in the entirety of the text - Complete Text of Regulation 39547 Derogation of the Regulation to the Comprehensive Crop Insurance Law Complete Text record: 10B87B N° 39547-MAG THE PRESIDENT OF THE REPUBLIC, AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers established in Articles 140, subsections 3), 8), 18) and 20) and Article 146 of the Political Constitution; Articles 25, 27, subsection 1), 28, subsection 2), paragraph b) of Law N° 6227 of May 2, 1978, General Law of Public Administration; Law N° 7064 of April 29, 1987, Law for the Promotion of Agricultural Production FODEA and Organic Law of the MAG; Insurance Market Regulatory Law, Law N° 8653 of July 22, 2008 and the Regulatory Law of the Insurance Contract, Law N° 8956 of June 17, 2011.
I.-That with the Comprehensive Crop Insurance Law, Law N° 4461 of November 10, 1969, a comprehensive crop insurance was created, administered by the National Insurance Institute (INS), as the only insurer existing at that time in the country.
II.-That the Executive Branch, through Executive Decree N° 70 of April 16, 1970, called "Regulation of the Comprehensive Crop Insurance Law," regulated the aforementioned Law.
III.-That through the Insurance Market Regulatory Law, Law N° 8653 of July 22, 2008 and the Regulatory Law of the Insurance Contract, Law N° 8956 of June 17, 2011, the country opened the insurance market, which includes crop insurance.
IV.-That with the enactment of the Laws indicated in the preceding considering clause, it becomes necessary to proceed with the derogation of Executive Decree N° 70 of April 16, 1970, called "Regulation of the Comprehensive Crop Insurance Law" and its amendments; this because its content was superseded by updated and current Laws of the Republic regarding the insurance market and the insurance contract. I.-Que con la Ley del Seguro Integral de Cosechas, Ley N° 4461 del 10 de noviembre de 1969, se creó un seguro integral de cosechas administrado por el Instituto Nacional de Seguros (INS), como la única aseguradora existente para ese momento en el país.
II.-Que el Poder Ejecutivo, mediante el Decreto Ejecutivo N° 70 del 16 de abril de 1970, denominado "Reglamento de la Ley del Seguro Integral de Cosechas", reglamentó la referida Ley.
III.-Que mediante la Ley Reguladora del Mercado de Seguros, Ley N° 8653 del 22 de julio de 2008 y la Ley Reguladora del Contrato de Seguros, Ley N° 8956 del 17 de junio del 2011, el país efectuó la apertura del mercado en materia de seguros, lo cual incluye el seguro de cosechas.
IV.-Que con la promulgación de las Leyes indicadas en el considerando anterior, se hace necesario proceder a la derogatoria del Decreto Ejecutivo N° 70 del 16 de abril de 1970, denominado "Reglamento de la Ley del Seguro Integral de Cosechas" y sus reformas; esto por cuanto su contenido fue superado por Leyes de la República actualizadas y vigentes en materia del mercado de seguros y del contrato de seguros.
