General Provisions

CHAPTER I

Municipality: Municipality of Osa.

Mayor: The Mayor of the Municipality of Osa.

Municipal Council: The Municipal Council of the Municipality of Osa.

Taxpayer: Natural or legal person obligated to pay the fee for the service of cleaning roads, parks, green zones, and beaches of the Z.M.T.

Service: Cleaning of roads, parks, green zones, and beaches of the Z.M.T. performed by the Municipality of Osa, through its various departments.

Cost: Financial cost incurred by the municipality for providing the service.

Fee: Levy to be paid to the Municipality by users of properties, registered or not, in the canton of Osa, in order to cover the costs demanded by the service of cleaning roads, parks, green zones, and beaches of the Z.M.T.

Public Road: Any terrain of public domain and common use, which by disposition of the administrative authority is designated for free transit in accordance with planning laws and regulations and which is currently in fact designated for public use.

Parks and Green Zones: Public spaces, terrains located within a population center, where people can enjoy leisure time.

1— Cleaning or sweeping of parks, clearing them of leaves and solid waste that may affect communal drains or sewer systems.

2— Cleaning of curbs and gutters, as well as open ditches, irrigation channels, and culverts, clearing them of solid waste, weeds, or any type of obstruction that impedes the free flow of water and that are not located on private properties.

3—The cleaning of beaches of the Z.M.T., such as: beaches, boulevards, tourist promenades, that are under municipal administration. Cleaning of public roads, when ordinary waste or dead animals are present on them.

4— Inspection and technical assessment of the roads and public sites where the service is provided, taking into account all the activities involved.

Formula for determining the charge C.E.= Effective Cost T.B.I.= Totality of the Taxable Base of the district V.P.= Property Value.

DISTRICT T.B.I./C.E. = Factor.

Factor x V.P. of each taxpayer/4= Fee to be paid quarterly.

CAPÍTULO I

Disposiciones Generales

Municipalidad: Municipalidad de Osa.

Alcalde: El Alcalde o Alcaldesa de la Municipalidad de Osa.

Concejo Municipal: El Concejo Municipal de la Municipalidad de Osa.

Contribuyente: Persona física o jurídica obligada a cancelar la tarifa relativa al servicio de limpieza de vías, parques, zonas verdes y playas de la Z.M.T.

Servicio: Limpieza de vías, parques, zonas verdes y playas de la Z.M.T. que realiza la Municipalidad de Osa, a través de sus distintas dependencias.

Costo: Costo financiero en que incurre la municipalidad por la prestación del servicio.

Tarifa: Taza que deberán cancelar a la Municipalidad los usuarios de bienes inscritos o no en el cantón de Osa, con el fin de sufragar los costos que demanda el servicio de limpieza de vías, parques, zonas verdes y playas de la Z.M.T.

Vía Pública: Es todo terreno de dominio público y de uso común, que por disposición de la autoridad administrativa se destinare al libre tránsito de conformidad con las leyes y reglamentos de planificación y que de hecho esté destinado actualmente al uso público.

Parques y Zonas Verdes: Son los espacios públicos, terrenos situados en el interior de una población, donde las personas pueden disfrutar del tiempo libre.

1- Limpieza o barrido de los parques, liberándolos de las hojas y residuos sólidos que puedan afectar los desagües o alcantarillado comunal.

2- Limpieza del cordón y caño, así como de las zanjas a cielo abierto, acequias y alcantarillas, liberándolas de residuos sólidos, zacate o cualquier tipo de obstrucción que impida el libre tránsito de las aguas y que no se encuentren en fincas privadas.

3- La limpieza de playas de Z.M.T. como: Playas, bulevares, paseos turísticos, que sean de administración municipal. Limpieza de las vías públicas, cuando en ellas existan residuos ordinarios o animales muertos.

4- Inspección y valoración técnica de las vías y sitios públicos en donde se ofrece el servicio, tomando en cuenta todas las actividades que involucra.

Del procedimiento para el cobro

CAPÍTULO II

Fórmula para determinar el cobro C.E= Costo Efectivo T.B.I.= Totalidad de la Base Imponible del distrito V.P= Valor de la Propiedad.

T.B.I. DEL DISTRITO/C.E. = Factor.

Factor x V.P. de cada contribuyente/4= Tarifa a cancelar trimestralmente.

Artículo 1 — —For the purposes of this regulation, the following terms are defined:

Artículo 2 — —The service of cleaning roads, parks, green zones, and beaches of the Z.M.T. comprises the following activities:

Artículo 5 — —For the purposes of this regulation, a levy is understood as the service of cleaning roads, parks, green zones, and beaches of the Z.M.T., whose obligation is generated by the ownership of real estate by natural or legal persons in each district of the Canton of Osa.

Artículo 6 — —The Municipality shall charge a levy for the service of cleaning roads, parks, green zones, and beaches of the Z.M.T., to all taxpayers owning real estate in the Canton of Osa.

Artículo 8 — —The procedure mentioned in the previous article shall be applied separately for each district of the Canton of Osa.

Artículo 9 — —This levy must be paid by the liable party indicated in article 3 of this regulation.

Artículo 10 — —The charge for the service of cleaning roads, parks, zones greens, and beaches of the Z.M.T., shall be made quarterly, the liable party being authorized to make the annual payment in the first quarter of each year or to make advance payments at any time.

Artículo 12 — —In accordance with article 70 of the Código Municipal, debts for municipal taxes shall constitute a preferred legal mortgage on the respective properties.

Artículo 13 — —The collection of this levy for the service of cleaning roads, parks, green zones, and beaches of the Z.M.T., comes into effect 30 business days after its publication in the Diario Oficial La Gaceta.

Artículo 14 — —This Regulation for the Collection of the Levy for the Cleaning of Roads, Parks, Green Zones, and Beaches of the Z.M.T. of the canton of Osa, repeals any previous regulation that governs this type of service and fee.

Artículo 1 — Para efectos del presente reglamento se definen los siguientes términos:

Artículo 2 — El servicio de limpieza de vías, parques, zonas verdes y playas de la Z.M.T. comprende las siguientes actividades:

Artículo 6 — La Municipalidad, cobrará una tasa por concepto del servicio de limpieza de vías, parques, zonas verdes y playas de la Z.M.T., a todos los contribuyentes propietarios de bienes inmuebles del Cantón de Osa.

Artículo 8 — El procedimiento mencionado en el artículo anterior, se aplicada de forma separada por cada distrito del Cantón de Osa.

Artículo 9 — Esta tasa deberá pagarla el sujeto pasivo indicado en el artículo 3 del presente reglamento.

Artículo 12 — De conformidad con el artículo 70 del Código Municipal, las deudas por tributos municipales constituirán hipoteca legal preferente sobre los respectivos inmuebles.

Artículo 13 — El cobro de esta tasa por concepto de servicio de limpieza de vías, parques, zonas verdes y playas de la Z.M.T., rige en 30 días hábiles después de su publicación en el Diario Oficial La Gaceta.

Artículo 14 — El presente Reglamento para el Cobro de la Tasa por Concepto de Limpieza de Vías, Parques, Zonas Verdes y Playas de la Z.M.T. del cantón de Osa, deroga todo reglamento anterior que regule este tipo de servicio y tarifa.
