1. 1That Law No. 8436, Fisheries and Aquaculture Law, of April 25, 2005 establishes in Article 13 that INCOPESCA shall exercise control over fishing and aquaculture activities carried out in marine and inland waters and shall provide technical assistance to aquaculture activities in continental and marine waters. In continental waters, the protection of aquatic resources shall correspond to MINAE.
2. 2That Article 38 of the cited Law establishes that INCOPESCA shall determine the prohibited methods, techniques, equipment, and fishing gear.
3. 3That Article 72 of Law 7384 establishes that INCOPESCA shall promote the conservation of species of sport interest, carrying out technical and scientific studies and promoting sustainable management policies, and Article 73 indicates that INCOPESCA shall establish the fees, seasons, zones, and minimum sizes, as well as the maximum number of specimens that a sport fisher may catch, in accordance with the conditions of the resource in question and the particular characteristics of the place where the activity is carried out.
4. 4That the Bobo fish (Joturus pichardi, Poey 1860) is geographically distributed on the Caribbean Slope from Mexico to Panama.
5. 5That in Costa Rica its existence has been documented in the rivers of the Atlantic and Northern Zone (Bussing 2002), inhabiting the rapid and torrential sectors of the rivers.
6. 6That in the Sarapiquí River, of Costa Rica, an abundance of sexually mature individuals has been reported for the month of October and a decrease in the same for the month of September (Villalobos and Molina 2005).
7. 7That based on the considerations enumerated above, the Board of Directors, Therefore,

AGREES:

1º-A closed season is established for sport and tourism fishing of the bobo fish Joturus pichardi, Poey 1860, in the Pacuare river basin, during the month of October of every year.

2º-In periods outside the closed season established in the preceding article, only fishing with rods and reels and handline is permitted as fishing gear for the bobo fish, Joturus Pichardi, Poey 1860.

3º-Firm Agreement

Considering:

1. 1Que la Ley N° 8436, Ley de Pesca y Acuicultura, del 25 de abril del 2005 establece en el artículo 13 que el INCOPESCA ejercerá el control de la actividad pesquera y acuícola que se realice en aguas marinas e interiores y brindará asistencia técnica a la actividad acuícola en aguas continentales y marinas. En aguas continentales la protección de los recursos acuáticos le corresponderá al MINAE.
2. 2Que en el artículo 38 de la citada Ley, se establece que el INCOPESCA determinará los métodos, las técnicas, los equipos y las artes de pesca prohibidas.
3. 3Que el artículo 72 de la Ley 7384 establece que el INCOPESCA impulsará la conservación de especies de interés deportivo, realizando estudios técnicos y científicos y promoviendo políticas de manejo sostenibles y en artículo 73 se indica que el INCOPESCA establecerá los cánones, las épocas, las zonas y las tallas mínimas, así como el número máximo de ejemplares que pueda capturar un pescador deportivo, de acuerdo con las condiciones del recurso de que se trate y las características particulares del lugar en donde se desarrolle la actividad.
4. 4Que el pez Bobo (Joturus pichardi, Poey 1860) se distribuye geográficamente en la Vertiente del Caribe desde México hasta Panamá.
5. 5Que en Costa Rica se tiene documentada su existencia en los ríos del Atlántico y Zona Norte (Bussing 2002), habitando los sectores rápidos y torrentosos de los ríos
6. 6Que en el río Sarapiquí, de Costa Rica, se ha reportado abundancia de individuos maduros sexualmente para el mes de octubre y una disminución de la misma en el mes de setiembre, (Villalobos y Molina 2005).
7. 7Que con base a las consideraciones anteriormente enumeradas, la Junta Directiva, Por tanto,

ACUERDA:

1º-Se establece veda para la pesca deportiva y turística del pez bobo Joturus pichardi, Poey 1860, en la cuenca del rio Pacuare, durante el mes de octubre de todos los años.

2º-En periodos fuera de veda establecida en el artículo anterior, sólo se permite como artes de pesca para el pez bobo, Joturus Pichardi, Poey 1860, la pesca con cañas y carretes y cuerda de mano.

3º-Acuerdo Firme
