in the entirety of the text - Complete Text of Norm 39348 Internal Regulation on travel and transportation expenses for officials of the Ministry of Environment and Energy Complete Text record: 154ADC No. 39348-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In use of the powers conferred by Article 140, subsections 3 and 18 of the Political Constitution, Article 27, subsection 1) of the General Law of the Public Administration No. 6227 of May 2, 1978, the Law Regulating Travel Expenses and Expenses for Transportation for all State Officials, No. 3462 of November 26, 1964, and the Regulation on Travel and Transportation Expenses for Public Officials of May 10, 2001.
Considering:
4-DI-AA-2001 at three o'clock in the afternoon on the tenth day of May of two thousand one, states: "When the official needs to use collective public transportation services, the recognition of that payment shall be made in accordance with the fare authorized by the corresponding Regulatory Body. The use of taxi services at the beginning, during, or at the end of a field trip (gira) must be regulated, in a prior, formal, and general manner by the active Administration; otherwise, its payment shall not proceed."
Therefore, THEY DECREE:
Internal Regulation on travel and transportation expenses for officials of the Ministry of Environment and Energy
(Its name thus amended by Article 1 of Executive Decree No. 43743 of August 26, 2022. It was previously named: "Internal Regulation on the Use of Public Transportation for Officials of the Ministry of Environment and Energy")
On the nature and definition of the use of public transportation.
CHAPTER I
The Ministry of Environment and Energy shall have an internal regulation on transportation and travel expenses for its officials, which shall regulate:

The internal regulation is an instrument that regulates and supports the Executing Management, from its own operating budget, to contract, in an agile and expeditious manner, the public transportation services defined in Article 1, and which, due to their special characteristics, shall be executed through the ordinary transfer request procedure, which concludes the use of the public transportation service. These special characteristics are:
. In response to the duties of each official during special hours . In response to emergencies, and . Necessary contracts (Ferry or animals (semovientes)) for the transfer of officials and/or vehicles and equipment on scheduled field trips (giras).
The use of public transportation must respond to operational needs that justify its use.
There shall be no cap on the total amount that may be covered for the use of the public transportation service, but it shall be governed by the fares determined by the Regulatory Authorities.
. Transportation expenses (Gasto por transporte): Expenses intended to cover the use of public transportation (taxi, bus, train, ferry, or animals (semovientes)), during travel on official mission within the national territory.
. Hierarch (Jerarca): Refers to the hierarchical superior of any dependency of the ministry; who exercises the maximum authority within the organ or entity, whether unipersonal or collegiate.
. Public transportation (Transporte público): Corresponds to the contracting or use of taxi, bus, train, ferry, or animals (semovientes) services.
. Tolls (Peajes): Associated with the rate or tariff charged to a means of land transportation as a transit right, for using the infrastructure of the respective roadway. Payment for this concept shall be recognized by the ministry when travel is made in an official vehicle.
. Special Hours (Horario Especial): Special hours is understood as the transfer of officials to their workplaces, under conditions of necessity, in order to cover the service that must be provided by MINAE, 24 hours a day, and in special situations where, in the reasoned judgment of the Administration, the recognition and payment of per diem allowances (viáticos) is justified for any aspect not contemplated in this Regulation, and provided such situations meet the following requirements:
. Emergencies (Emergencias): Emergencies correspond to the support of the different activities carried out by the ministry and which, in the event of an unforeseen failure, outside normal hours in the different dependencies, could not have their repair postponed since their execution must be continuous, such as computer equipment, automatic stations, and any peripheral equipment related to Information Technologies, as well as when the country is under any of the alert levels established by the National Commission for Risk Management and Emergency Response (CNE) and the official must travel to cover any need that the situation warrants.
Per diem allowances (Viáticos): Is that sum intended to cover expenses for lodging, meals, and other minor expenses, which the Ministry of Environment and Energy recognizes to its servants when they must temporarily travel from their workplace in order to fulfill the obligations of their position.

The approval of this Regulation, its dissemination, and application is the power of the Minister of Environment and Energy.
The Legal Advisory Directorate of the Ministry of Environment and Energy is responsible for the periodic review and updating of this regulation, according to the needs that emerge from its application, within the framework of current legal provisions.

CHAPTER II
The approval procedure for the use of the public transportation service shall be as follows:
The amount authorized for the use of public transportation shall be related to the tariffs established by the corresponding Regulatory Authorities. Except in cases where the hierarch (jerarca) of each ministerial dependency authorizes higher amounts for duly justified needs.
Each hierarch (jerarca) of the dependencies of this ministry may empower the corresponding department heads to authorize the different expenditures for the use of Public Transportation; these being directly responsible for the proper use of the resources.
In the case of non-compliance with Article 10 of the Regulation on travel and transportation expenses for public officials issued by the Comptroller General of the Republic, specifically, when the official violates the settlement deadlines (whether or not advances of per diem allowances (viáticos) are involved) established in said regulation, the respective Program Head or the person formally authorized by them, must formally warn the official in writing one single time, and provide them with a period of three days to present the settlement. In the event that the official does not comply with the warning, the Program Head must demand, by formal notice, the immediate reimbursement of the entire sum received as an advance.
In the event that the official fails to comply with the previous warnings, the Program Head must, within a period of 5 days, request the corresponding administrative procedures from the Ministerial Hierarch (Jerarca Ministerial), for which they must transfer the case via formal notice with the justifications of fact and law, together with the administrative file created for the case, duly foliated and in strict chronological order, with the evidence for the case.

Final provisions
CHAPTER III
This provision regulates the payment of per diem allowances (viáticos) and transportation expenses to permanent or interim officials of the Ministry of Environment and Energy according to Articles 16, 17, and 24 of the Regulation on Travel and Transportation Expenses for Public Officials, issued by the Comptroller General of the Republic, by reason of which, per diem allowances (viáticos) may be covered for officials provided they meet the following conditions:
Every immediate head responsible for authorizing with their signature expenses provided for in this regulation shall be obliged to verify the veracity and justification of the authorized amounts and shall be jointly and severally liable for damages of any kind arising from the breach of said obligations.

Transfer expenses incurred by officials who must travel abroad, in fulfillment of official missions, shall be recognized, without needing to be included in the travel agreement, as transfer expenses from the officials' domicile to the air transport terminal and vice versa.
The approval of expenses for public transportation that officials must incur in the destination country (taxi, train, or bus), from the air transport terminal to the hotel or lodging site and vice versa, as well as transportation between cities, which are not covered by the financial aid provided by the Organizing Institutions, must be requested from the Hierarch (Jerarca) of the Ministry of Environment and Energy and included in the "Travel Agreement."

4-DI-AA- 2001 de las quince horas del día diez de mayo de dos mil uno, señala: "Cuando el funcionario necesite utilizar los servicios de transporte público colectivo, el reconocimiento de ese pago se hará de acuerdo con la tarifa autorizada por el Organismo Regulador correspondiente. La utilización de servicios de taxi al inicio, durante o finalización de una gira debe ser regulada, en forma previa, formal y general por la Administración activa, de los contrario no procede su pago".

De la naturaleza y definición del uso de transporte público.
DECRETAN:
CAPÍTULO I
El Ministerio del Ambiente y Energía, contará con un reglamento interno de gastos de transporte y viaje, para sus funcionarios, el cual regulará:
1. La utilización del servicio de taxi, autobuses y trenes en horarios especiales o en atención de emergencias.
2. La utilización de semovientes en las giras que se programen.
3. La utilización del servicio de transportes fluvial y marítimo.
4. El pago de tarifas por el uso de Peajes.
5. El pago de viáticos en el área metropolitana de San José y entre Cantones.
(Así reformado por el artículo 3° del decreto ejecutivo N° 43743 del 26 de agosto de 2022)

. Gasto por transporte: Gastos destinados a cubrir el uso de transporte público (taxi, autobús, tren, ferry o semovientes), durante el viaje en misión oficial dentro del territorio nacional.
. Jerarca: Se refiere al superior jerárquico de cualquier dependencia del ministerio; que ejerce la máxima autoridad dentro del órgano o ente, unipersonal o colegiado.
. Transporte público: Corresponde a la contratación o uso del servicio de taxi, autobús, tren, ferry o semovientes.
. Peajes: Se asocia con la tasa o tarifa que se cobra a un medio de transporte terrestre como derecho de tránsito, para utilizar la infraestructura de la respectiva vía de comunicación. El pago por este concepto será reconocido por el ministerio, cuando los viajes se realicen en vehículo oficial.
. Horario Especial: Se entiende como horario especial, el traslado de los funcionarios a sus lugares de trabajo, bajo condiciones de necesidad, con el fin de cubrir el servicio que se debe prestar por parte del MINAE, las 24 horas y en situaciones especiales en que, en criterio razonado de la Administración, se justifique el reconocimiento y pago de viáticos, sobre cualquier aspecto no contemplado en este Reglamento y que tales situaciones cumplan con los siguientes requisitos:
. Emergencias: Las emergencias corresponden al soporte de las diferentes actividades que realiza el ministerio y que ante un fallo imprevisto, fuera de horario normal en las diferentes dependencias, no podría posponerse la reparación ya que su ejecución debe ser continua, como lo es equipos de cómputo, estaciones automáticas y cualquier equipo periférico relacionado con Tecnologías de la Información, así como cuando se encuentre el país en cualquiera de los niveles de alerta que establezca la Comisión Nacional de Gestión del Riesgo y Atención de Emergencias (CNE) y el funcionario tenga que desplazarse para cubrir cualquier necesidad que la situación amerite.
Viáticos: Es aquella suma destinada a la atención de gastos de hospedaje, alimentación y otros gastos menores, que el Ministerio de Ambiente y Energía reconoce a sus servidores cuando éstos deban desplazarse en forma transitoria de su centro de trabajo con el fin de cumplir con las obligaciones de su cargo.

Es facultad de Ministro de Ambiente y Energía la aprobación del presente Reglamento, difundirlo y aplicarlo.
La Dirección de Asesoría Legal del Ministerio de Ambiente y Energía, es responsable de la revisión y actualización periódica del presente reglamento, según las necesidades que emerjan de su aplicación, en el marco de las disposiciones legales vigentes.
Cualquier funcionario del MINAE debidamente autorizado por la jefatura correspondiente.
. Formulario "Liquidación de gastos de transporte y otros gastos en el interior del País" . Reserva de Recursos . Informe de gira . Facturas cuando corresponda (comprobantes del uso de Peaje)
Del uso, aprobación, funcionamiento, deberes y responsabilidades.
CAPÍTULO II
El trámite de aprobación del uso del servicio de transporte público, será el siguiente:
El monto autorizado para el uso de transporte público, estará relacionado con las tarifas establecidas por las Autoridades Reguladoras correspondientes. Salvo los casos en que el jerarca de cada dependencia ministerial autorice montos mayores ante necesidades debidamente justificadas.
Cada jerarca de las dependencias de este ministerio, podrá facultar a las jefaturas correspondientes, para que autoricen los diferentes egresos por el uso de Transporte Público; siendo estos, los responsables directos del buen uso de los recursos.
Para el caso del incumplimiento del artículo 10 del Reglamento de gastos de viaje y de transporte para funcionarios públicos emitido por la Contraloría General de la República, específicamente, cuando el funcionario transgreda los plazos de liquidación (se trate o no de adelantos de viáticos) establecidos en dicha reglamentación, el Jefe de Programa respectivo o la persona a quien este autorice formalmente, deberá apercibirle mediante escrito por una única vez, y brindarle un plazo de tres días, para que presente la liquidación, En caso de que el funcionario no atienda el apercibimiento, el Jefe de Programa deberá exigirle mediante nota formal, el reintegro inmediato de la totalidad de la suma recibida en calidad de adelanto.
En caso de que el funcionario incumpla con los anteriores apercibimientos, el Jefe de Programa deberá en el plazo de 5 días, solicitar al Jerarca Ministerial los procedimientos administrativos que correspondan, para lo cual, deberá hacer el traslado mediante nota formal con las justificaciones de hecho y de Derecho, junto con el expediente administrativo levantado para el caso, debidamente foliado y en estricto orden cronológico, con las pruebas del caso.

CAPÍTULO III
La presente disposición regula el pago de viáticos y gastos de transporte a los funcionarios en propiedad o interinos del Ministerio de Ambiente y Energía según los artículos 16, 17 y 24 del Reglamento de Gastos de Viaje y Transporte para Funcionarios Públicos, emitido por la Contraloría General de la República, en razón del cual, se podrán cubrir viáticos a los funcionarios siempre y cuando cumpla con las siguientes condiciones:
Todo Jefe inmediato encargado de autorizar con su firma gastos previstos en el presente reglamento, estará obligado a constatar la veracidad y justificación de los montos autorizados y será solidariamente responsable por los perjuicios de cualquier índole que se deriven del incumplimiento de dichas obligaciones.

Los gastos de traslado que incurran los funcionarios que deban viajar fuera del país, en cumplimiento de misiones oficiales, se reconocerán, sin necesidad de incluirse en el acuerdo de viaje, los gastos de traslado desde el domicilio de los funcionarios hasta la terminal de transporte aérea y viceversa.
La aprobación de los gastos por transporte público, que los funcionarios deban incurrir en el país de destino (taxi, tren o autobús), de la terminal de transporte aérea hasta el hotel o sitio de hospedaje y viceversa, así como el transporte entre ciudades, que no estén contemplados en la ayuda económica que brindan las Instituciones Organizadoras, deberá ser solicitada ante el Jerarca del Ministerio de Ambiente y Energía, e incluirse en el "Acuerdo de Viaje".
