in the entirety of the text - Complete Text of Regulation 39263 Declares of public interest and national convenience the Project for Improvements to the Nicoya Aqueduct Complete Text record: 107FED No. 39263 MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by articles 11, 140 subsections 3) and 18) and 146 of the Political Constitution and numeral 27 of the General Law of Public Administration No. 6227 of May 2, 1978 and article 19 subsection b) of the Forest Law (Ley Forestal) No. 7575 of February 13, 1996 and article 2 subsection m) of Executive Decree No. 25721-MINAE, of October 17, 1996.
I.-That the Costa Rican Institute of Aqueducts and Sewers, hereinafter AyA, in order to fulfill the Mission of "Regulating and guaranteeing potable water, sanitary sewerage and treatment services according to the requirements of society and our clients, contributing to the economic and social development of the country" signed Loan Contract 1725 with the Central American Bank for Economic Integration (BCIE), on March 26, 2008.
For this purpose, through Agreement No. 2009-239, session No. 2009-029 ordinary, dated 05-19-2009, the Board of Directors of AyA agrees: 1- The Executing Unit AYA/BCIE is hereby constituted, "Supply Program for the Metropolitan Area of San José, Urban Aqueducts and Sanitary Sewerage of Puerto Viejo de Limón, financed with BCIE LOAN 1725", a Unit that will depend directly on the Executive Presidency of AYA.
The Supply Program for the Metropolitan Area of San José, Urban Aqueducts and Sanitary Sewerage of Puerto Viejo de Limón, financed with BCIE LOAN 1725, carries out investments in potable water supply works throughout the country; a component for the protection of producing watersheds at the national level and a sanitary sewerage project in a coastal tourist locality. The execution of this Program will provide direct benefit to the population located in the Metropolitan Area of San José and to a total of 19 cities including 3 important coastal tourist localities, among which the city of Nicoya is included.
II.-That due to the severe drought caused by the ENSO (El Niño - Southern Oscillation) phenomenon, precipitation has significantly decreased throughout the province of Guanacaste, seriously affecting the entire Chorotega region. Due to the foregoing, the Executive Branch issues, through Decree No. 38642-MP-MAG, the state of emergency in the cantons of the entire Guanacastecan province.
III.-That due to this phenomenon, the canton of Nicoya has very limited resources to supply potable water to the Nicoyan city, so the population's quality of life has been seriously affected due to the shortage of this vital resource.
IV.-Therefore, through the Program, AYA will carry out the Project for Improvements to the Nicoya Aqueduct, Guanacaste (BCIE), which includes the enabling of two wells in the Varillal zone with a flow rate of 25 l/s and the construction of a Storage Tank. This project comes to supply the present and future need regarding production and storage of the potable water supply system for the City of Nicoya and neighboring towns.
V.-The geographical position of the existing and future production sources for the Nicoya Aqueduct, whether wells or surface intakes; place the lot where the storage tank will be built at an ideal point to guarantee the operational functionality of the System.
VI.-That through Agreement No. 2011-113 of the Board of Directors of AyA, published in La Gaceta No. 80 of Wednesday, April 27, 2011, p. 55; the relevant portion states:
8th-That the indicated acquisition is of evident public interest, for the fulfillment of institutional purposes. Therefore:
Based on articles 45 and 50 of the Political Constitution and the Constitutive Law of AyA, Law No. 6313 on Acquisitions, Expropriations and Constitution of Easements (Servidumbres), applicable to AyA, by mandate of Law No. 6622, it is agreed:
1. To declare of public utility and social necessity the acquisition of a lot with a total area of 16276.00 square meters, for the construction of a storage tank, for the project "Improvements to the Nicoya Aqueduct, as part of the Potable Water Supply Program being carried out by AyA with financing through a loan from BCIE.
According to the plan surveyed by the Topography Department of AyA, cadastrally registered under No. G-1449043-2010, the lot to be acquired is part of the property registered in the party of Guanacaste, in the Public Registry under the Real Folio System No. 083377-000, with a total area according to the registry of 507061.07 square meters, owned by the Administrative Board of the Professional Technical Agricultural College of Nicoya (Junta Administradora del Colegio Técnico Profesional Agropecuario de Nicoya), legal identification number No. 3-008-084986.
VII.-The National Environmental Technical Secretariat (SETENA) granted environmental feasibility to AyA through resolution No. 0780-2013-SETENA of 9:50 hours on March 20, 2013.
VIII.-That article 19, subsection b) of the Forest Law No. 7575 prohibits land-use change (cambio de uso de suelo) on lands covered by forest, excepting those state or private projects that the Executive Branch declares of National Convenience.
IX.-That article 3 subsection m) of the Forest Law No. 7575 declares as activities of national convenience those carried out by centralized dependencies of the State, autonomous institutions or private companies, whose social benefits are greater than the socio-environmental costs.
X.-In article 2 of the Regulation to the Forest Law, Executive Decree No. 25721-MINAE indicates as an activity of national convenience those related to the study and execution of projects or activities of public interest carried out by centralized dependencies of the State, autonomous institutions or private enterprise, that provide benefits to all or a large part of society and among them is the supply service of water suitable for human consumption to the entire population of the country. Based on this declaration, the Costa Rican Institute of Aqueducts and Sewers can proceed to request authorization for land-use change. Considering:
7575 of February 13, 1996 and article 2, subsection m of Executive Decree No. 25721-MINAE, of October 17, 1996, AyA must process the corresponding authorizations from the Nicoya Subregional Office of the Tempisque Conservation Area, of the National System of Conservation Areas.
This action and those derived from it shall be resolved in coordination with said office, which for its part shall certify compliance with the foregoing.

text-indent:24.0pt'>I.-Que el Instituto Costarricense de Acueductos y Alcantarillado, en adelante AyA, con el fin de cumplir con la Misión de "Normar y garantizar los servicios de agua potable, alcantarillado sanitario y tratamiento según los requerimientos de la sociedad y de nuestros clientes, contribuyendo al desarrollo económico y social del país" firmó el Contrato Préstamo 1725 con el Banco Centroamericano de Integración Económica (BCIE), el 26 de marzo del 2008.
Para ello mediante el Acuerdo N° 2009-239, sesión N° 2009- 029 ordinaria, de fecha 19-05-2009, la Junta Directiva del AyA acuerda: 1- Se tiene por constituida la Unidad Ejecutora AYA/BCIE, "Programa de Abastecimiento del Área Metropolitana de San José, Acueductos Urbanos y Alcantarillado Sanitario de Puerto Viejo de Limón, financiado con el PRÉSTAMO BCIE 1725", Unidad que dependerá directamente de la Presidencia Ejecutiva de AYA.
El Programa de Abastecimiento del Área Metropolitana de San José, Acueductos Urbanos y Alcantarillado Sanitario de Puerto Viejo de Limón, financiado con el PRÉSTAMO BCIE 1725, realiza inversiones en obras de abastecimiento de agua potable en todo el país; un componente de protección de las cuencas productoras a nivel nacional y un proyecto de alcantarillado sanitario en una localidad turística costera. La ejecución de este Programa brindará beneficio directo a la población localizada en el Área Metropolitana de San José y a un total de 19 ciudades que incluye 3 importantes localidades turísticas costeras, dentro de las cuales está incluida la ciudad de Nicoya.
II.-Que debido a la fuerte sequía ocasionada por el fenómeno ENOS (El Niño - Oscilación Sur), han disminuido significativamente las precipitaciones en toda la provincia de Guanacaste, afectando seriamente toda la región Chorotega. Debido a lo anterior, el Poder Ejecutivo emite mediante Decreto N° 38642-MP-MAG el estado de emergencia en los cantones de toda la provincia Guanacasteca.
III.-Que debido a este fenómeno el cantón de Nicoya cuenta con recursos muy limitados para proveer de agua potable a la ciudad Nicoyana, por lo que la calidad de vida de la población se ha visto seriamente afectada debido al faltante de este vital recurso.
IV.-Por ello, a través del Programa, el AYA llevará a cabo el Proyecto de Mejoras al Acueducto de Nicoya, Guanacaste (BCIE), que incluye la habilitación de dos pozos en la zona de Varillal con un caudal de 25 l/s y la construcción de un Tanque de Almacenamiento. Este proyecto viene a suplir la necesidad presente y futura en lo que corresponde a producción y almacenamiento del Sistema de abastecimiento de agua potable de la Ciudad de Nicoya y poblados vecinos.
V.-La posición geográfica de las fuentes de producción existentes y futuras para el Acueducto de Nicoya, ya sean pozos o tomas superficiales; ubican al lote donde se construirá el tanque de almacenamiento en un punto idóneo para garantizar la funcionalidad operativa del Sistema.
VI.-Que mediante el Acuerdo Nº 2011-113 de la Junta Directiva del AyA, publicado en La Gaceta Nº 80 del miércoles 27 de abril del 2011, pág. 55; se señala en lo conducente:
Con fundamento en el artículo 45 y 50 de la Constitución Política y la Ley Constitutiva de AyA, Ley Nº 6313 de Adquisiciones, Expropiaciones y Constitución de Servidumbres, aplicable a AyA, por mandato de la Ley Nº 6622, se acuerda:
1. Declarar de utilidad pública y necesidad social la adquisición de un lote con un área total de 16276,00 metros cuadrados, para la construcción de un tanque de almacenamiento, para el proyecto "Mejoras del Acueducto de Nicoya, como parte del Programa de Abastecimiento de Agua Potable que está llevando a cabo el AyA con financiamiento mediante préstamo del BCIE.
Conforme al plano levantado por del Departamento de Topografía de AyA, catastrado bajo el Nº G-1449043-2010, el lote que se debe adquirir es parte de la finca inscrita en el partido de Guanacaste, del Registro Público al Sistema de Folio Real Nº 083377-000, con un área total según registro de 507061,07 metros cuadrados, propiedad de la Junta Administradora del Colegio Técnico Profesional Agropecuario de Nicoya, cédula jurídica Nº 3-008-084986.
VII.-La Secretaría Técnica Nacional Ambiental (SETENA) otorgó la viabilidad ambiental al AyA mediante resolución Nº 0780-2013-SETENA de las 9:50 horas del día 20 de marzo del 2013.
VIII.-Que el artículo 19, inciso b) de la Ley Forestal Nº 7575 prohíbe el cambio de uso de suelo en terrenos cubiertos de bosque, exceptuando aquellos proyectos estatales o privados que el Poder Ejecutivo declare de Conveniencia Nacional.
IX.-Que el artículo 3 inciso m) de la Ley Forestal Nº 7575 declara como actividades de conveniencia nacional las realizadas por las dependencias centralizadas del Estado, instituciones autónomas o empresas privadas, cuyos beneficios sociales sean mayores a los costos socio-ambientales.
X.-En el artículo 2 del Reglamento a la Ley Forestal, Decreto Ejecutivo Nº 25721-MINAE se indica como actividad de conveniencia nacional a aquellas relacionadas con el estudio y ejecución de proyectos o actividades de interés público efectuadas por las dependencias centralizadas del Estado, las instituciones autónomas o la empresa privada, que brindan beneficios a toda o gran parte de la sociedad y entre ellas se encuentra el servicio de abastecimiento de agua apta para consumo humano a toda la población del país. Con base en esta declaratoria, el Instituto Costarricense de Acueductos y Alcantarillados puede proceder a solicitar la autorización para el cambio de uso del suelo. Por tanto,
