throughout the entire text - Complete Text of Decree 38893 Revokes and voids Executive Decree No. 35864-J by which the Administrative Association of the Rural Aqueduct of Santa María, San Francisco, and Pilar de Cajón de Pérez Zeledón was declared of Public Utility Complete Text of record: 102D23 No. 38893-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Pursuant to the provisions of articles 140, subsection 18), and 146 of the Political Constitution, articles 13 and 32 of the Law of Associations No. 218, and articles 27 et seq. of its Regulation.
I.-That article 32 of the Law of Associations No. 218 of August eighth, nineteen thirty-nine, and its amendments, grants the Executive Branch the power to declare of Public Utility simple, federated, or confederated Associations whose development and activities are particularly useful to the interests of the State, and which thereby contribute to solving a social need, as well as to revoke this benefit if the reasons for which it was granted cease to exist.
II.-That the Costa Rican Institute of Aqueducts and Sewers ordered that the rural aqueduct associations of the district of Cajón de Pérez Zeledón were to merge.
III.-That the Administrative Association of the Rural Aqueduct of Santa María, San Francisco, and Pilar de Cajón de Pérez Zeledón, legal ID number 3-002-296515, was declared of public utility through Executive Decree No. 35864-J, published in the Official Gazette No. 66 of April 7, 2010, and is one of the Associations that was to merge.
IV.-That all the Rural Aqueduct Associations of Cajón de Pérez Zeledón were to merge and came into legal existence as the Administrative Association of the Aqueduct and Sanitary Sewer of the District of Cajón de Pérez Zeledón, legal ID number 3-002-238594.
V.-That in accordance with article 13 of the Law of Associations, the dissolution (extinción) of the Association is appropriate when it is materially and legally impossible to continue operating as an Association.
VI.-That the Administrative Association of the Aqueduct and Sanitary Sewer of the District of Cajón de Pérez Zeledón, legal ID number 3-002-238594, is applying for the Declaration of Public Utility before the Ministry of Justice and Peace.
VII.-That by virtue of the foregoing, the appropriate course is to revoke the declaration of public utility granted to the Administrative Association of the Rural Aqueduct of Santa María, San Francisco, and Pilar de Cajón de Pérez Zeledón, legal ID number 3-002-296515, issued through Executive Decree No. 35864-J, published in La Gaceta No. 66 of April 7, 2010. Enacted at the Presidency of the Republic.-San José, on the twenty-seventh day of November, two thousand fourteen.

I.-Que el artículo 32 de la Ley de Asociaciones N° 218 de ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social, así como revocar este beneficio, si desaparecen los motivos por los cuales fue concedido.
II.-Que el Instituto Costarricense de Acueductos y Alcantarillados dispuso que las Asociaciones de acueductos rurales del distrito de Cajón de Pérez Zeledón debieron fusionarse.
III.-Que la Asociación Administrativa del Acueducto Rural de Santa María, San Francisco y Pilar de Cajón de Pérez Zeledón, cédula jurídica N° 3-002-296515, fue declarada de utilidad pública mediante Decreto Ejecutivo N° 35864-J, publicado en el Diario Oficial N° 66 de 7 de abril del 2010 y es una de las Asociaciones que debió fusionarse.
IV.-Que todas las Asociaciones de Acueductos Rurales de Cajón de Pérez Zeledón, debieron fusionarse, y nacieron a la vida jurídica como Asociación Administradora del Acueducto y Alcantarillado Sanitario del Distrito de Cajón de Pérez Zeledón, cédula jurídica N° 3-002-238594.
V.-Que de conformidad con el artículo 13 de la Ley de Asociaciones la extinción de la Asociación procede cuando sea materialmente y legalmente imposible continuar operando como Asociación.
VI.-Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Distrito de Cajón de Pérez Zeledón, cédula jurídica N° 3-002-238594, se encuentra solicitando la Declaratoria de Utilidad Pública ante el Ministerio de Justicia y Paz.
VII.-Que en virtud de lo anterior, lo procedente es revocar la declaratoria de utilidad pública otorgada a la Asociación Administrativa del Acueducto Rural de Santa María, San Francisco y Pilar de Cajón de Pérez Zeledón, cédula jurídica N° 3-002-296515, emitida mediante el Decreto Ejecutivo N° 35864-J, publicado en La Gaceta N° 66 del 7 de abril del 2010.
