Every Seed Processor MUST comply with the provisions of the "Reglamento para Empresas de Acondicionamiento de Semillas" and be authorized for this purpose by the National Seed Office.

For its operation, the corresponding annual fee differs from that of the other categories. In this regard, for cases where, in addition to being a Processor, the User carries out any other, several, or all of the remaining activities, they shall not pay an additional fee for them.

* For reproduction and multiplication activities, producers must comply with the provisions of the Ley de Semillas, its Regulations, and the stipulations of the Technical Regulations for each species.

PROCEDURE FOR THE SINGLE COMPANY REGISTRATION PROCESS PROCESS DESCRIPTION:

As users of the different services performed by the National Seed Office, seed producing, processing, importing, exporting, and marketing companies must register to carry out their activities in accordance with the provisions of the seed regulations. According to the Ley de Semillas No. 6289, the National Seed Office must register individuals or legal entities engaged in these activities.

LEGAL BASIS:

Ley de Semillas No. 6289.

Articles 43, 44, 47, 48, 50, 51, 53, 54, 62 to 74 of the Regulations to the Ley de Semillas.

Reglamento para la Importación, Exportación y Comercialización de Semillas (Approved by Board of Directors Session 546/January 24, 2005 Agreement 2, Article 4).

RESPONSIBLE OFFICIALS:

The process will be handled in the first instance by Mrs. Cyra Bonilla Cerdas (ext. 101). Mrs. Laura Vindas Valverde (ext. 106) and Mrs. Vilma Solano Chaves (ext. 112), will handle it in the second instance.

REQUIREMENTS: Depending on the type of service, you must specifically provide the following information and meet the following requirements:

Seed Producers:

To obtain the status of seed producer, the interested party shall complete the form that the National Seed Office has prepared for this purpose, providing the following data for each of the lots to be registered in each cycle:

• a)Name or corporate name of the applicant; b) Copy of the topographic map (plano topográfico) of the property, on which the fields intended for seed production can be indicated, at the discretion of the National Seed Office; c) Area intended for seed production; d) Crop, variety to be reproduced, and category to be registered; e) Variety and area planted in the previous period of the lot to be registered; f) Estimated dates of planting and harvest The obligations of seed producers, to obtain such qualification, are:
• a)Submit the application as a seed producer, within the period determined for this purpose by the National Seed Office; b) Maintain the quality of the seeds in accordance with the category to be produced and the criteria of the National Seed Office; c) Prove that they will have the lots registered with the Office available for the time necessary to produce the seed; d) Provide the inspectors of the National Seed Office with the information they require in the performance of their duties and allow them to take samples; and require in the performance of their duties and allow them to take samples; and e) Execute, within the established period, all the instructions regarding the crop that are presented to them by the inspectors during each visit to their field.

If the crops comply with the established standards and requirements, the multipliers must deliver the entirety of the production (raw seed) to the company indicated in the registration application, unless this company authorizes, before the National Seed Office, the sale of the same to other seed companies.

Seed Processors:

To obtain registration as a seed processor, the interested party must provide the National Seed Office with the following information:

• a)Name or corporate name and address of the applicant; b) Location of the plant intended for seed processing and storage; c) Description and capacity of the equipment and facilities available for seed processing and storage; d) Indication of the species and varieties to be processed; e) Attach the proposed labeling and packaging design to be used; which will be returned to the interested party once it has been studied by the National Seed Office; f) Payment of the stipulated fee; and g) Any other necessary data, in the judgment of the National Seed Office.

For seed processing, the following requirements must be met:

• a)Possess the minimum processing equipment required by the National Seed Office; b) Have adequate facilities for storing the processed materials; c) Maintain the identification and location in the warehouse of the seed lots, as required in these regulations; and d) Permanent direction exercised by a technical advisor on seeds, when, due to the species in question and volume, it is necessary in the judgment of the National Seed Office.

Seed processors must comply with the following requirements:

• a)Provide the inspectors in charge of official control with the information they require in the performance of their duties and allow them to take samples; b) Execute all the instructions regarding the operation of their plant that are presented to them by the National Seed Office; c) Send the National Seed Office the updated report of their seed distributors throughout the country and their marketing activities. Send monthly the detail of the purchase-sale movement, including copies of the invoices.

Seed Merchants:

To obtain registration in the Seed Merchants Registry, interested parties must submit an application to the National Seed Office, indicating:

• a)Name or corporate name of the applicant; b) Name and address of the commercial premises; c) Category of the seeds to be distributed; e) Description of the storage conditions and sites that will guarantee the adequate preservation of the seed; d) Origin of the seeds (country); e) Description of the storage conditions and sites that will guarantee the adequate preservation of the seed; f) The storage sites, for their approval, will be subject to inspection by the National Seed Office; g) Payment of the stipulated fee; and h) The permit will be valid for one year.

Once the aforementioned requirements are met, the National Seed Office will issue the corresponding marketing permit.

Obligations of Seed Merchants:

Seed merchants must comply with the following obligations:

• a)Keep the seeds in storage conditions that prevent the alteration of quality attributes, according to the official analysis indicated on the label; b) Market only seeds of registered varieties for those crops so determined; c) Allow control visits and sample taking that the National Seed Office deems appropriate; d) Provide the National Seed Office with the information it requires; e) Keep a record of seed marketing, as established by the National Seed Office, such as invoice number, seller, buyer, lot number, variety, and quantity sold; f) They may not sell seeds in violation of the provisions of the following regulation; and g) Every seed merchant will be directly responsible for compliance with the standards established for this purpose.

Seed Importers:

Any individual or legal entity that imports seeds into the country must be duly registered with the National Seed Office.

To obtain registration as a seed importer, the interested party must submit an application to the National Seed Office with the following information:

• a)Name or corporate name, identification, and address of the applicant; b) Duly authenticated responsible signature; and c) Seeds to import and the purpose for which they are imported.

Seed importation may only be carried out with the express authorization of the National Seed Office, considering the national interest.

Seeds subject to importation will comply with the following requirements:

• a)The phytosanitary standards established by the Dirección de Sanidad Vegetal of the Ministerio de Agricultura y Ganadería; b) The quality standards for the crop that the National Seed Office has established for the corresponding category; c) Seeds for verified experimental purposes require prior authorization from the National Seed Office; and d) Those established by the National Seed Office in the performance of its duties. Seed exportation; may only be carried out with the authorization of the National Seed Office, considering the national public interest.

Seed exporters must register with the National Seed Office, by means of an application that will indicate the following:

• a)Name or corporate name and address of the applicant; b) Duly authenticated signature of the responsible party; and c) The National Seed Office will make the exceptions it deems necessary.

PROCESS:

• 1)The user must submit the "User Registration for Services" form, duly completed with the required information and the corresponding payment.

Note:

• i)If a legal entity: Clearly detail the name and ID number of the legal representative and present a legal status certification (personería jurídica). A copy of the original verified by the official may also be submitted. It must be observed that the ID number has twelve digits (without hyphens).
• ii)If an Individual: copy of the identity card. (Must specify nine digits and zeros in place of hyphens).
• iii)The sum to be paid is ¢55,000.00 for producers, marketers, importers, and exporters. Processing companies must pay ¢365,000.00 per conditioning plant.

Payment can be received through any of the following options:

• a)Directly at our facilities (Avenida 8 Calles 21-25, San José).
• b)By bank deposit or electronic transfer to any of the following checking accounts in the name of the National Seed Office:

It is feasible to send the registration application and attached documents via fax (2223-5431), email ([email protected]), or in person at our facilities.

• 2)Once the documentation and corresponding payment are received, the official must stamp the original receipt and gives the copy to the user indicating the initials of the person who received and processed the registration. Likewise, they will proceed to prepare the money receipt.
• 3)In the Computer System, the official will include the information in the sub-file Client Types (Maintenance area), crediting it with an "S", the validity of which automatically ends on December 31. The program may provide the information by company with its respective activity(ies) and by the classification of the crops they work with. The lists by classification will be kept published on the website: http://www.ofinase.go.cr In the fixed file, the information will be arranged in alphabetical order of the registered users, as active for those in force and passive for those who did not renew their registration.
• 4)The collected money will be immediately transferred to the Financial Department (Administrative Assistant) for its deposit.
• 5)The official delivers the file to the secretary of the Administrative-Financial Department so that she can proceed with the preparation of the certificate.
• 6)The Secretary of the Administrative Department prepares the certificate, passes it to the Executive Director for their signature, and notifies the company for its collection.

If any company modifies its condition or varies the crops it works with during the year, it must only notify the Office. Likewise, seed producers and/or processors must report changes regarding remodeling or acquisition of new equipment, whether for improvement or replacement.

Anything not stipulated herein will be resolved by the Executive Directorate or by the Administrative- Financial Management in coordination with the Technical Management.

* Para las actividades de reproducción y multiplicación, los productores deberán acatar lo dispuesto en la Ley de Semillas, su Reglamento y lo estipulado en los Reglamentos Técnicos para cada especie.

PROCEDIMIENTO PARA EL TRÁMITE DEL REGISTRO UNICO DE EMPRESAS DESCRIPCIÓN DEL TRÁMITE:

Como usuarios de los diferentes servicios que realiza la Oficina Nacional de Semillas, las empresas productoras, procesadoras, importadoras, exportadoras, comercializadoras de semillas deben inscribirse para realizar sus actividades acorde a lo establecido en la reglamentación de semillas. De acuerdo a la Ley de Semillas Nº 6289, la Oficina Nacional de Semillas debe registrar a las personas físicas o jurídicas que se dediquen a estas actividades.

SUSTENTO LEGAL:

Ley de Semillas Nº 6289.

Artículos 43,44, 47, 48, 50, 51, 53, 54, 62 a 74 de Reglamento a la Ley de Semillas.

Reglamento para la Importación, Exportación y Comercialización de Semillas (Aprobado Junta Directiva Sesión 546/24 enero 2005 Acuerdo 2, Artículo 4).

FUNCIONARIOS RESPONSABLES:

El trámite estará a cargo en primera instancia de la Sra. Cyra Bonilla Cerdas (ext.101). Las Sras. Laura Vindas Valverde (ext.106) y Vilma Solano Chaves (ext.112), atenderán en segunda instancia.

REQUISITOS: dependiendo del tipo de servicio, deberá aportar en particular la siguiente información y cumplir con los siguientes requisitos:

Productores de semillas:

Para obtener la condición de productor de semillas, el interesado llenará el formulario que para tal efecto ha confeccionado la Oficina Nacional de Semillas suministrando los siguientes datos para cada uno de los lotes que vayan a inscribir en cada ciclo:

• a)Nombre o razón social del solicitante; b) Copia del plano topográfico de la propiedad, en el cual se puedan señalar los campos destinados a la producción de semillas, a criterio de la Oficina Nacional de Semillas; c) Área destinada a la producción de semillas; d) Cultivo, variedad a reproducir y categoría a inscribir; e) Variedad y extensión sembrada en el período anterior del lote a inscribir; f) Estimación de las fechas de siembra y cosecha Son obligaciones de los productores de semillas, para obtener tal calificación:
• a)Presentar la solicitud como productor de semillas, en el período que para el efecto determine la Oficina Nacional de Semillas; b) Mantener la calidad de las semillas acorde con la categoría a producir y el criterio de la Oficina Nacional de Semillas; c) Acreditar que dispondrán de los lotes inscritos ante la Oficina, por el tiempo necesario para producir la semilla; d) Suministrar a los inspectores de la Oficina Nacional de Semillas, la información que requieran en el cumplimiento de sus funciones y permitir la toma de muestras por parte de éstos; y requieran en el cumplimiento de sus funciones y permitir la toma de muestras por parte de éstos; y e) Ejecutar dentro del período establecido todas las indicaciones que sobre el cultivo le sean presentadas por los inspectores en cada visita a su campo.

Si los cultivos cumplen con las normas y requisitos establecidos, los reproductores, deberán entregar la totalidad de la producción (semilla en bruto) a la empresa que se indica en la solicitud de inscripción, excepto que esta empresa autorice ante la Oficina Nacional de Semillas, la venta de la misma a otras empresas semilleristas.

Procesadores de semilla:

Para obtener la inscripción como procesador de semilla, el interesado deberá entregar a la Oficina Nacional de Semillas la siguiente información:

• a)Nombre o razón social y dirección del solicitante; b) Localización de la planta destinada al procesamiento y almacenamiento de semillas; c) Descripción y capacidad del equipo e instalaciones disponibles para el procesamiento y almacenamiento de semillas; d) Indicación de las especies y variedades que van a procesar; e) Acompañar el proyecto de etiquetado y empaque a utilizar; el que será devuelto al interesado una vez que haya sido estudiado por la Oficina Nacional de Semillas; f) El pago de la tasa estipulada; y g) Cualquier otro dato necesario, a juicio de la Oficina Nacional de Semillas.

Para el procesamiento de semillas deberán cumplirse los siguientes requisitos:

• a)Poseer el equipo mínimo de procesamiento exigido por la Oficina Nacional de Semillas; b) Contar con las instalaciones adecuadas para el almacenamiento de los materiales procesados; c) Mantener la identificación y ubicación en el almacén, de los lotes de semillas, según se exige en el presente reglamento; y d) Dirección permanente ejercida por un asesor técnico en semillas, cuando por la especie en cuestión y volumen sea necesario a juicio de la Oficina Nacional de Semillas.

Los procesadores de semillas deben cumplir con los siguientes requisitos:

• a)Suministrar a los inspectores encargados del control oficial, la información que requieran en el cumplimiento de sus funciones y permitir la toma de muestras por parte de ellos; b) Ejecutar todas las indicaciones que sobre la operación de su planta le sean presentadas por la Oficina Nacional de Semillas; c) Enviar a la Oficina Nacional de Semillas el informe actualizado de sus distribuidores de semilla en todo el país y de sus labores de comercialización. Enviar mensualmente el detalle del movimiento de compra-venta, incluyendo copia de las facturas.

Comerciantes de semilla:

Para obtener la inscripción en el Registro de Comerciantes de Semilla, los interesados deberán presentar solicitud a la Oficina Nacional de Semillas; indicando:

• a)Nombre o razón social del solicitante; b) Nombre y dirección del local comercial; c) Categoría de las semillas que va a distribuir; e) Descripción de las condiciones y sitios de almacenamiento que garantizarán la adecuada conservación de la semilla; d) Origen de las semillas (país); e) Descripción de las condiciones y sitios de almacenamiento que garantizarán la adecuada conservación de la semilla; f) Los sitios de almacenamiento para su aprobación serán objeto de inspección por la Oficina Nacional de Semillas; g) Pago de tasa estipulada; y h) El permiso tendrá vigencia por un año.

Cumplidos los requisitos antes mencionados, la Oficina Nacional de Semillas expedirá el permiso correspondiente de comercialización.

Obligaciones de los comerciantes de semilla:

Los comerciantes de semillas deben cumplir con las siguientes obligaciones:

• a)Mantener las semillas en condiciones de almacenamiento que eviten la alteración de los atributos de calidad, de acuerdo al análisis oficial que indica la etiqueta; b) Comercializar únicamente semillas de variedades inscritas en aquellos cultivos que así se determine; c) Permitir las visitas de control y toma de muestras que la Oficina Nacional de Semillas considere conveniente; d) Suministrar a la Oficina Nacional de Semillas la información que ésta requiera; e) Llevar un control de comercialización de semilla, según lo establezca la Oficina Nacional de Semillas tales como número de factura, vendedor, comprador, número de lote, variedad y cantidad vendida; f) No podrán vender semilla violando lo dispuesto en el siguiente reglamento; y g) Todo comerciante de semillas será directamente responsable del cumplimiento de las normas establecidas para tal efecto.

Importadores de Semillas:

Toda persona física o jurídica que importe semillas al país, deberá estar debidamente inscrita ante la Oficina Nacional de Semillas.

Para obtener la inscripción como portador de semillas, el interesado deberá formular solicitud ante la Oficina Nacional de Semillas con la siguiente información:

• a)Nombre o razón social, identificación y dirección del peticionario; b) Firma responsable debidamente autenticada; y c) Semillas a importar y fin con que se importan.

La importación de semilla sólo podrá hacerse con la autorización expresa de la Oficina Nacional de Semillas atendiendo el interés nacional.

Las semillas sujetas a importación cumplirán con los siguientes requisitos:

• a)Las normas fitosanitarios establecidas por la Dirección de Sanidad Vegetal del Ministerio de Agricultura y Ganadería; b) Las normas de calidad para el cultivo que haya establecido la Oficina Nacional de Semillas en la categoría correspondiente; c) Las semillas para fines experimentales comprobados, requieren autorización previa de la Oficina Nacional de Semillas; y d) Los que establezca la Oficina Nacional de Semillas en el cumplimiento de sus funciones. La exportación de semillas; sólo podrá hacerse con la autorización de la Oficina Nacional de Semillas atendiendo el interés público nacional.

Los exportadores de semillas deberán registrarse ante la Oficina Nacional de Semillas, mediante solicitud que indicará lo siguiente:

• a)Nombre o razón social y dirección del peticionario; b) Firma del responsable debidamente autenticada; y c) La Oficina Nacional de Semillas hará las excepciones que considere necesarias.

TRÁMITE:

• 1)El usuario debe presentar el formulario de "Registro de Usuario de Servicios", debidamente completo con la información requerida y el pago correspondiente.

Nota:

• i)Si es persona jurídica: Detallar claramente el nombre y número de cédula del representante legal y presentar una personería jurídica. También se puede entregar una copia del original verificada por el funcionario. Debe observarse que el número de cédula presente doce dígitos (sin guiones).
• ii)Si es Persona Física: copia de la cédula de identidad. (Debe especificar nueve dígitos y ceros en lugar de guiones).
• iii)La suma a cancelar es de ¢55.000,00 para productores, comercializadores, importadores y exportadores. Las empresas procesadoras deberán cancelar ¢365.000,00 por planta acondicionadora.

El dinero se puede recibir por cualquiera de las siguientes opciones:

• a)Directamente en sus instalaciones (Avenida 8 Calles 21-25, San José).
• b)Mediante depósito bancario o transferencia electrónica en cualquiera de las siguientes cuentas corrientes a nombre de la Oficina Nacional de Semillas:

Es factible enviar la solicitud de registro y documentos anexos vía fax (2223-5431), correo electrónico ([email protected]) o personalmente en nuestras instalaciones.

• 2)Una vez recibida la documentación y el pago correspondiente, el funcionario debe sellar el recibo original y entrega la copia al usuario indicando las iniciales de quien recibió y tramitó el registro. Asimismo, procederá a confeccionar el recibo de dinero.
• 3)En el Sistema de Cómputo, el funcionario incluirá la información en el sub-archivo Tipos de Cliente (Área de mantenimiento), acreditándolo con una "S" y cuya vigencia finaliza los 31 de diciembre automáticamente. El programa podrá suministrar la información por empresas con su(s) respectiva(s) actividad (es) y por la clasificación de los cultivos con que trabajan. Los listados por clasificación se mantendrán publicados en la página web: http://www.ofinase.go.cr En el archivo fijo, la información estará ordenada por orden alfabético de los usuarios registrados en activos para los vigentes y pasivos para los que no renovaron su registro.
• 4)El dinero recaudado será trasladado inmediatamente al Dpto. Financiero (Asistente Administrativa) para su depósito.
• 5)El funcionario entrega el proceda a la elaboración del certificado.
• 6)La Secretaria del Dpto. Administrativo elabora el certificado, lo pasa al Director Ejecutivo para su firma y comunica a la empresa para su retiro.

Si alguna empresa modifica su condición o varía los cultivos con que trabaja durante el año, solamente deberá notificarlo a la Oficina. De igual forma los productores y/o procesadores de semilla deberán comunicar los cambios en cuanto a remodelaciones o adquisición de nuevo equipo sea para mejora o sustitución.

Lo aquí no estipulado será resuelto por la Dirección Ejecutiva o por la Jefatura Administrativa- Financiera en coordinación con la Jefatura Técnica.
