in the entirety of the text - Full Text of Norm 38296 Reform of the Public Use Regulations for Manuel Antonio National Park Full Text acta: F98CB No. 38296-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In the exercise of the powers conferred by subsections 3 and 18 of article 140 and article 146 of the Political Constitution, in relation to articles 1 and 3 of Law "Declares Manuel Antonio Beaches National Recreational Park" (now Manuel Antonio National Park) No. 5100 of November 15, 1972, article 1 of the National Parks Service Law No. 6084 of August 24, 1977, and article 58 of the Biodiversity Law No. 7788 of April 23, 1998.

1. 1That Law No. 5100 of November 15, 1972, published in La Gaceta No. 223 of November 23, 1972, which remains in force to date, declares the existence of the Manuel Antonio Beaches National Recreational Park, today Manuel Antonio National Park, expanded by Executive Decree No. 11148-A of February 5, 1980.
2. 2That by Executive Decree No. 22482-MIRENEM, published in La Gaceta No. 173 of September 9, 1993, the Public Use Regulations for Manuel Antonio National Park were made official. The same were reformed by Executive Decree No. 36095-MINAET of June 28, 2010.
3. 3That Manuel Antonio Beaches National Park, due to its special characteristics regarding biodiversity and scenic beauty, is a place of great tourist appeal. In addition, it has important wildlife populations that are fundamental for the maintenance of diversity.
4. 4That article 12 of the Public Use Regulations for Manuel Antonio National Park establishes the express prohibition of feeding animals within the Park and of consuming alcoholic beverages and drugs. However, the high number of visitors and allowing visitors to enter the Protected Wild Area with food has caused wildlife to be fed, causing problems due to changes in feeding habits, contamination through exchange, and transmission of diseases, making it essential to immediately eliminate the causes of this problem to reduce risks and ensure the conservation and protection of the species.
5. 5That Manuel Antonio Beaches National Park has experienced, in recent years, a growing increase in the number of visitors, which has caused various forms of environmental impact on the resources protected in said area. This makes it necessary to take measures to prevent excessive pressure on the natural resources of the Wild Area and, at the same time, allow for sustainable use of the ecosystem services provided by it.
6. 6That article 50 of the Political Constitution enshrines in favor of all inhabitants of the Nation the right to a healthy and ecologically balanced environment, and this right includes the conservation, sustainable use, and management of biodiversity and the equitable distribution of benefits derived from it, ensuring the greatest participation of the community.
7. 7That with the purpose of protecting the natural resources of the Park, it is necessary to increase the visiting days. Therefore,

Considering:

1. 1Que la Ley Nº 5100 del 15 de noviembre del año 1972, publicada en La Gaceta Nº 223 del 23 de noviembre del año 1972, la cual se encuentra vigente a la fecha, declara la existencia del Parque Recreativo Nacional Playas de Manuel Antonio, hoy Parque Nacional Manuel Antonio, ampliado mediante Decreto Ejecutivo Nº 11148-A del 5 de febrero de 1980.
2. 2Que mediante Decreto Ejecutivo Nº 22482-MIRENEM, publicado en La Gaceta Nº 173 del 9 de setiembre de 1993, se oficializa el Reglamento de Uso Público para el Parque Nacional Manuel Antonio. Mismo que fue reformado mediante Decreto Ejecutivo N° 36095-MINAET del 28 de junio del 2010.
3. 3Que el Parque Nacional Playas de Manuel Antonio por sus especiales características en cuanto a la biodiversidad y belleza escénica, es un lugar de gran atractivo turístico. Además cuenta con poblaciones importantes de vida silvestre que resultan fundamentales para el mantenimiento de la diversidad.
4. 4Que el artículo 12 del Reglamento de Uso Público para el Parque Nacional Manuel Antonio, establece la prohibición expresa de alimentar los animales dentro del Parque y del consumo de bebidas alcohólicas y drogas. Sin embargo, la alta visitación y el permitir que los visitantes ingresen con alimentos al Área Silvestre Protegida, ha provocado que se alimente a la vida silvestre causando problemas por cambios en los hábitos de alimentación, contaminación por intercambio y transmisión de enfermedades por lo que es indispensable eliminar de inmediato las causas de este problema para reducir los riesgos y asegurar la conservación y protección de las especies.
5. 5Que el Parque Nacional Playas de Manuel Antonio ha experimentado en los últimos años, un aumento creciente del número de visitantes, lo cual ha provocado diversas formas de impacto ambiental sobre los recursos que se protegen en dicha área. Esto hace necesario qué se tomen medidas que para evitar que exista una presión excesiva sobre los recursos naturales del Área Silvestre y al mismo tiempo se dé un aprovechamiento sustentable de los servicios ecosistémicos brindados por éste.
6. 6Que el artículo 50 de la Constitución Política consagra a favor de todos los habitantes de la Nación el derecho a un ambiente sano y ecológicamente equilibrado, siendo que este derecho incluye la conservación, uso y manejo sostenible de la biodiversidad y la equitativa distribución de beneficios derivados de esta, asegurando la mayor participación de la comunidad.
7. 7Que con el propósito de proteger los recursos naturales del Parque, se hace necesario aumentar los días de visitación. Por tanto,
