in the entirety of the text - Full Text of Regulation 38646 Increases the maximum budgetary expenditure for the National Commission for Biodiversity Management for the year 2014 Full Text of record: FE739 Nº 38646-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers granted to them by articles 140 subsections 3) and 18) and 146 of the Political Constitution; articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) paragraph b) of Law Nº 6227, General Law of Public Administration of May 2, 1978, and its amendments; Law Nº 8131, Law of Financial Administration of the Republic and Public Budgets of September 18, 2001, and its amendments; its Regulation, Decreto Ejecutivo Nº 32988-H-MP-PLAN of January 31, 2006, and its amendments; Law Nº 7788, Biodiversity Law of April 30, 1998, and its amendments; Decreto Ejecutivo Nº 32452-H of June 29, 2005, and its amendments; and Decreto Ejecutivo Nº 37595-H of March 18, 2013, and its amendments.

1. 1That through Law Nº 7788, published in La Gaceta Nº 101 of May 27, 1998, and its amendments, the National Commission for Biodiversity Management (CONAGEBIO) was created as a deconcentrated body of the Ministry of Environment and Energy with instrumental legal personality, and functions related to the conservation, ecologically sustainable use, and restoration of biodiversity.
2. 2That through official letters OT-098-2014, OT-131-2014, and OT-162-2014, dated respectively April 28, May 30, and July 8, all of 2014, the Executive Director of the National Commission for Biodiversity Management, with the endorsement of the Minister of Environment and Energy, granted in official letter Nº DM-258-2014 of May 2, 2014, requested to increase the maximum budgetary expenditure of said institution for 2014, for a total amount of ¢45,309,544.00 (exactly forty-five million three hundred nine thousand five hundred forty-four colones), to finance various services and expenses for institutional management.
3. 3That from said amount, the sum of ¢45,281,819.00 (exactly forty-five million two hundred eighty-one thousand eight hundred nineteen colones) is to be increased via Decreto Ejecutivo to cover expenses in the line items of Remunerations, Services, Materials and Supplies, and Current Transfers, which correspond to resources from the specific surplus.
4. 4That the increase for the remaining ¢27,725.00 (exactly twenty-seven thousand seven hundred twenty-five colones) is not approved, as these are resources that are excluded from the maximum budgetary expenditure, according to Decreto Ejecutivo Nº 37595-H published in Alcance Nº 54 to La Gaceta Nº 57 of March 21, 2013, and its amendments.
5. 5That through the aforementioned Decreto Ejecutivo Nº 37595-H, the General Budgetary Policy Guidelines for the year 2014 were issued, establishing in article 2, the maximum percentage by which the budgetary expenditure of public entities, ministries, and other bodies could be increased, with respect to the preceding year. In accordance with said provision, the resulting maximum budgetary expenditure amount for the year 2014 for the National Commission for Biodiversity Management was established at the sum of ¢225,930,000.00 (exactly two hundred twenty-five million nine hundred thirty thousand colones), which was communicated in official letter STAP-0727-2013 of April 16, 2013, a figure that does not include the expenditure previously indicated in this decree.
6. 6That through Decreto Ejecutivo Nº 32452-H published in La Gaceta Nº 130 of July 6, 2005, and its amendments, the "Guideline for the application of article 6 of Law Nº 8131, Law of Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing" was issued.
7. 7That in relation to the specific surplus, provision 9 of the referenced Decreto Ejecutivo Nº 32452-H makes it possible to use it for the payment of expenses defined in the purposes established in the special or legal provisions applicable to such resources.
8. 8That due to the foregoing, it is necessary to increase the maximum budgetary expenditure set for the National Commission for Biodiversity Management for the year 2014, by the sum of ¢45,281,819.00 (exactly forty-five million two hundred eighty-one thousand eight hundred nineteen colones). Therefore,

en la totalidad del texto - Texto Completo Norma 38646 Amplia para la Comisión Nacional para la Gestión de la Biodiversidad, el gasto presupuestario máximo para el año 2014 Texto Completo acta: FE739 Nº 38646-H EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley Nº 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley Nº 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas; la Ley Nº 7788, Ley de Biodiversidad de 30 de abril de 1998 y sus reformas; el Decreto Ejecutivo Nº 32452-H de 29 de junio de 2005 y sus reformas; y el Decreto Ejecutivo Nº 37595-H de 18 de marzo de 2013 y sus reformas.

1. 1Que mediante la Ley Nº 7788, publicada en La Gaceta Nº 101 de 27 de mayo de 1998 y sus reformas; se creó la Comisión Nacional para la Gestión de la Biodiversidad (CONAGEBIO), como un órgano desconcentrado del Ministerio del Ambiente y Energía con personería jurídica instrumental, y funciones referentes a la conservación, el uso ecológicamente sostenible y la restauración de la biodiversidad.
2. 2Que mediante los oficios OT-098-2014, OT-131-2014 y OT-162-2014, respectivamente de 28 de abril, 30 de mayo y 08 de julio, todos de 2014; la Directora Ejecutiva de la Comisión Nacional para la Gestión de la Biodiversidad, con el aval del Ministro de Ambiente y Energía, otorgado en el oficio Nº DM-258-2014 de 2 de mayo de 2014, solicitó incrementar el gasto presupuestario máximo de dicha institución para el 2014, por un monto total de ¢45.309.544,00 (cuarenta y cinco millones trescientos nueve mil quinientos cuarenta y cuatro colones exactos), para financiar diferentes servicios y gastos para la gestión institucional.
3. 3Que de dicho monto corresponde ampliar por la vía del Decreto Ejecutivo, la suma de ¢45.281.819,00 (cuarenta y cinco millones doscientos ochenta y un mil ochocientos diecinueve colones exactos) para sufragar gastos en las partidas de Remuneraciones, Servicios, Materiales y Suministros y Transferencias Corrientes, los cuales corresponden a recursos provenientes del superávit específico.
4. 4Que no se aprueba la ampliación por los restantes ¢27.725,00 (veintisiete mil setecientos veinticinco colones exactos), ya que son recursos que se encuentran excluidos del gasto presupuestario máximo, según Decreto Ejecutivo Nº 37595-H publicado en el Alcance Nº 54 a La Gaceta Nº 57 de 21 de marzo de 2013 y sus reformas.
5. 5Que mediante el citado Decreto Ejecutivo Nº 37595-H, se emitieron las Directrices Generales de Política Presupuestaria para el año 2014, estableciéndose en el artículo 2°, el porcentaje máximo en que podría incrementarse el gasto presupuestario de las entidades públicas, ministerios y demás órganos, con respecto al del año precedente. En correspondencia con dicha disposición, el monto de gasto presupuestario máximo para el año 2014 resultante para la Comisión Nacional para la Gestión de la Biodiversidad, fue establecido en la suma de ¢225.930.000,00 (doscientos veinticinco millones novecientos treinta mil colones exactos) el cual fue comunicado en el oficio STAP-0727-2013 del 16 de abril de 2013, cifra que no contempla el gasto indicado previamente en este decreto.
6. 6Que mediante el Decreto Ejecutivo Nº 32452-H publicado en La Gaceta Nº 130 de 6 de julio de 2005 y sus reformas, se emite el "Lineamiento para la aplicación del artículo 6 de la Ley Nº 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
7. 7Que en relación con el superávit específico, el numeral 9° del referido Decreto Ejecutivo Nº 32452-H, posibilita la utilización de éste, para el pago de gastos definidos en los fines establecidos en las disposiciones especiales o legales aplicables a tales recursos.
8. 8Que por lo anterior, resulta necesario ampliar el gasto presupuestario máximo fijado a la Comisión Nacional para la Gestión de la Biodiversidad para el año 2014, incrementándolo en la suma de ¢45.281.819,00 (cuarenta y cinco millones doscientos ochenta y un mil ochocientos diecinueve colones exactos). Por tanto,
