in the entirety of the text - Complete Text of Regulation 38712 Imposition of aqueduct easement on property in the Guanacaste district under registration N° 017733-000 Complete Text of record: 102190 N° 38712-MGP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF GOVERNANCE AND POLICE Based on Article 146 of the Political Constitution, Articles 99 and following of the Water Law No. 276 of August 27, 1942 and its amendments, Article 383 and following and concordant articles of the Civil Code.
I.-That by resolution No. R-054-2007-AGUAS-MINAE of February 5, 2007, the Water Department of the Ministry of Environment and Energy granted a water use concession (aprovechamiento de aguas), for a ten-year term, in the name of Comercial Oropéndula de Veracruz S. A., legal ID No. 3-101- 053949-23, for use on its property (inmueble) registered under Real Folio Registration 5-12838-000, with the water capture (captación) taking place on property owned by Ganadera Abancari S.R.L. (farm No. 5-17733-000). Folio 19.
II.-That by resolution No. R-0541-2009-AGUAS-MINAET at 10:15 a.m. on July 13, 2009, the Water Department of the Ministry of Environment, Energy and Telecommunications approved the transfer of the water use concession to the name of Agroturismo Brisas del Lago Sociedad Anónima. The foregoing because it is indicated "that from the provided registry certification it was demonstrated that the farm in favor of which the transfer is sought, farm Real Folio 124739-000, has as its prior title (antecedente de dominio) the farm to which the concession was originally granted, that is, farm Real Folio 12838-000. Folio 23.
III.-That Mr. Ezzio Segnini Lamas, representative of the company Agroturismo Brisas del Lago S. A., filed a request for imposition of an aqueduct easement (servidumbre de acueducto) on farm 17733- 000, Guanacaste district, before this Office, in compliance with the provisions of the Water Law No. 276 of August 27, 1942 and its amendments. Folio 1.
IV.-That by resolution No. 840-2010-DMG at 10:00 a.m. on March 24, 2010, of the Ministry of Governance and Police (the body designated to carry out the proceedings for the imposition of aqueduct easements) grants a hearing to the representative of the respondent servient tenement (fundo sirviente) so that within 30 days following notification of this resolution, they may assert their rights, offer evidence, and indicate a place and/or means for receiving notifications. Folio 54. That the representation of the company Ganadera Abancari S.R.L. responded in this regard.
V.-That after resolving prior situations (nullities) that led to the rectification of the procedure, this by resolutions No. 264-2012-DMG, (folio 294) No. 265-2012-DMG (folio 300) as well as No. 484-2012-DMG, (folio 294), by resolution No. 571-2012-DMG (folio 324) the oppositions of Ganadera Abancari S.R.L. were rejected, continuing with the proceedings for the forced imposition of easement initiated by Agroturismo Brisas del Lago S. A.
VI.-That by official letter DAJG-255-2014 of March 13, 2014, issued by the Legal Advisory Directorate of the Ministry of Governance and Police, the parties were informed of Appraisal (Avalúo) AA-010-2014 dated February 12, 2014, carried out by the Expert Appraiser (Perito Valuador), Eng. José Luis Palacios Alvarado, file No. 002-2013 of the Administrative Valuation Area, of the Regional Ministry of Finance of Puntarenas. Folio 407. Likewise, by official letter 427-2014- DAJG, of May 9, 2014, from that same Directorate, the company Ganadera Abancari S.R.L. is informed that, according to the aforementioned appraisal, it must indicate the account number and Bank so that the company Agroturismo Brisas del Lago S. A. may proceed to make the deposit for the concept of compensation (indemnización) for the imposition of the water easement. Folio 423.
VII.-That by official letter 562-2014-DAJG, of June 10, 2014, the Legal Advisory Directorate of the Ministry of Governance and Police indicates that the deposit has already been made according to the appraisal rendered by the Valuations Department of the Ministry of Finance, for the amount of compensation corresponding to the owner of the servient tenement, which amounts to the sum of ¢187,170.52. Said sum was paid by deposit No. 02789714 into account No. 100-01-142-000529-7 of the Banco Nacional de Costa Rica and in the name of Forestal Río Grande Sociedad Anónima, as requested by the representative of the company Ganadera Abancari S.R.L. Folio 430.
VIII.-That in accordance with the studies carried out by the Ministry of Governance and Police and the water use concession granted by resolution No. R-054- 2007-AGUAS-MINAE of February 5, 2007, cited in the first considering clause of this decree, Articles 99 and following of the Water Law No. 276 of August 27, 1942 and its amendments, and Article 383 and following of the Civil Code, it is appropriate to decree the constitution of the corresponding aqueduct easement.
Therefore, they decree:
IMPOSITION OF AQUEDUCT EASEMENT ON PROPERTY IN THE GUANACASTE DISTRICT UNDER REGISTRATION N° 017733-000
Considering:
Boundaries: to the north, with Hacienda La Trampa Limitada; to the south, public road with 1684 m 5 cm other; to the east, public road 1674 m 5 cm; to the west, with Hacienda La Trampa Limitada. The farm described above belongs to the company Ganadera Abancari S.R.L., and the easement (servidumbre) shall be in favor of the farm of the Guanacaste district 124739-000 owned by Agroturismo Brisas del Lago S. A.
The easement to be established is an aqueduct easement, consisting of a strip of land whose purpose is the passage of an underground aqueduct and the construction of an adjacent water intake tank (tanque de toma de agua), and within the same width of the easement right it will serve as a maintenance access for the aqueduct infrastructure. It is located in the province (05) Guanacaste, canton (07) Abangares, district (003) San Juan. In the sector known as Vainilla, between geographic coordinates 244-246 north latitude and 431-433 west longitude, of the Juntas cartographic sheet, of the Instituto Geográfico Nacional, scale 1:50000. The property to be assessed on which the easement will be established is a vacant strip of land with an average length of 52.00 meters and an estimated width of 3.00 meters with an area of 160 square meters, it is elongated in shape and is located internally towards the southeast end of the farm.

I.-Que mediante resolución N° R-054-2007-AGUAS-MINAE del 5 de febrero del 2007, el Departamento de Aguas del Ministerio de Ambiente y Energía, otorgó concesión de aprovechamiento de aguas, por un plazo de diez años, a nombre de Comercial Oropéndula de Veracruz S. A., cédula jurídica N° 3-101- 053949-23, para utilizarla en su inmueble inscrito bajo matrícula de Folio Real 5-12838-000, realizando la captación en propiedad de Ganadera Abancari S.R.L. (finca N° 5-17733-000). Folio 19.
II.-Que mediante resolución N° R-0541-2009-AGUAS-MINAET de las 10:15 horas del 13 de julio del 2009, el Departamento de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones aprobó el traspaso de la concesión de aprovechamiento de aguas a nombre de Agroturismo Brisas del Lago Sociedad Anónima. Lo anterior por cuanto se indica "que de la certificación registral aportada se demostró que la finca a favor de la cual se pretende que se otorgue el traspaso, finca Folio Real 124739-000 tiene como antecedente de dominio la finca a la que se otorgó originalmente la concesión es decir, la finca Folio Real 12838-000. Folio 23.
III.-Que el señor Ezzio Segnini Lamas, representante de la empresa Agroturismo Brisas del Lago S. A. presentó solicitud de imposición de servidumbre de acueducto en la finca 17733- 000 partido de Guanacaste ante este Despacho, en apego a lo establecido en la Ley de Aguas N° 276 del 27 de agosto de 1942 y sus reformas. Folio 1.
IV.-Que mediante resolución N° 840-2010-DMG de las 10:00 horas del 24 de marzo del 2010, del Ministerio de Gobernación y Policía (órgano designado para efectuar las diligencias de imposición de servidumbre de acueducto) confiere audiencia al representante del reclamado fundo sirviente a fin de que dentro de 30 días siguientes a la notificación de la presente resolución, haga valer sus derechos, ofrezca pruebas y señale lugar y/o medios para atender notificaciones. Folio 54. Que la representación de la compañía Ganadera Abancari S.R.L. se pronunció al respecto.
V.-Que luego de resolver situaciones previas (nulidades) que provocan el enderezamiento del procedimiento, esto mediante resoluciones N° 264-2012-DMG, (folio 294) N° 265-2012-DMG (folio 300) así como la N° 484-2012-DMG, (folio 294), mediante resolución N° 571-2012-DMG (folio 324) se rechazaron las oposiciones de Ganadera Abancari S.R.L. continuándose con las diligencias de la imposición forzosa de servidumbre incoada por Agroturismo Brisas del Lago S. A.
VI.-Que mediante oficio DAJG-255-2014 del 13 de marzo del 2014, emitido por la Dirección de Asesoría Jurídica del Ministerio de Gobernación y Policía, se puso en conocimiento de las partes el Avalúo AA-010-2014 de fecha 12 de febrero del 2014, realizado por el Perito Valuador, Ing. José Luis Palacios Alvarado, Hacienda Regional de Puntarenas. Folio 407. Así mismo mediante oficio 427-2014- DAJG, del 9 de mayo del 2014, de esa misma Dirección se le indica a la compañía Ganadera Abancari S.R.L., que según el avalúo mencionado debe indicar el número de cuenta y Banco a efectos de que la empresa Agroturismo Brisas del Lago S. A. proceda a realizar el depósito por concepto de indemnización por la imposición de la servidumbre de aguas. Folio 423.
VII.-Que mediante oficio 562-2014-DAJG, del 10 de junio del 2014 la Dirección de Asesoría Jurídica del Ministerio de Gobernación y Policía, señala que ya se realizó el depósito según el avalúo rendido por el Departamento de Valoraciones del Ministerio de Hacienda, sobre el monto de indemnización correspondiente al propietario del fundo sirviente, el cual asciende a la suma de ¢187.170,52. Dicha suma fue cancelada mediante depósito N° 02789714 en la cuenta N° 100-01-142-000529-7 del Banco Nacional de Costa Rica y a nombre de Forestal Río Grande Sociedad Anónima, según lo solicitara el representante de la empresa Ganadera Abancari S.R.L. Folio 430.
VIII.-Que de conformidad con los estudios realizados por el Ministerio de Gobernación y Policía y la concesión de aprovechamiento de aguas otorgada mediante resolución N° R-054- 2007-AGUAS-MINAE del 5 de febrero del 2007 citada en el considerando primero de este decreto, los artículos 99 y siguientes de la Ley de Aguas N° 276 del 27 de agosto de 1942 y sus reformas y el artículo 383 y siguientes del Código Civil, procede decretar la constitución de la correspondiente servidumbre de acueducto.

La servidumbre a establecer es una servidumbre de acueducto, consiste en una franja de terreno que tiene como finalidad el paso de acueducto subterráneo y la construcción de un tanque de toma de agua, adyacente, y dentro del mismo ancho del derecho de servidumbre servirá de acceso de mantenimiento de infraestructura de acueducto. Se ubica en la provincia (05) Guanacaste, cantón (07) Abangares, distrito (003) San Juan. En el Sector conocido con el nombre de Vainilla, entre las coordenadas geográficas 244-246 latitud norte y 431-433 longitud oeste, de la hoja cartográfica Juntas, del Instituto Geográfico Nacional, escala 1:50000. El inmueble a valorar sobre el cual se va a establecer la servidumbre es una franja de terreno vacante de longitud promedio de 52,00 metros y un ancho estimado en 3,00 metros con un área de 160 metros cuadrados, es de forma alongada y está ubicada internamente hacia el extremo sureste de la finca.
