ANNOUNCES:

1. 1That the Osa Conservation Area verified and certified the existence of the estuary (ría) in the Uvita River located in district 4° Bahía Ballena, canton 5° Osa, province 06° Puntarenas, the official technical data of the work have been registered according to official communication SINAC-ACOSA-PNE-AD-041-14 of February 27, 2014, from the State Natural Heritage unit (PNE-OT) of ACOSA, and certification SINAC-ACOSA-PNE-089 of 10:00 a.m. on March 24, 2015, issued by the Directorate of ACOSA.
2. 2That the georeferenced digital delimitation methodology employed by the Osa Conservation Area is in accordance with Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone" of June 28, 2011, and the technical criteria of the National Geographic Institute, to delimit the public zone of the Maritime Terrestrial Zone corresponding to the estuaries (rías) of the streams and rivers of the cantons of Osa, Golfito, and Corredores of the province of Puntarenas, given that some sectors of the estuaries (rías) located in the aforementioned cantons are—as of the date of signing of this notice—not totally delimited through the placement of boundary markers (mojones) made official via the respective publication in the official newspaper La Gaceta.
3. 3That the sectors of estuaries (rías) of the streams and rivers of the cantons of Osa, Golfito, and Corredores of the province of Puntarenas, which are delimited with placement of boundary markers (mojones) made official via the respective publication in the Official Newspaper La Gaceta, maintain their condition unchanged.
4. 4That the public zone of the Maritime Terrestrial Zone corresponding to the estuary (ría) of the Uvita River in the canton of Osa, province of Puntarenas, verified and delimited by the Osa Conservation Area and the National Geographic Institute, corresponds to a Sector of tidal influence (afectación mareal) whose coordinates of the endpoint "upstream (aguas arriba)" are indicated in the official cartographic projection system of Costa Rica CRTM05, and as a reference in the Lambert Sur projection, as follows:

5º-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone, the estuary (ría) of the Uvita River in the canton of Osa, province of Puntarenas, have been registered in the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).—San José, June 19, 2015.

en la totalidad del texto - Texto Completo Norma 05 Delimitación de la zona pública de la Zona Marítimo terrestre correspondiente a la ría del río Uvita Texto Completo acta: 1052BD INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO text-align:center'>AVISO N° 2015-05 ZONA MARÍTIMA TERRESTRE Delimitación de la zona pública de la Zona Marítimo Terrestre correspondiente a la ría del río Uvita text-indent:35.4pt'>De conformidad con lo dispuesto en el artículo 63 del Reglamento de la Ley Nº 6043 sobre la Zona Marítimo Terrestre del 2 de marzo de 1977, el concepto de ría que se encuentra en artículo 69 de la Ley de Aguas N° 276 del 27 de agosto de 1942, las recomendaciones técnicas del Decreto Ejecutivo N° 36786-MINAET del 12 de agosto de 2011, y la promulgación del decreto ejecutivo sobre humedales nacionales N° 35803-MINAET del 7 de enero 2010, el Instituto Geográfico Nacional.

COMUNICA:

1. 1Que el Área de Conservación Osa verificó y certificó la existencia de la ría en el río Uvita ubicada en el distrito 4° Bahía Ballena, cantón 5° Osa, provincia 06° Puntarenas, los datos técnicos oficiales del trabajo han quedado registrados según oficio SINAC-ACOSA-PNE-AD-041-14 del 27 de febrero de 2014 de unidad Patrimonio Natural del Estado (PNE-OT) de ACOSA, y la certificación SINAC-ACOSA-PNE-089 de las 10 horas del día 24 de marzo del 2015 emitida por la Dirección de ACOSA.
2. 2Que la metodología de delimitación digital georreferenciada empleada por el Área de Conservación Osa es conforme con el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre" del 28 de junio del 2011, y los criterios técnicos del Instituto Geográfico Nacional, para delimitar la zona pública de la Zona Marítimo Terrestre correspondiente a las rías de las quebradas y ríos de los cantones de Osa, Golfito y Corredores de la provincia de Puntarenas, dado que algunos sectores de las rías localizadas en los cantones antes citados a la fecha de firma del presente aviso- no están delimitados totalmente a través de la colocación de mojones oficializados vía respectiva publicación en el diario oficial La Gaceta.
3. 3Que los sectores de rías de las quebradas y ríos de los cantones de Osa, Golfito y Corredores de la provincia de Puntarenas, que se encuentran delimitados con colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta mantienen su condición invariable.
4. 4Que zona pública de la Zona Marítimo Terrestre correspondiente a la ría del río Uvita del cantón de Osa, de la provincia de Puntarenas, verificada y delimitada por el Área de Conservación Osa y el Instituto Geográfico Nacional, corresponde a un Sector de afectación mareal cuyas coordenadas de punto extremo "aguas arriba" se indican en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, y como referencia en la proyección Lambert Sur, como sigue:

. Sector de ría del río Uvita, ubicada en el distrito 4° Bahía Ballena, cantón 5° Osa, provincia 06° Puntarenas (Mapa MBCR- 1/50.000 Hoja cartográfica Coronado 3443 II):

5º-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre, la ría del río Uvita del cantón de Osa, de la provincia de Puntarenas han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).-San José, 19 de junio de 2015.
