THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Exercising the powers conferred by Articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution, Articles 25, 27.1, 28.2b of Law Nº 6227 of May 2, 1978, General Law of Public Administration, Law Nº 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, and Law Nº 7664 of April 8, 1997, Plant Protection Law.

EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En ejercicio de las facultades que les confieren los artículos 140, incisos 3), 8), 18) y 20) y 146 de la Constitución Política, los artículos 25, 27.1, 28.2b de la Ley Nº 6227 del 2 de mayo de 1978, Ley General de la Administración Pública, de la Ley Nº 7064 del 29 de abril de 1987, Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, y la Ley Nº 7664 del 8 de abril de 1997, Ley de Protección Fitosanitaria.

Considerando:

Dado en la Presidencia de la República.-San José, a los veintinueve días del mes de junio del dos mil quince.

Artículo 1 — That it is an essential function of the State to protect the health and life of people and animals, as well as to guarantee the protection of crops from pests and diseases that may endanger or cause damage to agricultural production.

Artículo 3 — That the pest known as Xylella fastidiosa, according to technical reports and studies carried out by the State Phytosanitary Service, is a pest that is distributed throughout the national territory, which is of quarantine importance for many of the trading partner countries.

Artículo 5 — That it is necessary to provide official support to producers, both for the application of corrective phytosanitary protection measures and so that plantations continue generating jobs and thus prevent unemployment in our country.

Artículo 6 — That the Executive Branch, upon prior recommendation of the State Phytosanitary Service, may declare a phytosanitary emergency status when there are pests or diseases of importance that constitute or represent a threat to the national economy.

Artículo 1 — Hereby declared a National Phytosanitary Emergency Status due to the increase of the pest known as Xylella fastidiosa.

Artículo 2 — Every producer, exporter, or occupant of land under any title is obligated to report the presence of the pest to the State Phytosanitary Service.
