throughout the entire text - Complete Text of Standard 002 Approves General Emergency Plan pursuant to Executive Decree No. 38642-MP-MAG for drought Complete Text of minutes: 101DDF NATIONAL COMMISSION FOR RISK PREVENTION AND EMERGENCY RESPONSE The Board of Directors of the National Commission for Risk Prevention and Emergency Response (CNE) announces that in Ordinary Session No. 01-01-15, held on Wednesday, January 14, 2015, Agreement No. 002-01-2015 was approved, which in its relevant part and in relation states:
That Dr. Iván Brenes, President of the CNE, presents before this Board of Directors the presentation of the General Emergency Plan for Executive Decree No. 38642-MP-MAG Drought.
That the drought event had a direct and immediate effect on the agricultural and livestock production of the year 2014 in the cantons that are under the coverage of the decree; said effect has been duly assessed by the authorities of the Sector. However, the repercussions of the drought, according to the expert opinion presented in the Plan, will persist during the dry season of the year 2015 due to the existing water deficit in the affected area, caused by the limited recharge of the aquifer (manto acuífero) layers.
That the National Emergency and Risk Prevention Law provides that, in the event of a public calamity caused by acts of nature or of man, which are unforeseeable or foreseeable but inevitable, and cannot be controlled, managed, or dominated with the ordinary powers available to the Government, the Executive Branch may declare a state of emergency in any part of the national territory, in order to integrate and define the responsibilities and functions of all agencies, public and private entities, and to provide a solution commensurate with the magnitude of the disaster.
That by reason of the foregoing, it is enacted to take the exceptional measures indicated by the Political Constitution and the National Emergency and Risk Prevention Law, to face the effects caused by the drought and mitigate the consequences caused by its impact in different areas of the country, in exercise of the powers conferred by articles 140, subsections 3) and 18), 146 and 180 of the Political Constitution, articles 25 subsection 1), 27 subsection 1), 28 subsections b) and j), of Law No. 6227 of May 2, 1978, which is the General Law of Public Administration, and article 29 of Law No. 8488 of November 22, 2005, which is the National Emergency and Risk Prevention Law, Executive Decree No. 37305-MP, published in La Gaceta No. 141, of Thursday, September 27, 2012.
That after deliberating, this Board of Directors therefore decides:

en la totalidad del texto - Texto Completo Norma 002 Aprueba Plan General de Emergencia según Decreto Ejecutivo N°38642-MP-MAG por sequía Texto Completo acta: 101DDF COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS La Junta Directiva de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE), comunica que en Sesión Ordinaria Nº 01-01-15, celebrada el día miércoles 14 de enero del 2015, se aprobó el Acuerdo N° 002-01-2015 que en lo conducente y en relación señala:
Que presenta ante esta Junta Directiva el Dr. Iván Brenes, Presidente de la CNE, la exposición del Plan General de la Emergencia Decreto Ejecutivo N°38642-MP-MAG Sequía.
Que el evento de sequía tuvo un efecto directo e inmediato en la producción agropecuaria del año 2014 de los cantones que se encuentran bajo la cobertura del decreto; dicho efecto ha sido debidamente ponderado por las autoridades del Sector. Sin embargo, las repercusiones de la sequía, según el criterio experto que se presenta en el Plan, se mantiene durante la estación seca del año 2015 debido al déficit de agua existente en la zona de afectación, ocasionado por la limitada recarga de los mantos acuíferos.
Que la Ley Nacional de Emergencias y Prevención del Riesgo dispone que, en caso de calamidad pública, ocasionada por hechos de la naturaleza o del hombre, que son imprevisibles o previsibles pero inevitables, y no puedan ser controlados, manejados ni dominados con las potestades ordinarias de que dispone el Gobierno, el Poder Ejecutivo podrá declarar estado de emergencia en cualquier parte del territorio nacional, a fin de integrar y definir las responsabilidades y funciones de todos los organismos, entidades públicas, privadas y poder brindar una solución acorde a la magnitud del desastre.
Que en razón de lo Constitución Política y la Ley Nacional de Emergencias y Prevención del Riesgo, para hacerle frente a los efectos ocasionados por la sequía y mitigar las consecuencias que ocasionó su impacto en las diferentes zonas del país, en ejercicio de las facultades que les confieren los artículos 140, incisos 3) y 18), 146 y 180 de la Constitución Política, artículos 25 inciso 1), 27 inciso 1), 28 incisos b) y j), de la Ley Nº 6227 del 2 de mayo de 1978 que es Ley General de la Administración Pública, y artículo 29 de la Ley Nº 8488 del 22 de noviembre del 2005, que es la Ley Nacional de Emergencias y Prevención del Riesgo, el Decreto Ejecutivo N°37305-MP, publicado en La Gaceta N°141, del jueves 27 de setiembre de 2012.
