I.-The proposal for the Fee Schedule for the year 2015, presented by MBA. Betty Valverde Cordero, Head of the Financial Department, and prepared by the General Administrative Directorate, was submitted, considering for its establishment a general increase of 6%, in accordance with the inflation rate indicated by the Central Bank of Costa Rica for the current period.

II.-The Directors, for their part, consider the approval of the submitted proposal necessary, given that it incorporates the express request of this Board of Directors for a percentage increase of 6%.

III.-Given the need to minimize the impact on the fisheries and aquaculture sector, in such a way that allows these sectors to achieve sufficient economic development to face the challenges that society demands, tending to become drivers of national social and economic development, the Board of Directors, aware of the responsibility that corresponds to it as the Executing Authority of the Ley de Pesca y Acuicultura, in harmony with the stewardship of the fisheries and aquaculture resource and the possibility of sustainable access to that resource, based on the methodology applied for the preparation of the proposal submitted for the fees for the next fiscal year 2015. Therefore, IT IS AGREED:

1.-To acknowledge as known and received the presentation of the fee schedule for the year 2015 with its Explanatory Notes, presented by MBA. Betty Valverde Cordero, via official communication DF-063-09-2014, which is accepted and approved under the following terms and conditions:

For the purpose of charging commercial fishing licenses for vessels, the classification set forth in Article 43 of Ley N° 8436, Ley de Pesca y Acuicultura, must be taken into account, as well as the autonomy authorized by the MOPT.

2. Regarding the identification cards for captains, crewmembers, and assistants of sport or tourist fishing or cetacean observation vessels, these shall be annual. For their issuance, a copy of the identification document and a passport-sized photograph must be presented. Foreign captains under tourist status are prohibited from working as such on tourist fishing vessels flying the national flag.

3. In the case of payment for commercial fishing licenses for inactive vessels, the indicated payment shall be the only one that must be made annually to maintain the validity of the inactivity. If the permit holder decides to reactivate or activate the vessel for fishing operations while one of the periods of inactivity is in progress, the percentage corresponding to the elapsed time must be deducted from the amount paid for inactivity, and the difference from the cost of the vessel's operating license for the respective annual period must be paid.

4. Permit holders or individual shipowners in whose name commercial fishing licenses are granted shall not be required to pay the corresponding item for the card established in Article 44 of Ley N°8436, Ley de Pesca y Acuicultura, as their status is deemed accredited in the corresponding fishing license; however, the institution must issue it at no cost.

5. Interested parties, tour operating companies, or associations may acquire, in a planned and prior manner, the number of identification cards they deem appropriate to keep available for their clients, understanding that INCOPESCA will issue said cards with an issue date on the day they are acquired and with an expiration date according to the selected validity period. Once the expiration date has passed without the cards having been used by the users, they shall expire automatically without the possibility of being revalidated.

6. The issuance fee for commercial fishing identification cards and sport or tourist fishing identification cards, continental or marine, shall not be charged in the case of Costa Rican applicants, permit holders, or authorized persons over 65 years of age, duly verified against their identity card or birth certificate.

7. For those services related to inspections for the unloading of hydrobiological products, berthing at the pier, or movement of cargo in vehicles, the term "fraction" shall be applied as follows:

a. When the stay time of the vessel or vehicle is equal to or less than thirty minutes (30 min or less), the equivalent of 30 minutes will be charged.

b. If the stay time of the vessel or vehicle is greater than thirty minutes or equal to 60 minutes (31 min or 60 min), the equivalent of 1 hour will be charged.

c. For stays longer than one hour and a fraction, the concepts indicated in points a) and b) above will be applied.

d. In the case of inspections for the unloading of hydrobiological products, any fraction after the first hour will be charged as a half fraction, whether during regular hours or overtime hours.

8. For inspections, the regular fee corresponds to those carried out within the Institute's regular working hours, i.e., from 08:00 a.m. to 04:00 p.m. The overtime fee corresponds to inspections carried out from 04:01 p.m. to 07:59 a.m., as well as those carried out on holidays, Saturdays, Sundays, or days off.

9. In the case of inspections for the unloading of hydrobiological products involving shrimp, sardine, shark, sailfish, swordfish, and tuna, carried out at the Muelle Público of the Terminal Multiservicios Pesqueros in Barrio El Carmen, Puntarenas, or at any other private pier, collection center, or receiving station duly authorized by INCOPESCA and SENASA, the institution shall proceed as follows:

During regular hours:

a. Those vessels belonging to the national medium-scale and advanced fleet that unload shark will be charged the total hours involved in the inspection.

b. Vessels belonging to the national medium-scale and advanced fleet that do not unload shark will be charged for the first hour of inspection.

c. In the case of the national semi-industrial sardine fleet, the first two hours of unloading inspection will be charged, a period during which INCOPESCA officials shall take the respective sample to determine the average total length of the sardine caught, in accordance with agreement AJDIP/215-98.

d. Regarding the national semi-industrial coastal and deep-sea shrimp fleet, the first two hours of unloading inspection will be charged, a period during which INCOPESCA officials shall take the respective sample to determine the minimum average catch weight for white, pinky, Fidel shrimp; camello, camellito, and Chilean langoustine (chicharra), in accordance with Article 48 of the Reglamento a la Ley N° 8436, as well as the composition of the bycatch fauna, according to Decreto Ejecutivo N° 18795-MAG of January 9, 1989.

e. Vessels belonging to the foreign non-tuna fleet will be charged the total hours involved in the inspection, regardless of the commercial groups or species they unload.

f. Vessels belonging to the small-scale artisanal fleet are exempt from the request, inspection, and charge.

During overtime hours:

a. All unloading inspections shall be charged, regardless of the fleet, commercial groups, or species unloaded.

10. In the case of the foreign tuna fleet, whether during regular or overtime hours, the first two hours of unloading shall be charged, a period during which INCOPESCA officials shall randomly request the unloading of specific holds to determine, in accordance with Article 58 of Ley 8436, the absence of hydrobiological products other than tuna. Likewise, the last two hours of unloading shall be charged to verify that the holds are completely empty.

11. In those cases where, at the request of the interested party, INCOPESCA has made arrangements for the designation of the inspector and the inspector appeared at the established place, time, and date, but the interested party decides to postpone the unloading, one hour of inspection shall be charged, whether during regular or overtime hours. Once the suspended inspection is rescheduled, it shall recommence as a new inspection, for which reason the cost of the first hour and subsequent hours shall be charged again, whether regular or overtime, as applicable.

12. Regarding the berthing of vessels for scientific, research, educational, and development purposes, by reasoned and justified agreement, the Board of Directors may waive the charge in those cases where there is a purpose of public benefit to the country or the institution.

13. In the case of the berthing of national or foreign commercial vessels for purposes other than the unloading of fisheries products or provisioning, prior to the corresponding authorization, the institution must assess the nature of the type of activities required to be carried out, in order to determine possible negative effects on ecosystems or on the unloading activity of hydrobiological products that is carried out or will be carried out in the area designated for this purpose, so as to ensure safety.

14. Every inspection must be paid in advance or no later than the next business day after it is carried out by the Institute's officials, whether by bank deposit or electronic transfer to one of INCOPESCA's bank accounts or by direct payment at one of the institute's offices. If the payment is made by deposit or transfer, the user must deliver a copy of the respective bank receipt to the nearest office. The institution is not authorized to grant credit for this service; therefore, a user who does not comply with the established provision will be suspended from all services provided by INCOPESCA and must pay a late payment fine for goods and services equivalent to the average active interest rate of the Financial System for the last month (*), calculated from loans in national currency and in dollars, which will be applied to fees set in colones and in dollars, respectively.

The user of the water service, berthing and docking service, and other services provided by the institution at the Terminal Pesquera must pay for them before the vessel casts off or no later than 30 calendar days after receiving the services, provided they have credit previously authorized by INCOPESCA. If they do not have authorized credit, they must pay for the services before the vessel casts off. A user who does not comply with these provisions will be suspended from all services and must additionally pay a late payment fine for goods and services equivalent to the average active interest rate of the Financial System for the last month (*), calculated from loans in national currency and in dollars, which will be applied to fees set in colones and in dollars, respectively.

(*) (Thus modified its designation by point 2 of agreement AJDIP/145-2016 of April 14, 2016. Previously it stated: "of the Financial System for the last six months.") 16. Vehicles entering to load and unload products shall pay for the hours of stay before leaving the delimited pier area.

17. Licenses, permits, authorizations, and any type of service that are not paid in the corresponding period must be paid at the annual fee amount corresponding to each year owed, plus a percentage for each year of delay, brought to present value up to the day of payment, as a late payment fine for goods and services equivalent to the average active interest rate of the Financial System for the last month (*), calculated from loans in national currency and in dollars, which will be applied to fees set in colones and in dollars, respectively.

(*) (Thus modified its designation by point 2 of agreement AJDIP/145-2016 of April 14, 2016. Previously it stated: "of the Financial System for the last six months.") 18. The money collected from the charged fees shall be deposited and entered into the bank accounts that INCOPESCA holds in banks of the National Banking System. Likewise, users may pay the fee amounts by electronic means (transfer, dataphone, website).

19. The established fees will be subject to review and adjustment when appropriate, by INCOPESCA.

(*) 20. The various institutional offices are authorized to issue identification cards for the practice of sport fishing from land at no cost to the applicant. Likewise, it must be identified in said document that it only authorizes the practice of sport fishing from land, lacking any validity for the exercise of this activity aboard a vessel.

(*) (By agreement N° AJDIP/499 of December 17, 2014, it was agreed to modify the previous explanatory note, establishing a cost for the issuance of the sport fishing from land card in the amount of ¢1,000.00 (one thousand net colones).)

21. For Universities and Researchers, obtaining information and copies of statistical data on the behavior, availability, and utilization of fisheries biomass shall be free of charge, as long as an express request is submitted by the interested party, in which they state their commitment to present to INCOPESCA the partial and/or final results of the studies conducted, based on the information provided by the Department of Fisheries Statistics of INCOPESCA.

The Financial Department shall semi-annually review the average active interest rates of the Financial System for the last month (*), in both national currency and dollars, in order to update it for charging the late payment fine for goods and services, in colones and in dollars.

Considering:

1º-Presentado el por parte de la MBA. Betty Valverde Cordero, Jefe del Departamento Financiero, la propuesta del cuadro de Tarifas para el año 2015, misma que fue elaborada por la Dirección General Administrativa, considerando para su establecimiento, un aumento general del 6%, de conformidad con el índice de inflación señalado por el Banco Central de Costa Rica, para el presente período.

1. 2Que por su parte, consideran los Sres. Directores necesario la aprobación de la propuesta presentada, dado que la misma recoge la solicitud expresa de ésta Junta Directiva de un incremento porcentual del 6%.
2. 3Que dada la necesidad de minimizar el impacto al sector pesquero y acuícola, de manera tal que le permita a éstos sectores alcanzar el desarrollo económico suficiente que le permita enfrentar los desafíos que la sociedad demanda, tendientes a convertirse en motores del desarrollo social y económico nacional, la Junta Directiva, conciente en la responsabilidad que, como Autoridad Ejecutora de la Ley de Pesca y Acuicultura, le corresponde, en sintonía con la tutela del recurso pesquero y acuícola y la posibilidad del acceso sustentable sobre ese recurso, con fundamento en la metodología aplicada para la elaboración de la propuesta presentada para las tarifas del próximo ejercicio económico del año 2015. Por tanto,

ACUERDA:

Para efecto del cobro de las licencias de pesca comercial a embarcaciones, deberá tenerse en cuenta la clasificación dispuesta en el artículo 43 de la Ley N° 8436 Ley de Pesca y Acuicultura, así como la autonomía autorizada por el MOPT.

2. En cuanto a los carné para capitanes, tripulantes y ayudantes de embarcaciones de pesca deportiva o turística o de observación de cetáceos, estos serán anuales. Para su otorgamiento deberán presentar copia del documento de identificación y una fotografía tamaño pasaporte. A los capitanes extranjeros en condición de turistas, les estará prohibido el ejercicio como tal en embarcaciones de pesca turística de bandera nacional.

3. En el caso del pago de las licencias de pesca comercial de embarcaciones inactivas, el pago indicado será el único que deba realizarse anualmente para mantener la vigencia de la inactividad y si el permisionario decide reactivar o activar la embarcación para la realización de las faenas de pesca, estando en curso una de las inactividades, deberá abonarse del monto de la inactividad cancelado, el porcentaje correspondiente al tiempo transcurrido, y pagarse la diferencia del costo de la licencia de operación de la embarcación en el período anual respectivo.

4. Los permisionarios o armadores físicos a nombre de quienes estén otorgadas las licencias de pesca comercial, no estarán obligados a cancelar el rubro correspondiente por concepto del carné establecido en el artículo 44 de la Ley N°8436 Ley de Pesca y Acuicultura, en razón de tenerse por acreditada su condición en la licencia de pesca correspondiente, sin embargo, la institución deberá emitirlo sin costo alguno.

5. Los interesados, las empresas operadoras de tours o las asociaciones, podrán adquirir de manera previa y planificada, la cantidad de carné que consideren conveniente mantener a disposición de sus clientes y en el entendido de que dichos carné INCOPESCA los otorgará con fecha de emisión al día en que son adquiridos y con fecha de vencimiento según el plazo de vigencia seleccionado. Cumplido el plazo de vencimiento sin que hubiesen sido utilizados por los usuarios, estos caducarán de pleno derecho sin que puedan ser revalidados.

6. No se cobrará el monto de la emisión por carné de identificación de pesca comercial y pesca deportiva o turística continental o marina en los casos de solicitantes, permisionarios o autorizados que sean costarricenses mayores de 65 años, debidamente verificado contra su cédula de identidad o certificación de nacimiento.

7. En aquellos servicios relacionados con inspecciones por descarga de productos hidrobiológicos, estadía en muelle o movilización de carga en vehículos, se aplicará el término fracción de la siguiente manera:

a. Cuando el tiempo de permanencia de la embarcación o vehículo es igual o menor a treinta minutos (30 min o menos), se cobrará el equivalente a 30 minutos.

b. Si el tiempo de permanencia de la embarcación o vehículo es mayor a treinta minutos o igual a 60 minutos (31 min o 60 min), se cobrará el equivalente a 1 hora.

c. Para permanencias mayores a una hora y fracción, se aplicarán los conceptos indicados en los puntos a) y b) anteriores.

d. En el caso de las inspecciones por descarga de productos hidrobiológicos, cualquier fracción después de la primera hora se cobrará como media fracción, sea en horario ordinario o extraordinario.

8. Para las inspecciones la tarifa ordinaria corresponde a las realizadas dentro del horario ordinario de trabajo del Instituto, sea de las 08:00 a. m. a las 04:00 p. m. La tarifa extraordinaria corresponde a las inspecciones realizadas de 04:01 p. m. a 07:59 a. m. así como las efectuadas en días feriados, sábados, domingos o asuetos.

9. En el caso de las inspecciones por descarga de producto hidrobiológico, que comprendan camarón, sardina, tiburón, vela, espada y atún, que se realicen en el Muelle Público de la Terminal Multiservicios Pesqueros del Barrio El Carmen, Puntarenas o en cualquier otro muelle, centro de acopio o puesto de recibo privados, debidamente autorizados por el INCOPESCA y el SENASA, la institución procederá de la siguiente manera:

En horario ordinario:

a. Aquellas embarcaciones pertenecientes a la flota nacional mediana escala y avanzada, que desembarquen tiburón, serán objeto del cobro total de las horas que conlleve la inspección.

b. Las embarcaciones pertenecientes a la flota nacional mediana escala y avanzada que no desembarquen tiburón, serán objeto del cobro de las primera hora de inspección.

c. En tratándose de la flota nacional semiindustrial sardinera, se cobrará las dos primeras horas de inspección por descarga, periodo durante el cual, los funcionarios del INCOPESCA procederán a tomar la muestra respectiva para determinar la longitud total promedio de la sardina capturada, de conformidad con el acuerdo AJDIP/215-98.

d. En relación con la flota nacional semiindustrial camaronera de orilla y de profundidad, se cobrarán las dos primeras horas de inspección por descarga, periodo durante el cual, los funcionarios del INCOPESCA procederán a tomar la muestra respectiva para determinar el peso mínimo promedio de captura del camarón blanco, pinky, Fidel; camello, camellito y langostino chileno (chicharra) de conformidad con el artículo 48 del Reglamento a la Ley N° 8436, así como la composición de la fauna de acompañamiento, según el Decreto Ejecutivo N° 18795- MAG del 9 de enero de 1989.

e. Las embarcaciones pertenecientes a la flota extranjera no atunera, serán objeto del cobro total de las horas que conlleve la inspección, independientemente de los grupos comerciales o las especies que desembarque.

f. Se exceptúa de la solicitud, inspección y del cobro a las embarcaciones pertenecientes a la flota artesanal en pequeña escala.

En horario extraordinario:

a. Todas las inspecciones por descarga serán cobradas, independientemente de la flota, los grupos comerciales o especies que desembarque.

10. En tratándose de la flota atunera extranjera, sea en horario ordinario o extraordinario, se cobrarán las dos primeras horas de descarga, periodo durante el cual los funcionarios del INCOPESCA procederán a solicitar de manera aleatoria la descarga de determinadas bodegas, a efecto de determinar, de conformidad con el artículo 58 de la Ley 8436, la no existencia de productos hidrobiológicos diferentes al atún. De igual manera, se cobrará las últimas dos horas de descarga a efecto de verificar que las bodegas estén completamente vacías.

11. En aquellos casos en que a solicitud del interesado, el INCOPESCA ha realizado las gestiones para la designación del inspector y este se hiciera presente en el lugar, hora y fecha establecidos, y el interesado decide posponer la descarga, se cobrará una hora de inspección, según sea en horario ordinario o extraordinario. Una vez reprogramada la inspección que fue suspendida, se reiniciará como si se tratase de una nueva inspección, razón por la que se cobrará nuevamente el costo de la primera hora y siguientes, sea ordinaria o extraordinaria según corresponda.

12. En relación con la estadía de las embarcaciones con fines científicos, de investigación, didácticos y de fomento, mediante acuerdo razonado y justificado, la Junta Directiva podrá eximir el cobro, en aquellos casos en que exista un fin de beneficio público al país o a la institución.

13. En el caso de la estadía de las embarcaciones nacionales o extranjeras comerciales para fines distintos a la descarga de productos pesqueros o avituallamiento, previo a la autorización correspondiente, la institución debe valorar la naturaleza propia del tipo de actividades que se requieren realizar, a fin de determinar posibles efectos negativos sobre los ecosistemas o sobre la actividad de descarga de productos hidrobiológicos que se realicen o se vayan a realizar en el área destinada para ese propósito, de manera que se asegure la inocuidad.

14. Toda inspección deberá ser cancelada previamente o a más tardar el día hábil siguiente a que es realizada por los funcionarios del Instituto, sea mediante depósito bancario o transferencia electrónica a una de las cuentas bancarias de INCOPESCA o mediante el pago directo en una de las oficinas del instituto. Si el pago se realiza por depósito o transferencia, el usuario deberá entregar copia del respectivo comprobante bancario a la oficina más cercana. La institución no está autorizada para conceder crédito por este servicio, por lo tanto, al usuario que no atienda la disposición establecida se le suspenderán todos los servicios que brinda el INCOPESCA y deberá pagar una multa por pago tardío de los bienes y servicios equivalente a la tasa de interés activa promedio del Sistema Financiero del último mes(*) calculadas a partir de los préstamos en moneda nacional y en dólares, las cuales serán aplicadas a las tarifas fijadas en colones y en dólares, respectivamente.

15. El usuario del servicio de agua, servicio de estadía y muellaje y otros servicios que brinde la institución en la Terminal Pesquera, deberá cancelarlos antes de desatracar la embarcación o a más tardar 30 días naturales posteriores a recibir los servicios, siempre y cuando cuente con crédito autorizado previamente por el INCOPESCA. En caso de no contar con crédito autorizado, deberá pagar los servicios antes de desatracar la embarcación. Al usuario que no atienda estas disposiciones se le suspenderán todos los servicios y deberá pagar adicionalmente una multa por pago tardío de los bienes y servicios equivalente a la tasa de interés activa promedio del Sistema Financiero del último mes(*) calculados a partir de los préstamos en moneda nacional y en dólares, las cuales serán aplicadas a las tarifas fijadas en colones y en dólares, respectivamente.

16. Los vehículos que ingresen a cargar y descargar productos cancelarán las horas de permanencia antes de salir del área delimitada de muelle.

17. Las licencias, permisos, autorizaciones y todo tipo de servicio que no sean pagado en el periodo correspondiente, deberán ser cancelados con el monto de la tarifa anual que corresponda a cada año adeudado, más un porcentaje por cada año de atraso, traído a valor presente hasta el día de pago, por concepto de multa por pago tardío de los bienes y servicios equivalente a la tasa de interés activa promedio del Sistema Financiero del último mes(*) calculados a partir de los préstamos en moneda nacional y en dólares, las cuales serán aplicadas a las tarifas fijadas en colones y en dólares, respectivamente.

18. El dinero recaudado por las tarifas cobradas será depositado e ingresado en las cuentas bancarias que el INCOPESCA tenga en los bancos del Sistema Bancario Nacional. De igual manera, los usuarios podrán pagar el importe por las tarifas mediante medios electrónicos (transferencia, datafono, página web).

19. Las tarifas establecidas estarán sujetas a revisión y ajuste cuando ello fuere procedente, por parte del INCOPESCA.

(*)20. Se autoriza a las diversas dependencias institucionales la emisión de carnés para la práctica de la pesca deportiva desde tierra sin ningún costo para quien lo solicite. Igualmente deberá identificarse en dicho documento, que el mismo únicamente autoriza la práctica de la pesca deportiva desde tierra, careciendo de total validez para el ejercicio de ésta actividad a bordo de una embarcación.

(*) (Mediante acuerdo N° AJDIP/499 del 17 de diciembre de 2014, se acordó modificar la nota explicativa anterior estableciendo un costo de la emisión de carné de pesca deportiva desde tierra por un monto de ¢1.000,00 (mil colones netos).)

21. Tratándose de Universidades e Investigadores, la obtención de información y copias de datos estadísticos sobre el comportamiento, disponibilidad y aprovechamiento de la biomasa pesquera serán de carácter gratuito, en el tanto y cuanto se presente solicitud expresa por parte del interesado; en la que se manifieste su compromiso de presentar al INCOPESCA el resultado parcial y/o final de los estudios realizados con sustento a la información suministrada por el Departamento de Estadísticas Pesqueras del INCOPESCA.

El Departamento Financiero procederá semestralmente a realizar la revisión de las tasas de interés activa promedio del Sistema Financiero del último mes(*), tanto en moneda nacional como dólares, a fin de actualizarla en el cobro de la multa por pago tardío de los bienes y servicios, en colones y en dólares.
