By means of the diplomatic note dated December 8, 2014, signed by Mr. Alejandro Solano Ortiz, Acting Minister of Foreign Affairs and Worship, and the diplomatic note dated September 22, 2014, signed by His Excellency Mr. Ingo Winkelmann, Ambassador of the Federal Republic of Germany, the present Agreement was formalized under the modality of Exchange of Notes concerning the project "Implementation of the National Biological Corridors Program (PNCB) within the Framework of the National Biodiversity Strategy of Costa Rica."

Alejandro Solano Ortiz, Acting Minister of Foreign Relations and Worship, and the diplomatic note dated September 22, 2014, signed by His Excellency Mr. Ingo Winkelmann, Ambassador of the Federal Republic of Germany, the texts of which are as follows:
San José, December 8, 2014 DM-DGPE/0794-14 Your Excellency:
I have the honor to address Your Excellency, on the occasion of acknowledging receipt of your kind note dated September 22, 2014, which reads as follows:
"Your Excellency Mr. Minister:
With reference to the Joint Declaration of the Federal Ministry for the Environment, Nature Conservation, and Nuclear Safety and the Ministry of Environment and Energy of Costa Rica of October 24, 2013, and in compliance with the Convention on Technical Cooperation, concluded between our two Governments on July 23, 1965, amended by the Protocol of Amendment of December 18, 2006, I have the honor to propose to Your Excellency, on behalf of the Government of the Federal Republic of Germany, the following Agreement on the project 'Implementation of the National Biological Corridors Program (PNCB) within the Framework of the National Biodiversity Strategy of Costa Rica', within the framework of the International Climate Protection Initiative of the Federal Ministry for the Environment, Nature Conservation, and Nuclear Safety:
TO HIS EXCELLENCY INGO WINKELMANN AMBASSADOR OF THE FEDERAL REPUBLIC OF GERMANY SAN JOSÉ
3. The Government of the Federal Republic of Germany will provide human resources and furnish material contributions and, where appropriate, financial contributions for the project mentioned in paragraph 1 for a total value of up to 6,000,000 euros.
The Government of the Federal Republic of Germany will entrust the execution of this project to the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH.
4. On the part of the Government of the Republic of Costa Rica, the Ministry of Environment and Energy and the National System of Conservation Areas will be responsible for the execution of the project.
5. The details of the project and the respective contributions and obligations shall be set out in individual implementing agreements and, where appropriate, financing agreements, which shall be concluded between the executing organization mentioned in paragraph 3 and the institutions of the Government of the Republic of Costa Rica mentioned in paragraph 4 of this document. Said implementing contracts and, where appropriate, financing contracts shall be subject to the legal provisions in force in the Federal Republic of Germany.
6. The commitment of the Government of the Federal Republic of Germany for the project shall become void if the implementing and, where appropriate, financing contracts mentioned in paragraph 5 are not concluded by December 31, 2017.
7. The Government of the Republic of Costa Rica shall exempt the materials, vehicles, goods, and equipment, as well as the respective spare parts, supplied for the project specified in paragraph 1 from all import and export duties and other public charges, including port fees.
8. In all other respects, the provisions of the aforementioned Convention of July 23, 1965, amended by the Protocol of Amendment of December 18, 2006, shall also apply to this Agreement.
9. This Agreement is concluded in German and Spanish, both texts being equally authentic.
Should the Government of the Republic of Costa Rica declare its agreement with the proposals contained in paragraphs 1 to 9, this Note and the Note in reply from Your Excellency expressing your Government's agreement shall constitute an Agreement between our Governments, which shall enter into force on the day the Government of the Republic of Costa Rica has communicated to the Government of the Federal Republic of Germany through the diplomatic channel the fulfillment of the necessary internal requirements for the entry into force of the Exchange of Notes. For these purposes, the date of receipt of said communication shall be the determining factor.
I take this opportunity to reiterate to you, Mr. Minister, the assurances of my highest and most distinguished consideration." Regarding this matter, I have the honor to inform Your Excellency that the foregoing proposal is acceptable to the Government of the Republic of Costa Rica and that Your Excellency's Note and the present note constitute an Agreement between our two Governments, which shall enter into force on the day the Government of the Republic of Costa Rica has communicated to the Government of the Federal Republic of Germany, through the diplomatic channel, the fulfillment of the necessary internal requirements for the entry into force of this Exchange of Notes, on the understanding that the national institutions shall be governed by Costa Rican legislation in all matters legally pertinent and applicable.

Considerando:
Por tanto, En uso de las facultades conferidas por el artículo 140, incisos10) y 12) de la Constitución Política.
Decretan:
í. de Relaciones Exteriores y Culto y la nota diplomática de fecha 22 de setiembre del 2014 suscrita por el Excelentísimo Señor Ingo Winkelmann, Embajador de la República Federal de Alemania, cuyos textos son los siguientes:

Tengo el honor de dirigirme a Vuestra Excelencia, en ocasión de acusar recibo de su atenta nota de fecha 22 de setiembre de 2014, que dice lo siguiente:
"Excelentísimo Señor Ministro:
Con referencia a la Declaración Conjunta del Ministerio Federal de Medio Ambiente, Protección de la Naturaleza y Seguridad Nuclear y del Ministerio de Ambiente y Energía de Costa Rica del 24 de octubre de 2013 y en cumplimiento del Convenio sobre Cooperación Técnica, concertado entre nuestros dos Gobiernos el 23 de julio de 1965, modificado por el Protocolo de Enmienda del 18 de diciembre de 2006, tengo el honor de proponer a Vuestra Excelencia, en nombre del Gobierno de la República Federal de Alemania, el siguiente Acuerdo sobre el proyecto "Implementación del Programa Nacional de Corredores Biológicos (PNCB) en el Marco de la Estrategia Nacional de Biodiversidad de Costa Rica", en el marco de la Iniciativa Internacional de Protección del Clima del Ministerio Federal de Medio Ambiente, Protección de la Naturaleza y Seguridad Nuclear:
1. El Gobierno de la República Federal de Alemania y el Gobierno de la República de Costa Rica fomentarán conjuntamente el proyecto "Implementación del Programa Nacional de Corredores Biológicos (PNCB) en el Marco de la Estrategia Nacional de Biodiversidad de Costa Rica" siempre y cuando se constate la factibilidad de dicho fomento tras el examen de la propuesta de proyecto.
A SU EXCELENCIA INGO WINKELMANN EMBAJADOR DE LA REPÚBLICA FEDERAL DE ALEMANIA SAN JOSÉ 2. El objetivo del proyecto consiste en mejorar las capacidades para conservar la biodiversidad y la provisión de sus servicios ecosistémicos en los corredores biológicos de Costa Rica.
3. El Gobierno de la República Federal de Alemania facilitará recursos humanos y realizará prestaciones materiales y, si procede, aportaciones financieras para el proyecto mencionado en el párrafo 1 por un valor total de hasta 6.000.000 de euros.
El Gobierno de la República Federal de Alemania confiará la ejecución del presente proyecto a la Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH.
4. Por parte del Gobierno de la República de Costa Rica serán responsables de la ejecución del proyecto el Ministerio de Ambiente y Energía y el Sistema Nacional de Áreas de Conservación.
5. Los detalles del proyecto y de las prestaciones y obligaciones respectivas se fijarán en convenios de ejecución y, si procede, de financiación individuales, que habrán de ser concertados entre la organización ejecutora mencionada en el párrafo 3 y las instituciones del Gobierno de la República de Costa Rica mencionadas en el párrafo 4 de ese documento. Dichos contratos de ejecución y, si procede, de financiación estarán sujetos a las disposiciones legales vigentes en la República Federal de Alemania.
6. El compromiso del Gobierno de la República Federal de Alemania para el proyecto quedará sin efecto si los contratos de ejecución y, si procede, de financiación mencionados en el párrafo 5 no se conciertan hasta el 31 de diciembre de 2017.
7. El Gobierno de la República de Costa Rica eximirá a los materiales, vehículos, bienes y equipos, así como a los respectivos repuestos, suministrados para el proyecto especificado en el párrafo 1 de todos los derechos de importación y exportación y demás gravámenes públicos, incluso tasas portuarias.
8. Por lo demás se aplicarán también al presente Acuerdo las disposiciones del arriba mencionado Convenio del 23 de julio de 1965, modificado por el Protocolo de Enmienda del 18 de diciembre de 2006.
9. El presente Acuerdo se concierta en alemán y español, siendo ambos textos igualmente auténticos.
En caso de que el Gobierno de la República de Costa Rica se declare conforme con las propuestas contenidas en los párrafos 1 a 9, esta Nota y la Nota de respuesta de Vuestra Excelencia en la que conste la conformidad de su Gobierno constituirán un Acuerdo entre nuestros Gobiernos que entrará en vigor el día en que el Gobierno de la República de Costa Rica haya comunicado al Gobierno de la República Federal de Alemania por la vía diplomática el cumplimiento de los requisitos internos necesarios para la entrada en vigor del Canje de Notas. A tales efectos será determinante la fecha de entrada de la comunicación en cuestión.
Aprovecho la ocasión para reiterarle, Señor Ministro, el testimonio de mi más alta y distinguida consideración".
Sobre el particular, tengo el honor de informar a Vuestra Excelencia que la propuesta anterior es aceptable al Gobierno de la República de Costa Rica y que la Nota de Vuestra Excelencia y la presente constituyen un Acuerdo entre nuestros dos Gobiernos que entrará en vigencia el día en que el Gobierno de la República de Costa Rica haya comunicado al Gobierno de la República Federal de Alemania, por la vía diplomática, el cumplimiento de los requisitos internos necesarios para la entrada en vigor del presente Canje de Notas, en el entendido de que las institucionales nacionales se regirán por la legislación costarricense en lo que fuere jurídicamente procedente y aplicable.
Aprovecho la oportunidad para reiterar a Vuestra Excelencia las seguridades de mi más alta y distinguida consideración.
