in the entirety of the text - Full Text of Norm 39412 Public Use Regulation for the Tenorio Volcano National Park and the Tenorio Protective Zone Full Text act: 10A5D9 N° 39412 - MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by Article 140, subsections 3) and 18) and Article 146 of the Political Constitution, the Organic Environmental Law No. 7554, of October 4, 1995, the National Parks Service Law No. 6084, of August 24, 1977, the Biodiversity Law No. 7788, of April 23, 1998, the Wildlife Conservation Law and its amendments No. 7317 of October 30, 1992, the Forestry Law No. 7575 of February 13, 1996, Executive Decree No. P0169-MIRENEM of January 24, 1991, Executive Decree No. 24290-MIRENEM of April 27, 1995, and Executive Decree No. 34433-MINAE of March 11, 2008.

I.-That Executive Decree No. 20172-MIRENEM, published in the official gazette La Gaceta number 17 of January 24, 1991, defined the Tenorio Protective Zone (Zona Protectora Tenorio).

II.-That by means of Executive Decree No. 24290-MIRENEM of April 27, 1995, the Tenorio Volcano National Park (Parque Nacional Volcán Tenorio) was created.

III.-That the Biodiversity Law No. 7788 of April 30, 1998, in its Article 22, created the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), as a decentralized and participatory institutional management and coordination system that integrates competencies in forestry, wildlife, protected areas, and the Ministry of Environment and Energy, for the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.

IV.-That the Organic Environmental Law No. 7554 provides that the creation, conservation, administration, development, and surveillance of Protected Areas shall have, among other objectives, the conservation of natural environments, ensuring the balance and continuity of the evolutionary and ecological processes on which some wild species depend.

V.-That the Organic Environmental Law No. 7554 determines the Management Categories, as well as the competencies, regulations, and responsibilities designated to the state through MINAE and SINAC, to achieve compliance with its conservation objectives.

VI.-That the Sustainable Tourism Plan for the Tenorio Volcano National Park exists, prepared in 2009, which offers technical recommendations for the development of tourism activity in the Park.

VII.-That in the Five-Year Strategic Plan 2010-2015 of the National System of Conservation Areas, developing the sustainable tourism program in protected areas is included as a strategic action.

VIII.-That it is necessary to issue a new regulation for the public use of the Tenorio Volcano National Park and the Tenorio Protective Zone, in accordance with the provisions of the Management Plan for these protected wild areas in relation to the activities permitted by the corresponding management categories.

IX.-That by means of Agreement No. 9 of the Ordinary Session No. 12-2013 of December 10, 2013, the National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación, CONAC) approved the Management Plan of the Tenorio Volcano National Park, in accordance with Article 12, subsection d) of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008. Therefore, THEY DECREE:

"Public Use Regulation for the Tenorio Volcano National Park and the Tenorio Protective Zone"

General Provisions

Considering:

CHAPTER I

7788.

38295-MINAE denominated "Fees for Entry Rights and other services offered in the Protected Wild Areas under the Administration of the National System of Conservation Areas" and its amendments.

The following are excepted from this provision: local guides without formal schooling who have continuously exercised the guiding activity in this protected area for the last five years counted prior to the issuance of this Regulation; for which they must complete the sworn statement form, which is made before the official of the Park Administration receiving the application.

The uniform worn by local, regional, or national guides in these protected areas may not at any time be similar or resemble in shirt and pants color that of the officials of the Administration of the Tenorio Volcano National Park and the Tenorio Protective Zone.

1. Harass (Acosar): The action of cornering, trapping, pursuing, or attempting to remove an animal from its natural habitat.

2. Hunting (Caza): The action, for any purpose, of harassing, capturing, or killing wild animals, as well as the collection of products or by-products derived from them.

3. Extract (Extraer): To remove wildlife, its parts, products, or derivatives.

4. Manipulate (Manipular): To operate with hands or any instrument species of wild flora or fauna.

5. General Management Plan (Plan General de Manejo): Is the planning instrument that allows orienting the management of the PNVT and the ZPT towards the fulfillment of their long-term conservation objectives. It is based on medium-term strategic action lines and on management objectives for the natural and cultural elements included within the area, as well as the relationship of the latter with their socio-environmental surroundings. It is the basis for the development of other planning and regulatory instruments for the PNVT and the ZPT.

6. Subsistence fishing (Pesca de subsistencia): Fishing for domestic consumption which is carried out from land or in small boats, solely using rods, reels, or hand lines, without profit motive and with the sole purpose of consuming the product for one's own subsistence or that of the family.

7. Specialized tourism (Turismo especializado): A sustainable tourism modality that provides the visitor with an ecological and scientific understanding of the natural environment, where the objective of the visit seeks to broaden or share knowledge on specific topics of interest. It is conceived as a low-impact tourism modality on natural resources.

Entry to the Tenorio Volcano National Park and the Tenorio Protective Zone

CHAPTER II

a)To carry out commercial, scientific, educational, and tourism filming, the interested party must carry out the procedure provided in Article 25 of this Regulation.
b)To carry out scientific or academic research and collection, they must be governed by the provisions of Articles 19 and 20 of this Regulation.

The Administration of the ACAT shall keep an updated control system that will allow it to determine, at all times, the number of visitors present.

Zoning

CHAPTER III

a)Zone of absolute protection (ZPA).
b)Public use zone (ZUP).
c)Special use zone (ZUE).
d)Restricted use zone (ZUR).

Activities within the Tenorio Volcano National Park and the Tenorio Protective Zone

Regulation of Permitted Activities

CHAPTER IV

SECTION I

For the exercise of said activity, the interested party must have the respective duly issued and current permits and licenses.

32553-MINAE of March 29, 2005, denominated "Procedures Manual for Conducting Research in Biodiversity and Cultural Resources in Conservation Areas" and in the Wildlife Conservation Law No. 7317, or failing that, in the regulations in force that govern said activity in protected wild areas.

a)In the Zone of Absolute Protection, the exercise of ecotourism activity is completely prohibited.
b)In the Restricted Use Zone, only specialized ecotourism by exception shall be authorized, and for this, authorization from the Administrator of the protected area must be obtained, who shall define the terms and conditions to be met in the event of approving the activity.
c)In the Public Use Zone of intensive use, the following ecotourism activities are permitted: walks (caminatas), filming, and photography.
d)In the Public Use Zone of extensive use, the following ecotourism activities are permitted: walks carried out with a tour guide in groups of no more than fifteen persons, and specialized tourism.

The Directorate of the ACAT shall grant or deny the requested permit by means of a duly reasoned resolution, which shall be issued within a maximum period of 10 calendar days after the submission of the application.

Said application must contain the following information:

a)Name and qualifications of the applicant. If the applicant is a legal entity, the application must be signed by the legal representative or, failing that, by a person holding a general or special power of attorney that grants them sufficient powers to make the application.
b)Purposes of the material to be filmed.
c)Indication of the number of days intended for filming.
d)Indicate a place for notifications Furthermore, the following documents must be attached to the application:
a)Registry certification of the legal entity and a copy of the identity card of the legal representative in the case of legal entities, or a copy of the identity card in the case of individuals.
b)Copy of the filming script.

If for reasons of maintenance, protection, or conservation, the filming permits are restricted, filming for scientific research purposes and management activities shall have priority over commercial filming.

Prohibited Activities

SECTION II

a)The trade and trafficking of any wildlife product of aquatic and terrestrial origin.
b)Fishing, hunting, extracting, manipulating, harassing, and molesting individuals of any type of aquatic or terrestrial animal species.
c)Extracting and manipulating organisms of any type of aquatic or terrestrial plant species.
d)Extracting and manipulating any species belonging to the Fungi kingdom.
e)Extracting any type of organic or inorganic material, including clays, for any type of use.
f)The use of cages for wildlife observation, except for scientific or educational purposes, provided they have the respective permit granted by the competent authority.
g)Feeding aquatic and terrestrial organisms.

The exercise of such conduct is only permitted under the following assumptions:

a)When carried out for scientific, educational, or management purposes by SINAC personnel or researchers who have the respective authorization.
b)Subsistence fishing carried out in Lake Cote, for which purpose they must have the license duly granted by the ACAT. In any case, and to maximally protect the special customs of the Maleku indigenous population, other forms of extraction may be authorized, which also includes the arts or instruments used; always ensuring that there is an adequate balance between the protection of fishery resources and the needs and practices of the indigenous population.

a)Making any type of mark on trees, rocks, and any other element within the boundaries of the PNVT.
b)The carrying or use of any type of weapon (be it firearms, compressed air or spring-loaded, etc.) unless used for management purposes authorized by the ACAT, and control and surveillance exercised by the State.
c)The sale and consumption of drugs. Those substances for medical treatment are excepted from this provision.
d)Camping or lighting campfires within the boundaries of the protected wild area.
e)Nudism f) Any type of environmental contamination produced by solid waste or wastewater.
g)The generation of excessive noise, except that generated for administrative reasons.

Powers of the Administration

CHAPTER V

Without prejudice to the powers of other police forces and judicial bodies.

As well as to guide and provide environmental information to visitors.

Closure may also be ordered when necessary for the execution of the actions recommended by the management programs, whose proper development could be affected by the presence of visitors in the area.

Likewise, the authorization for staying and carrying out activities may be suspended due to adverse weather conditions or any other duly justified reason, without this generating liability for the Administration.

Final Provisions

CHAPTER VI

6084, in Chapters XI and XII of the Wildlife Conservation Law and its amendments No. 7317, as well as the application of any other punitive norm in force at the date of the events.

Primero.-Que el Decreto Ejecutivo Nº 20172-MIRENEM, publicado en el diario oficial La Gaceta número 17 del 24 de enero de 1991 definió la Zona Protectora Tenorio.

Segundo.-Que mediante el Decreto Ejecutivo Nº 24290-MIRENEM del 27 de abril de 1995 se creó el Parque Nacional Volcán Tenorio.

Tercero.-Que la Ley de Biodiversidad Nº 7788 del 30 de abril de 1998, en su artículo 22 creó el Sistema Nacional de Áreas de Conservación (SINAC), como un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integra las competencias en materia forestal, vida silvestre, áreas protegidas y el Ministerio de Ambiente y Energía, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.

Cuarto.-Que la Ley Orgánica del Ambiente N° 7554, dispone que la creación, la conservación, la administración y desarrollo y la vigilancia de las Áreas Protegidas tendrán como objetivos entre otros conservar los ambientes naturales asegurando el equilibrio y la continuidad de los procesos evolutivos y ecológicos de los cuales dependen algunas especies silvestres.

Quinto.-Que la Ley Orgánica del Ambiente N° 7554, determina las Categorías de Manejo, así como las competencias, regulaciones y responsabilidades que le son designadas al estado a través del MINAE y SINAC, para lograr el cumplimiento de los objetivos de conservación de la misma.

Sexto.-Que existe el Plan de Turismo Sostenible para el Parque Nacional Volcán Tenorio, elaborado en el año 2009; que ofrece recomendaciones técnicas para el desarrollo de la actividad turística del Parque.

Sétimo.-Que en el Plan Estratégico Quinquenio 2010-2015 del Sistema Nacional de Áreas de Conservación, se incluye como una acción estratégica el Desarrollar el programa de turismo sostenible en las áreas protegidas.

Octavo.-Que resulta necesario dictar una nueva regulación para el uso público del Parque Nacional Volcán Tenorio y la Zona Protectora Tenorio, acorde a lo establecido en el Plan de Manejo de éstas áreas silvestres protegidas en relación con las actividades que admiten las categorías de manejo correspondientes.

Noveno.-Que mediante Acuerdo Nº 9 de la Sesión ordinaria Nº 12-2013 del 10 de diciembre del 2013 el Consejo Nacional de Áreas de Conservación (CONAC) aprobó el Plan de Manejo del Parque Nacional Volcán Tenorio, de conformidad al artículo 12, inciso d) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo del 2008. Por tanto,

"Reglamento de Uso Público del Parque Nacional Volcán Tenorio y la Zona Protectora Tenorio"

Considerando:

DECRETAN:

CAPÍTULO I

Disposiciones Generales

Se exceptúa de la presente disposición a los baquianos sin escolaridad que de forma continua hayan ejercido la actividad de guiado en esta área protegida durante los últimos cinco años contados antes de la emisión del presente Reglamento; para lo cual deberá llenar el formulario de declaración jurada, la cual se rinde ante el funcionario de la Administración del Parque que está recibiendo el trámite.

El uniforme que usen los guías locales, regionales o nacionales en estas áreas protegidas no podrán ser en ningún momento semejante o parecido en color de camisa y pantalón con el de los (as) funcionarios (as) de la Administración del Parque Nacional Volcán Tenorio y la Zona Protectora Tenorio.

1. Acosar: Acción de acorralar, atrapar, perseguir o tratar de extraer de hábitat natural a un animal.

2. Caza: La acción, con cualquier fin, de acosar, apresar o matar animales silvestres, así como la recolección de productos o subproductos derivados de estos.

3. Extraer: Sacar vida silvestre, sus partes, productos o derivados.

4. Manipular: Operar con las manos o con cualquier instrumento especies de flora o fauna silvestre.

5. Plan General de Manejo: Es el instrumento de planificación que permite orientar la gestión del PNVT y la ZPT hacia el cumplimiento de sus objetivos de conservación a largo plazo. Se fundamenta en líneas de acción estratégicas a mediano plazo y en objetivos de manejo para los elementos naturales y culturales incluidos dentro del área, así como en la relación de estos últimos con su entorno socio ambiental. Es la base para el desarrollo de otros instrumentos de planificación y reglamentación del PNVT y la ZPT.

6. Pesca de subsistencia: Pesca para el consumo doméstico la que se efectúa desde tierra o en embarcaciones pequeñas, únicamente mediante el uso de cañas, carretes o cuerdas de mano, sin propósito de lucro y con el único objeto de consumir el producto para la subsistencia propia o de la familia.

7. Turismo especializado: Modalidad de turismo sostenible que proporciona al visitante un entendimiento ecológico y científico del medio ambiente natural donde el objetivo de la visita persigue el ampliar o compartir conocimientos en temas específicos de su interés. Se concibe como una modalidad de turismo de bajo impacto sobre los recursos naturales.

Del Ingreso al Parque Nacional Volcán Tenorio y la Zona Protectora Tenorio

CAPÍTULO II

En todo caso la hora límite para presentarse en el sitio de salida oficial lo será las 16:00 horas.

a)Para la realización de filmación comercial, científica, educativa y turística el interesado deberá, realizar el trámite previsto en el artículo 25 del presente Reglamento.
b)Para la realización de investigación y colecta científica o académica deberá regirse por lo dispuesto en los artículos 19 y 20 del presente Reglamento.

La Administración del ACAT, llevará un sistema de control actualizado, que le permitirá determinar en todo momento, el número visitantes presentes.

Zonificación

CAPÍTULO III

a)Zona de protección absoluta (ZPA).
b)Zona de uso público (ZUP).
c)Zona de uso especial (ZUE).
d)Zona de uso restringido (ZUR).

Actividades dentro del Parque Nacional Volcán Tenorio y la Zona Protectora Tenorio

Regulación de Actividades Permitidas

CAPÍTULO IV

SECCIÓN I

Para el ejercicio de dicha actividad el interesado deberá contar con los permisos y licencias respectivas debidamente emitidas y vigentes.

a)En la Zona de Protección Absoluta se encuentra totalmente prohibido el ejercicio de la actividad ecoturistica.
b)En la Zona de Uso Restringido únicamente se autorizará ecoturismo especializado por excepción y para ello deberá contarse con autorización del Administrador del área protegida quien definirá los términos y condiciones que deberán cumplirse en caso de aprobar la actividad.
c)En la Zona de Uso Público de uso intensivo se permiten las siguientes actividades de ecoturismo: caminatas, filmación y fotografía.
d)En la Zona de Uso Público de uso extensivo se permiten las siguientes actividades de ecoturismo: caminatas efectuadas con guía turístico en grupos no mayores a quince personas y turismo especializado.

La Dirección del ACAT otorgará o denegará el permiso solicitado mediante resolución debidamente fundamentada la cual se emitirá en un plazo máximo de 10 días naturales posterior a la presentación de la solicitud.

Dicha solicitud deberá contener los siguientes datos:

a)Nombre y calidades del solicitante. En caso de que el solicitante sea una persona jurídica la solicitud deberá estar suscrita por el representante legal o en su defecto por quien posea poder general o especial que le otorgue facultades suficientes para realizar la solicitud.
b)Fines del material a ser filmado.
c)Indicación de la cantidad de días que se pretende realizar filmación.
d)Indicar lugar para notificaciones Además, deberá adjuntarse a la solicitud los siguientes documentos:
a)Certificación registral de la personería jurídica y copia de cédula de identidad del representante legal en caso de personas jurídicas o copia de cédula de identidad en caso de personas físicas.
b)Copia del guión de filmación.

Si por razones de mantenimiento, protección o conservación se restringen los permisos de filmación, tendrá prioridad la filmación por motivos de investigación científica y de actividades de manejo sobre la filmación comercial.

Actividades Prohibidas

SECCIÓN II

a)El comercio y trasiego de cualquier producto de vida silvestre de origen acuático y terrestre.
b)Pescar, cazar, extraer, manipular, acosar, y hostigar a individuos de cualquier tipo de especies animales acuáticas o terrestres.
c)Extraer y manipular organismos de cualquier tipo de especies vegetales acuáticas o terrestres.
d)Extraer y manipular cualquier especie perteneciente al reino Fungi (hongos).
e)Extraer cualquier tipo de material orgánico o inorgánico, incluye arcillas para cualquier tipo de uso.
f)El uso de jaulas para la observación de fauna, salvo para fines científicos o educativos, siempre y cuando, cuenten con el permiso respectivo otorgado por la autoridad competente.
g)Alimentar a los organismos acuáticos y terrestres.

Solamente se permitirá el ejercicio de dichas conductas en los siguientes supuestos:

a)Cuando se efectúen con fines científicos, educativos o de manejo por parte de personal del SINAC o investigadores, que cuenten con la respectiva autorización.
b)La pesca de subsistencia ejercida en el Lago Cote, para tal efecto deberán contar con la licencia debidamente otorgada por el ACAT. En todo caso y en resguardo al máximo las especiales costumbres de la población indígena Maleku, podrán autorizarse otras formas de extracción, lo que incluye también las artes o instrumentos utilizados; velando siempre por que exista un adecuado equilibrio entre la protección de los recursos pesqueros y las necesidades y prácticas de la población indígena.

a)Realizar cualquier tipo de marca en árboles, rocas y cualquier otro elemento dentro de los límites del PNVT.
b)La portación ni el uso de ningún tipo de arma (sean estas de fuego, aire comprimido o resorte, etc.) excepto que éstas se usen con fines de manejo autorizado por el ACAT, y control y vigilancia ejercido por el Estado.
c)La venta y consumo de drogas. Se exceptúan de la presente disposición aquellas sustancias de tratamiento médico.
d)Acampar o encender fogatas dentro de los límites del área silvestre protegida.
e)El nudismo f) Cualquier tipo de contaminación ambiental producida por desechos sólidos o aguas servidas.
g)La generación de ruidos excesivos salvo los que se generen por razones administrativas.

Potestades de la Administración

CAPÍTULO V

Sin perjuicio de las facultades de otros cuerpos policiales y órganos judiciales.

Así como para orientar y brindar información ambiental a los visitantes.

También podrá ordenarse el cierre cuando sea necesario para la ejecución de las acciones recomendadas por los programas de manejo, cuyo buen desarrollo pudiera ser afectado por la presencia de visitantes en el área.

Así mismo podrá suspenderse la autorización de permanencia y la realización de actividades por motivo de condiciones climáticas adversas o cualquier otra razón debidamente justificada sin que ello genere responsabilidad para la Administración.

CAPÍTULO VI

Disposiciones finales

Dado en la Presidencia de la República.-San José, 2 de junio del dos mil quince.

Public Use Regulation of Tenorio Volcano National Park and Tenorio Protected ZoneReglamento de Uso Público del Parque Nacional Volcán Tenorio y la Zona Protectora Tenorio

Artículo 1 — This Regulation establishes the provisions for the use of the services provided, permitted activities, restricted activities, and prohibited activities within the boundaries of the Tenorio Volcano National Park (PNVT) and the Tenorio Protective Zone (ZPT).

Artículo 2 — The provisions of this Regulation and the instructions issued by the officials of the Tenorio Volcano National Park and the Tenorio Protective Zone to persons entering said Protected Wild Areas, in compliance with said instrument and the regulations in force, are mandatory.

Artículo 4 — Payment of the fees corresponding to the activities authorized under the light of this provision shall be made in accordance with the provisions of Executive Decree No.

Artículo 6 — For the purposes of this Regulation, the following nomenclatures and abbreviations shall be used:

Artículo 7 — For the purposes of this Regulation, the following terms are defined:

Artículo 8 — It shall correspond to the Administration of the PNVT to approve or deny entry to the PNVT and the ZPT.

Artículo 9 — Entry to the PNVT and the ZPT is permitted solely for the exercise of the permitted and restricted activities established in Chapter IV of this Regulation or for activities carried out by the Administration in the exercise of its competencies.

Artículo 10 — Entry to the PNVT and the ZPT for ecotourism purposes must be made through the official entrance to said protected area, which is located in the community of Pilón, Bijagua district, canton of Upala, Province of Alajuela.

Artículo 13 — For the purposes of entry to the PNVT and ZPT, and in order to prove their nationality or place of origin, visitors must show the officials at the entry booth their identity card, residency card, or passport, as applicable and when warranted.

Artículo 14 — In the following cases, for entry to the PNVT and ZPT, the interested party must make requests for additional permits in the terms indicated below:

Artículo 15 — Officials of the PNVT and the ZPT may deny access to persons when it is apparent that they are under the influence of any narcotic, psychotropic substance, or drug of unauthorized use.

Artículo 16 — The Administration of the PNVT and the ZPT shall permit the presence of persons in these protected areas, following the provisions established by the land-based carrying capacity studies or visitor flow studies officially endorsed by CORACAT.

Artículo 18 — As established in the Management Plan of the Tenorio Volcano National Park and the Tenorio Protective Zone, as well as the regulations in force, only the activities of research, training, and low-impact ecotourism are permitted to the administered parties.

Artículo 19 — Research activities and scientific and academic collection are permitted within the entire geographical zoning of the PNVT and the ZPT.

Artículo 20 — Research activities and scientific and academic collection shall be governed as established in Executive Decree No.

Artículo 21 — Ecotourism activities are permitted under the following terms:

Artículo 22 — Every walk must be carried out on the trails and routes established by the Administration of the PNVT and the ZPT.

Artículo 23 — In Lake Cote (Lago Cote), the entry of rowboats, inflatable rafts, or kayaks is permitted, respecting the specific administrative provisions for the use of the site.

Artículo 24 — Mandatorily, every visitor must obey the safety and orientation instructions given by the official in charge or authorized guide of the group.

Artículo 25 — To carry out commercial, scientific, educational, or tourism filming activities, the user must process, with a minimum advance notice of 15 calendar days, a permit before the Directorate of the ACAT and pay the corresponding fee.

Artículo 26 — Amateur filming intended solely for preserving a memory of the visit to the Protected Wild Area shall be exempt from paying a fee as provided in Executive Decree No.

Artículo 27 — Volunteer activities shall be governed as established in the regulations in force issued to specifically regulate volunteering in protected wild areas.

Artículo 28 — Within the area of the PNVT and the ZPT, the entry of vehicles of any type is not permitted, except for control and surveillance tasks or by express authorization of the Administration of the PNVT and ZPT or the Directorate of the ACAT.

Artículo 29 — Within the bodies of water, be they rivers, streams (quebradas), lagoons, or thermal waters, of the PNVT and the ZPT, entry, bathing, and swimming by visitors is absolutely prohibited, except for an activity as part of a research project duly authorized by the Administration.

Artículo 30 — In Lake Cote, the entry of launches, jet skis, or any other type of motorized vessel is absolutely prohibited; government vessels duly authorized by the Administration of the protected area are excepted.

Artículo 31 — Regarding wild species, within the PNVT and the ZPT, the following is strictly prohibited:

Artículo 33 — All activities that are considered as such by the environmental regulations in force, or that constitute contraventions or crimes according to the national legal system, are generally prohibited.

Artículo 34 — The officials of the central offices of the ACAT and the officials of the PNVT and the ZPT constitute the personnel responsible for ensuring compliance with the legal regulations in force for all activities carried out within the Protected Wild Areas.

Artículo 38 — The personnel of the PNVT, duly identified, may, when deemed necessary, carry out any other inspection that the Administration considers necessary to comply with this regulation and related regulations.

Artículo 39 — Officials of the ACAT or volunteers authorized by the PNVT, duly identified, may, without prior notice, accompany ecotourists when deemed appropriate, for the purpose of supervising, controlling, and monitoring the activities they carry out.

Artículo 42 — Any official of the ACAT may expel from the boundaries of the PNVT and the ZPT those persons who, present in the protected area, carry out prohibited activities or fail to obey provisions issued by the officials in timely fulfillment of their duties.

Artículo 44 — The prohibitions set forth shall be sanctioned in accordance with the provisions of the National Parks Service Law No.

Artículo 45 — It shall become effective upon its publication in the Official Gazette La Gaceta.

Artículo 1 — El presente Reglamento establece las disposiciones para el uso de los servicios brindados, actividades permitidas, actividades restringidas y actividades prohibidas dentro de los límites del Parque Nacional Volcán Tenorio y la Zona Protectora Tenorio.

Artículo 6 — Para efectos del presente Reglamento se utilizarán las siguientes nomenclaturas y abreviaturas:

Artículo 7 — Para efectos del presente Reglamento se definen los siguientes términos:

Artículo 8 — Corresponderá a la Administración del PNVT, aprobar o denegar el ingreso al PNVT y la ZPT.

Artículo 9 — El ingreso al PNVT y la ZPT está permitido únicamente para el ejercicio de las actividades permitidas y restringidas establecidas en el Capítulo IV del presente reglamento o para actividades efectuadas por la Administración en el ejercicio de sus competencias.

Artículo 10 — El ingreso al PNVT y la ZPT para fines de ecoturismo deberá realizarse por la entrada oficial a dicha área protegida, mismo que se encuentra ubicado en la comunidad del Pilón, distrito Bijagua, cantón de Upala, Provincia de Alajuela.

Artículo 12 — Toda persona física que deseen ingresar por razones de ecoturismo al PNVT y la ZPT podrá hacerlo en el siguiente horario los días que corren de lunes a domingo ingresando entre las 8:00 horas y las 14:00 horas.

Artículo 14 — En los siguientes casos, para el ingreso al PNVT y ZPT, el interesado deberá realizar solicitudes de permisos adicionales en los términos que seguidamente se indican:

Artículo 15 — Los funcionarios del PNVT y la ZPT podrán denegar el acceso a personas cuando sea aparente que se encuentren bajo los efectos de algún estupefaciente, sustancia psicotrópica o droga de uso no autorizado.

Artículo 16 — La Administración del PNVT y la ZPT, permitirá la presencia de personas en estas áreas protegidas, siguiendo las disposiciones que establezcan los estudios de capacidad de carga terrestre o flujo de visitación oficializados por el CORACAT.

Artículo 18 — Según lo establecido en el Plan de Manejo del Parque Nacional Volcán Tenorio y la Zona Protectora Tenorio así como la normativa vigente, solo se permite a los administrados las actividades de investigación, capacitación y ecoturismo de bajo impacto.

Artículo 19 — Las actividades de investigación y de colecta científica y académica están permitidas dentro de toda la zonificación geográfica del PNVT y la ZPT.

Artículo 21 — Las actividades de ecoturismo están permitidas en los siguientes términos:

Artículo 22 — Toda caminata deberá efectuarse en los senderos y rutas establecidas por la Administración del PNVT y la ZPT.

Artículo 23 — En el Lago Cote se permitirá el ingreso de botes de remo, balsas inflables o kayaks respetando las disposiciones administrativas específicas para el uso del sitio.

Artículo 24 — De manera obligatoria, todo visitante deberá acatar las indicaciones de seguridad y orientación dadas por el funcionario o guía autorizado, a cargo del grupo.

Artículo 25 — Para realizar las actividades de filmación comercial, científica, educativa o turística el usuario deberá tramitar con un plazo de antelación de un mínimo de 15 días naturales, un permiso ante la Dirección del ACAT y pagar la tarifa correspondiente.

Artículo 27 — Las actividades de voluntariado se regirán según lo establecido en la normativa vigente dictada para regular específicamente el voluntariado en áreas silvestres protegidas.

Artículo 28 — Dentro del área del PNVT y la ZPT, no se permitirá el ingreso de vehículos de ningún tipo salvo para labores de control y vigilancia o por autorización

Artículo 30 — En el Lago Cote queda absolutamente prohibido el ingreso de lanchas, motos acuáticas u otro tipo de embarcación con motor; se exceptúan las embarcaciones gubernamentales debidamente autorizadas por la Administración del área protegida.

Artículo 31 — Respecto a las especies de vida silvestre, dentro del PNVT y la ZPT queda estrictamente prohibido:

Artículo 32 — En relación con el uso del PNVT y la ZPT, queda absolutamente prohibido:

Artículo 33 — Quedan prohibidas de forma general todas aquellas actividades que se encuentren así consideradas por la normativa ambiental vigente o que constituyan contravenciones o delitos según el ordenamiento jurídico nacional.

Artículo 37 — La administración del PNVT y la ZPT puede, en cualquier momento, restringir las actividades y sitios de uso público, ello siguiendo los principios que rigen en materia ambiental y los objetivos establecidos en el Plan de Manejo de ambas áreas silvestres protegidas.

Artículo 38 — El personal del PNVT, debidamente identificado, podrá cuando lo estime necesario, realizar cualquier otra inspección que la Administración considere necesaria para dar cumplimiento al presente reglamento y la normativa conexa.

Artículo 39 — Funcionarios del ACAT o voluntarios autorizados por el PNVT debidamente identificado, sin previo aviso, podrán acompañar a los ecoturistas, cuando lo estimen conveniente, con el fin de fiscalizar, controlar y monitorear las actividades que estos realicen.

Artículo 42 — Cualquier funcionario del ACAT, podrá expulsar de los límites del PNVT y de la ZPT a aquellas personas que, presentes en el área protegida efectúen actividades prohibidas u omitan obedecer disposiciones emitidas por los funcionarios en cumplimiento oportuno de sus labores.

Artículo 45 — Rige a partir de su publicación en el Diario Oficial La Gaceta.
