1º-Whereas in ordinary session 08-2016, Mr. Antonio Porras Porras, Technical Director General, in his capacity as Coordinator of the National Fisheries Closures Commission (Comisión Nacional de Vedas, CV), presented the 2016 closure (veda) proposal, in accordance with what was thus agreed upon by that Commission, for which the recommendations made by the Scientific Technical Coordination Commission (Comisión de Coordinación Científico Técnica, CCCT) were also considered.
1. Establish a total closure (veda) for small-scale fishing, in the area enclosed by an imaginary straight line running from Punta Torres, known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the outer lighthouse of Isla Negritos (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula and from there seaward to the imaginary line running from Estero Canjelito (10°01´05" North Latitude, 085°09´47" West Longitude) to Estero Moraga (10°08´03" North Latitude, 085°03´51" West Longitude). This fishing prohibition runs from May 1, 2016, to August 31, 2016, both dates inclusive.
3. Establish a closure (veda) for semi-industrial shrimp trawl fishing in the area enclosed by an imaginary line running from Punta Agujas (09°43´46´´ North Latitude, 084°38´57´´ West Longitude) to the outer lighthouse of Isla Negritos (09°49´14´´ North Latitude, 084°49´35´´ West Longitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula and from these lines seaward to the mouth of the Tempisque River. This closure (veda) runs from May 1, 2016, to August 31, 2016, both dates inclusive.
4. Authorize sport and recreational fishing permit holders (permisionarios de pesca turística y deportiva) to carry out fishing activities, in the area closed (vedada) to small-scale fishing, only in the zone enclosed by the imaginary line running from Punta Torres, known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to Guayabo located on the outer part of Isla San Lucas (09°54´54".1 North Latitude, 084°53´15" West Longitude) and from there to Punta Gigante on the Nicoya Peninsula (09°50´41".2 North Latitude, 084°52´45" West Longitude) and from there seaward. This fishing is only permitted using trolling and casting (cast rod "targeting pelagic species") as fishing methods and using the catch and release modality; therefore, no specimens caught as a product of this fishing may be retained.
3º-Whereas with the implementation of this closure (veda), as it has been conceived, the urgent need to protect and guarantee the hydrobiological resources of the Gulf of Nicoya in their most important stage of reproduction is addressed; in addition to the fact that, thanks to the efforts of IMAS in coordination with INCOPESCA, it has also been possible to extend the subsidy —to fishers whose license only allows them to fish in said zone— for an additional month during the closure (veda) in zone 201 (A); a zone which, due to its conditions and characteristics, is of great importance for the repopulation of commercially important species in the Gulf of Nicoya.
4º-Likewise, those fishers who, in accordance with the provisions of subsection 1) of recital (considerando) 2º) of this agreement, decide to fish for barracuda or candado (Sphyraena ensis), during the months of June and July 2016, must communicate this at least one month in advance to the Department of Protection and Registration of INCOPESCA, on the understanding that they will not be recognized the right to receive the subsidy during the months they carry out fishing activities, but rather will be entitled to receive fuel at a competitive price for the exercise of those fishing activities, in accordance with their fishing license.
5º-Having heard the presentation of the Technical Director General, the Board Members express their satisfaction that this proposal integrates not only the criteria of these two Commissions, but is also presented with the due advance notice, which will allow the necessary provisions to be made so that its implementation occurs in a timely manner with respect to the legal and social spheres, reason for which, the Board of Directors. Therefore, AGREES:
1º-To approve the 2016 closure (veda) under the following terms and conditions:
1. Establish a total closure (veda) for small-scale fishing, in the area enclosed by an imaginary straight line running from Punta Torres, known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the outer lighthouse of Isla Negritos (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula and from there seaward to the imaginary line running from Estero Canjelito (10°01´05" North Latitude, 085°09´47" West Longitude) to Estero Moraga (10°8´3" North Latitude, 085°03´51" West Longitude). 1º-Siendo que en la sesión ordinaria 08-2016, el Sr. Antonio Porras Porras, Director General Técnico, en su condición de Coordinador de la Comisión Nacional de Vedas (CV), presentó la propuesta de veda 2016, de conformidad con lo así acordado por esa Comisión, para lo cual se consideraron, además, las recomendaciones vertidas por la Comisión de Coordinación Científico Técnica (CCCT).
2º-Es por ello que mediante oficio DGT-A-008-2016, recibe ésta Junta Directiva la propuesta de veda 2016, en los siguientes términos y condiciones:
1. Establecer una veda total para la pesca en pequeña escala, en el área comprendida por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (09°53´31"Latitud Norte, 084°43´52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya y de ahí agua adentro hasta la línea imaginaria que va desde del Estero Canjelito (10°01´05" Latitud Norte, 085°09´47" Longitud Oeste) hasta Estero Moraga (10°08´03" Latitud Norte, 085°03´51" Longitud Oeste). Esta prohibición de pesca va desde el 01 de mayo del 2016 hasta el 31 de julio del 2016, ambas fechas incluidas.

Autorizar a los permisionarios de pesca turística y deportiva realizar actividades de pesca, en la zona vedada para la pesca en pequeña escala, únicamente en la zona comprendida entre la línea imaginaria que va desde Punta Torres conocida como Peñón (09°53´31"Latitud Norte, 084°43´52" Longitud Oeste) hasta Guayabo ubicado en la parte externa de Isla San Lucas (09°54´54".1 Latitud Norte, 084°53´15" Longitud Oeste) y de ahí hasta Punta Gigante en la península de Nicoya (09°50´41".2 Latitud Norte, 084°52´45" Longitud Oeste) y de ahí aguas afuera. 4º-Asimismo, aquellos pescadores que de conformidad con lo dispuesto en el inciso 1) del considerando 2º) del presente acuerdo, decidan realizar la pesca de barracudas o candado (Sphyraena ensis), durante los meses de junio y julio del 2016, deberán comunicarlo con al menos un mes de antelación al Departamento de Protección y Registro del INCOPESCA, en el entendido que no se les reconocerá el derecho a recibir el subsidio durante los meses que realicen labores de pesca, sino que tendrán derecho a recibir combustible a precio competitivo para el ejercicio de esas labores de pesca, de conformidad con su licencia de pesca.
5º-Escuchada la presentación del Director General Técnico, manifiestan los Sres. Directivos su satisfacción de que ésta propuesta integre no solo los criterios de éstas dos Comisiones, sino que la misma se presenta con la antelación debida, lo cual permitirá tomar las previsiones necesarias a efecto que su implementación en tiempo y forma en relación a los ámbitos legal y social, razón por la cual, la Junta Directiva. Por tanto, ACUERDA:
1º-Aprobar la veda 2016 en los siguientes términos y condiciones:
1. Establecer una veda total para la pesca en pequeña escala, en el área comprendida por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (09°53´31"Latitud Norte, 084°43´52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya y de ahí agua adentro hasta la línea imaginaria que va desde del Estero Canjelito (10°01´05" Latitud Norte, 085°09´47" Longitud Oeste) hasta Estero Moraga (10°8´3" Latitud Norte, 085°03´51" Longitud Oeste). Autorizar a los permisionarios de pesca turística y deportiva realizar actividades de pesca, en la zona vedada para la pesca en pequeña escala, únicamente en la zona comprendida entre la línea imaginaria que va desde Punta Torres conocida como Peñón (09°53´31"Latitud Norte, 084°43´52" Longitud Oeste) hasta Guayabo ubicado en la parte externa de Isla San Lucas (09°54´54".1 Latitud Norte, 084°53´15" Longitud Oeste) y de ahí hasta Punta Gigante en la península de Nicoya (09°50´41".2 Latitud Norte, 084°52´45" Longitud Oeste) y de ahí aguas afuera. Esta pesca únicamente se permite utilizando como métodos de pesca el troleo y casting (caña lanzada "dirigida a especies pelágicas") y utilizando la modalidad de captura y liberación; por lo que no se podrán retener ningún espécimen capturados como producto de esta pesca.
