1.—Official communication DFOE-SD-2130 is received, signed by Mrs. Alexia Umaña Alvarado, Auditor of the Operative and Evaluative Audit Division of the Office of the Comptroller General of the Republic, through which, and in compliance with Provisions 4.5 and 4.6 of Report No. DFOE-EC-IF-15-2014.

2.—That these provisions concern: “4.5 Order the Executive Presidency that every proposal for closures that is elevated to this board, in accordance with the annual regulation periods and zones, be supported by technical, scientific, economic, and social criteria, as established in articles 34 of Law No. 8436 and 41 of Executive Decree No. 36782, considering in turn the opinion of the Technical Scientific Coordination Commission (CCT) as indicated in article 29 of Law No. 7384, among other regulations. The analysis that this Board of Directors carries out must verify that the closure proposal considered the indicated criteria and the referred opinion as support for making its decisions, in order to protect marine resources. To certify full compliance with this provision, the corresponding agreement ordering the Executive Presidency shall be remitted within a period of 10 business days.

3.—That furthermore, each semester during the years 2015 and 2016, you shall remit to this Comptroller General a certification accrediting that in the establishment of the closures for that period, the criteria indicated in article 34 of Law No. 8436 were considered.

4.—That for its part, the Executive Presidency, in compliance with what was indicated in this point, remitted official communication PESJ-015-01-2015, accompanied by Agreement AJDIP/031-2015, through which the Board of Directors orders that Department to attend to the provisions of article 34 of Law 8436, relying for this purpose on the support of the Technical Scientific Coordination Commission.

5.—That for its part, the formalization of the Technical Scientific Coordination Commission occurred in ordinary session No. 23-2015, held on May 22, 2015, and the closure period was in effect from May 15 to September 15, 2015, which, given that the constitution and swearing-in of the Technical Scientific Coordination Commission occurred on a date subsequent to the issuance of the Agreement and the start of this year’s closure, no criterion was considered or requested.

6.—That by reason of this and being that to date compliance with the provisions contained in article 34 of Law 8436 has not been accredited, the Office of the Comptroller requests the remission of the corresponding certification; as well as the date of establishment of the next closure.

7.—That for its part, regarding provision 4.6 of the aforementioned Report, it established the need for the board of directors to approve the “Control Procedures for the Declaration of Closures to Guarantee the Protection and Sustainability of the Fishery Resources of the Gulf of Nicoya,” in strict observance and compliance of the provisions of article 34 of Law 8436, with consideration of the opinion that may emanate from the Technical Scientific Coordination Commission (Article 29, Law 7384).

8.—That in accordance with what was required by the aforementioned Report, the Board of Directors established the corresponding mechanism through Agreement AJDIP/060-2015, which established Control Procedures for the Declaration of Closures to Guarantee the Protection and Sustainability of the Fishery Resources of the Gulf of Nicoya. Said procedure was ratified and duly communicated to the Office of the Comptroller General of the Republic.

9.—That in that same vein, this procedure was found to be neglectful and did not establish consideration of the Opinion of the Technical Scientific Coordination Commission, for which reason it requires that the Board of Directors establish what actions it will adopt to attend to this particular point.

10.—That having duly analyzed the official communication remitted by Mrs. Alexia Umaña Alvarado, Auditor of the Operative and Evaluative Audit Division of the Office of the Comptroller General of the Republic, the Directors deem it, in the interest of attending to the specific requests established in provisions 4.5 and 4.6, absolutely necessary and convenient to modify Agreement AJDIP/060-2015, so that it is understood as being mandatorily integrated beforehand, the criterion of the Technical Scientific Coordination Commission, in the decision-making of the National Closures Commission, regarding the establishment of closure periods. For this reason, the board of directors, Therefore; AGREES:

1.—To amend Agreement AJDIP/060-2015 on “Control Procedures for the Declaration of Closures to Guarantee the Protection and Sustainability of the Fishery Resources of the Gulf of Nicoya,” so that it is understood as being mandatorily integrated beforehand, the criterion of the Technical Scientific Coordination Commission, in the decision-making of the National Closures Commission, regarding the establishment of the closure periods that it recommends to this Board of Directors.

2.—Firm agreement.

Considering:

1º-Se conoce oficio DFOE-SD-2130, suscrito por la señora Alexia Umaña Alvarado, Fiscalizadora de la División de Fiscalización Operativa y Evaluativa de la Contraloría General de la República, por medio de la cual, y en atención a las Disposiciones 4.5 y 4.6 del Informe N° DFOE-EC-IF-15-2014.

1. 2Que éstas disposiciones versan sobre: "4.5 Ordenar a la Presidencia Ejecutiva que cada propuesta de vedas que se eleve a ese órgano colegiado, de acuerdo con los períodos y zonas de regulación anual, esté respaldada en criterios técnicos, científicos, económicos y sociales, según se establece en los artículos 34 de la Ley N° 8436 y 41 del Decreto Ejecutivo N° 36782, considerando a su vez el dictamen de la Comisión de Coordinación Científico Técnica (CCT) que señala el artículo 29 de la Ley N° 7384, entre otra normativa. El análisis que realice esa Junta Directiva debe verificar que la propuesta de vedas consideró los criterios señalados y el referido dictamen como respaldo para tomar sus decisiones, con el fin de proteger los recursos marinos. Para acreditar el cabal cumplimiento de esta disposición, se deberá remitir en un plazo de 10 días hábiles el acuerdo correspondiente en donde se gira la orden a la Presidencia Ejecutiva.
2. 3Que además, cada semestre durante los años 2015 y 2016, deberán remitir a ésta Contraloría General una certificación en que se acredite que en el establecimiento de las vedas de ese período se consideraron los criterios que señala el artículo 34 de la Ley N° 8436.
3. 4Que por su parte, la Presidencia Ejecutiva, remitió en atención a lo señalado en este punto, el oficio PESJ-015-01-2015, acompañándolo del Acuerdo AJDIP/031-2015, por medio del cual la Junta Directiva, le ordena a esa Dependencia la atención de lo dispuesto en el artículo 34 de la Ley 8436, contando para ello con el soporte de la Comisión de Coordinación Científico Técnica.
4. 5Que por su parte, la oficialización de la Comisión de Coordinación Científico Técnica, se produce en la sesión ordinaria N° 23-2015, celebrada el 22 de mayo de 2015 y el período de veda regía a partir del 15 de mayo al 15 de setiembre de 2015, lo cual dada la constitución y juramentación de la Comisión de Coordinación Científico Técnica se produce en fecha posterior a la emisión del Acuerdo e inicio de la veda del presente año, no fue considerado, ni requerido criterio alguno.
5. 6Que en razón de ello y siendo que a la fecha no se ha acreditado el cumplimiento de las disposiciones contenidas en el artículo 34 de la Ley 8436, solicita el Ente Contralor la remisión de la certificación correspondiente; así como la fecha de establecimiento de la veda próxima.
6. 7Que por su parte, en cuanto a la disposición 4.6, del Informe supra, éste estableció la necesidad de que la junta directiva aprobara los Procedimientos de Control para Declaratoria de Vedas para Garantizar la Protección y Sostenibilidad de los Recursos Pesqueros del Golfo de Nicoya", en estricto respeto y cumplimiento de lo dispuesto en el artículo 34 de la Ley 8436, con la consideración del dictamen que pudiere emanar la Comisión de Coordinación Científico Técnica (Artículo 29, Ley 7384).
7. 8Que de conformidad con lo requerido por el Informe supra citado, la Junta Directiva estableció el mecanismo correspondiente mediante Acuerdo AJDIP/060-2015, que estableció Procedimientos de Control para Declaratoria de Vedas para Garantizar la Protección y Sostenibilidad de los Recursos Pesqueros del Golfo de Nicoya, dicho procedimiento fue ratificado y debidamente comunicado a la Contraloría General de la República.
8. 9Que en ese mismo giro, éste procedimiento, resultó omiso y no estableció la consideración del Dictamen de la Comisión de Coordinación Científico Técnica, por lo que requiere que la Junta Directiva, establezca que acciones va a adoptar para la atención de éste punto en particular.

10.-Que debidamente analizado el oficio remitido por la señora Alexia Umaña Alvarado, Fiscalizadora de la División de Fiscalización Operativa y Evaluativa de la Contraloría General de la República, estiman los Sres. Directores, en aras de atender las solicitudes puntuales establecidas en las disposiciones 4.5 y 4.6, que resulta absolutamente necesario y conveniente, modificar el Acuerdo AJDIP/060-2015, para que se tenga por integrado obligatoriamente de previo, el criterio de la Comisión de Coordinación Científico Técnica, en la toma de decisión de la Comisión Nacional de Vedas, sobre el establecimiento de los períodos de veda, razón por la cual, la junta directiva, Por tanto; ACUERDA:

1º-Modificar el Acuerdo AJDIP/060-2015 de "Procedimientos de Control para Declaratoria de Vedas para Garantizar la Protección y Sostenibilidad de los Recursos Pesqueros del Golfo de Nicoya", para que se tenga por integrado obligatoriamente de previo, el criterio de la Comisión de Coordinación Científico Técnica, en la toma de decisiones de la Comisión Nacional de Vedas, sobre el establecimiento de los períodos de veda que recomiende a ésta Junta Directiva.

2º-Acuerdo firme.
