It shall be effective upon its publication.

Draft "Tariff System Regulation for the Charging of the Fee for the Ordinary Solid Waste Management Service of the Municipality of El Guarco" The Municipality of El Guarco, in exercise of the powers conferred by the Código Municipal, the Political Constitution, and the laws of the Republic of Costa Rica, establishes the following Tariff System Regulation for ordinary solid waste management, by different commercial categories.

Definitions

CHAPTER I

a)Estimated quantity of ordinary solid waste: average quantity of ordinary solid waste generated per week.
b)Commercial category: classification assigned to a taxpayer who carries out any for-profit activity, according to the range of the quantity of ordinary waste they generate per week.
c)Commerce: physical place organized for the purpose of developing productive and/or for-profit activities and where a license to exercise said activity exists.
d)Generation factor: The range in which a user is placed depending on the estimated quantity of ordinary solid waste produced per week, taking as a basis the estimated generation of ordinary solid waste for a residential or commercial unit.
e)Weighting factor: Equivalent units according to the generation of ordinary solid waste of a specific place, taking as a basis the estimated generation of ordinary solid waste for a residential unit.
f)Municipality: Municipality of El Guarco.
g)Fee for the collection and final disposal services of ordinary solid waste by category: Charge to the taxpayer in proportion to the estimated quantity of ordinary solid waste generated per week.

Any definition required shall be consulted in the Ley para la Gestión Integral de Residuos No. 8839 of July 13, 2010, and the Reglamento sobre el manejo de residuos sólidos ordinarios No. 36093-S of July 15, 2010.

In this study, at least 3 samplings must be carried out within a period of up to three months to calculate the estimated quantity of ordinary solid waste, without the possibility of the user finding out the date on which these samplings will be carried out. The study will be conducted for commercial and institutional categories, since the residential category is a single one.

In the residential tariff, the generation factor is 1.

In commercial tariff 1, the generation factor is 2.

In commercial tariff 2, the generation factor is 5.

In commercial tariff 3, the generation factor is 7.

In commercial tariff 4, the generation factor is 10.

In commercial tariff 5, the generation factor is 15.

In commercial tariff 6, the generation factor is 25.

For institutional tariff 1, the generation factor is taken as 2.

This includes all public educational centers, religious organizations, rehabilitation centers, comprehensive development associations, associations that administer community aqueducts, nursing homes, non-profit organizations, and any other institution of the same nature and similar conditions located within the coverage area of the collection service.

For institutional tariff 2, the generation factor is taken as 5.

This includes state banks, Instituto Nacional de Seguros, Acueductos y Alcantarillados, mutual associations, cooperatives, central government public offices, Instituto Costarricense de Electricidad, Caja Costarricense de Seguro Social, foundations, and any other institution of the same nature and similar conditions located within the coverage area of the collection service.

Disposal of Special Management Waste

8839 of July 13, 2010, the Reglamento sobre el manejo de residuos sólidos ordinarios No. 36093-S of July 15, 2010, and the Reglamento para la Declaratoria de Residuos de Manejo Especial No. 38272-S of January 7, 2014.

Claims

CHAPTER VII

a. The form duly filled out and signed by the owner and the license holder.

b. The photocopy of the identification card of the legal representative in the case of a legal entity, or the photocopy of the identity card in the case of a natural person.

c. In the case of a legal entity, certification of legal capacity (personería) issued no more than one month prior, if by a Notary Public, or according to the effective date determined by the National Registry.

d. The real estate declaration up to date.

Inclusion of New Services

CHAPTER VIII

This may be modified through a study when the administration considers that the assigned category differs from the estimated quantity of ordinary solid waste.

Modification and Exclusion of Services

CHAPTER IX

For the cancellation of the service or change of category, the owner must be current in all their municipal obligations.

Requirements to Request the Availability of the Ordinary Solid Waste Collection and Treatment Service

CHAPTER X

a. Be current with the payment of municipal taxes and services.

b. Have the real estate declaration up to date.

c. In the case of construction or expansion of a housing development, condominium, or industry, provide a copy of the preliminary project.

d. Fill out the service request form, which must contain the following data:

- Name of the project.

- Description of the project (number of residential units, commerces, or others).

- Exact address.

- Cadastral or property plan number.

- Name and telephone number of the applicant.

- Name and telephone number of the registered owner.

The availability of the service is subject to a technical study. It shall be effective upon its publication.

Proyecto de "Reglamento de Sistema Tarifario para el Cobro de la Tasa por el Servicio de Gestión de Residuos Sólidos Ordinarios de la Municipalidad de El Guarco" La Municipalidad de El Guarco en uso de las facultades que le confiere el Código Municipal, la Constitución Política y las leyes de la República de Costa Rica establece el siguiente Reglamento de sistema tarifario de gestión de residuos sólidos ordinarios, por diferentes categorías comerciales.

Definiciones

CAPÍTULO I

a)Cantidad estimada de residuos sólidos ordinarios: promedio de la cantidad de residuos sólidos ordinarios generada por semana.
b)Categoría comercial: clasificación atribuida a un contribuyente que realice alguna actividad lucrativa, de acuerdo al rango de cantidad de residuos ordinarios que genera por semana.
c)Comercio: lugar físico organizado con el fin de desarrollar actividades productivas y/o lucrativas y donde exista una licencia para ejercer dicha actividad.
d)Factor de generación: Es el rango en el que se ubica un usuario dependiendo de la cantidad estimada de residuos sólidos ordinarios producida por semana, tomando como base la generación de residuos sólidos ordinarios estimada para una unidad habitacional o comercial.
e)Factor de ponderación: Unidades equivalentes de acuerdo a la generación de residuos sólidos ordinarios de un determinado lugar, tomando como base la generación de residuos sólidos ordinarios estimada para una unidad habitacional.
f)Municipalidad: Municipalidad de El Guarco.
g)Tasa de los servicios de recolección y disposición final de residuos sólidos ordinarios por categoría: Cobro al contribuyente en proporción a la cantidad estimada de residuos sólidos ordinarios generada por semana.

Cualquier definición requerida se deberá consultar en la Ley para la Gestión Integral de Residuos N° 8839 del 13 de julio del 2010 y el Reglamento sobre el manejo de residuos sólidos ordinarios N° 36093-S del 15 de julio del 2010.

En este estudio se deberán realizar al menos 3 muestreos en el lapso de hasta tres meses para calcular la cantidad estimada de residuos sólidos ordinarios, sin que exista la posibilidad de que el usuario se entere de la fecha en que se realizarán estos muestreos. El estudio se realizará para las categorías comerciales e institucionales ya que la categoría residencial es única.

En la tarifa residencial el factor de generación es de 1.

En la tarifa comercial 1 el factor de generación es 2.

En la tarifa comercial 2 el factor de generación es 5.

En la tarifa comercial 3 el factor generación es 7.

En la tarifa comercial 4 el factor generación es 10.

En la tarifa comercial 5 el factor de generación es 15.

En la tarifa comercial 6 el factor de generación es 25.

Para la tarifa institucional 1se toma como factor de generación 2.

En esta se incluyen todos los centros educativos públicos, organizaciones religiosas, centros de rehabilitación, asociaciones de desarrollo integral, asociaciones administradoras de acueductos comunales, hogares de ancianos, organizaciones sin fines de lucro, cualquier otra institución de igual naturaleza y condiciones semejantes que se ubiquen dentro del área de cobertura del servicio de recolección.

Para la tarifa institucional 2 se toma como factor de generación 5.

En esta se incluyen los bancos estatales, Instituto Nacional de Seguros, Acueductos y Alcantarillados, mutuales, cooperativas, oficinas públicas del gobierno central, Instituto Costarricense de Electricidad, Caja Costarricense de Seguro Social, fundaciones, cualquier otra institución de igual naturaleza y condiciones semejantes que se ubiquen dentro del área de cobertura del servicio de recolección.

Disposición de residuos de manejo especial

Reclamos

CAPÍTULO VII

a. El formulario debidamente lleno y firmado por el propietario y el patentado.

b. La fotocopia de la cédula del representante legal en caso de persona jurídica o la fotocopia de la cédula de identidad en caso de persona física.

c. En caso de persona jurídica, certificación de personería con no más de un mes de emitida, si es de Notario Público, o bien según la fecha de vigencia que determine el Registro Nacional.

d. La declaración de Bienes Inmuebles al día.

Inclusión de nuevos servicios

CAPÍTULO VIII

Esta podrá ser modificada mediante estudio cuando la administración considere que la categoría asignada difiere de la cantidad estimada de residuos sólidos ordinarios.

Modificación y exclusión de servicios

CAPÍTULO IX

Para la cancelación del servicio o cambio de categoría el propietario deberá encontrarse al día en todas sus obligaciones municipales.

Requisitos para solicitar la disponibilidad del servicio de recolección y tratamiento de residuos sólidos ordinarios

CAPÍTULO X

a. Estar al día con el pago de impuestos y servicios municipales.

b. Tener la declaración de Bienes Inmuebles al día.

c. En caso de construcción o ampliación de urbanización, de condominio o industria, brindar una copia del anteproyecto.

d. Llenar el formulario de solicitud del servicio, el cual debe contener los siguientes datos:

- Nombre del proyecto.

- Descripción del proyecto (número de unidades habitacionales, comercios u otros).

- Dirección exacta.

- Número de plano catastro o finca.

- Nombre y teléfono del solicitante.

- Nombre y teléfono del propietario registral.

La disponibilidad del servicio queda sujeta a estudio técnico. Rige a partir de su publicación.

Tariff System Regulation for the Ordinary Solid Waste Management Service Fee of the Municipality of El GuarcoReglamento de Sistema Tarifario para el Cobro de la Tasa por el Servicio de Gestión de Residuos Sólidos Ordinarios de la Municipalidad de El Guarco

Artículo 1 — —For the purposes of this regulation, the following shall be understood as:

Artículo 2 — —Every owner of a residential, commercial, industrial, and institutional unit, of a public or private entity, located within the coverage area of the ordinary solid waste collection service must comply with this regulation.

Artículo 5 — —Each beneficiary of the solid waste collection service must notify the Municipality of the transfer or segregation (segregación) of the real estate, in order to update the beneficiary records that said institution keeps for this purpose.

Artículo 7 — —The municipality shall classify the different commerces and public or private entities into commercial categories, in proportion to the estimated quantity of waste they generate per week.

Artículo 8 — —The municipality may conduct a specific study for the users of the commercial service where it is considered that the quantity of ordinary solid waste generated per week is different from that established in the generation range where it was originally classified.

Artículo 9 — —The municipality, based on the specific study, may change the category of any user of the commercial service if the estimated quantity of ordinary solid waste is lower or higher than that established in the generation range where it was originally classified.

Artículo 10 — —25 kilograms per week is estimated as the average ordinary solid waste generation per residential unit in the canton of El Guarco.

Artículo 11 — —For the charging of the collection, disposal, and treatment fee, the following categories are established, which correspond to the generation factors:

Artículo 12 — —The residential tariff is taken as the fee to apply to every residential unit where the estimated quantity of ordinary solid waste is less than 25 kilograms per week.

Artículo 13 — —The commercial tariff 1 is taken as the fee to apply to any commerce where the estimated quantity of ordinary solid waste is less than 40 kilograms per week.

Artículo 14 — —The commercial tariff 2 is taken as the fee to apply to any commerce where the estimated quantity of ordinary solid waste ranges between more than 40 kilograms and up to 80 kilograms per week.

Artículo 15 — —The commercial tariff 3 is taken as the fee to apply to any commerce where the estimated quantity of ordinary solid waste ranges between more than 80 kilograms and up to 120 kilograms per week.

Artículo 16 — —The commercial tariff 4 is taken as the fee to apply to any commerce where the estimated quantity of ordinary solid waste ranges between more than 120 kilograms and up to 160 kilograms per week.

Artículo 17 — —The commercial tariff 5 is taken as the fee to apply to any commerce where the estimated quantity of ordinary solid waste ranges between more than 160 kilograms and up to 200 kilograms per week.

Artículo 18 — —The commercial tariff 6 is taken as the fee to apply to any commerce where the estimated quantity of ordinary solid waste per week is greater than 200 kilograms per week.

Artículo 19 — —The Institutional tariff 1 is taken as the fee to apply to the following public entities.

Artículo 20 — —The institutional tariff 2 is taken as the fee to apply to the following public entities.

Artículo 21 — —In any residential unit where a business license (patente) exists and a commercial activity is carried out within the same dwelling, the residential fee plus the commercial fee according to the category shall be charged, based on the estimated quantity of ordinary solid waste.

Artículo 22 — —Special management waste (residuos de manejo especial) shall be managed as established in the Ley para la Gestión Integral de Residuos No.

Artículo 24 — —For the filing of a claim, the municipality shall proceed to carry out the study described in Article 8 once all the requirements described in the following article are fulfilled.

Artículo 25 — —For the filing of a claim of this type, the interested party must be current in all their municipal obligations and present:

Artículo 26 — —For the inclusion of new services, the minimum category of the activity to which the commerce belongs shall be assigned.

Artículo 27 — —In the event of cancellation of the business license (patente), the user must also request the elimination of the solid waste collection service.

Artículo 29 — —In the event of requesting the availability of the collection and treatment service of solid waste for new urban development, commercial, industrial projects, and any other type of subdivision (fraccionamiento), the interested party must comply with the following requirements:

Artículo 1 — Para los efectos de este reglamento entiéndase por:

Artículo 2 — Todo propietario de unidad habitacional, comercial, industrial e institucional, de ente de carácter público o privado, que se encuentre dentro del área de cobertura del servicio de recolección de residuos sólidos ordinarios deberá de cumplir con el presente reglamento.

Artículo 5 — Cada beneficiario del servicio de recolección de desechos sólidos, debe comunicar a la Municipalidad, el traspaso o segregación de los inmuebles, a fin de poder actualizar los registros de beneficiarios que lleva al efecto dicha institución.

Artículo 7 — La municipalidad clasificará los distintos comercios y entes públicos o privados, en categorías comerciales, en proporción a la cantidad estimada de residuos que generan por semana.

Artículo 8 — La municipalidad podrá realizar un estudio específico para los usuarios del servicio comercial donde se considere que la cantidad de residuos sólidos ordinarios generados por semana sea diferente a la establecida en el rango de generación donde se clasificó originalmente.

Artículo 9 — La municipalidad con base en el estudio específico, podrá cambiar de categoría a cualquier usuario del servicio comercial, si la cantidad estimada de residuos sólidos ordinarios es inferior o superior a la establecida en el rango de generación donde se clasificó originalmente.

Artículo 10 — Se estima 25 kilogramos por semana como el promedio de generación de residuos sólidos ordinarios por unidad habitacional en el cantón de El Guarco.

Artículo 11 — Para el cobro de la tasa de recolección, disposición y tratamiento, se establecen las siguientes categorías las cuales corresponden a los factores de generación:

Artículo 12 — Se toma como tarifa residencial, la tasa a aplicar a toda unidad habitacional en donde la cantidad estimada de residuos sólidos ordinarios sea inferior a 25 kilogramos por semana.

Artículo 13 — Se toma como tarifa comercial 1, la tasa a aplicar a todo aquel comercio donde la cantidad estimada de residuos sólidos ordinarios sea inferior a 40 kilogramos por semana.

Artículo 14 — Se toma como tarifa comercial 2, la tasa a aplicar a todo aquel comercio donde la cantidad estimada de residuos sólidos ordinarios oscila entre más de 40 kilogramos y hasta 80 kilogramos por semana.

Artículo 15 — Se toma como tarifa comercial 3, la tasa a aplicar a todo aquel comercio donde la cantidad estimada de residuos sólidos ordinarios oscila entre más de 80 kilogramos y hasta 120 kilogramos por semana.

Artículo 16 — Se toma como tarifa comercial 4, la tasa a aplicar a todo aquel comercio donde la cantidad estimada de residuos sólidos ordinarios oscila entre más de 120 kilogramos y hasta 160 kilogramos por semana.

Artículo 17 — Se toma como tarifa comercial 5, la tasa a aplicar a todo aquel comercio donde la cantidad estimada de residuos sólidos ordinarios oscila entre más de 160 kilogramos y hasta 200 kilogramos por semana.

Artículo 18 — Se toma como tarifa comercial 6, la tasa a aplicar a todo aquel comercio donde la cantidad estimada de residuos sólidos ordinarios por semana que sea superior a 200 kilogramos por semana.

Artículo 19 — Se toma como tarifa Institucional 1, la tasa a aplicar a los siguientes entes de carácter público.

Artículo 20 — Se toma como tarifa institucional 2, la tasa a aplicar a los siguientes entes de carácter público.

Artículo 24 — Para la presentación de un reclamo, la municipalidad procederá a realizar el estudio descrito en el artículo 8 una vez que se cumplen con todos los requisitos descritos en el artículo siguiente.

Artículo 25 — Para la presentación de un reclamo de este tipo, el interesado deberá encontrarse al día en todas sus obligaciones municipales y presentar:

Artículo 26 — Para la inclusión de nuevos servicios, se atribuirá la categoría mínima de la actividad a la cual pertenece el comercio.

Artículo 27 — En caso de cancelación de la patente, el usuario deberá solicitar también la eliminación del servicio de recolección de residuos sólidos.

Artículo 29 — En caso de solicitar la disponibilidad del servicio de recolección y tratamiento de los residuos sólidos para nuevos proyectos urbanísticos, comerciales, industriales y cualquier otro tipo de fraccionamiento, el interesado deberá cumplir con los siguientes requisitos:
