- a)Provide the solid waste collection service in an accessible, periodic, and efficient manner for all users.
- b)The vehicles used for waste collection must be correct for the type of waste they collect and be duly identified. The vehicles must have the following characteristics:
1. For the collection of recoverable and non-recoverable waste, non-traditional or bulky waste, electronic waste, scrap and metal waste: A non-compacting truck with a covered cargo bed, adequate load capacity for the transport needs, sealed to prevent the leakage of solids and liquids onto the public road, and compliance with other requirements established in current legislation.
- c)Collection officials must, at all times during the execution of their duties, have adequate occupational safety implements such as: gloves, comfortable non-slip shoes, long pants, and have a fire extinguisher and an appropriate first-aid kit available in the vehicle.
- d)Guarantee collection in the area under its responsibility. The frequency of collection is decided by mutual agreement with municipal officials. The collector may be the Municipality or a private company to which a concession was granted; preference will be given to social and charitable organizations that qualify as an organization with business capacity. However, the responsibility to the user remains with the Municipality.
- e)If the collector is a private company, it must:
1. Adopt the municipal segregated collection system if one exists, and this must be stipulated in the contract, comply with vehicle and occupational safety requirements, and everything stipulated in this regulation and binding legislation.
2. Be duly registered and authorized by the Ministry of Health.
3. Every collector, without exception, to carry out these tasks in the canton, must be registered and authorized with the Municipality. The registration will be valid for twelve months, and to renew its status as an authorized collector, it must deliver in writing at least one month in advance: the collection agreements with users, a collection service plan, communication lines available for users and the municipality, and a certified copy by a notary public of the destination of the valued recyclables in the twelve months of prior service, backed by sales invoices.
4. Provide semi-annual reports on the manner of service execution, indicate the weights of the materials collected, the exact address for the treatment or final disposal (disposición final) of the collected waste, and deliver documents certifying the above.
5. Comply with the following requirements: workers' compensation insurance (póliza de riesgos del trabajo), a property or building with a current sanitary operating permit, being licensed and up-to-date with municipal taxes, being up-to-date with employer obligations to the CCSS.
- f)The private collector will lose authorization to provide the service without legal or economic responsibility for the Municipality if: it changes address without reporting it; does not maintain an efficient communication line with the Municipality and users; ceases to be up-to-date with the Ministry of Health, the Municipality, the CCSS, or the INS; three proven and justified complaints are received for incorrect management of collected waste, neglect, or mistreatment of users; if the registered collection truck(s) do not maintain the characteristics required for their operation. In case of committing any of the cited faults, a period of six months will be given to correct the situation and the respective documentation before the Municipality.
- g)In the event that waste is left scattered on the public road at the time of collection, the Municipality or the responsible company must pick it up and deposit it in the collection truck; as well as take any other appropriate means to prevent contamination.
