5773 of August 19, 1975, with an area of 43,700 hectares, expanded by Executive Decree No. 13496-A of March 31, 1982.

2013-LN-000002-00200 was awarded for the concession of non-essential services in Chirripó National Park, effective as of July 20, 2014, for the provision of the following services to the public: food, lodging, luggage and material transport, equipment rental, and nature store.

Of the sixty available spaces, eight spaces have been assigned for the concessionaire's operation, and fifty-two spaces for tourist lodging.

Therefore, the following is established:

PROCEDURE FOR THE RESERVATION SYSTEM FOR CHIRRIPÓ NATIONAL PARK The reservation procedure for Chirripó National Park includes the obligation of the user to reserve and pay admission fees to the Administration and to reserve and pay the corresponding amount for lodging service to the concessionaire, and payment for ecotourism activities in cases of alternate routes authorized through a valid use permit (permiso de uso), as well as the obligation of the tourist to report to the Park Administration before entering the ASP.

The auxiliary telephone reservation system will operate during the hours of Monday through Friday from eight in the morning to noon and from one to four in the afternoon. It does not apply on legal holidays or days off declared by the Executive Branch.

Once the auxiliary System is in effect, reservations for entry to Chirripó National Park may only be made up to one month in advance.

In the first of the cases, they must present a note indicating the reasons for not using the space, the full name and identification number of the transferor and the person to whom the reservation is transferred, and attach a legible copy of the identification document of both, signature, and place or means for receiving notifications.

In cases where the bank charges some type of commission for the refund transaction, it will be deducted from the amount to be refunded. The commission amount will be set by the banking entity responsible for making the corresponding refund.

The registered user who credited the reservation payment, interested in having the money refunded, must submit a written, duly signed request addressed to the Park Administration clearly indicating the request for a money refund, date, full name of the applicant, place or means for receiving notifications, a copy of the identification document, and a copy of the reservation voucher. The lack of a signature will result in the rejection of the request and its archiving.

The request must be physically delivered to the administrative office of Chirripó National Park located in San Gerardo de Rivas, Canton of Pérez Zeledón, province of San José, and via email to [email protected] and/or fax (506) 2742 50 85. The administration will confirm receipt of the request within a period of no more than three business days. When using electronic means, it is the responsibility of the interested party to verify that the administration received it.

In the case of refund requests for lodging and other Non-Essential Services, the Administration will not be responsible, and therefore interested parties must adhere to the policies defined by the concessionaire.

Those wishing to enter during the early morning or in the first hours of the morning on the day of entry must register the day before from eight in the morning to four-thirty in the afternoon.

Those wishing to enter on the same day their entry is authorized must register from eight in the morning until ten in the morning. For safety reasons, registration or entry to the Park will not be permitted after ten in the morning.

Tourists entering via the San Jerónimo - Sabana de Los Leones - Base Crestones trail must complete their entry registration to the Park before four-thirty in the afternoon on the day prior to their entry, or until ten in the morning on the same day of entry, and will do so in a logbook that the administration will provide to the Permit Holder, who must submit quarterly reports.

If another access route to Chirripó National Park is approved in the future through a Use Permit, the entry registration procedure will be defined via an administrative resolution.

Upon receiving the communication, the Director of ACLA-P will instruct, via official letter, the Administrator and the Reservation Officer of Chirripó National Park to start the auxiliary reservation system.

The Administration will have the necessary time to resolve the system failures, and in the event of the impossibility of restoring it, may decide to use the auxiliary telephone reservation system.

Once the problems of the online reservation system are resolved, the Information Technology Officer of the Executive Secretariat or of ACLA-P of the National System of Conservation Areas will formally communicate via official letter to the Regional Directorate of ACLA-P to resume the online reservation process, who in turn will make the corresponding communications.

This does not apply to valid use permits, as they have a maximum allowed stay of two nights and three days.

In this case, they must complete the stay registration with the SINAC official stationed at Base Crestones and the Concessionaire.

This six-month advance period does not apply in cases where the auxiliary telephone reservation system is in operation.

For this purpose, the Directorate of ACLA-P must coordinate with the Administration of Chirripó National Park the allocation of spaces one month in advance; otherwise, the Administration of the protected area will make the spaces available to users through the authorized procedure.

10.-The Administration of Chirripó National Park will have 10 daily spaces for visitors who wish to enter the park for only one day, via the main trail, and who do not require lodging at the Albergue Base Crestones. These visitors must complete the reservation procedure prior to their entry and registration with the Administration in accordance with this resolution.

(Thus amended the preceding point 10) through resolution No. SINAC-ACLA-P-D-047-2016 of February 8, 2016) 11.-The amount paid to SINAC for the admission fee covers only the daily entry right per person to Chirripó National Park, in accordance with the provisions of the current fee decree.

12.-After payment of the reservation, the lodging service at the Albergue Crestones must be paid directly to the Concessionaire through the process they establish for this purpose. The amount payable corresponds to the rate established in the Concession of Non-Essential Services contract, which may be modified through the established mechanisms.

13.-For routes authorized through a use permit that are currently valid, in addition to the procedure indicated in the preceding point with the Concessionaire, they must coordinate with the Permit Holder organization regarding payment for duly authorized ecotourism activities.

14.-The user must pay the Concessionaire the corresponding lodging fees within a maximum period of ten calendar days after the reservation; otherwise, the admission reservation will be canceled, and the user must proceed to request a refund of the money paid for the admission fee, within the period established according to the fee decree.

(Thus amended the preceding point 14) through resolution No. SINAC-ACLA-P-D-047-2016 of February 8, 2016) 15.-The user entering via routes authorized through a use permit must pay the lodging fees to the Concessionaire, adhering to the preceding point, and the ecotourism activity fees to the Permit Holder organization within a period of ten calendar days after the reservation, under the warning that their admission right will be canceled if they fail to do so, and the user must proceed to request a refund of the money within the established periods.

17.-The tourist may occupy the corresponding room at the Albergue Crestones starting at noon (12:00 m.d) on the day of entry.

18.-Tourists must vacate the assigned room at the Albergue Crestones before eleven in the morning (11:00 a.m).

19.-Exoneration from payment of admission fees may be granted only based on the provisions of the executive decree regulating entry fees to protected wilderness areas. Anyone interested in entering Chirripó National Park exempted will be subject to the availability of space that the Park Administration establishes at the Albergue Crestones and must provide a copy of the resolution authorizing their entry. Once the corresponding spaces are obtained from the Administration of Chirripó National Park, they must pay the Concessionaire, into the accounts established for this purpose, the lodging fees as indicated in this resolution, in the event they use the concessioned services.

20.-Anyone who does not comply with the provisions mentioned above may not enter or remain within Chirripó National Park or the Albergue Base Crestones. Likewise, those visitors whose actions contravene the provisions of the Public Use Regulation of Chirripó National Park will also be expelled from the protected area.

21.-The La Amistad Pacífico Conservation Area reserves the right to close the entry of visitors to Chirripó National Park via a reasoned administrative resolution when deemed pertinent. For the holding of the annual Chirripó Ecological Cultural Cross-Country Race, the Administration reserves all spaces at the Albergue Base Crestones for the day before and the day of the race.

22.-Every visitor who remains inside Chirripó National Park must demonstrate the legitimacy of their stay during their visit by presenting an identification document with a photograph and in accordance with the established control measures.

23.-Against this resolution, the ordinary appeals for revocation and/or appeal are admissible, in accordance with Articles 343 and subsequent of the General Public Administration Law, which will be resolved as follows: the revocation appeal by the same body that issued the resolution, and the appeal by the National Council of Conservation Areas. The appeals must be filed before the body that issues this resolution within three days following its publication.

De los sesenta espacios disponibles, ocho espacios han sido asignados para la operación del concesionario, y cincuenta y dos espacios para el alojamiento de turistas.

Por lo tanto, Se establece el PROCEDIMIENTO PARA EL SISTEMA DE RESERVACIONES AL PARQUE NACIONAL CHIRRIPÓ El procedimiento de reservaciones del Parque Nacional Chirripó comprende la obligación del usuario de reservar y cancelar ante la Administración los derechos de admisión y ante el concesionario reservar y cancelar el monto correspondiente al servicio de alojamiento y la cancelación por concepto de actividades ecoturísticas en los casos de rutas alternas autorizadas mediante permiso de uso vigentes, así como la obligación del turista de reportarse ante la Administración del Parque antes del ingreso al ASP.

El sistema auxiliar de reservaciones por la vía telefónica funcionará en el horario comprendido de lunes a viernes de ocho de la mañana al medio día y de la una a las cuatro de la tarde. No aplica para días feriados de ley o asuetos declarados por el Poder Ejecutivo.

Una vez puesto en vigencia el Sistema auxiliar, únicamente podrá reservarse hasta con un mes de anticipación para el ingreso al Parque Nacional Chirripó.

En el primero de los casos, deberá presentar nota donde indique los motivos para no usar el espacio, el nombre completo y número de identificación del cedente y de la persona a quien le cede la reservación y adjuntar copia legible del documento de identificación de ambos, firma y lugar o medio para recibir notificaciones.

En loscasos en que el banco cobre algún tipo de comisión por la transacción de la devolución, la misma se les rebajará del monto a devolver. El monto de la comisión será fijado por la entidad bancaria encargada de realizar la devolución correspondiente.

El usuario registrado quién acreditó el pago de la reservación, interesado en que se le haga devolución del dinero, deberá presentar una solicitud por escrito, debidamente firmada dirigida a la Administración del Parque indicando claramente que solicita la devolución del dinero, fecha, nombre y apellidos del solicitante, lugar o medio para recibir notificaciones, copia del documento de identificación y copia del comprobante de la reservación. La falta de firma producirá el rechazo de la solicitud y el archivo de la misma.

Debe hacerla llegar físicamente a la oficina administrativa del Parque Nacional Chirripó ubicada en San Gerardo de Rivas, Cantón de Pérez Zeledón, provincia de San José y mediante correo electrónico [email protected] y/o fax (506) 2742 50 85, la administración en un plazo no mayor a tres días hábiles confirmará la recepción de la solicitud, cuando se trate de medios electrónicos es responsabilidad del interesado constatar que la administración la recibió.

En el caso de solicitudes de devoluciones por concepto de alojamiento y otros Servicios no Esenciales, la Administración no será responsable y por lo tanto los interesados deberán someterse a las políticas definidas por el concesionario.

Para quienes deseen ingresar durante la madrugada o en las primeras horas de la mañana del día de ingreso, deberán registrarse el día antes en horario de ocho de la mañana a cuatro y treinta de la tarde.

Para quienes deseen ingresar el mismo día en que está autorizado su ingreso, deberán registrarse a partir de las ocho de la mañana y hasta las diez de la mañana. Por razones de seguridad no se permitirá el registro ni ingreso al Parque después de las diez de la mañana.

Para los turistas que ingresan por el sendero San Jerónimo - Sabana de Los Leones - Base Crestones deberán realizar el registro de ingreso al Parque antes de las cuatro y treinta del día anterior a su ingreso o hasta las diez de la mañana del mismo día de ingreso y lo hará en una bitácora que la administración le entregará a la Permisionaria, quién deberá entregar informes trimestrales.

De aprobarse a futuro otra ruta de acceso al Parque Nacional Chirripó mediante Permiso de uso, se definirá el procedimiento de registro de ingreso vía resolución administrativa.

Recibida la comunicación, el Director del ACLA-P instruirá mediante oficio al Administrador y al Encargado de Reservaciones del Parque Nacional Chirripó para que den inicio al sistema auxiliar de reservaciones.

La Administración dispondrá del tiempo necesario para resolver las fallas del sistema y en caso de imposibilidad de restablecerlo, podrá tomar la decisión de utilizar el sistema auxiliar de reservaciones por la vía telefónica.

Una vez resueltos los problemas del sistema de reservaciones en línea, el encargado de Tecnología de Información de la Secretaría Ejecutiva o del ACLA-P del Sistema Nacional de Áreas de Conservación, comunicará por oficio a la Dirección Regional del ACLA-P para que se retome el proceso de reservaciones en línea, quien a su vez hará las comunicaciones correspondientes.

Esto no aplica para los permisos de uso vigentes, ya que tienen un máximo permitido de dos noches y tres días.

En este caso deberá realizar el registro de permanencia ante el funcionario del SINAC destacado en Base Crestones y el Concesionario.

Este plazo de seis meses de antelación no opera en los casos en que entre en funcionamiento el sistema auxiliar de reservaciones mediante la vía telefónica.

Para ello, la Dirección del ACLA-P deberá coordinar con la Administración del Parque Nacional Chirripó, la asignación de los espacios con un mes de anticipación, de lo contrario la Administración del área protegida, pondrá los espacios a disposición de los usuarios a través del procedimiento autorizado.

10.-La Administración del Parque Nacional Chirripó dispondrá de 10 espacios diarios para los visitantes que deseen ingresar al parque solo por un día, por el sendero principal y que no requieren alojamiento en el Albergue Base Crestones, los cuales deberán desarrollar el procedimiento de reservaciones previo a su ingreso y de registro ante la Administración conforme a esta resolución.

(Así reformado el punto 10°) anterior mediante resolución N° SINAC-ACLA-P-D-047-2016 del 8 de febrero del 2016) 11.-El monto cancelado al SINAC por el derecho de admisión cubre únicamente el derecho de ingreso diario para cada persona al Parque Nacional Chirripó conforme a lo establecido en el decreto de tarifas vigente.

12.-Posterior al pago de la reservación, el servicio de alojamiento en el Albergue Crestones debe ser cancelado de forma directa al Concesionario mediante el proceso que establezcan para tal efecto. El monto que debe cancelar corresponde a la tarifa establecida en el contrato de Concesión de Servicios No Esenciales, y que podrá ser modificado por los mecanismos establecidos.

13.-Para las rutas autorizadas mediante permiso de uso y que se encuentren vigentes, además; del trámite indicado en el punto anterior con el Concesionario, deberán coordinar con la organización Permisionaria lo relacionado al pago por actividades ecoturísticas debidamente autorizadas.

14.-El usuario deberá pagar al Concesionario los derechos correspondientes al alojamiento en un plazo máximo de diez días naturales posteriores a la reservación, de lo contrario se cancelará la reservación de la admisión y el usuario deberá proceder a realizar la solicitud de reembolso del dinero pagado por derecho de admisión, dentro del plazo establecido según el decreto de tarifas.

(Así reformado el punto 14°) anterior mediante resolución N° SINAC-ACLA-P-D-047-2016 del 8 de febrero del 2016) 15.-El usuario que ingrese por las rutas autorizadas mediante permiso de uso deberá pagar los derechos de alojamiento al Concesionario ajustándose a lo que indica el punto anterior y los derechos por actividades ecoturísticas a la organización Permisionaria dentro de un plazo de diez días naturales posteriores a la reservación, bajo la advertencia de que se le cancelará el derecho de admisión si no lo hace y el usuario deberá proceder a realizar la solicitud de reembolso del dinero, en los plazos establecidos.

(Así reformado el punto 15°) anterior mediante resolución N° SINAC-ACLA-P-D-047-2016 del 8 de febrero del 2016) 16.-Ningún turista podrá ingresar después de las diez de la mañana al Parque Nacional Chirripó.

17.-El turista podrá ocupar la habitación correspondiente en el Albergue Crestones a partir de las doce mediodía (12:00 m.d) del día de ingreso.

18.-Los turistas deberán desocupar la habitación asignada en el Albergue Crestones antes de las once de la mañana (11:00 a.m).

19.-La exoneración del pago de derechos de admisión se podrá otorgar únicamente con base en lo establecido por el decreto ejecutivo que regula las tarifas de ingreso a las áreas silvestres protegidas. Todo interesado en ingresar exonerado al Parque Nacional Chirripó, estará sujeto a la disponibilidad de espacio que la Administración del Parque establezca en el Albergue Crestones y deberá aportar copia de la resolución que le autoriza su ingreso. Una vez obtenidos los espacios correspondientes ante la Administración del Parque Nacional Chirripó deberá cancelar ante el Concesionario y en las cuentas que ellos establezcan para tal fin, los derechos de alojamiento conforme se indica en esta resolución, en el caso que utilicen los servicios concesionados.

20.-Quien no acate las disposiciones antes mencionadas no podrá ingresar ni permanecer dentro del Parque Nacional Chirripó y en el Albergue Base Crestones. De igual manera, aquellos visitantes que con sus acciones vayan en contra de lo establecido en el Reglamento de Uso Público del Parque Nacional Chirripó, también serán expulsados del área protegida.

21.-El Área de Conservación La Amistad Pacífico se reserva el derecho de cerrar el ingreso de visitantes al Parque Nacional Chirripó, vía resolución administrativa motivada cuando lo considere pertinente. Para la realización de la Carrera anual Ecológica Cultural a campo traviesa del Chirripó, la Administración se reserva la totalidad de los espacios en el Albergue Base Crestones para el día previo y el día de la realización de la carrera.

22.-Todo visitante que permanezca dentro del Parque Nacional Chirripó, deberá demostrar la legitimidad de su permanencia durante su estadía, presentando un documento de identificación con fotografía y conforme a los medios de control que se establezcan.

23.-Contra la presente resolución proceden los recursos ordinarios de revocatoria y / o apelación, de conformidad con los artículos 343 y siguientes de la Ley General de la Administración Pública, los cuales serán resueltos, el de revocatoria por el mismo órgano que lo dictó y el de apelación por el Consejo Nacional de Áreas de Conservación. Los recursos deberán interponerse ante el órgano que dicta ésta resolución dentro de los tres días posteriores a su publicación.
