28937, subsequently repealed by Executive Decree No. 31062-MOPT-MIVAH-MINAE, for the purpose of ensuring the operation and continuity of urban planning processes, and for this purpose, ordered, among other things, the creation of the Secretariat of the National Urban Development Plan and the National Urban Planning Council.

31062 - MOPT-MIVAH-MINAE, has among its functions to guide the work directives of the Secretariat of the National Urban Development Plan. The Secretariat of this council, in turn, has as its main objective to cooperate with the Urbanism Directorate of the National Institute of Housing and Urbanism in formulating the National Urban Development Plan, in order to evaluate and recommend the technical follow-up actions that the units and entities of the Public Administration must undertake in a coordinated manner in favor of said objectives.

10.—That Plan GAM, in its form as the Regional Urban Plan of the Greater Metropolitan Area, on whose territorial environmental base the present Plan GAM is founded, obtained environmental viability (viabilidad ambiental) from the National Environmental Technical Secretariat (Secretaría Técnica Nacional Ambiental, SETENA), through Resolution No. 1308-2009 of June 9, 2009, as well as its adjustment and expansion, through Resolution No. 1532-2009 SETENA of July 7, 2009.

11.—That Directive No. 35-MIVAH - PLAN of June 28, 2012, establishes the obligation that all policies, plans, programs, or projects related to land-use planning (ordenamiento territorial) and urban development of the Greater Metropolitan Area must take into consideration as inputs the products generated by the Regional Planning Project of the Greater Metropolitan Area of Costa Rica.

12.—That Risk Management, in accordance with the National Emergency and Risk Prevention Law No. 8488 of November 22, 2005, establishes the need to reverse the conditions of vulnerability of the population and to incorporate effective criteria for disaster prevention and mitigation within territorial, sectoral, and socioeconomic planning, as well as preparedness, response, and recovery for emergencies.

13.—That the National Urban Planning Council, in session No. 1-2014, by means of agreement number two on January 20, 2014, approved in its entirety the Regional Land-Use Planning Plan for the Greater Metropolitan Area 2013-2030, thus ratifying the minutes in that same act. Therefore, They decree:

Considerando:

Asimismo que en el artículo 50 se indica que toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado.

Asimismo, uno de sus fines es lograr el funcionamiento ordenado de las ciudades, satisfaciendo las necesidades de los habitantes en un marco institucional de eficiencia y priorización de los recursos.

Igual procedimiento se observará respecto a la adopción de partes, adiciones o enmiendas que se le hagan.

La Secretaría de este consejo, a su vez, tiene como objetivo principal cooperar con la Dirección de Urbanismo del Instituto Nacional de Vivienda y Urbanismo en la formulación del Plan Nacional de Desarrollo Urbano, a fin de evaluar y recomendar las acciones técnicas de seguimiento que las dependencias y entidades de la Administración Pública deban emprender en forma coordinada a favor de dichos objetivos.

10.-Que Plan GAM, en su modalidad de Plan Regional Urbano de la Gran Área Metropolitana, en cuya base ambiental territorial se fundamenta el presente Plan GAM, obtuvo viabilidad ambiental de la Secretaría Técnica Nacional Ambiental, mediante la Resolución Nº 1308-2009 del 9 de junio del 2009, así como su ajuste y ampliación, por medio de la Resolución Nº 1532-2009 SETENA del 7 de julio del 2009.

11.-Que la Directriz N° 35-MIVAH - PLAN de 28 de junio de 2012, establece la obligatoriedad de que toda política, plan, programa o proyecto relacionado con materia de ordenamiento territorial y de desarrollo urbano de la Gran Área Metropolitana, deben tomar en consideración como insumos los productos generados por el Proyecto de Planificación Regional de la Gran Área Metropolitana de Costa Rica.

12. -Que la Gestión del Riesgo, de conformidad con la Ley Nacional de Emergencias y Prevención del Riesgo N° 8488 del 22 de noviembre de 2005, establece la necesidad de que se reviertan las condiciones de vulnerabilidad de la población y que se incorporen criterios efectivos de prevención y mitigación de desastres dentro de la planificación territorial, sectorial y socioeconómica, así como la preparación, atención y recuperación ante las emergencias.

13. -Que el Consejo Nacional de Planificación Urbana en sesión N º 1-2014 mediante el acuerdo segundo el día 20 de enero del 2014, aprobó en todas sus partes el Plan Regional de Ordenamiento Territorial de la Gran Área Metropolitana 2013-2030, dejando en ese mismo acto ratificada el acta. Por tanto,
