in the entirety of the text - Complete Text of Standard 404 Amendment to Agreement AJDIP/060-2015 on “Control Procedures for the Declaration of Closures to Guarantee the Protection and Sustainability of the Fishery Resources of the Gulf of Nicoya” Complete Text of Record: 10B8E3 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/404-2015.—Puntarenas, on the ninth day of the month of October, two thousand fifteen.
1.—Official communication DFOE-SD-2130 is received, signed by Mrs. Alexia Umaña Alvarado, Auditor of the Operative and Evaluative Audit Division of the Office of the Comptroller General of the Republic, through which, and in compliance with Provisions 4.5 and 4.6 of Report No. DFOE-EC-IF-15-2014.
2.—That these provisions concern: “4.5 Order the Executive Presidency that every proposal for closures that is elevated to this board, in accordance with the annual regulation periods and zones, be supported by technical, scientific, economic, and social criteria, as established in articles 34 of Law No. 8436 and 41 of Executive Decree No. 36782, considering in turn the opinion of the Technical Scientific Coordination Commission (CCT) as indicated in article 29 of Law No. 7384, among other regulations. The analysis that this Board of Directors carries out must verify that the closure proposal considered the indicated criteria and the referred opinion as support for making its decisions, in order to protect marine resources. To certify full compliance with this provision, the corresponding agreement ordering the Executive Presidency shall be remitted within a period of 10 business days.
3.—That furthermore, each semester during the years 2015 and 2016, you shall remit to this Comptroller General a certification accrediting that in the establishment of the closures for that period, the criteria indicated in article 34 of Law No. 8436 were considered.
4.—That for its part, the Executive Presidency, in compliance with what was indicated in this point, remitted official communication PESJ-015-01-2015, accompanied by Agreement AJDIP/031-2015, through which the Board of Directors orders that Department to attend to the provisions of article 34 of Law 8436, relying for this purpose on the support of the Technical Scientific Coordination Commission.
5.—That for its part, the formalization of the Technical Scientific Coordination Commission occurred in ordinary session No. 23-2015, held on May 22, 2015, and the closure period was in effect from May 15 to September 15, 2015, which, given that the constitution and swearing-in of the Technical Scientific Coordination Commission occurred on a date subsequent to the issuance of the Agreement and the start of this year’s closure, no criterion was considered or requested.
6.—That by reason of this and being that to date compliance with the provisions contained in article 34 of Law 8436 has not been accredited, the Office of the Comptroller requests the remission of the corresponding certification; as well as the date of establishment of the next closure.
7.—That for its part, regarding provision 4.6 of the aforementioned Report, it established the need for the board of directors to approve the “Control Procedures for the Declaration of Closures to Guarantee the Protection and Sustainability of the Fishery Resources of the Gulf of Nicoya,” in strict observance and compliance of the provisions of article 34 of Law 8436, with consideration of the opinion that may emanate from the Technical Scientific Coordination Commission (Article 29, Law 7384).
8.—That in accordance with what was required by the aforementioned Report, the Board of Directors established the corresponding mechanism through Agreement AJDIP/060-2015, which established Control Procedures for the Declaration of Closures to Guarantee the Protection and Sustainability of the Fishery Resources of the Gulf of Nicoya. Said procedure was ratified and duly communicated to the Office of the Comptroller General of the Republic.
9.—That in that same vein, this procedure was found to be neglectful and did not establish consideration of the Opinion of the Technical Scientific Coordination Commission, for which reason it requires that the Board of Directors establish what actions it will adopt to attend to this particular point.
10.—That having duly analyzed the official communication remitted by Mrs. Alexia Umaña Alvarado, Auditor of the Operative and Evaluative Audit Division of the Office of the Comptroller General of the Republic, the Directors deem it, in the interest of attending to the specific requests established in provisions 4.5 and 4.6, absolutely necessary and convenient to modify Agreement AJDIP/060-2015, so that it is understood as being mandatorily integrated beforehand, the criterion of the Technical Scientific Coordination Commission, in the decision-making of the National Closures Commission, regarding the establishment of closure periods. For this reason, the board of directors, Therefore; AGREES:
1.—To amend Agreement AJDIP/060-2015 on “Control Procedures for the Declaration of Closures to Guarantee the Protection and Sustainability of the Fishery Resources of the Gulf of Nicoya,” so that it is understood as being mandatorily integrated beforehand, the criterion of the Technical Scientific Coordination Commission, in the decision-making of the National Closures Commission, regarding the establishment of the closure periods that it recommends to this Board of Directors.
2.—Firm agreement.

10.-Que debidamente analizado el oficio remitido por la señora Alexia Umaña Alvarado, Fiscalizadora de la División de Fiscalización Operativa y Evaluativa de la Contraloría General de la República, estiman los Sres. Directores, en aras de atender las solicitudes puntuales establecidas en las disposiciones 4.5 y 4.6, que resulta absolutamente necesario y conveniente, modificar el Acuerdo AJDIP/060-2015, para que se tenga por integrado obligatoriamente de previo, el criterio de la Comisión de Coordinación Científico Técnica, en la toma de decisión de la Comisión Nacional de Vedas, sobre el establecimiento de los períodos de veda, razón por la cual, la junta directiva, Por tanto; ACUERDA:
1º-Modificar el Acuerdo AJDIP/060-2015 de "Procedimientos de Control para Declaratoria de Vedas para Garantizar la Protección y Sostenibilidad de los Recursos Pesqueros del Golfo de Nicoya", para que se tenga por integrado obligatoriamente de previo, el criterio de la Comisión de Coordinación Científico Técnica, en la toma de decisiones de la Comisión Nacional de Vedas, sobre el establecimiento de los períodos de veda que recomiende a ésta Junta Directiva.
2º-Acuerdo firme.
