in the entirety of the text - Complete Text of Norm 39058 Declares a National Phytosanitary Emergency Status due to the increase of the pest known as Xylella fastidiosa Complete Text of act: 158D4C Nº 39058-MAG (This executive decree was repealed by Article 2 of Executive Decree N° 43922 of December 2, 2022) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Exercising the powers conferred by Articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution, Articles 25, 27.1, 28.2b of Law Nº 6227 of May 2, 1978, General Law of Public Administration, Law Nº 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, and Law Nº 7664 of April 8, 1997, Plant Protection Law.

1. 1That it is an essential function of the State to protect the health and life of people and animals, as well as to guarantee the protection of crops from pests and diseases that may endanger or cause damage to agricultural production.
2. 2That it is the responsibility of the Ministry of Agriculture and Livestock, through the State Phytosanitary Service, to ensure the phytosanitary protection of crops in our country, ordering, once the existence of a pest or disease is verified, the technical and control measures to prevent their spread.
3. 3That the pest known as Xylella fastidiosa, according to technical reports and studies carried out by the State Phytosanitary Service, is a pest that is distributed throughout the national territory, which is of quarantine importance for many of the trading partner countries.
4. 4That in November 2014, the European Union detected ornamental coffee plants with the presence of the bacteria; in addition to the direct damage to crops, due to its quarantine condition, it constitutes a barrier to the export of a large number of products to various countries around the world, and therefore its management must be maintained under State control.
5. 5That it is necessary to provide official support to producers, both for the application of corrective phytosanitary protection measures and so that plantations continue generating jobs and thus prevent unemployment in our country.
6. 6That the Executive Branch, upon prior recommendation of the State Phytosanitary Service, may declare a phytosanitary emergency status when there are pests or diseases of importance that constitute or represent a threat to the national economy. Therefore,

PHYTOSANITARY EMERGENCY STATUS DUE TO THE DETECTION OF XYLELLA FASTIDIOSA IN ORNAMENTAL PLANTS FOR PLANTING IN MEMBER COUNTRIES OF THE EUROPEAN UNION (Previous title corrected via Errata, and published in La Gaceta N° 142 page 108. Previously it stated: "PHYTOSANITARY EMERGENCY STATUS DUE TO THE DETECTION OF XYLELLA FASTIDIOSA IN ORNAMENTAL COFFEE PLANTS IN MEMBER COUNTRIES OF THE EUROPEAN UNION")

Whereas:

en la totalidad del texto - Texto Completo Norma 39058 Declara Estado de emergencia fitosanitaria nacional por el incremento de la plaga conocida como Xylella fastidiosa Texto Completo acta: 158D4C Nº 39058-MAG (Este decreto ejecutivo fue derogado por el artículo 2° del decreto ejecutivo N° 43922 del 2 de diciembre del 2022) EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En ejercicio de las facultades que les confieren los artículos 140, incisos 3), 8), 18) y 20) y 146 de la Constitución Política, los artículos 25, 27.1, 28.2b de la Ley Nº 6227 del 2 de mayo de 1978, Ley General de la Administración Pública, de la Ley Nº 7064 del 29 de abril de 1987, Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, y la Ley Nº 7664 del 8 de abril de 1997, Ley de Protección Fitosanitaria.

1. 1Que es función esencial del Estado proteger la salud y la vida de las personas y animales, así como garantizar la protección de los cultivos de las plagas y enfermedades que puedan poner en riesgo o causar daños a la producción agrícola.
2. 2Que corresponde al Ministerio de Agricultura y Ganadería a través del Servicio Fitosanitario del Estado velar por la protección fitosanitaria de los cultivos en nuestro país, disponiendo, una vez comprobada la existencia de una plaga o enfermedad, las medidas técnicas y de control que eviten la propagación de estas.
3. 3Que la plaga conocida como Xylella fastidiosa, según los informes técnicos y estudios realizados por el Servicio Fitosanitario del Estado es una plaga que se encuentra distribuida en el territorio nacional, la cual es de importancia cuarentenaria para muchos de los países socios comerciales.
4. 4Que en noviembre del año 2014, la Unión Europea detectó plantas ornamentales de café con presencia de la bacteria, además de los daños directos a los cultivos, por su condición cuarentenaria constituye una barrera para la exportación de gran cantidad de productos a varios países del mundo, por lo que se debe mantener su manejo bajo control del Estado.
5. 5Que es necesario brindar el apoyo oficial a los productores, tanto para la aplicación de medidas correctivas de protección fitosanitaria, como para que las plantaciones sigan generando empleos y evitar con esto la desocupación en nuestro país.
6. 6Que el Poder Ejecutivo, previa recomendación del Servicio Fitosanitario del Estado, podrá decretar estado de emergencia fitosanitaria, cuando existan plagas o enfermedades de importancia, que constituyan o representen una amenaza para la economía nacional, Por tanto,
