throughout the entire text - Complete Text of Norm 099 Creation of the Responsible Fishing Marine Area of the Paquera-Tambor District and its Management Plan Complete Text of record: FEF44 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/099-2014.-Puntarenas, on the ninth day of the month of April, two thousand fourteen.

  1. 1That having received from the representatives of the Asociación de Pescadores Artesanales de Paquera (APEP), Asociación Paquereña para el Aprovechamiento de los Recursos Marinos (ASPARMAR), Asociación de Buzos de Paquera (ABUZPA), Cámara de Turismo de Paquera (CAPATUR), Cámara de Turismo de Tambor (CATUCOTAMBOR), Asociación de Pescadores y Pescadoras Unidos de Playa Blanca, and the Asociación de Pescadores de Tambor, the endorsement of the final work of the Fisheries Management Plan (Plan de Ordenamiento Pesquero) as a prerequisite for the approval of the Responsible Fishing Marine Area of the Paquera - Tambor District, which was prepared by the Inter-institutional Working Group formed by the Executive Presidency, through Resolution PEP-1109-10-2012, dated November 29, 2012, to formulate the Fisheries Management Plan, as a prerequisite for establishing the Responsible Fishing Marine Area of the Paquera-Tambor District. In light of which the Board of Directors established the holding of an extraordinary session to learn in detail the scope comprised in the cited Management Plan.
  2. 2That in accordance with this, Article 50 of the Constitución Política provides that it is the obligation of the State to procure the greatest well-being for all inhabitants of the country, organizing and stimulating production and the most adequate distribution of wealth. Likewise, it incorporates the right of every person to a healthy and ecologically balanced environment.
  3. 3That it is the responsibility of INCOPESCA as the Governing Institution of the fisheries and aquaculture sector of our country, to establish management measures for the sustainable use of hydrobiological resources, which allow for the protection of reproduction, recruitment, and feeding areas, which favor the increase of species and the increase of their biomass, in a manner that guarantees their sustainability for the benefit of the ecosystems and the fishers.
  4. 4That according to the Code of Conduct for Responsible Fisheries, Decreto Ejecutivo N° 27919-MAG recognizes in its Article 6, the important contribution of small-scale artisanal fisheries to the generation of employment, income, and food security. Hence the need for the State to appropriately guarantee the rights of fishers, adopting regulatory measures that favor the use of fishery resources in the waters of national jurisdiction.
  5. 5That for the formulation of the Fisheries Management Plan of the Paquera-Tambor District (POP-AMPR- D-Paquera/ Tambor), the fundamental purpose is to comply with the provisions set forth in the Agreement AJDIP-138-2008, of the Board of Directors of INCOPESCA and Decreto Ejecutivo No 35502-MAG dated October 1, 2009, as a prerequisite for establishing a Responsible Fishing Marine Area.
  6. 6That the proposal for the creation of this new AMPR responds to a new management model, broad, participatory, and coherent, that seeks to address the needs that small-scale artisanal fishing communities are having today, particularly in the Paquera-Tambor District.
  7. 7That among the objectives and goals pursued by the Creation of this Responsible Fishing Marine Area, are:

- General Objective: The Responsible Fishing Marine Area of the Paquera-Tambor District contributes to the sustainability of marine and fishery resources in the Gulf of Nicoya zone.

- Specific objectives.

a. Promote fisheries management (ordenamiento pesquero) and participatory marine zoning jointly with community organizations and fishers, through the Fisheries Management Plan of the Responsible Fishing Marine Area of the Paquera-Tambor District.

b. Foster the sustainable use of fishery resources through the development of research on environmentally friendly fishing methods and gear, the substitution of illegal fishing gear, as well as the monitoring of the impacts of the new regulatory measures.

c. Contribute to the restoration of habitat and fishery resources, through the implementation of sustainable projects and improvement of the environmental quality of marine ecosystems.

d. Carry out training, awareness-raising, and consolidation processes for small-scale artisanal fisheries sector organizations, through the training of fishers, on regulatory and technical aspects of the FAO Code of Conduct for Responsible Fisheries, more environmentally friendly fishing methods and gear, environmental education, technical-administrative, operational matters, and fishing infrastructure.

e. Develop productive alternatives that contribute to improving the socioeconomic condition and human development of the fishers of the AMPR D/Paquera-Tambor, and at the same time reduce fishing effort.

f. Articulate the participation (technical and financial cooperation, promotion of competitiveness) of diverse public-private actors, linked to the development of fisheries and aquaculture, as strategic partners for the development of the Responsible Fishing Marine Area of the Paquera-Tambor District.

- Proposed goals.

a. Marine zoning established in the Fisheries Management Plan of the Responsible Fishing Marine Area of the Paquera-Tambor District.

b. Regulatory measures updated based on the results derived from the research and monitoring of catches with the fishing gear and methods established in the POP-AMPR-D. Paquera-Tambor.

c. Fishery resources and Habitat of the AMPR-D.Paquera- Tambor restored as a result of the reduction of fishing effort and implementation of programs, projects, and established regulatory measures.

d. Percentage of trained fishers and strengthened Fishing Organizations contribute to the consolidation of the AMPR.

e. Percentage of productive alternatives developed to improve the socioeconomic condition of fishers and that contribute to reducing fishing effort.

f. Percentage of public-private actors participating as strategic partners for the development of the Responsible Fishing Marine Area of the Paquera-Tambor District.

  1. 8That it being of vital importance to the Board of Directors the strengthening and implementation of these types of fisheries governance models, the Board of Directors. Por tanto,

Considering:

en la totalidad del texto - Texto Completo Norma 099 Creación del Área Marina de Pesca Responsable Distrito Paquera-Tambor y su Plan de Ordenación Texto Completo acta: FEF44 INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/099-2014.-Puntarenas, a los nueve días del mes de abril de dos mil catorce.

  1. 1Que habiéndose recibido de parte de los representantes de la Asociación de Pescadores Artesanales de Paquera (APEP), Asociación Paquereña para el Aprovechamiento de los Recursos Marinos (ASPARMAR), Asociación de Buzos de Paquera (ABUZPA), Cámara de Turismo de Paquera (CAPATUR), Cámara de Turismo de Tambor (CATUCOTAMBOR), Asociación de Pescadores y Pescadoras Unidos de Playa Blanca y la Asociación de Pescadores de Tambor, el respaldo al trabajo final del Plan de Ordenamiento Pesquero como requisito previo para la aprobación del Área Marina de Pesca Responsable del Distrito de Paquera - Tambor, el cual fue elaborado por el Grupo de Trabajo Interinstitucional conformado por la Presidencia Ejecutiva, mediante Resolución PEP-1109-10-2012, de fecha 29 de Noviembre del 2012, para formular el Plan de Ordenamiento Pesquero, como requisito previo para establecer el Área Marina de Pesca Responsable del Distrito Paquera-Tambor. Ante lo cual la Junta Directiva estableció la celebración de una sesión extraordinaria a fin de conocer en detalle los alcances comprendidos en el Plan de Ordenamiento citado.
  2. 2Que en concordancia con ello, según el Artículo 50 de la Constitución Política dispone que es obligación del Estado procurar el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Asimismo, incorpora el derecho de toda persona a un ambiente sano y ecológicamente equilibrado.
  3. 3Que corresponde al INCOPESCA como Institución Rectora del sector pesquero y acuícola de nuestro país, establecer medidas de ordenamiento para el aprovechamiento sostenible de los recursos hidrobiológicos, que permitan proteger áreas de reproducción, reclutamiento y de alimentación, que favorezcan el incremento de las especies y el aumento de su biomasa, de manera que se garantice su sostenibilidad en provecho de los ecosistemas y de los pescadores.
  4. 4Que de acuerdo al Código de Conducta para la Pesca Responsable, Decreto Ejecutivo N° 27919-MAG reconoce en su Artículo 6, la importante contribución de la pesca artesanal en pequeña escala a la generación de empleo, ingresos y seguridad alimentaria. De ahí la necesidad de que el Estado garantice apropiadamente el derecho de los pescadores y pescadoras, adoptando medidas de regulación que favorezcan el aprovechamiento de los recursos pesqueros en las aguas de jurisdicción nacional.
  5. 5Que para la formulación del Plan de Ordenamiento Pesquero del Distrito Paquera-Tambor (POP-AMPR- D-Paquera/ Tambor), se tiene como propósito fundamental dar cumplimiento a lo establecido en el Acuerdo AJDIP-138-2008, de Junta Directiva del INCOPESCA y al Decreto Ejecutivo No 35502-MAG de fecha 01 de Octubre del 2009, como requisito previo para establecer un Área Marina de Pesca Responsable.
  6. 6Que la propuesta de creación esta nueva AMPR responde a un nuevo modelo de gestión, amplio, participativo y coherente que busca atender las necesidades que hoy en día están teniendo las comunidades pesqueras artesanales de pequeña escala, particularmente en el Distrito de Paquera-Tambor.
  7. 7Que entre los objetivos y metas que persigue la Creación de ésta Área Marina de Pesca Responsable, se tienen:

- Objetivo General: El Área Marina de Pesca Responsable del Distrito de Paquera-Tambor contribuye con la sostenibilidad de recursos marinos y pesqueros en la zona del Golfo de Nicoya.

- Objetivos específicos.

a. Promover el ordenamiento pesquero y la zonificación marina participativa conjuntamente con las organizaciones comunitarias y pescadores, por medio del Plan de Ordenamiento Pesquero del Área Marina de Pesca Responsable del Distrito Paquera-Tambor.

b. Fomentar el aprovechamiento sostenible de los recursos pesqueros mediante el desarrollo de investigación sobre métodos y artes de pesca amigables con el ambiente, la sustitución de artes de pesca ilegales, así como el monitoreo de los impactos de las nuevas medidas de regulación.

c. Contribuir con la restauración de hábitat y de los recursos pesqueros, mediante la implementación de proyectos sostenibles y mejoramiento de la calidad ambiental de los ecosistemas marinos.

d. Llevar a cabo procesos de formación, concientización y consolidación de las organizaciones del sector pesquero artesanal de pequeña escala, mediante la capacitación a pescadores y pescadoras, sobre aspectos normativos y técnicos del Código de Conducta Para la Pesca Responsable de la FAO, métodos y artes de artes de pesca más amigables con el ambiente, educación ambiental, asuntos técnicos administrativos, operativos e infraestructura pesquera.

e. Desarrollar alternativas productivas que contribuyan a mejorar la condición socioeconómica y el desarrollo humano de los pescadores del AMPR D/Paquera-Tambor, y a la vez disminuir el esfuerzo pesquero.

f. Articular la participación (cooperación técnica y financiera, promoción de la competitividad) de diversos actores públicos - privados, vinculados al desarrollo de la pesca y la acuicultura, como socios estratégicos para el desarrollo del Área Marina de Pesca Responsable del Distrito de Paquera-Tambor.

- Metas propuesta.

a. Zonificación marina establecida en el Plan de Ordenamiento Pesquero del Área Marina de Pesca Responsable del Distrito Paquera-Tambor.

b. Medida regulatorias actualizadas con base en los resultados derivados de las investigaciones y monitoreos de las capturas con las artes y métodos de pesca establecidas en el POP-AMPR-D. Paquera-Tambor.

c. Recursos pesqueros y Hábitat del AMPR-D.Paquera- Tambor restaurados como resultado de la reducción del esfuerzo pesquero e implementación de programas, proyectos y medidas regulatorias establecidas.

d. Porcentaje de pescadores capacitados y Organizaciones Pesqueras fortalecidas contribuyen a la consolidación del AMPR.

e. Porcentaje de alternativas productivas desarrolladas para mejorar la condición socioeconómica de los pescadores y que contribuya a disminuir el esfuerzo pesquero.

f. Porcentaje de actores público-privados participando como socios estratégicos para el desarrollo del Área Marina de Pesca Responsable del Distrito de Paquera-Tambor.

  1. 8Que siendo para la Junta Directiva de vital importancia el fortalecimiento e implementación de éste tipo de modelos de gobernanza pesquera, la Junta Directiva. Por tanto,

ACUERDA:

1º-Aprobar la Creación del Área Marina de Pesca Responsable Distrito de Paquera-Tambor y su Plan de Ordenación, de conformidad con los siguientes términos y condiciones:

Regulaciones y actividades permitidas en cada Zona 2º-Téngase como parte integral del presente Acuerdo, el oficio DGT-088-10-2014, suscrito por el Lic. Antonio Porras Porras, Director General Técnico.
