"Approve all municipal regulations requested by the Municipal Mayor as detailed below: 1) Municipal Aqueduct Regulation:" MUNICIPAL CLIENT-AQUEDUCT SERVICE PROVISION REGULATION 2014 Glossary of terms:

ü Potable water: Water that meets the physical, chemical and biological characteristics that make it suitable for human consumption, in accordance with the potability standards of the Pan American Health Organization approved by the Government.

ü High consumption: That which exceeds the average monthly consumption of the last six months by 100%.

ü Payment arrangement: Agreement between parties (owner or users and the Municipal Aqueduct), in which both agree that the former's debt be covered under special conditions, that is, in installments whose amounts and terms are established in the Tax Administration Regulation.

ü Quality of service: Refers to the fact that the potable water service must comply with the attributes of water quality, sufficient quantity, and continuity.

ü Fortuitous event: Refers to foreseeable but unavoidable events exonerating the Aqueduct and its representative the Mayor from all liability.

ü Flow: Volume of liquid or fluid that passes through a section of a pipe per unit of time. Usually expressed in liters per second.

ü Commercial cycle: The cycle that the commercial units of AyA must follow to carry out the entire billing and collection process for services.

ü Billing cycle: Cycle in which the Aqueduct permanently bills its clients for the value of the services provided. It is part of the commercial cycle.

ü Reading cycle: Cycle in which meters are read by books, allowing billing according to consumption. It is part of the commercial cycle.

ü Active connections: Those that are receiving the services provided by the Municipality and are subject to billing in accordance with the provisions of this regulation.

ü Inactive connections: Those whose services have been suspended due to lack of payment or other causes contemplated in this Regulation.

ü Normal consumption: The client's monthly consumption, free of distorting influences.

ü Normal average consumption: The average of the normal consumption recorded in the last six months.

ü Continuity of service: Implies that the potable water service is maintained continuously, without interruption, 24 hours a day, except in cases of force majeure or for periods of system maintenance affecting the area where the connection is located, in which case the interruption will be announced.

ü Excess: Monthly volume of potable water that exceeds the minimum volume established by AyA.

ü Force majeure: Refers to any unforeseen and inevitable event of nature (earthquake, hurricanes, floods, lightning, etc.) which exonerate the Aqueduct from all liability.

ü Leak: Escape of water in the network.

ü Leak with damage: Accidental escape of water in the installations between the private property boundary and the meter.

ü Water meter: Device designed to measure and record water consumption.

ü Individualization: The new service line installed by the Aqueduct to individualize the potable water services for each of the consumption units into which the property receiving services is segregated.

ü Installation: Refers to the sanitary fixtures and their connection to the internal potable water system, such as sinks, washtubs, showers, among others.

ü Service line: Section of pipe and accessories that connects the public network with the client's private network. The service line reaches up to the meter.

ü Owner: Any person who proves through public deed or legitimate title of possession, to be the owner of the property.

ü Branch line: Short terminal section of a distribution network.

ü Private network: The distribution network of the internal system owned by the client.

ü Public network: The distribution network of the public system owned by the Municipal Aqueduct.

ü Internal system: The internal potable water network and installations, owned by the client.

ü Private system: Set of potable water installations and sanitary sewer owned by the client.

ü Consumption unit: Each of the housing, commercial or industrial units and others, which have their own potable water installations and receive the Municipal Aqueduct services.

ü User: Any person who uses the potable water services.

ü Public thoroughfare: Road that is part of the public domain.

General objectives

The service referred to in this regulation is:

ü Potable water service.

In this sense, they must always keep in mind article 114 of the General Public Administration Act.

1634, General Potable Water Act, and article 70 of the Municipal Code), the foregoing without prejudice that the Municipality may indistinctly use mortgage, pledge, or simple proceedings as compulsive means of payment. The aforementioned responsibilities are transfers from owner to owner without the possibility of waiver.

The internal systems and installations necessary for the enjoyment of the service are the responsibility of the owner and remain under their exclusive ownership.

The aqueduct shall not assume any responsibility for their malfunction; therefore, it is exempt from any claim for damages to persons or property, caused directly or indirectly by the use of the mentioned systems.

Since the priority is water for human consumption.

Home inspections:

How to obtain aqueduct service:

If the applicant has other services in their name, these must be up to date in their payment obligations before requesting another service.

If the public network does not reach the property in question, the owner must carry out an extension of the branch line in accordance with the technical requirements that the Aqueduct will provide to the client interested in the service, in addition to the installation of a hydrant for the owners of new developments with the specifications provided to us by the Fire Department.

● Present identity or residency card, and a photocopy of the same.

● In the case of a legal entity, present legal entity identification, certification of current legal standing, and copies of the same.

● Registry or notarial certification proving ownership of the property, or in its place a certified copy of the same describing its nature, situation, boundaries, and measurements, with a validity of thirty days from issuance at the time of its presentation before the Aqueduct.

● A copy of the cadastral plan approved by the Municipality, in addition to the construction permit duly signed and sealed by the Municipal Engineer.

● In the case of horizontal condominiums with individual metering, they must present a copy of the easement (servidumbre) deed; in the case of collective services to subsidiary properties of an administrator, they will make the request for all of them, complying with the preceding requirements.

In the event that it is not possible to comply with all the requirements of point three above, for reasons duly justified before the Aqueduct, the interested party must provide, instead, the presentation of other documents proving their rights of possession or ownership, such as a bill of sale or possessory information issued by a duly licensed lawyer. Additionally, after filling out the new service application, it will only be valid for six months; otherwise, they will lose their right.

● Provisional services will be installed on the respective property, presenting the requirements mentioned in the previous article. The service will be provided provisionally for a maximum period of three months counted from the day the respective request is made.

If the water meters and their accessories suffer damage caused by the client, the amount for the same will be charged to the client's account in the following billing cycle or through an income receipt. Except in cases of theft, the Aqueduct bears the cost of replacing the meter.

Note: For service line relocations, the plumber will evaluate the costs of the work, and these must be paid before carrying out the respective work.

The request must be accompanied by evidence proving that the applicant is the legitimate owner of the property in question. The Aqueduct may, ex officio, proceed with the change of name for the services that the Municipality provides to the population.

The department will study the case and, if warranted, will proceed to make the change requested, upon prior payment of the corresponding costs.

The Aqueduct Department will study the case, and if the relocation is technically possible and the necessary works within the system for the new location have been carried out, it will be made effective upon prior payment of the corresponding costs, which will be based on half of the current price of new services.

Suspension of potable water service:

In case of suspension, they must pay the reconnection fee, even if the disconnection process has not been carried out, as they are in the late period.

Regarding tenants, their relationship with the property owner being of a private nature and unrelated to the Aqueduct, it will be regulated in accordance with the corresponding legislation.

The client or third parties are prohibited from intervening in the systems that are exclusive to and the property of the Municipality of Abangares. Due to differences between owners and tenants, the former cannot in any way suspend services to the latter, even if the internal systems allow them to, except by judicial order duly notified to the Municipal Aqueduct.

Provisional services:

● In the case of fairs, festivals, circuses, and others (only for the days of the event).

● When it is for Municipality construction.

The applicable rate for spectacles will be the reproductive rate. The aqueduct will suspend services on the specified date, unless there is a request for an extension.

Supply of potable water to mobile units:

Fraudulent services

● When the service has been suspended and it is reconnected without any authorization from the Aqueduct or Municipal Mayor.

● When, not being registered by the Aqueduct, an existing service line from a neighboring property has been connected.

● When, being registered by the Aqueduct, it is found connected (via bypass) before the water meter, to falsify the actual consumption of this service.

Charging them:

● Installation fee.

● Water service charges.

● Damages caused.

The amount to be paid will be established after a prior study by the Municipal Aqueduct department, and payment can be made at the Municipality's service windows.

Rate system:

These will be approved by the Municipal Council and published in the La Gaceta newspaper.

● Domestic.

● Ordinary.

● Reproductive.

● Preferential.

● Government.

In these cases, the use of potable water is to satisfy the domestic needs of families.

Notwithstanding the above, when a commercial premises is attached to the dwelling, if it has two separate water outlets, the provisions of articles 48 and 49 of this regulation will apply; otherwise, article 52 will apply.

This rate applies only to institutions where activities of social interest are taught or carried out.

When it involves public establishments dedicated to the sale of products or services of social and public interest (such as petroleum derivatives, electrical energy, telephone service, insurance, food products, banks, public medical services, public clinics and hospitals, etc.)

However, the owner may request the Aqueduct for individualization of the service by class, provided the internal system allows this separation, and with prior payment of the new service fees.

Fees:

Billing and collection of services Billing

Collection:

When requested, and prior to the adjustment, the department will first conduct a home inspection carried out by Aqueduct personnel, and if it is found that the leak is at the meter, the aqueduct department will make the modification or adjustment to the rate claimed, but if it is confirmed that the leak is within the property, it is the client's responsibility. The approval and application of adjustments may only be authorized by the Aqueduct Manager.

For the calculation of the modifications, consumption projections with the new water meter may be used.

El servicio a que se refiere el presente reglamento es:

ü Servicio de agua potable.

En este sentido, debe de tener muy presente en sus actuaciones el artículo 114 de la Ley General de Administración Pública.

Las responsabilidades cantáridas son transferencias de propietario a propietario sin posibilidad de renuncia.

Los sistemas e instalaciones internos necesarios para el disfrute del servicio, son responsabilidad del propietario y permanencia bajo su propiedad exclusiva.

El acueducto no asumirá ninguna responsabilidad por su mal funcionamiento, por tanto, queda eximido de todo reclamo por daños y perjuicios a personas o propiedades, ocasionados directa o indirectamente por el uso de los sistemas mencionados.

Ya que la prioridad es agua para el consumo humano.

Revisiones domiciliarias:

Como obtener el servicio del acueducto:

Si el solicitante cuenta con otros servicios a su nombre estos deberán encontrarse al día en sus obligaciones de pago antes de solicitar otro servicio.

Si la red pública no alcanza hasta la propiedad en cuestión, el propietario deberá de realizar una extensión del ramal de acuerdo con los requerimientos técnicos que el Acueducto le estará dando al cliente interesado del servicio, además de la instalación de un hidrante para los propietarios de nuevas urbanizaciones con las especificaciones que nos brinda el Cuerpo de Bomberos.

● Presentar cédula de identidad o residencia, y fotocopia de la misma.

● En caso de persona jurídica presentar cédula jurídica, certificación de la personería vigente y copia de las mismas.

● Certificación registral o notarial que demuestre la titularidad del inmueble, o en su efecto copia certificada de las misma en las que se describa su naturaleza, situación, linderos y medidas con una vigencia de treinta días de expedidas al momento de su prestación ante el Acueducto.

● Una copia del planco catastrado y visado por la Municipalidad, además del permiso de construcción debidamente firmado y sellado por el Ingeniero Municipal.

● En caso de condominios horizontales con mediciones individuales, deberán presentar copia de la escritura de servidumbre, en caso de servicios colectivos a finca filiales de administrador, hará la solicitud para todas ellas, cumpliendo con los requisitos que anteceden.

En el caso que no sea posible cumplir con todo los requisitos del punto tres anterior, por razones debidamente justificadas ante el Acueducto, el interesado deberá de aportar en su efecto la presentación de otros documentos que prueben sus derechos de posesión o propiedad, tales como carta de venta o información posesoria extendida por un abogado debidamente incorporado. Adicionalmente posterior al llenar la solicitud de nuevo servicio la misma tendrá una validez solo de seis meses, de lo contrario perderán su derecho.

● Se instalarán servicios provisionales en la respectiva propiedad presentando los requisitos mencionado en el artículo anterior. El servicio se prestará provisionalmente por un plazo máximo de tres meses contado a partir del día en que se hace la respectiva solicitud.

Si en el momento de realizar la conexión se detecta diferencias de costos, se notificará al propietario de dichas diferencias que serán incluidas para su pago en el recibo que se le factura por primera vez.

Si los hidrómetros y sus accesorios sufren daños por parte del cliente el monto de mismo se cargara en la cuenta del cliente en la siguiente facturación o mediante comprobante de ingresos. Excepto por caso de hurto el Acueducto corre con el costo de la reposición del medidor.

Nota: Para los traslados de previstas se evaluara por parte del fontanero los costos del trabajo y se tendrán que cancelar los mismos antes de realizar el trabajo respectivo.

La solicitud debe acompañarse con atestados que demuestren que el solicitante es el dueño legítimo de la propiedad en cuestión. El Acueducto puede de oficio a proceder al cambio de nombre de los servicios que la Municipalidad brinda a la población.

El departamento, estudiará el caso y si se amerita, procederá a hacer el cambio solicitado, previo pago de los costos que correspondan.

El Departamento de Acueducto estudiara el caso y si el traslado es técnicamente posible y han realizado las obras necesarias dentro del sistema para la nueva localización, se procederá a hacerlo efectivo previo pago de los costos correspondientes, el cual se basará en la mitad del precio actual de nuevos servicios.

Suspensión del servicio de agua potable:

Tratándose de inquilinos, su relación con el propietario del inmueble siendo de orden privado y ajeno a Acueducto, se regulará de conformidad con la legislación correspondiente.

Queda prohibido al cliente o a terceras personas intervenir los sistemas que son exclusivos y de propiedad de la Municipalidad de Abangares. Por diferencias entre propietarios e inquilinos, el primero no puede en ninguna forma suspender los servicios al segundo, aun en el caso que los sistemas internos le permiten, solamente por orden judicial debidamente notificada al Acueducto Municipal.

Servicios provisionales:

● El caso de ferias, turnos, circos otros, (solo por los días del evento).

● Cuando es el caso de la construcción de la Municipalidad.

La tarifa aplicable para los espectáculos será reproductiva. El acueducto suspenderá los servicios en la fecha específica, salvo que exista solicitud de prórroga.

Suministro de agua potable a unidades móviles:

Servicios fraudulentos

● Cuando habiendo sido suspendido el servicio, esté se reconecte sin ninguna autorización del Acueducto o Alcalde Municipal.

● Cuando no están registrada por el Acueducto ha sido conectada una prevista existente en una propiedad vecina.

● Cuando estando registrados por el Acueducto se encuentre conectada (mediante by-pass) antes del hidrómetro, para falsear el consumo real de este servicio.

Y de continuar con sus actos violatorios a la normativa, se procederá a aplicar el debido proceso y se pasará la denuncia correspondiente al Ministerio Público.

Cobrándole:

● Derecho de instalación.

● Servicios de cañería.

● Daños causados.

El monto a cancelar será establecido previo estudio por el departamento de Acueducto Municipal, y lo pueden realizar en las ventanillas de la Municipalidad.

Sistema tarifario:

Las mismas serán aprobadas por medio del Concejo Municipal y publicadas en el diario La Gaceta.

● Domiciliaria.

● Ordinaria.

● Reproductiva.

● Preferencia.

● Gobierno.

En estos casos, el uso de agua potable es para satisfacer las necesidades domésticas de las familias.

No obstante, lo anterior cuando exista en las viviendas un local comercial adjunto, si la misma cuenta con dos salidas propias de agua, se aplicará lo dispuesto por los artículos 48, 49 del presente reglamento, caso contrario se aplicará el artículo 52.

Esta tarifa comprende solamente a las instituciones donde se imparte o realizan actividades de interés social.

Cuando se trate de establecimiento públicos dedicados a actividades de venta de producto o servicios de interés social, y públicos (como derivados del petróleo, energía eléctrica, teléfono, seguro productos alimenticios, bancos, servicios médicos públicos, clínicas y hospitales públicos etc.)

Sin embargo, el propietario puede pedir a Acueducto la individualización del servicio por clase, siempre y cuando el sistema interno permita esta separación, y con previa cancelación de los derechos de servicios nuevos.

Tasas:

Facturación y cobros de los servicios de la facturación

Cobro:

Superiores a los 50 m3 en las tarifas domiciliarias, ordinaria, o superiores a los 100 m3 en las tarifas reproductiva, preferencial o de gobierno. El Acueducto podrá aplicar ajustes a una factura por año, siempre y cuando el cliente lo solicite dentro de los veinte días hábiles siguientes a la fecha de vencimiento de la facturación afectada. Cuando se solicite y previo el ajuste el departamento, procederá a realizar primero una inspección domiciliaria aplicada por el personal del Acueducto, y si se comprueba que la fuga es en el medidor, el departamento de acueducto realizará la modificación o ajuste en la tarifa reclamada, pero comprobándose que la fuga es dentro de la propiedad es responsabilidad del cliente. La aprobación y aplicación de ajustes solo podrán ser autorizada por el Encargado del Acueducto.

Para el cálculo de las modificaciones se podrá utilizar las proyecciones de consumo con el nuevo hidrómetro.
