala y Avanzada, en el cual se debe registrar la diferente información relativa al viaje de pesca, siendo dicha información que se registre confidencial, de manera que solo pueda ser utilizada para fines de investigación. La información colectada pueda ser utilizada por el INCOPESCA para determinar la efectividad de las medidas de manejo existentes o bien para mejorar las mismas, considerando que se busca que las bitácoras cuenten con información precisa y consistente con la pesquería realizada por las embarcaciones de pesca comercial de Mediana Escala y Avanzada.

El Libro de Registro de Operaciones de Pesca, estará compuesto de dos secciones:

• 1)Información relacionada al objetivo del viaje de pesca, los equipos y el avituallamiento de la embarcación al momento del zarpe, la descripción del arte de pesca. Igualmente se consignaran los números de formularios correspondientes a los formularios de lances y formulario de trasbordo, que no serán parte del libro de registro de operaciones de pesca (bitácora), pero que deberán ser aportados debidamente complementados por el capitán, al momento de la descarga.
• 2)Los formularios de registro de lances y el formulario de trasbordo, serán entregados a cada dueño de embarcación de mediana escala y avanzada, junto con el libro de registro de operaciones de pesca.

Sección 1º-Viaje de pesca, avituallamiento y descripción del arte de pesca. Esta sección considerara las siguientes variables a registrar:

Viaje de pesca Nombre de la embarcación: Colocar el nombre de la embarcación a la que pertenece el cuaderno de bitácora, y que realiza el viaje de pesca.

Matrícula de la embarcación: Código proporcionado por la Autoridad competente para la identificación de la embarcación, mediante la cual se otorga el permiso de navegación.

Nombre del capitán: Registrar el nombre del Capitán que dirigió la faena de pesca.

Número de licencia de pesca: Registrar el número de licencia de pesca, documento otorgado por el INCOPESCA.

Número de zarpe: Anotar el número de identificación oficial del zarpe que se le emite a la embarcación para que pueda proceder a realizar su faena de pesca.

Fecha del zarpe: Coloque la fecha en la cual la embarcación salió a la faena de pesca. Dicha información se obtendrá del Permiso de Zarpe otorgado por la Autoridad Competente.

Puerto de salida de la embarcación: Coloque el nombre oficial del lugar donde se realiza el zarpe la embarcación.

Fecha de salida de la embarcación: indicar la fecha en que la embarcación zarpa a realizar su faena de pesca Muelle de arribo: Coloque el nombre oficial del lugar donde atraca la embarcación.

Muelle de desembarque: Coloque el nombre oficial del lugar donde se realiza el desembarque Fecha de arribo: Colocar la fecha en que la embarcación llegó al sito de desembarque después de realizar su faena de pesca Fecha del desembarque: Coloque la fecha en la cual se inicia la inspección del desembarque. La fecha debe escribirse de la siguiente forma: día, mes y año separándolas por un guion. En el caso del día y el mes utilizar dos dígitos y en el año los cuatro dígitos, de manera a evitar confusión o falta de información al tabular la misma.

Fecha del primer lance: indicar la fecha que se realiza el primer lance de pesca.

Fecha del último lance: indicar la fecha que se realiza el último lance de pesca.

Días efectivos de pesca: Considerar días efectivos de pesca como el número de días en que se realizaron lances de pesca.

Pesca objetivo: anotar la especie a la que dirige la pesca.

Número de lances: Coloque el número total de lances efectuados durante la faena de pesca.

Número de tripulantes: anotar el número total de tripulantes que participan en la embarcación y realizan la faena de pesca.

Observador a bordo: anotar "si" o "no" dependiendo de si durante el viaje de pesca la embarcación lleva observador abordo.

Número de formulario(s) de trasbordo(s): si la embarcación transbordó producto en altamar, la embarcación debe completar el formulario de solicitud de transbordos y anotar en este espacio el número de formulario al que corresponde cada uno de los trasbordos.

Número de formulario(s) de lances(s): La embarcación debe completar el formulario de registro de lances y anotar en este espacio el número de formulario al que corresponden los lances por viaje de pesca.

Avituallamiento Valor total del alisto: anotar el costo total del viaje de pesca al zarpar la embarcación (comida, agua, combustible, hielo, productos de higiene, entre otros) Cantidad de carnada por especie: anotar la cantidad estimada en kg por tipo de carnada Método de conservación del producto: anotar el método usado para conservar la captura abordo: a) hielo, b) congelado, c) hielo y congelado.

Cantidad de hielo utilizado: En el caso que la captura sea conservada con hielo, es necesario anotar la cantidad de hielo en kg.

Máquina de hielo: El barco posee sistema de enfriamiento diferente al hielo:

Otros gastos del viaje: anotar otros gastos en que se tuviera que incurrir durante el viaje y el valor de los mismos.

Descripción general del arte de pesca Largo del palangre: Anotar en millas náuticas el largo total del palangre. La distancia que existe desde que la primer bandera de la línea hasta donde se tira la última bandera.

Profundidad a la que utiliza el palangre: Coloque la profundidad promedio del caladero o sitio en cual se realiza la faena de pesca. Especificar el valor en metros o en brazas.

Distancia entre anzuelos: registrar la distancia entre cada anzuelo. Indicar la distancia en brazas.

Número de anzuelos entre boyas: Escriba la cantidad de anzuelos ubicados entre cada boya.

Número de radioboyas: Escriba la cantidad de radioboyas utilizadas en la línea madre.

Número de boyas entre banderas: Escriba la cantidad de boyas o galones ubicados entre una bandera y otra.

Número de banderas entre radioboyas: Escribir el número de banderas ubicadas entre cada una de las radioboyas.

Número total de anzuelos utilizados en el palangre: Anotar la cantidad promedio de Anzuelos utilizados en cada uno de los lances de pesca.

Tamaño de anzuelo: especificar el tamaño de los anzuelos utilizados durante la faena de pesca.

Largo del boyero o bajante: Anotar la longitud de la "mecatilla" que se encuentra entre el flotador y la línea madre. Indicar la longitud en brazas.

Largo del reinal o chilillo: Escriba la distancia promedio que existe desde la gacilla que sostiene el reinal a la línea madre, hasta el anzuelo. Indicar la longitud en brazas.

Reinal inferior de acero: Indicar si el reinal o chilillo utiliza un cable de acero para sujetar el anzuelo y anotar con una "x" las opciones: sí o no.

Pérdida de equipo de pesca: En caso que se pierdan boyas o radio boyas marcadas con el número de matrícula y nombre de la embarcación durante la faena de pesca, es necesario que el capitán anote las coordenadas donde se ha perdido y el tamaño o cantidad del equipo que se estaría perdiendo.

El libro de operaciones de pesca, deberá estar debidamente foliado por el Departamento legal del INCOPESCA y el permisionario asumirá los costos tanto del Libro de operación de pesca, como el costo de los formularios de lances y del formulario de trasbordo.

• III)Formularios Hoja de Lances 2) El Marcaje de equipos de pesca de las embarcaciones comerciales de Mediana Escala y Avanzada rige un mes transcurrido después de su publicación, y el L i b r o de registro de operaciones de pesca para ser utilizado en embarcaciones de pesca comercial de Mediana Escala y pesca comercial Avanzada, durante las faenas de pesca, así como los Formularios, regirán tres meses después de su publicación.
• 3)Acuerdo Firme.
