I.—That Law No. 8495 of April 6, 2006, the General Law of the National Animal Health Service (SENASA), in its section 6, subsection e), assigns SENASA the competence to “…issue the pertinent technical standards, prepare procedure manuals, as well as execute and control animal welfare measures.” II.—That Article 12 of Law No. 8495, the General Law of the National Animal Health Service (SENASA), grants the possibility of establishing advisory bodies, with different actors or representatives from the public or private sector, for consultation and coordination on matters related to the purpose of the aforementioned law.
III.—That Animal Welfare is understood as the state in which the animal has its health, behavioral, mental, and physiological needs satisfied in the face of changes in its environment, generally imposed by human beings.
IV.—That the National Animal Health Service (SENASA) has a program that oversees actions related to companion animals or small species, defined as those intended to live with people, without any for-profit activity, this definition being applicable to all companion arthropods, amphibians, fish, reptiles, birds, and mammals whose ownership is not prohibited by current regulations. It will especially apply to the subspecies and varieties of dogs (Canis familiaris) and cats (Felis catus). Excluded from this definition are laboratory animals whose protection is regulated by special regulations, and those bred to obtain work, meat, skin, or any other product useful to humans.
V.—That Animal Welfare is a global issue of growing importance, where public institutions and non-governmental organizations, associations, foundations, and other interested stakeholders play a key role in establishing improvements in the condition and treatment of animals. Therefore, THE GENERAL DIRECTOR OF THE NATIONAL ANIMAL HEALTH SERVICE OF THE MINISTRY OF AGRICULTURE AND LIVESTOCK Issues the following Directive, CREATION OF THE NATIONAL ADVISORY COUNCIL ON ANIMAL WELFARE
Considering:
Likewise, those regional organizations, duly formalized and that develop activities aimed at the protection of companion animals or small species, may form part of CONABA, with a maximum of 8 representatives.
In said document, they shall record their intention to occupy a position on the Council, and said application must be signed by the legal representative of the requesting Organization or Foundation. Additionally, a Certification of Legal Status issued no more than three months prior must be attached.
At the respective assemblies, an alternate organization shall be designated, which shall assume the permanent position in the event that the designated permanent organization leaves, resigns, or is removed from the position.
The General Director of SENASA or whomever they designate must participate in the Council sessions; they shall be a part of it, with the right to speak, a casting vote, and shall preside over it. Also participating, with the right to speak, shall be whoever holds the position of Head of the Small Species Animal Welfare Program of SENASA, who shall also serve as the Executive Secretary of said Council. Those officials from SENASA or other public institutions who are convened for information on a particular topic may also participate with the right to speak.
All agreements and recommendations shall be adopted by a simple majority of those present.
The removal of said members must be adopted by means of an agreement by the General Director of SENASA.
Publish in the Official Gazette La Gaceta and also on the Website of the National Animal Health Service.
Sole Transitory Provision: Within a period of no more than 10 business days running from the publication of this Directive in the Official Gazette La Gaceta, the formal actors of national and regional character must submit, before the corresponding General or Regional Directorate, the respective application referred to in Article 6 of this directive. Upon the expiry of said period and within a term of no more than 30 calendar days, the corresponding General or Regional Directorate shall convene the Assembly cited in Articles 4 and 7 of this Directive.

I.-Que la Ley N° 8495 del 06 de abril del 2006, Ley General del Servicio Nacional de Salud Animal (SENASA), en su numeral 6 inciso e), le asigna como competencia al SENASA el ".dictar las normas técnicas pertinentes, elaborar los manuales de procedimientos, así como ejecutar y controlar las medidas de bienestar animal.".
II.-Que el artículo 12 de la Ley N° 8495, Ley General del Servicio Nacional de Salud Animal (SENASA) otorga la posibilidad de establecer órganos asesores, con diferentes actores o representantes del sector público o privado, para la consulta y coordinación de los temas relacionados con el objeto de la supracitada norma.
III.-Que el Bienestar Animal se entiende como el estado en el que el animal tiene satisfechas sus necesidades de salud, comportamiento, mentales y fisiológicas frente a cambios en su ambiente, generalmente impuestas por el Ser Humano.
IV.-Que el Servicio Nacional de Salud Animal (SENASA) cuenta con un programa que tutela las acciones en relación a los animales de compañía o pequeñas especies, definidos estos como los que tienen la finalidad de convivir con las personas, sin ninguna actividad lucrativa, aplicable esta definición a todos los artrópodos, anfibios, peces, reptiles, aves y mamíferos de compañía cuya tenencia no esté prohibida por la normativa vigente. Especialmente será de aplicación a las subespecies y variedades de perros (Canisfamiliaris) y gatos (Feliscatus). Quedan excluidos de esta definición los animales de experimentación cuya protección esté regulada por regulaciones especiales, y los que se crían para obtener trabajo, carne, piel o algún otro producto útil al hombre.
V.-Que el Bienestar Animal es un tema global de creciente importancia, en donde las instituciones públicas y las organizaciones no gubernamentales, asociaciones, fundaciones y demás participantes interesados, juegan un papel clave para establecer mejoras en la condición y trato de los animales. Igualmente, podrán conformar parte del CONABA aquellas organizaciones de carácter regional debidamente formalizadas y que desarrollen actividades tendientes a la protección de animales de compañía o pequeñas especies, las cuales tendrán hasta un máximo de 8 representantes.
En dicho documento harán constar su intención de ocupar un puesto en el Consejo debiendo ser dicha solicitud suscrita por el representante legal de la Organización o Fundación solicitante. Además deberá adjuntársele Certificación de Personería Jurídica con no más de tres meses de haber sido emitida.
En las respectivas asambleas se designará una organización suplente, la cual asumirá propiedad en el eventual caso que la designada propietaria abandone, renuncie o sea separada del cargo.
El Director General del SENASA o a quien éste designe deberá participar en las sesiones del Consejo, será parte de él, con derecho a voz, voto de calidad y lo presidirá. También participará, con derecho a voz, quien ocupe el puesto de Jefatura del Programa de Bienestar Animal de Pequeñas Especies del SENASA, quien fungirá igualmente como Secretaría Ejecutiva de dicho Consejo. También podrán participar con derecho a voz aquellos funcionarios del SENASA u otras instituciones públicas que se convoquen para el conocimiento de un tema en particular.
Todos los acuerdos y recomendaciones serán adoptados por mayoría simple de los presentes.
La separación de dichos miembros deberá adoptarse por medio de acuerdo del Director General del SENASA.
Publíquese en el Diario Oficial La Gaceta e igualmente en la Página Web del Servicio Nacional de Salud Animal.
Transitorio único: En un plazo no mayor a 10 días hábiles que correrán a partir de la publicación de la presente Directriz en el Diario Oficial La Gaceta, los actores formales de carácter nacional y regional deberán presentar ante la Dirección General o Regional según corresponda, la respectiva solicitud a que se refiere el artículo 6 de la presente directriz. Acaecido dicho plazo y dentro de un término no mayor a 30 días calendario la Dirección General o Regional correspondiente convocará a la Asamblea citada en los artículos 4 y 7 de esta Directriz.
