Regulation for the Request, Sale, Delivery, and Transport of Non-Metallic Materials Extracted from the Public-Domain Bed of the Térraba RiverReglamento para la Solicitud, Venta, Entrega y Traslado de Materiales No Metálicos Extraídos del Cauce del Río Térraba

This Regulation is enacted and based upon the provisions of Articles 38, 40, 49, and 55 of the Mining Code and its Regulations and Resolution No. R-071-2013-Minaet of the Ministry of Environment, Energy and Telecommunications, according to administrative file 20-2011.

For the purposes of this Regulation, the following terms shall be used:

• 1)Sand (Arena): Fine granular material having a maximum dimension of 0.478 cm, resulting from the natural disintegration or artificial grinding of rocks.
• 2)Public domain riverbed (Cauce de dominio público): The riverbed or channel (álveo o cauce) of a river or stream is understood to be the land covered by its waters during the largest ordinary floods.
• 3)Concession (Concesión): A legal act of the State Administration granting a limited real right, enforceable against third parties, over public property.
• 4)Concessionaire or permit holder (Concesionario o permisionario): A natural or legal person, whether national or foreign and duly registered in the country, to whom the State has granted an exploitation concession (concesión de explotación) as a temporary holder of those rights, under the conditions and requirements established by the Mining Code, its Regulations, and other related laws.
• 5)Exploitation (Explotación): Extraction of minerals from a deposit according to surface or underground mining techniques.
• 6)Mechanized extraction (Extracción mecanizada): Extraction carried out with machinery, such as a loader, tractor, dredge, backhoe, or others.
• 7)Gravel (Grava): Granular material retained on a No. 04 Sieve (0.478 cm), resulting from the natural disintegration and abrasion or artificial crushing of rocks.
• 8)Ballast (Lastre): A combination of poor-quality granular materials (gravel and sand) used in civil works.
• 9)Extracted cubic meter (Metro cúbico extraído): The result of extracting material from the bank or from the riverbed.
• 10)Permit (Permiso): A legal act of the Public Administration granting a right of use of public property, assertable even against third parties.
• 11)Stone (Piedra): A product resulting from the natural or artificial breaking of rocks or large stones, where some of its faces are the result of said action.
• 12)Applicant (Solicitante): A natural or legal person requesting the sale of materials from the Municipality of Osa.
• 13)Market value (Valor de mercado): Refers to the price a consumer would be willing to pay per cubic meter of extracted material. It is understood that this cubic meter is the result of the extraction of material from the bank or riverbed.
• 14)Mineral materials: Cubic meters of gravel, sand, stone, ballasts.

General Aspects of the Sale of Non-Metallic Materials Extracted from the Public Domain Riverbed of the Térraba River

Likewise, said form may be downloaded from the municipality's website or requested and submitted at the municipal services platform.

Along with the submission of the form, they must provide a document indicating the machinery to be used for the extraction of material, as this information must be communicated to Geologías Minas.

A change in the maximum limit shall be varied when the Municipal Council deems it appropriate, provided that such action is justified in the interest of the Administration's interests. The use of a percentage of material for the administration, for the purpose of meeting the Canton's needs, must also be considered.

After this time has elapsed, the delivery of the material shall be subject to the scheduling established by the Municipality according to its particular needs.

Therefore, the user who makes and pays the first purchase request reserves the right to the percentage of the purchased material solely during the period and under the conditions established in Article 8 of this regulation, and the second user shall have access to the purchase of the remaining material, and so on.

In the same manner, any anomalous situation arising at the time of material delivery must be coordinated with the person in charge so that the delivery is completed satisfactorily.

For the purposes of compliance with this article, the Mayor shall designate an official to control the delivery of the sold material.

Obtaining and Donating Non-Metallic Materials Extracted from the Public Domain Riverbed of the Térraba River

The Municipality may donate a maximum of 500 cubic meters annually to Comprehensive Development Associations (Asociaciones de Desarrollo Integral), District Councils (Concejos de Distritos), Road Committees (Comité de Caminos), and any other legally recognized social organization, provided that the materials are for a public purpose of social interest and non-profit.

Said request must be accompanied by the detail of the amount of material to be used, the works to be developed with the requested material, the public interest to be achieved, and the approval (visto bueno) of the Engineer in charge of the Department of the Municipal Road Management Technical Unit (Unidad Técnica de Gestión Vial Municipal). Likewise, all documents to be presented must be signed by the legal representatives of each institution. Only the Municipal Council, through an agreement taken and firmly approved, may authorize the Municipal Administration to donate the requested materials (stone, gravel, sand, and ballast).

Payment and Update of the Price of Non-Metallic Materials per Cubic Meter

- From 1 m³ to 500 m³, a price of $4.00 USD (Four dollars) shall be charged per cubic meter of material. - From 501 m³ to 10,000 m³, a price of $2.50 USD (Two dollars and fifty cents) shall be charged per cubic meter of material. - From 10,001 m³ to 20,000 m³, a price of $1.00 USD (One dollar) shall be charged per cubic meter of material. - From 20,001 m³ onwards, a price of $0.90 USD (Ninety dollar cents) shall be charged per cubic meter of material.

Said price shall be paid at the colones exchange rate on the day of purchase and applies to any of the following materials: sand, stone, ballast, and gravel.

General Provisions

In the same way, the criteria of social equity, environmental sustainability (sostenibilidad ambiental), energy conservation, and economic efficiency, defined in the National Development Plan, shall be considered, according to Article 31 of the Law of the Regulatory Authority of Public Services.

Para los efectos del presente Reglamento, se utilizarán los siguientes términos:

• 2)Cauce de dominio público: Se entiende por álveo o cauce de un río o arroyo, el terreno que cubren sus aguas en las mayores crecidas ordinarias.
• 3)Concesión: Acto jurídico de la Administración del Estado que otorga un derecho real limitado y oponible a terceros, sobre bienes públicos.
• 4)Concesionario o permisionario: Persona física o jurídica, legal o extranjera debidamente inscrita en el país a quien el Estado le ha otorgado una concesión de requisitos que establece el Código de Minería, su Reglamento y demás leyes relacionadas.
• 5)Explotación: Extracción de minerales de un yacimiento de acuerdo a técnicas mineras de superficie o subterráneas.
• 6)Extracción mecanizada: La que se lleva a cabo con maquinaria, tales como cargador, tractor, draga, retroexcavador u otras.
• 7)Grava: Material granular retenido a partir del Tamiz N° 04 (0,478 cm) y resulta de la desintegración natural y abrasión o trituración artificial de rocas.
• 8)Lastre: Combinación de materiales granulares (grava y arena) de mala calidad, utilizada en obras civiles.
• 9)Metro cúbico extraído: Es el resultado de la extracción del material en banco o en cauce.
• 10)Permiso: Acto jurídico de la Administración pública que otorga un derecho de uso de los bienes públicos, alegable incluso ante terceros.
• 11)Piedra: Producto que resulta de la quiebra natural o artificial de rocas o grandes piedras y que algunas de sus caras son el resultado de la acción citada 12) Solicitante: Persona física o jurídica que solicita la venta de los materiales por parte de la Municipalidad de Osa.
• 13)Valor de mercado: Se refiere al precio que estaría dispuesto a pagar el consumidor por metro cúbico de material extraído. En el entendido que este metro cúbico es el resultado de la extracción de material en banco o en cauce.
• 14)Materiales minerales: Metros cúbicos de grava, arena, piedra, lastres.

Aspectos generales de la venta de materiales no metálicos extraídos del cauce de dominio público sobre el Río Térraba

Adjunto a la entrega del formulario deberán entregar documento que indique la maquinaria que utilizaran para efectos de la extracción de material, pues esta información deberá estar siendo comunicada a Geologías Minas

Transcurrido este tiempo, la entrega del material se somete a la programación que la Municipalidad establezca de acuerdo a sus necesidades particulares.

De la misma manera deberá de coordinar con el encargado cualquier situación anómala que se presente al momento de la entrega del material, con el propósito de que se realice la entrega satisfactoriamente.

Que para los efectos del cumplimiento de este artículo el Alcalde designara a un funcionario el control de la entrega del material vendido

Obtención y donación de los materiales no metálicos extraídos del cauce de dominio público sobre el Río Térraba

La Municipalidad podrá donar un máximo de 500 metros cúbicos anuales a las Asociaciones de Desarrollo Integral, Concejos de Distritos, Comité de Caminos y cualquier otra organización social legalmente reconocida, siempre y cuando los materiales sean para un fin público de interés social y sin fines de lucro.

Únicamente el Concejo Municipal mediante acuerdo tomado y aprobado en firme podrá autorizar a la administración Municipal la donación de los materiales solicitados (piedra, grava, arena y lastre).

Pago y actualización del precio de los materiales no metálicos por metro cúbico

- De 1 m³ a 500 m³ se cobrará un precio de $4,00 USD (Cuatro dólares) por cada metro cúbico de material.

- De 501 m³ a 10.000 m³ se cobrará un precio de $2,50 USD (Dos dólares con cincuenta centavos) por cada metro cúbico de material.

- De 10.001 m³ a 20.000 m³ se cobrará un precio de $1,00 USD (Un dólar) por cada metro cúbico de material.

- De 20.001 m³ en adelante se cobrará un precio de $0,90 (Noventa centavos de dólar) por cada metro cúbico de material.

Dicho precio se cancelará al tipo de cambio en colones del día de la compra y aplica para cualquiera de los siguientes materiales: arena, piedra, lastre y grava.

No obstante el sistema exige una numeración consecutiva por lo que se creó el mismo pero sin texto)
