IN THE FULL TEXT - Complete Text of Regulation 185 Establishes a total closure area comprised by an imaginary straight line that runs from Punta Torres known as Peñón to the Lighthouse of Isla Negritos offshore and to the eastern part of Punta Cuchillo on the Nicoya Peninsula and a closure for Semi-industrial shrimp fishing Complete Text of Record: 10433C COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/185-2015.-Puntarenas, on the twenty-fourth day of April, two thousand fifteen.

1º-The matter is submitted for consideration by the Members of the Board of Directors, for analysis, review, and approval, of official communication DGT-031-2015, through which Mr. Antonio Porras Porras, Technical Director General, forwards a closure proposal for the Gulf of Nicoya, adopted by the National Closures Commission, as agreed upon in meeting 02-2015, which is established as follows:

1. Establish a total closure in the area comprised by an imaginary straight line that runs from Punta Torres known as Peñón (84°43'52" West Longitude, 09°53'31" North Latitude) to the Lighthouse of Isla Negritos offshore (84°49'35" West Longitude, 09°49'14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula, from these lines inshore to the mouth of the Tempisque River. This fishing prohibition runs from May 15 to August 14, 2015, both dates inclusive.

2. Likewise, a closure is established for Semi-industrial shrimp trawling and sardine purse-seine (cerco) fishing, in the area comprised by an imaginary line that runs from the mouth of the Agujas River (84°39'15" West Longitude, 09°43'20" North Latitude) to the Lighthouse of Isla Negritos offshore (84°49'35" West Longitude, 09°49'14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula and from these lines inshore to the mouth of the Tempisque River; from May 15 to September 14, 2015, both dates inclusive.

3. Authorize the practice of sport fishing activity in the closed zone, from the shore, using rod, reel, and hand line.

4. Authorize the holding of sport and tourist fishing tournaments in the closure area, provided they have the authorization of the INCOPESCA Board of Directors.

1. 2That for their part, the Directors deem that while it is true the process followed for the preparation of this recommendation has included the participation of the sectors, which reinforces the establishment of the closure in the Gulf of Nicoya, within the highest reproductive peak of the species, there is also an interest in establishing a differentiation regarding the conduct of commercial fishing activity in relation to sport-tourist fishing, in addition to the need to guarantee sardine for bait.
2. 3That accordingly, the Board of Directors endorses the proposal forwarded by the Technical Director General, as a result of what was agreed by the National Closures Commission, adding to it the authorization for the development of sport and tourist fishing activities, as well as the capture of sardine solely for bait purposes for the fishing sector, for which reason the Board of Directors. Therefore,

AGREES:

1º-Establish a total closure in the area comprised by an imaginary straight line that runs from Punta Torres known as Peñón (84°43'52" West Longitude, 09°53'31" North Latitude) to the Lighthouse of Isla Negritos offshore (84°49'35" West Longitude, 09°49'14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula, from these lines inshore to the mouth of the Tempisque River. This fishing prohibition runs from May 15 to August 14, 2015, both dates inclusive.

2º-Likewise, a closure is established for Semi-industrial sardine purse-seine (cerco) fishing, in the area comprised by an imaginary line that runs from Punta Torres known as Peñón (84°43'52" West Longitude, 09°53'31" North Latitude) to the Lighthouse of Isla Negritos offshore (84°49'35" West Longitude, 09°49'14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula and from these lines inshore to the mouth of the Tempisque River. For Semi-industrial shrimp trawling fishing, the closure is established in the area comprised by an imaginary line that runs from the mouth of the Agujas River (84°39'15" West Longitude, 09°43'20" North Latitude) to the Lighthouse of Isla Negritos offshore (84°49'35" West Longitude, 09°49'14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula and from these lines inshore to the mouth of the Tempisque River. For both fleets, the closure shall cover from May 15 to September 14 of 2015, both dates inclusive.

(Thus amended the previous point by agreement AJDIP/219 of May 29, 2015) 3º-Authorize the practice of sport fishing activity in the closed zone, from the shore, using rod, reel, and hand line. Also authorized is sport and tourist fishing using only trolling as the fishing method and in the closure zone comprised between Punta Torres known as Peñón (84°43'52" West Longitude, 09°53'31" North Latitude) to the Lighthouse of Isla Negritos offshore (84°49'35" West Longitude, 09°49'14" North Latitude) and from there offshore.

4º-Authorize the holding of sport and tourist fishing tournaments in the closure area, provided they have the authorization of the INCOPESCA Board of Directors.

5º-The reference map is attached for illustrative purposes.

6º-Final agreement.

Considering:

1º-Se somete a consideración de los Sres. Miembros de Junta Directiva, para análisis, revisión y aprobación, el oficio DGT- 031-2015, mediante el cual el Sr. Antonio Porras Porras, Director General Técnico, remite propuesta de veda en el Golfo de Nicoya, adoptada por la Comisión Nacional de Veda, según lo acordado en reunión 02-2015, misma que se establece de la siguiente manera:

1. Establecer una veda total en el área comprendida por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (84°43´52" Longitud Oeste, 09°53¨31"Latinud Norte) al Faro de la Isla Negritos afuera (84°49´35" Longitud Oeste, 09°49´14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya, de estas líneas aguas adentro hasta la desembocadura del río Tempisque. Esta prohibición de pesca va desde el 15 de mayo hasta el 14 de agosto del 2015, ambas fechas incluidas.

2. Asimismo se establece una veda, para la pesca Semi-industrial camaronera de arrastre y sardinera bolichera (cerco), en el área comprendida por una línea imaginaria que va desde la desembocadura del río Agujas (84°39´15" Longitud Oeste, 09°43¨20"Latinud Norte) al Faro de la Isla Negritos afuera (84°49´35" Longitud Oeste, 09°49´14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya y de esta líneas aguas adentro hasta la desembocadura del río Tempisque; desde el 15 de mayo hasta el 14 de setiembre del 2015, ambas fechas incluidas.

3. Autorizar la realización de la actividad de pesca deportiva en zona vedada, desde la orilla, con el uso de caña, carrete y cuerda de mano.

4. Autorizar la realización de torneos de pesca deportiva y turística en el área de veda, que cuenten con la autorización de la Junta Directiva del INCOPESCA.

1. 2Que por su parte, los Sres. Directores estiman que si bien es cierto el proceso seguido para la elaboración de ésta recomendación ha contado con la participación de los sectores, lo cual refuerza el establecimiento de la veda en el Golfo de Nicoya, dentro del pico más alto de reproducción de las especies, también lo es el interés de establecer una diferenciación en cuanto al desarrollo de la actividad de pesca comercial con relación a la pesca deportiva-turística, además de la necesidad de garantizar sardina para carnada.
2. 3Que bajo ese giro, la Junta Directiva avala la propuesta remitida por el Director General Técnico, como resultado de lo acordado por la Comisión Nacional de Veda, adicionándole la autorización para el desarrollo de actividades de pesca deportiva y turística, así como la captura de sardina únicamente con fines de carnada para el sector pesquero, razón por la cual, la Junta Directiva. Por tanto,

ACUERDA:

1º-Establecer una veda total en el área comprendida por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (84°43´52" Longitud Oeste, 09°53¨31"Latinud Norte) al Faro de la Isla Negritos afuera (84°49´35" Longitud Oeste, 09°49´14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya, de estas líneas aguas adentro hasta la desembocadura del río Tempisque. Esta prohibición de pesca va desde el 15 de mayo hasta el 14 de agosto del 2015, ambas fechas incluidas.

2º-Asimismo se establece una veda para la pesca Semi-industrial sardinera bolichera (cerco), en el área comprendida por una línea imaginaria que va desde Punta Torres conocida como Peñón (84°43´52" Longitud oeste, 09°53¨31"Latinud Norte) al Faro de la Isla Negritos afuera (84°49´35" Longitud oeste, 09°49´14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya y de esta líneas aguas adentro hasta la desembocadura del Río Tempisque. Para la pesca Semi-industrial camaronera de arrastre se establece la veda en el área comprendida por una línea imaginaria que va desde la desembocadura del Rio Agujas (84°39´15" Longitud Oeste, 09°43¨20"Latinud Norte) al Faro de la Isla Negritos afuera (84°49´35" Longitud Oeste, 09°49´14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya y de esta líneas aguas adentro hasta la desembocadura del Río Tempisque. Para ambas flotas la veda comprenderá desde el 15 de mayo hasta el 14 de setiembre del 2015, ambas fechas incluidas.

(Así reformado el punto anterior por acuerdo AJDIP/219 del 29 de mayo de 2015) 3º-Autorizar la realización de la actividad de pesca deportiva en zona vedada, desde la orilla, con el uso de caña, carrete y cuerda de mano. También se autoriza la pesca deportiva y turística utilizando únicamente como método de pesca el troleo y en la zona de veda comprendida entre Punta Torres conocida como Peñón (84°43´52" Longitud Oeste, 09°53¨31"Latinud Norte) al Faro de la Isla Negritos afuera (84°49´35" Longitud Oeste, 09°49´14" Latitud Norte) y desde ahí aguas afuera.

4º-Autorizar la realización de torneos de pesca deportiva y turística en el área de veda, que cuenten con la autorización de la Junta Directiva del INCOPESCA.

5º-Se adjunta con fines ilustrativos el mapa de referencia.

6º-Acuerdo firme.

Considerando:
