throughout the entire text - Full Text of Norm 38333 Increases for the Commission for the Management and Handling of the Upper Reventazón River Watershed (COMCURE), the maximum budget expenditure for the year 2014 Full Text of record: FAD86 No. 38333-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by articles 140 subsections 3) and 18) and 146 of the Political Constitution; articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) paragraph b) of Law No. 6227, General Law of Public Administration of May 2, 1978 and its amendments; Law No. 8131, Law of Financial Administration of the Republic and Public Budgets of September 18, 2001 and its amendments; its Regulation, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law No. 8023 of September 27, 2000, Management and Handling of the Reventazón River Watershed and its amendments; Executive Decree No. 32452-H of June 29, 2005 and its amendments; and Executive Decree No. 37595-H of March 21, 2013 and its amendments.

1. 1That through Law No. 8023, published in La Gaceta No. 203 of October 24, 2000 and its amendments, the Commission for the Management and Handling of the Upper Reventazón River Watershed (COMCURE) was created, whose objectives are to define, execute, and control the Management and Handling Plan for the Upper Reventazón River Watershed, with emphasis on water conservation and protection, with the support of its functional structure and in coordination with public and private institutions and the collegiate bodies created under the General Law of Public Administration and related laws, to define and execute a community training project on watershed management and handling, to train the officials of the institutions and the community leaders involved in the project in specific areas that support the Plan, to incorporate women in the execution of the Plan's activities, and to develop specific projects in geological, health, production, environmental, and cultural areas.
2. 2That by means of official letter COMCURE 311-2013, the Acting Manager of COMCURE requested an increase in the maximum budget expenditure set for that body for the 2014 period, in the amount of ¢76,440,000.00 (seventy-six million four hundred forty thousand exact colones), which will be allocated to the payment of basic remuneration, commercial and financial services, management and support services, travel and transportation expenses, insurance, reinsurance and other obligations, training and protocol, maintenance and repair of transportation equipment, materials and supplies, food and agricultural products, and the payment of materials and products for use in construction and maintenance.
3. 3That of said amount, the sum of ¢38,520,000.00 (thirty-eight million five hundred twenty thousand exact colones) should be increased via Executive Decree, which will be allocated to cover the daily operating expenses and maintenance of the actions and projects that COMCURE develops within the framework of the management plan for the Reventazón River Watershed, in accordance with the provisions of Article 5 of Executive Decree No. 37595-H, published in Digital Supplement No. 54 to La Gaceta No. 57 of March 21, 2013 and its amendments, as these are specific surplus funds.
4. 4That through the cited Executive Decree No. 37595-H, the General Budgetary Policy Guidelines for the year 2014 were issued, establishing in Article 2 the maximum percentage by which the budget expenditure of public entities, ministries, and other bodies could increase relative to the preceding year. In accordance with said provision, the resulting maximum budget expenditure amount for the Commission for the Management and Handling of the Upper Reventazón River Watershed was established in the sum of ¢128,530,000.00 (one hundred twenty-eight million five hundred thirty thousand exact colones), which was communicated via official letter STAP-0702-2013 of April 15, 2013, a figure that does not include the expenditure previously indicated in this decree.
5. 5That through Executive Decree No. 32452-H, published in La Gaceta No. 130 of July 6, 2005 and its amendments, the "Guideline for the application of Article 6 of Law No. 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing" was issued.
6. 6That in relation to the specific surplus, numeral 9 of the referred Executive Decree No. 32452-H enables its use for the payment of expenses defined within the purposes established in the special or legal provisions applicable to such resources.
7. 7That therefore, it is necessary to increase the maximum budget expenditure set for 2014, incrementing it by the sum of ¢38,520,000.00 (thirty-eight million five hundred twenty thousand exact colones). Therefore,

THEY DECREE

Considering:

en la totalidad del texto - Texto Completo Norma 38333 Amplia para la Comisión para el ordenamiento y manejo de la Cuenca Alta del Río Reventazón (COMCURE), el gasto presupuestario máximo para el año 2014 Texto Completo acta: FAD86 Nº 38333-H LA PRESIDENTA DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley Nº 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley Nº 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas; la Ley Nº 8023 de 27 de setiembre de 2000, Ordenamiento y Manejo de la Cuenca del Río Reventazón y sus reformas; el Decreto Ejecutivo Nº 32452-H de 29 de junio de 2005 y sus reformas; y el Decreto Ejecutivo Nº 37595-H de 21 de marzo de 2013 y sus reformas.

1. 1Que mediante la Ley Nº 8023, publicada en La Gaceta Nº 203 de 24 de octubre de 2000 y sus reformas, se crea la Comisión para el Ordenamiento y Manejo de la Cuenca Alta del Río Reventazón (COMCURE), cuyos objetivos son definir, ejecutar y controlar el Plan de Ordenamiento y Manejo de la Cuenca Alta del Río Reventazón, con énfasis en la conservación y protección del agua, con el apoyo de su estructura funcional y en coordinación con las instituciones públicas, privadas y los órganos colegiados creados al tenor de la Ley General de la Administración Pública y leyes conexas, definir y ejecutar un proyecto de capacitación para la comunidad en materia de ordenamiento y manejo de cuencas, capacitar a los funcionarios de las instituciones y a los líderes comunales involucrados en el proyecto, en materias específicas que apoyen el Plan, incorporar a la mujer en la ejecución de las actividades del Plan y desarrollar proyectos específicos en las áreas geológicas, sanitarias, de producción, ambientales y culturales.
2. 2Que por medio del oficio COMCURE 311-2013, el Gerente a. í. del COMCURE, solicitó incrementar el gasto presupuestario máximo fijado a ese órgano para el período 2014, por un monto de ¢76.440.000,00 (setenta y seis millones cuatrocientos cuarenta mil colones exactos), los cuales se destinarán al pago de remuneraciones básicas, servicios comerciales y financieros, servicios de gestión y apoyo, gastos de viaje y transporte, seguros, reaseguros y otras obligaciones, capacitación y protocolo, mantenimiento y reparación de equipo de transporte, materiales y suministros, alimentos y productos agropecuarios y el pago de materiales y productos de uso en la construcción y mantenimiento.
3. 3Que de dicho monto corresponde ampliar por la vía del Decreto Ejecutivo la suma de ¢38.520.000,00 (treinta y ocho millones quinientos veinte mil colones exactos), los cuales se destinarán a cubrir los gastos diarios de operación, mantenimiento de las acciones y proyectos que desarrolla COMCURE en el marco del plan de manejo de la Cuenca del Río Reventazón, de conformidad con lo establecido en el artículo 5° del Decreto Ejecutivo Nº 37595- H, publicado en el Alcance Digital Nº 54 a La Gaceta Nº 57 de 21 de marzo de 2013 y sus reformas, ya que son recursos de superávit específico.
4. 4Que mediante el Decreto Ejecutivo Nº 37595-H citado, se emitieron las Directrices Generales de Política Presupuestaria para el año 2014, estableciéndose en el artículo 2°, el porcentaje máximo en que podría incrementarse el gasto presupuestario de las entidades públicas, ministerios y demás órganos, con respecto al del año precedente. En correspondencia con dicha disposición, el monto de gasto presupuestario máximo resultante para la Comisión para el Ordenamiento y Manejo de la Cuenca Alta del Río Reventazón, fue establecido en la suma de ¢128.530.000,00 (ciento veintiocho millones quinientos treinta mil colones exactos), el cual fue comunicado mediante el oficio STAP-0702-2013 del 15 de abril de 2013, cifra que no contempla el gasto indicado previamente en este decreto.
5. 5Que mediante el Decreto Ejecutivo Nº 32452-H, publicado en La Gaceta Nº 130 de 6 de julio de 2005 y sus reformas, se emite el "Lineamiento para la aplicación del artículo 6 de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
6. 6Que en relación con el superávit específico, el numeral 9° del referido Decreto Ejecutivo Nº 32452-H, posibilita la utilización de éste, para el pago de gastos definidos en los fines establecidos en las disposiciones especiales o legales aplicables a tales recursos.
7. 7Que por lo anterior, resulta necesario ampliar el gasto presupuestario máximo fijado para el para el 2014, incrementándolo en la suma de ¢38.520.000,00 (treinta y ocho millones quinientos veinte mil colones exactos). Por tanto,
