text in its entirety - Full Text of Directive 019 Requests support from various institutions to give immediate priority to addressing the emergency situation faced due to the possible landslide and loss of radio and television towers located in the Irazú Volcano National Park Full Text of Act: 10184E N° 019-MICITT THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF SCIENCE, TECHNOLOGY AND TELECOMMUNICATIONS Based on the powers conferred upon them by Articles 130, 140 sections 20 and 146 of the Political Constitution; Articles 4, 25, 27 of Law No. 6227, General Law of Public Administration, published in the official gazette La Gaceta No. 102, Supplement No. 90 of May 30, 1978; and Articles 5, 25 and 27 of Law No. 8488, National Law on Emergencies and Risk Prevention, published in the Official Gazette La Gaceta No. 8 of January 11, 2006.

1. 1That the use of sound and television broadcasting, for its informational, cultural, and recreational aspects, constitutes a private activity of public interest.
2. 2That the sound or television broadcasting services defined in Article 29 of the General Telecommunications Law are those of free access; these are understood as sound broadcasting or conventional television services, with commercial, educational, or cultural programming, which may be freely received by the public, in general, without payment of subscription rights, and their signals are transmitted in a single direction to several points of simultaneous reception.
3. 3That there is a significant concentration of radio and television towers located at the highest point of the Irazú Volcano, within the Irazú Volcano National Park, which in turn forms part of the Cordillera Volcánica Central Conservation Area, protected under the supervision of the National System of Conservation Areas.
4. 4That during the year 2014, mainly starting in June, landslides of earth and rocks have been occurring from the upper part of the western flank of the Irazú volcano. The largest landslides have been recorded at the seismic stations located on the summit of the volcano; said monitoring has been recorded by the Cordillera Volcánica Central Conservation Area (ACCVC), the Costa Rican Volcanological and Seismological Observatory (OVSICORI), and by the National Emergency Commission.
5. 5That as a result of the landslides that have occurred and a crack in the upper crown of the massif, the stability of the lands on which at least eight radio and television towers of various operators are located has been compromised, as has been confirmed by the institutions cited in the preceding whereas clause.
6. 6That the Executive Branch, in the exercise of its power of direction in matters of government, and as the governing body in matters of Telecommunications, has the obligation to protect the rights of providers and users of telecommunications services, ensuring efficiency, equality, continuity, quality, greater and better coverage, greater and better information, more and better alternatives in the provision of services, as well as guaranteeing privacy and confidentiality in communications, in accordance with our Political Constitution.
7. 7That the Executive Branch also considers it necessary to implement emergency measures to prevent total or partial interruption of the radio and television signal, which could occur in the eventual case of a large-magnitude landslide in the Irazú Volcano National Park, resulting in the loss of the radio and television towers located there.
8. 8That the Head of Entity must ensure compliance with the emergency measures to collaborate in achieving the objectives contained in this directive. Therefore,

They issue the following directive ADDRESSED TO THE:

MINISTRY OF ENVIRONMENT AND ENERGY, MINISTRY OF SCIENCE, TECHNOLOGY AND TELECOMMUNICATIONS, NATIONAL ENVIRONMENTAL TECHNICAL SECRETARIAT, NATIONAL SYSTEM OF CONSERVATION AREAS, NATIONAL COMMISSION FOR RISK PREVENTION AND EMERGENCY RESPONSE, SUPERINTENDENCY OF TELECOMMUNICATIONS AND OTHER PERTINENT INSTITUTIONS

Considering:

en la totalidad del texto - Texto Completo Norma 019 Solicita apoyo de varias instituciones para que brinden prioridad inmediata a la atención de la solución a problemática de emergencia que enfrenta por posible deslizamiento y perdida de torres de radio y televisión ubicadas Parque Nacional Volcán Irazú Texto Completo acta: 10184E N° 019-MICITT EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DE CIENCIA, TECNOLOGÍA Y TELECOMUNICACIONES Con fundamento en las atribuciones que les confieren los artículos 130, 140 incisos 20 y 146 de la onstitución Política; los artículos 4, 25, 27, de la Ley N° 6227, Ley General de la Administración Pública, publicada en el diario oficial La Gaceta N° 102, Alcance N° 90 del 30 de mayo de 1978; en los artículos 5, 25 y 27 de la Ley N° 8488, Ley Nacional de Emergencias y Prevención del Riesgo, publicada en el Diario Oficial La Gaceta N° 8 del 11 de enero del 2006.

1. 1Que el aprovechamiento de la radiodifusión sonora y televisiva, por sus aspectos informativos, culturales y recreativos, constituye una actividad privada de interés público.
2. 2Que los servicios de radiodifusión sonora o televisiva definidos en el artículo 29 de la Ley General de Telecomunicaciones, son los de acceso libre; estos se entienden como servicios de radiodifusión sonora o televisión convencional, de programación comercial, educativa o cultural, que pueden ser recibidos libremente por el público, en general, sin pago de derechos de suscripción, y sus señales se transmiten en un solo sentido a varios puntos de recepción simultánea.
3. 3Que existe una concentración importante de torres de radio y televisión ubicadas en el punto más alto del Volcán Irazú, dentro del Parque Nacional Volcán Irazú, que a su vez forma parte del Área de Conservación Cordillera Volcánica Central, amparado bajo la supervisión del Sistema Nacional de Áreas de Conservación.
4. 4Que durante el año 2014, principalmente a partir de junio se han estado produciendo deslizamientos de tierra y rocas desde la parte superior del flanco oeste del volcán Irazú. Los deslizamientos de mayor tamaño han sido registrados en las estaciones sísmicas ubicadas en la cima del volcán, dicho monitoreo ha sido registrado por el Área de conservación Cordillera Volcánica Central (ACCVC), el Observatorio Vulcanológico y Sismológico de Costa Rica (OVSICORI) y por la Comisión Nacional de Emergencias.
5. 5Que producto de los deslizamientos presentados y un agrietamiento en la corona superior del macizo, se ha visto comprometida la estabilidad de los terrenos sobre los cuales se encuentran al menos ocho torres de radio y de televisión de diversos operadores, lo anterior ha sido constatado por las instituciones citadas en el considerando anterior.
6. 6Que el Poder Ejecutivo en el ejercicio de su potestad de dirección en materia de gobierno, y como órgano rector en materia de Telecomunicaciones, tiene la obligación de proteger los derechos de los proveedores y de los usuarios de los servicios de telecomunicaciones, asegurando eficiencia, igualdad, continuidad, calidad, mayor y mejor cobertura, mayor y mejor información, más y mejores alternativas en la prestación de los servicios, así como garantizar la privacidad y confidencialidad en las comunicaciones, de acuerdo con nuestra Constitución Política.
7. 7Que el Poder Ejecutivo considera necesario, asimismo, implementar medidas de emergencia para evitar interrupción total o parcial de la señal de radio y televisión, que podría ocurrir en el eventual caso de un deslizamiento de grandes magnitudes en el Parque Nacional Volcán Irazú, que tenga como resultado la perdida de las torres de radio y televisión ahí ubicadas.
8. 8Que el Jerarca deberá velar por el cumplimiento de las medidas de emergencia para colaborar con el logro de los objetivos contenidos en esta directriz. Por tanto,

MINISTERIO DE AMBIENTE Y ENERGÍA, MINISTERIO DE CIENCIA, TECNOLOGÍA Y TELECOMUNICACIONES, SECRETARÍA TÉCNICA NACIONAL AMBIENTAL, SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS, SUPERINTENDENCIA DE TELECOMUNICACIONES Y DEMÁS INSTITUCIONES ATINENTES
