I.-That Law No. 8839, Law for Integrated Waste Management, in its Article 28 establishes the obligation for all Public Administration institutions to implement environmental management systems (sistemas de gestión ambiental) in all their offices.
II.-That the General Regulation to the Law for Integrated Waste Management in its Article 27 indicates that Public Administration institutions, in order to comply with Article 28 of Law No. 8839, must prepare and implement Institutional Environmental Management Programs (Programas de Gestión Ambiental Institucional), as established in the Regulation for the Preparation of Institutional Environmental Management Programs in the Public Sector of Costa Rica, Executive Decree No. 36499.
III.-That Executive Decree No. 36499, "Regulation for the preparation of Institutional Environmental Management Programs in the Public Sector of Costa Rica," defines its scope, procedures to be followed by public institutions, as well as follow-up mechanisms by the Ministry of Environment and Energy and the Ministry of Health, through the Technical Evaluation Commission (Comisión Técnica Evaluadora) of the Institutional Environmental Management Programs.
IV.-That in accordance with public spending reduction measures and the provisions of Law No. 8292, "General Internal Control Law" of July 31, 2002, the Costa Rican public sector must improve efficiency in the administration of diverse resources, seeking savings and making efficient use of water, electricity, fuel, and paper, among others. It is also committed to reducing the negative environmental impacts generated by its own actions.
V.-That according to the agreement reached in session 02-2015 of the Sectoral Council for Environment, Energy, Seas, and Territorial Planning, of March 3, 2015, which was duly communicated to all heads of institutions on April 15, 2015, a 6-month deadline was given for public institutions to become current with the preparation, submission, and implementation of the Institutional Environmental Management Program (PGAI) before the Directorate of Environmental Quality Management (DIGECA).
VI.-That according to the record of ordinary session number forty-six of the Governing Council held on April 14, 2015, it was agreed that with the objective of meeting the goal that each institution develop and implement its institutional environmental management plan (PGAI), the Minister of Environment and Energy and his team are commissioned to prepare a directive addressed to the Central Government, which includes a contingency plan with practical measures of what must be done to comply with this.
Therefore, they issue the following:
DIRECTIVE ADDRESSED TO ALL HEADS OF INSTITUTIONS OF THE CENTRAL GOVERNMENT WITH THE PURPOSE OF IMPROVING PERFORMANCE IN THE IMPLEMENTATION OF INSTITUTIONAL ENVIRONMENTAL MANAGEMENT PROGRAMS

I.-Que la Ley N° 8839 Ley para la Gestión Integral de Residuos en su artículo 28 establece la obligatoriedad a todas las instituciones de la Administración Pública, de implementar sistemas de gestión ambiental en todas sus dependencias.
II.-Que el Reglamento General a la Ley para la Gestión Integral de Residuos en su artículo 27 indica que las instituciones de la Administración Pública, para cumplir el artículo 28 de la Ley N° 8839, deben elaborar e implementar Programas de Gestión Ambiental Institucional, tal como se establece en el Reglamento para la Elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica, Decreto Ejecutivo N° 36499.
III.-Que el Decreto Ejecutivo N° 36499 "Reglamento para la elaboración de los Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica" define su alcance, procedimientos a seguir por parte de las instituciones públicas, así como los mecanismos de seguimiento por parte del Ministerio de Ambiente y Energía y el Ministerio de Salud, a través de la Comisión Técnica Evaluadora de los Programas de Gestión Ambiental Institucional.
IV.-Que en concordancia con las medidas de reducción en el gasto público y lo establecido en la Ley N° 8292, "Ley General de Control Interno" del 31 de julio de 2002, el sector público costarricense debe mejorar la eficiencia en la administración de los diversos recursos, procurando ahorros y haciendo un uso eficiente del agua, la electricidad, el combustible y el papel, entre otros. Asimismo está comprometido en la reducción de los impactos ambientales negativos que genera su propio accionar.
V.-Que según el acuerdo tomado en la sesión 02-2015 del Consejo Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial, del 3 de marzo del 2015, el cual fue debidamente comunicado a todos los jerarcas el día 15 abril del 2015, se dio un plazo de 6 meses para que las instituciones públicas se pongan al día con la elaboración, entrega e implementación del Programa de Gestión Ambiental Institucional (PGAI) ante la Dirección de Gestión de la Calidad Ambiental (DIGECA) VI.-Que según el acta de sesión ordinaria número cuarenta y seis del Consejo de Gobierno celebrada el 14 de abril del 2015 se acuerda que con el objetivo de cumplir con la meta de que cada institución desarrolle e implemente su plan de gestión ambiental institucional (PGAI) se comisiona al Ministro de Ambiente y Energía y a su equipo preparar una directriz dirigida al Gobierno Central, que incluya un plan de contingencia con medidas prácticas de lo que se debe hacer para cumplir con ello.
Por tanto, emiten la siguiente:
